Analysis Of Blended And Multi-Modal Instruction And Its Effects On Spatial Visualization Ability, Diana Bairaktarova, Daron Williams, Petros Katsioloudis Jan 2019

Analysis Of Blended And Multi-Modal Instruction And Its Effects On Spatial Visualization Ability, Diana Bairaktarova, Daron Williams, Petros Katsioloudis

STEMPS Faculty Publications

For the last decade, remedial spatial visualization training has been offered to first-year engineering students in traditional classroom settings where students attend class and interact face-to-face with an instructor and peers. An alternative to the traditional pedagogical approach is a multi-modal blended learning format that combines in-class instruction with videos that can be viewed at the student’s convenience. The new setting affords students the opportunity to repeatedly revisit the basic instruction at the time and place of their choosing. This case study investigated student outcomes in a blended multi-modal Introduction to Spatial Visualization course that integrated video lectures; free-hand sketching …

National Personal Jurisdiction, Jonathan Remy Nash Jan 2019

National Personal Jurisdiction, Jonathan Remy Nash

Emory Law Journal

Personal jurisdiction has always constrained plaintiffs¿ access to courts, and recent Supreme Court decisions impose even more severe limits. These limitations are magnified by the standard understanding that the relevant forum for purposes of the personal jurisdiction calculus is the state. This Article explores the possibility of expanding the use of national personal jurisdiction. First, it argues that there is no Fifth Amendment Due Process Clause barrier to national personal jurisdiction. Second, it argues that Congress has the power to introduce national personal jurisdiction as to all claims brought in the federal courts, but that Congress lacks authority to introduce …

Partisan Gerrymandering And The Constitutionalization Of Statistics, Jacob Eisler Jan 2019

Partisan Gerrymandering And The Constitutionalization Of Statistics, Jacob Eisler

Emory Law Journal

Recent partisan gerrymandering litigation has relied heavily on statistical metrics to identify constitutional violations. If this trend continues, quantitative analysis could become the crux of constitutional analysis. This Article describes how constitutional law founded on numerical thresholds transforms judicial decision-making and undermines rights enforcement. Courts enforce constitutional law to ensure governmental compliance with rights founded in moral principles, not to advance alternative policy arrangements. Yet if quantitative outcomes are used to define rights, courts act as quasi-regulatory entities that compete with democratically elected branches. Arguably the most condemned decision of the twentieth century, Lochner, reflected such a quasi-regulatory approach to …

The Costs Of Changing Our Minds, Nita A. Farahany Jan 2019

The Costs Of Changing Our Minds, Nita A. Farahany

Emory Law Journal

The neuroscience revolution poses profound challenges to the doctrine of avoidable consequences in tort law and exposes deep theoretical riddles about the right to our own mental experiences and memories. To address this profound question, this Article begins with a deceptively simple principle of tort law: A victim of tortious wrongdoing by another is held responsible for mitigating her own physical injuries. This Article addresses whether that same doctrine should require a tort victim to likewise mitigate her emotional injuries. The answer to that question is of great and increasing importance because it goes to the heart of how society …

The Problem With Present-Value: How Local Bankruptcy Rules Impose Heavy Burdens On Chapter 13 Debtors, Jake Mcdonough Jan 2019

The Problem With Present-Value: How Local Bankruptcy Rules Impose Heavy Burdens On Chapter 13 Debtors, Jake Mcdonough

Emory Law Journal

When Congress created the Bankruptcy Code in 1978, it left open several gaps that needed to be resolved through the judicial system. One of these gaps concerns the process behind the present-value analysis required by Section 1325, which states that debtors must pay creditors the present value of their claims over the course of the debtor’s Chapter 13 bankruptcy plan. This process implicitly dictated that debtors must pay a discount rate to properly compensate their creditors. Because Congress never indicated how this discount rate should be calculated, bankruptcy courts created several different solutions to the problem. This left the bankruptcy …

The Role Of Data Analytics In Education: Possibilities & Limitations, Robert L. Moore Jan 2019

The Role Of Data Analytics In Education: Possibilities & Limitations, Robert L. Moore

STEMPS Faculty Publications

In the last decade, we have seen dramatic increases in the integration of technology within education. It has now become commonplace for K-5 educators to apply learning management systems (LMS) in ways that were previously only seen in higher education contexts. Similarly, on the higher education side, we are seeing a significant increase in online learning evidenced by the growing number of for-profit online colleges and universities (Picciano, 2012). This chapter utilizes Khan’s Learning Framework (Khan, 2001, 2005) to explore the role data analytics can play in education by looking at the possibilities and limitations of analytics.

What Am I Really Saying When I Open My Smartphone: A Response To Orin S. Kerr, Laurent Sacharoff Jan 2019

What Am I Really Saying When I Open My Smartphone: A Response To Orin S. Kerr, Laurent Sacharoff

Hofstra Law Faculty Scholarship

In his forthcoming article in the Texas Law Review, Compelled Decryption and the Privilege Against Self-Incrimination, Orin S. Kerr addresses a common question confronting courts. If a court orders a suspect or defendant to enter her password to open a smartphone or other device as part of a law enforcement investigation, does that order violate the Fifth Amendment right against self-incrimination?

To answer this question, Kerr appropriately looks by analogy to existing Fifth Amendment case law as applied to document subpoenas, the “act of production” doctrine, and its mysterious cousin, the “foregone conclusion” doctrine. From these materials, he gleans a …

The Role Of National Debts In The Determination Of The Yen-Dollar Exchange Rate, Ioannis Litsios, Keith Pilbeam Jan 2019

The Role Of National Debts In The Determination Of The Yen-Dollar Exchange Rate, Ioannis Litsios, Keith Pilbeam

Plymouth Business School

An intertemporal optimization model is developed to examine the determinants of the long-run nominal yen-dollar exchange rate in the presence of national debts. The model is tested empirically using data from Japan and the United States. The proposed theoretical specification is well supported by the data and shows that relative national debts as well as monetary and financial factors may play a significant role in the determination of the long-run nominal exchange rate between the yen and the dollar.

Of Piracy And General Average: Contribution In General Average For Ransom Payment Occasioned By Piratical Activity, Gm Gauci Jan 2019

Of Piracy And General Average: Contribution In General Average For Ransom Payment Occasioned By Piratical Activity, Gm Gauci

Plymouth Business School

This article examines the interplay between two ancient legal areas encountered in admiralty law, i.e. general average and piracy; the first is a unique indemnification system, to an extent similar to insurance, described as providing in ancient law ‘security against a certain aspect of the maritime risk, namely that which consists in deliberate sacrifice for the common safety’, whilst the second displays the idiosyncratic approach of admiralty law in providing a marine insurance definition of piracy which is to a substantial extent y at odds with that in public international law. The recent United Kingdom Supreme Court judgment in The …

Polanyi, Broudy And Teacher Preparation, Timothy L. Simpson Jan 2019

Polanyi, Broudy And Teacher Preparation, Timothy L. Simpson

Faculty Research at Morehead State University

To demonstrate the power and scope of Polanyi’s thought, this paper will establish the importance of Polanyi’s abundant insight for the accreditation of educator preparation programs in higher education. This inquiry will begin with a brief summary of the role and purpose of accreditation of educator preparation programs, highlighting the positivist presuppositions driving the current assessment process. With the aid of Harry Broudy, a close student of Polanyi, the essay will identify the implications of those presuppositions for educator preparation programs. Broudy’s analysis suggests that, despite claims to the contrary, the current assessment process fails to produce a professional teacher. …

Influence Of Corn Hybrid, Kernel Traits, Location, And Dry-Rolling Or Steam-Flaking On Digestibility, Flint W. Harrelson Jan 2019

Influence Of Corn Hybrid, Kernel Traits, Location, And Dry-Rolling Or Steam-Flaking On Digestibility, Flint W. Harrelson

Faculty Research at Morehead State University

Three trials were conducted to evaluate the effect of corn hybrid, kernel traits, growing location, and dry rolling or steam flaking on DM or starch digestibility or both. Trial 1 used 72 commercially available corn hybrids to evaluate the influence of hybrid on kernel characteristics and their effect on digestibility. Kernel characteristics evaluated were test weight, 1,000-kernel weight, and kernel hardness using the Stenvert hardness test. All analyses were conducted on dry, whole corn samples, and DM digestibility was determined for dry-rolled corn samples. Trial 2 used 12 hybrids to evaluate steam flaking or dry rolling on DM and starch …

Evidence For An Emerging Disc Wind And Collimated Outflow During An X-Ray Flare In The Narrow-Line Seyfert 1 Galaxy Mrk 335, Dirk Grupe Jan 2019

Evidence For An Emerging Disc Wind And Collimated Outflow During An X-Ray Flare In The Narrow-Line Seyfert 1 Galaxy Mrk 335, Dirk Grupe

Faculty Research at Morehead State University

A triggered 140 ks XMM-Newton observation of the narrow-line Seyfert 1 (NLS1) Mrk 335 in December 2015 caught the active galaxy at its lowest X-ray flux since 2007. The NLS1 is relatively quiescent for the first 120 ks of the observation before it flares in brightness by a factor of about five in the last 20 ks. Although only part of the flare is captured before the observation is terminated, the data reveal significant differences between the flare and quiescent phases. During the low-flux state, Mrk 335 demonstrates a reflection-dominated spectrum that results from a compact corona around a Kerr …

The First Swift Intensive Agn Accretion Disk Reverberation Mapping Survey, Dirk Grupe Jan 2019

The First Swift Intensive Agn Accretion Disk Reverberation Mapping Survey, Dirk Grupe

Faculty Research at Morehead State University

Swift intensive accretion disk reverberation mapping of four AGN yielded light curves sampled ∼200–350 times in 0.3–10 keV X-ray and six UV/optical bands. Uniform reduction and cross-correlation analysis of these data sets yields three main results: (1) The X-ray/UV correlations are much weaker than those within the UV/optical, posing severe problems for the lamp-post reprocessing model in which variations in a central X-ray corona drive and power those in the surrounding accretion disk. (2) The UV/optical interband lags are generally consistent with t μ l4 3 as predicted by the centrally illuminated thin accretion disk model. While the average interband …

Initiating A New Community Festival And Understanding Economic Impact: A Case Study Of A Rural Kentucky Community, Steve Chen Jan 2019

Initiating A New Community Festival And Understanding Economic Impact: A Case Study Of A Rural Kentucky Community, Steve Chen

Faculty Research at Morehead State University

City-run festivals, such as the art and crafts festival in Paintsville, Kentucky, create opportunities for rural communities to increase their local economy through visitor attendance and local purchases. Paintsville, KY has successfully hosted the annual Kentucky Apple Festival as its proud tradition for more than 50 years (City of Paintsville, 2017). The Apple Festival could draw an average of four to five thousand attendees annually. The Apple Festival visitors traveled from neighboring counties and spent money at many local vendors, traveling festival vendors, local restaurants and gas stations. This festival is an excellent example for a rural or country town …

Broadband Connectivity In “Flyover Country”, Randall Mccoy Jan 2019

Broadband Connectivity In “Flyover Country”, Randall Mccoy

Faculty Research at Morehead State University

Broadband commonly refers to high-speed internet access that is always on and faster than the traditional dial-up access. Most urban areas in the United States have broadband and cellular internet services abundantly provided, but adequate broadband in rural areas of the country still do not have enough internet service needed to perform and compete in modern markets. In the 21st Century, the Internet is necessary to complete necessary tasks in communications for education, businesses, health care, and farming communities. This case provides a conversation for a Computer Information Systems undergraduate course, or an introduction to Management Information Systems course, in …

A Negligence Approach To Section 14(E) Violations, Jessica Pekins Jan 2019

A Negligence Approach To Section 14(E) Violations, Jessica Pekins

Emory Law Journal

The tender offer is a common method used by third parties to gain control of a company. Third parties will approach a company’s shareholders with the opportunity to sell their shares at a fixed price, the result being a change in ownership and control. A company’s top executives may be threatened by this change in ownership and want to recommend that the shareholders reject the offer. However, executives have a duty to act in accordance with the shareholders’ best interests. This may lead to a conflict between the shareholders’ interests and the executives’ interests. Section 14(e) of the Securities Exchange …

Methods For Monitoring Matrix-Induced Autophagy., Carolyn Chen, Aastha Kapoor, Renato V. Iozzo

Department of Pathology, Anatomy, and Cell Biology Faculty Papers

A growing body of research demonstrates modulation of autophagy by a variety of matrix constituents, including decorin, endorepellin, and endostatin. These matrix proteins are both pro-autophagic and anti-angiogenic. Here, we detail a series of methods to monitor matrix-induced autophagy and its concurrent effects on angiogenesis. We first discuss cloning and purifying proteoglycan fragment and core proteins in the laboratory and review relevant techniques spanning from cell culture to treatment with these purified proteoglycans in vitro and ex vivo. Further, we cover protocols in monitoring autophagic progression via morphological and microscopic characterization, biochemical western blot analysis, and signaling pathway investigation. Downstream …
