An Institutional Theory Of Corporate Regulation, Iris H-Y Chiu Jan 2019

An Institutional Theory Of Corporate Regulation, Iris H-Y Chiu

Northwestern Journal of International Law & Business

The regulation of corporate behavior has persisted in spite of peaks of neo-liberalism in many developed jurisdictions of the world, including the U.K. This paradox is described as “regulatory capitalism” by a number of scholars. Of particular note is the proliferation of corporate regulation to govern “socially responsible” behavior in recent legislative reforms in the EU and U.K. In seeking to answer the broader question of whether corporate regulation indeed effectively governs and moderates corporate behavior, this paper focuses on the nature of corporate regulation. Although different pieces of corporate regulation purport to achieve different objectives and impose different types …

Mining At The Crossroads Of Law And Development: A Comparative Review Of Labor-Related Local Content Provisions In Africa's Mining Laws Through The Prism Of Automation, Nneoma Veronica Nwogu Jan 2019

Mining At The Crossroads Of Law And Development: A Comparative Review Of Labor-Related Local Content Provisions In Africa's Mining Laws Through The Prism Of Automation, Nneoma Veronica Nwogu

Washington International Law Journal

Africa boasts one-third of the world’s mineral resources. Mineral development, if governed by appropriate legal frameworks, is key to facilitating development in Africa. With this realization, the African Union (AU) adopted the Africa Mining Vision (AMV) in 2009, which aims to prioritize African industrialization, safeguard the environment, build and utilize local labor force capacity, facilitate transparency, and improve revenue-sharing mechanisms in Africa. However, at the same time, the dawn of artificial intelligence (AI) and complex levels of automation is making quick inroads into the mineral development sector. This article argues that, in response to the AMV, over half of Africa’s …

Making Land Titles In India Marketable: Using Title Insurance As A Viable Alternative To Conclusive Titling, Anirudh Burman Jan 2019

Making Land Titles In India Marketable: Using Title Insurance As A Viable Alternative To Conclusive Titling, Anirudh Burman

Washington International Law Journal

Though land comprises a significant component of the total asset portfolio of Indian households, the quality of land titles is poor. So far, policies have been directed at improving government records, with the objective of being able to issue titles that are “conclusive” in nature, and an indemnity system run by the state that compensates those who suffer from errors or omissions of government agencies maintaining such records. This paper explores an alternative method of reaching the same objective—title insurance. Recently, the 2016 Real Estate Regulation Act has allowed state governments to require title insurance for real estate projects. There …

Uniform Interpretation Of Cisg Jan 2019

Uniform Interpretation Of Cisg

The International Lawyer

This UN Convention on Contracts for the International Sale of Goods (CISG) has been U.S. law for a generation and requires that it be interpreted “to promote uniformity in its application”. This article argues that uniform interpretation is impractical because 1) it is written in six official languages which do not always mean the same thing; 2) with more than 90 countries’ courts and arbitrators applying CISG, each in its own language, some of which do not regularly print their opinions, it is difficult to access all opinions on a single point; 3) since Civil Law countries consider the writings …

Two- And Three-Year-Olds Consider Ownership When Selecting And Allocating Resources, M Petrowski, Patricia Kanngiesser, Ori Friedman Jan 2019

Two- And Three-Year-Olds Consider Ownership When Selecting And Allocating Resources, M Petrowski, Patricia Kanngiesser, Ori Friedman

School of Psychology

In three experiments, we investigated whether 2- and 3-year-olds (N = 240) consider ownership when taking resources for themselves and allocating resources to another agent. When selecting resources for themselves, children generally avoided taking resources that belonged to another agent and instead favored their own resources (Experiments 1 and 2). However, they did not avoid taking the agent’s resources when the only other resources available were described as not belonging to the agent (Experiment 3). Children also selected fewer of the agent’s resources when taking for themselves than when giving to the agent (Experiments 2 and 3). In giving to …

The Impact Of University Writing Curriculum On Preservice Teachers' Praxis I Scores, Virginia Ann Braithwaite Jan 2019

The Impact Of University Writing Curriculum On Preservice Teachers' Praxis I Scores, Virginia Ann Braithwaite

Walden Dissertations and Doctoral Studies

Until 2014, admission requirements for the educator preparation program at a university in the north central United States included a minimum competency level on the Praxis I basic skills writing test and completion of one general education writing course. However, evidence from the university's ETS reports showed that less than 60% of students as first-time test-takers met the required score. The purpose of this study was to assess the effectiveness of the required writing course in assisting students to meet the Praxis I writing competencies. In 2014, the ETS Core Academic Skills for Educators test replaced the Praxis I. Because …

This case study examined a graduate medical program in the Western United States that was redesigned to use adaptive learning with active and collaborative classroom learning in a flipped environment. Findings suggested student comprehension of material was as good or better than prior to the redesign, and students were able to complete coursework more efficiently, getting into the clinical environment sooner. Students improved abilities to apply knowledge was due in part to the capabilities of the adaptive system, the collaborative and active learning environment in the classroom, and the rapport and relationships built with the faculty. The multifaceted design of …

Dialogic Teaching In A Detracked High School Ela Class: "We Talk Here", Signy Emler Jan 2019

Dialogic Teaching In A Detracked High School Ela Class: "We Talk Here", Signy Emler

Theses & Dissertations

This dissertation combines the two fields of dialogic teaching and detracking in a study of one teacher’s English Language Arts high school classroom. The policy of tracking students into separate academic classes perpetuates segregation and is antithetical to the principles of democracy. Dialogic teaching is where students and the teacher engage in inquiry and exploratory talk to co-construct knowledge, and all students are provided with frequent opportunities to express their voices. Grounded in theory that views language and identity as socially constructed and situated, this qualitative case study examined how students from different racial, socio-economic, political and cultural backgrounds worked …

Assessing The Effects Of Motivative Augmentals, Pay-For-Performance, And Implicit Verbal Responding On Cooperation, Sharlet D. Rafacz, Ramona A. Houmanfar, Gregory S. Smith, Michael E. Levin Jan 2019

Assessing The Effects Of Motivative Augmentals, Pay-For-Performance, And Implicit Verbal Responding On Cooperation, Sharlet D. Rafacz, Ramona A. Houmanfar, Gregory S. Smith, Michael E. Levin

Psychology Faculty Publications

Motivative augmentals are rules or statements that temporarily change the effectiveness of a consequence, similar to establishing operations for nonverbal consequences (Hayes, Barnes-Holmes, & Roche, 2001). Many communications by an organization's leadership may function as such and alter the function of stimuli in the workplace, which in turn may influence employee behaviors (Houmanfar & Rodrigues, 2012). There is a lack of experimental research regarding this, however, particularly under different organizational pay systems (i.e., financial contingencies), which have been repeatedly shown to influence performance (e.g., Gupta & Shaw, 1998; Locke, Feren, McCaleb, Shaw, & Denny, 1980). The current study sought to …

Not Just Thinking, But Believing: Obsessive Beliefs And Domains Of Cognitive Fusion In The Prediction Of Ocd Symptom Dimensions, S. N. Hellberg, J. L. Buchholz, Michael P. Twohig, Jonathan S. Abramowitz

Psychology Faculty Publications

Cognitive fusion (CF), involves the tendency to “buy in” to thoughts and feelings and consists of three empirically established domains: somatic concerns, emotion regulation, and negative evaluation. CF is hypothesized to play a role in obsessive-compulsive disorder (OCD). The present study examined how well the CF domains, relative to traditional cognitive-behavioral constructs (i.e., obsessive beliefs such as inflated responsibility), predict OCD symptoms. 52 treatment-seeking adults with OCD completed self-report measures of CF, obsessive beliefs, OCD symptoms, and general distress. Domains of CF were differentially associated with the responsibility for harm, symmetry and unacceptable thoughts OCD dimensions, yet after accounting for …

Synthesis, Crystal Structure, And Characterization Of Two Heterometallic Transition Metal Citrate Complexes [M $=$ Co(Ii) And Cd(Ii)], Zeki̇ Kartal, Onur Şahi̇n, Abdülkeri̇m Yavuz

Turkish Journal of Chemistry

In this study, two heterometallic transition metal complexes with the formulas [CoK$_{4}(\mu _{10}$-C$_{6}$H$_{5}$O$_{7})_{2}$]$_{n}$ and [CdK($\mu _{8}$-C$_{6}$H$_{5}$O$_{7})(\mu $-H$_{2}$O)(H$_{2}$O)]$_{n}$ were synthesized as crystalline compounds. The structures of\textbf{ }these crystalline metal complexes were characterized by their spectral analyses (FT-IR, FT-Raman, thermal analysis, magnetic properties, and single-crystal X-ray diffraction techniques). According to the spectral data of the new metal complexes obtained, both metal complexes are in the monoclinic crystal system and in the P2$_{1}$/c and P2$_{1}$ space groups, respectively. The asymmetric unit of the metal complex [CoK$_{4}(\mu _{10}$-C$_{6}$H$_{5}$O$_{7})_{2}$]$_{n}$ contains one Co(II) ion, two potassium cations, and one (C$_{6}$H$_{5}$O$_{7})$ citrate ligand, whereas that of the …

Public Service Announcements To Promote Physical Activity, Jennifer Erickson, Jay Greiner

Journal of Social, Behavioral, and Health Sciences

The World Health Organization promotes physical activity (PA) as important for successful maintenance of health, but many individuals are inactive. Despite the potential for public service announcements (PSAs) to communicate health information and promote behavior change, no previous research on developing video PSAs to promote PA was found. The purpose of this quasi-experimental study was to examine how video PSAs designed for public health campaigns affect future levels of intention to engage in PA. The PSAs assessed perceived effectiveness of message foci and the impact of stage of change readiness. They were developed specifically for this study using the model …

Marine Quay Crane Scheduling Using A Combined Modified Genetic Algorithm And Priority Rules Approach, V. H. Nguyen, D. T. Nguyen Jan 2019

Marine Quay Crane Scheduling Using A Combined Modified Genetic Algorithm And Priority Rules Approach, V. H. Nguyen, D. T. Nguyen

Civil & Environmental Engineering Faculty Publications

Quay crane scheduling problem (QCSP) is the problem of the allocation of quay cranes to handle the unloading and loading of containers at seaport container terminals and defining the service sequence of vessel bays of each quay crane. The treatment of crane interference constraints and the increased in vessel size make the problem difficult to solve. Due to the growing interest in applied research for this problem, many researchers have used different algorithms and methods to obtain some solutions. This paper will propose a modified genetic algorithm combined with priority rules to deal with it. The advantage of the proposed …

Automatic Detection And Analysis Of Rip Currents At Haeundae Beach Using X-Band Marine Radar, Chanyeong Oh, Kyungmo Ahn, Se-Hyeon Cheon

OES Faculty Publications

The observation system has been developed to investigate the rip currents at Haeundae beach using Xband marine radar. X-band radar system can observe shape, size, and velocity of rip currents, which is difficult to obtain through field observation by conventional device. Algorithms which automatically detect locations, shapes, and magnitudes of rip currents were developed using time averaged X-band radar sea clutter images. X-band sea clutter images are transformed through 3D FFT into 2D wave number spectrum and frequency spectrum. Rip current velocities were estimated using differences in wave-number spectra and wave frequency spectra due to Doppler shift. The algorithm was …

The Dominant Global Modes Of Recent Internal Sea Level Variability, Benjamin Dillon Hamlington, Se-Hyeon Cheon, Christopher G. Piecuch, Kristopher B. Karnauskas, Philip R. Thompson, Kwang-Yul Kim, John Thomas Reager, Felix W. Landerer, Thomas Frederikse

OES Faculty Publications

The advances in the modern sea level observing system have allowed for a new level of knowledge of regional and global sea level in recent years. The combination of data from satellite altimeters, Gravity Recovery and Climate Experiment (GRACE) satellites, and Argo profiling floats has provided a clearer picture of the different contributors to sea level change, leading to an improved understanding of how sea level has changed in the present and, by extension, may change in the future. As the overlap between these records has recently extended past a decade in length, it is worth examining the extent to …

Ebullition Of Oxygen From Seagrasses Under Supersaturated Conditions, Matthew H. Long, Kevin Sutherland, Scott D. Wankel, David J. Burdige, Richard C. Zimmerman

OES Faculty Publications

Gas ebullition from aquatic systems to the atmosphere represents a potentially important fraction of primary production that goes unquantified by measurements of dissolved gas concentrations. Although gas ebullition from photosynthetic surfaces has often been observed, it is rarely quantified. The resulting underestimation of photosynthetic activity may significantly bias the determination of ecosystem trophic status and estimated rates of biogeochemical cycling from in situ measures of dissolved oxygen. Here, we quantified gas ebullition rates in Zostera marina meadows in Virginia, U.S.A. using simple funnel traps and analyzed the oxygen concentration and isotopic composition of the captured gas. Maximum hourly rates of …
