Social Studies Teachers’ Opinions And Practices Regarding Teaching Controversial Issues, Zafer Kuş, Durdane Öztürk
Australian Journal of Teacher Education
In today’s globalised world, many issues have become controversial. These controversial issues affect society and the individuals who form them. It is inevitable that these topics are brought into social studies classrooms, because this learning area is profoundly related to society. Social studies teachers’ behaviours, attitudes, and professional knowledge are crucial in teaching controversial issues. The goal of this study was to investigate social studies teachers’ opinions and practices regarding teaching controversial issues in Turkey. The study utilised a mixed method in which both quantitative and qualitative research methods were used. The quantitative data for this study were collected from …

Contextual And Educational Dimensions Of Efl Teacher Engagement In Second Language Acquisition Research, Zahra Shafiee, Elaheh Sotoudehnama
Australian Journal of Teacher Education
This mixed methods study investigated the contextual and educational dimensions of engaging language teachers in second language acquisition (SLA) theory and research to inform second language pedagogy. To this end, 132 Iranian English teachers completed the questionnaire designed by Nassaji (2012) that includes both Likert-scale items and open-ended questions. The participants had academic degrees in majors related to English language. They constituted two groups of public sector (n=66) and private sector (n=66). Each group was divided in two sub-groups, one with Bachelors of Arts (B.A.) and the other with Master of Arts (M.A.). Quantitative data analyses revealed a significant difference …

Australia’S Literacy And Numeracy Test For Initial Teacher Education Students: Trends In Numeracy For Low- And High-Achieving Students, Jennifer Hall, Simone Zmood
Australian Journal of Teacher Education
The numeracy capabilities of pre-service teachers are a recent focus in the Australian educational system. In this article, we discuss findings from an analysis of data from the Literacy and Numeracy Test for Initial Teacher Education Students (LANTITE), which is administered by the Australian Council for Educational Research. In our analysis, we considered numeracy test data from 20 students from one Australian university: those who achieved the 10 highest and the 10 lowest overall numeracy scores in 2016 at this university on their first attempt of the test. We found that these groups clearly have particular characteristics that were linked …
Teaching Legal Studies In Business Degrees: A Review Of A Method And Its Practice, Diane Kraal, Andrew Coleman
Teaching Legal Studies In Business Degrees: A Review Of A Method And Its Practice, Diane Kraal, Andrew Coleman
Australian Journal of Teacher Education
The legal studies teaching methodology IRAC (issue, rule, application, conclusion) is widely used in universities by both law and business schools. This paper examines the effectiveness of IRAC from a teaching perspective and its usefulness for business students. Data is generated from an Australian university case study using teacher interviews and a student survey. The findings suggest that, because of its flexibility and logical structure, the practice of IRAC has become normalised. However it is only effective if teachers disseminate these features consistently in their teaching. Students in the study understood the usefulness of IRAC for classwork, but encountered application …

A Multilevel Analysis Of The Impact Of Teachers’ Beliefs And Mathematical Knowledge For Teaching On Students’ Mathematics Achievement, Adem Ekmekci, Danya M. Corkin, Weihua Fan
Australian Journal of Teacher Education
: Teachers’ content knowledge and beliefs about teaching and learning are among the key factors for effective teaching and, in turn, for student achievement-related outcomes. This study explores the extent to which K-8 math teachers’—who teach in high-poverty urban schools—professional background, motivational beliefs, and mathematical knowledge for teaching (MKT) have an impact on students’ math achievement. Hierarchical linear modeling (HLM) results indicated that although students’ prior mathematics achievement was the most determining factor of their subsequent math achievement, teachers’ MKT and holding a bachelor’s degree in mathematics had significant positive effects on students’ math achievement. Results provide support for professional …

Showcase Panel I: What Is Regulation For?, Richard Epstein, Philip Hamburger, Kathryn Kovacs, Jon D. Michaels, Britt Grant
Nebraska Law Review
2018 National Lawyers Convention Transcripts
“The administrative state, with roots over a century old, was founded on the premise that Congress lacked the expertise to deal with the many complex issues facing government in a fast-changing country, and that it was unhelpfully mired in and influenced by politics, leading to bad outcomes when it did act. The alternative was to establish administrative agencies, each with assigned areas of responsibility, housing learned experts qualified to make policy decisions, deliberately insulated from political accountability. The Administrative Procedure Act (APA), passed in 1946, both governs the manner in which agencies may adopt and …
The Historical Case For Constitutional "Concepts", Glenn E. Chappell
The Historical Case For Constitutional "Concepts", Glenn E. Chappell
University of Richmond Law Review
The concepts/conceptions dichotomy is prominent in both the philosophy of language and the field of constitutional interpretation. It is most prominently illustrated through the provisions in the Constitution that contain broad, open-ended moral language. Those who hold the “conceptions” view believe that the legal content of those provisions includes both abstract moral concepts and its communicators’ subjective beliefs about, or conceptions of, how those concepts should apply. Under this view, the judge’s role is mostly empirical: he is tasked with examining historical evidence to ascertain those conceptions, which in turn supply applicational criteria by which he can decide specific cases. …
Partnership Lost, Christine Hurt
Partnership Lost, Christine Hurt
University of Richmond Law Review
A century ago, two distinct business entities existed that could best be defined by describing either one of them as simply not the other. The corporation and the general partnership were mirror images of one another and opposites on a spectrum of corporate governance, limited liability, and taxation. Partnerships, seen as small, livelihood enterprises between active-owner partners, had personal liability but pass-through taxation. Corporations, seen as larger, capital-intensive enterprises with passive-owner shareholders, had limited liability but double taxation. The tax distinctions survive today, but the stereotypical partnership does not; in fact, the modern partnership is more corporation-like than partnership-like.
Today, …
Of Hats And Robes: Judicial Review Of Nonadjudicative Article Iii Functions, Jeffrey L. Rensberger
Of Hats And Robes: Judicial Review Of Nonadjudicative Article Iii Functions, Jeffrey L. Rensberger
University of Richmond Law Review
We are accustomed to thinking of Article III courts and judges deciding cases and controversies. But, federal judges and courts have historically also engaged in official but nonadjudicative activities. In addition to a history of federal judges serving on nonjudicial commissions, federal judges and the Supreme Court participate in the rulemaking process for the federal procedural and evidentiary rules. Although some argue to the contrary, the Supreme Court has approved such arrangements in the face of separation of powers objections. Since Article III officers and courts perform nonadjudicative duties, the question arises of how federal courts who address a challenge …
Medication Safety In Emergency Medical Services: Approaching An Evidence-Based Method Of Verification To Reduce Errors, Paul Misasi, Joseph R. Keebler
Medication Safety In Emergency Medical Services: Approaching An Evidence-Based Method Of Verification To Reduce Errors, Paul Misasi, Joseph R. Keebler
Publications
Lack of verification is often cited as a root cause of medication errors; however, medication errors occur in spite of conventional verification practices and it appears that human factors engineering (HFE) can inform the design of a more effective method. To this end, an HFE-driven process was designed and implemented in an urban, Midwestern emergency medical service agency. Medication error data were collected over a 54-month period, 27 months before and after implementation. A decrease in the average monthly error rate was realized for all medications administered (49.0%) during the post-intervention time period. The average monthly error rate for fentanyl, …

Hypothesis testing is a prevalent method of inference used to test a claim about a population parameter based on sample data, and it is a central concept in many introductory statistics courses. At the same time, the use of hypothesis testing to interpret experimental data has raised concerns due to common misunderstandings by both scientists and students. With statistics education reform on the rise, as well as an increasing number of students enrolling in introductory statistics courses each year, there is a need for research to investigate students’ understanding of hypothesis testing. In this study we used APOS Theory to …

Technological development has created new forms of information, altered expectations of privacy, and given law enforcement more tools to examine that information and intrude on that privacy. One crucial facet of these changes involves internet service providers (ISPs): as people expose more of their lives to their ISPs—all the websites they visit, people they communicate with, emails they send, files they store, and more—law enforcement efforts to access that data become more and more common. But scholars and policymakers alike recognize that the existing statutory frameworks governing those efforts are based on obsolete technology and strike balances that are difficult …

Armed Conflict At The Threshold, Deborah Pearlstein
Armed Conflict At The Threshold, Deborah Pearlstein
Articles
Seventeen years into the United States’ engagement in what America has controversially understood as a global, non-international armed conflict against a shifting set of terrorist groups, a growing array of scholars has called for a reassessment of the significance of the “armed conflict” classification under international humanitarian law (IHL). The existence of an “armed conflict” has long been understood as a proxy on/off switch of inescapable importance. When an “armed conflict” exists, lethal targeting—without regard to particular self-defensive need or immediacy of threat—is permitted as a first resort. When an “armed conflict” does not exist, it is not. Challenging the …
The Integrity Of Our Convictions: Holding Stakeholders Accountable In An Era Of Criminal Justice Reform, Barry Scheck
The Integrity Of Our Convictions: Holding Stakeholders Accountable In An Era Of Criminal Justice Reform, Barry Scheck
Articles
The article argues for the implementation of systemic mechanisms to ensure accountability and transparency among criminal justice stakeholders to move away from a "win-at-all-costs" mentality. It proposes a transition toward a "just culture" that prioritizes learning from error and forward-looking accountability through structural reforms in discovery, misconduct tracking, and indigent defense.
To The Survivors Of Childhood Sexual Abuse- Whenever You’Re Ready: Eliminating The Criminal Statute Of Limitations On Childhood Sexual Assault Crimes In Light Of Pennsylvania’S Catholic Dioceses Grand Jury Investigation, Rebecca Schultz
Law Student Publications
It is exceptionally difficult for many survivors of sexual assault to come forward to tell their story. This is particularly the case where the perpetrator is someone in a position of power who the survivor trusted. The statute of limitations for cases of childhood sexual abuse can serve as another barrier preventing survivors from coming forward because it prevents any semblance of justice for those individuals. This is currently most evident in states like Pennsylvania that still impose a statute of limitations on crimes of sexually assaulting children. Pennsylvania is reeling from its most recent Catholic clergy sex abuse scandal, …
Obtaining And Enforcing A Security Interest In Local Currency Under Article 9 Of The Ucc, Marina C. Leary
Obtaining And Enforcing A Security Interest In Local Currency Under Article 9 Of The Ucc, Marina C. Leary
Law Student Publications
Community currency is known by many names including complementary currency, alternative currency, and parallel currency. Community currency operates alongside an official or national currency (e.g., dollars or euros) with the purpose of circulating within a small geographic area to facilitate the sale of goods and services. In other words, community currency refers to a privatized form of currency that is not backed by a government entity. With the increased use of community currency, it has the potential to serve as collateral for a security interest under the Article 9 of the Uniform Commercial Code. Although there are several types of …

Numerical Modelling Of Responses Of Offshore Wave Energy Converters In Extreme Waves, Pierre-Henri Musiedlak
Numerical Modelling Of Responses Of Offshore Wave Energy Converters In Extreme Waves, Pierre-Henri Musiedlak
School of Engineering, Computing and Mathematics Theses
Wave Energy is a promising sector for sustainable low-carbon energy production. Despite the effort put in the last decade, concerning problems remained unsolved. Numerical modelling can play a key role in the assessment of extreme responses necessary to the understanding of Wave Energy Converter (WEC) capacity to survive extreme conditions. However, high-fidelity codes are too time-consuming for industries, while codes of lower fidelity are based on major physical assumptions inducing concerning uncertainties. Therefore, the present study - sponsored jointly by DNV GL and the University of Plymouth - develops an hybrid model coupling the low-fidelity model WaveDyn, with a Computational …
Smoothed Particle Hydrodynamics Modelling Of The Impact Of A Flat Plate Upon An Aerated Water Surface, Hassan Muhammad Sdiq
Smoothed Particle Hydrodynamics Modelling Of The Impact Of A Flat Plate Upon An Aerated Water Surface, Hassan Muhammad Sdiq
School of Engineering, Computing and Mathematics Theses
Smoothed Particle Hydrodynamics (SPH) is a particle-based method for solving Navier-Stokes and similar equations and is well-suited to problems where the computational domain becomes highly deformed. This study will describe in detail SPH simulations of various single- and multiphase flows with free surfaces and interactions with structures and solid surfaces. All 2D and 3D implementations have been compared with other numerical and experimental results. By adoption of multiphase and 3D models the computational requirements rise due to the increased number of particles. The fact that large numbers of particles are required in the simulations means that a parallelised version of …

Human Electroencephalogram Based Biomarkers For Detection Of Alzheimer’S Disease, Ali H. Husseen Al-Nuaimi
School of Engineering, Computing and Mathematics Theses
Alzheimer’s disease (AD) is a progressive disorder that affects cognitive brain functions and develops many years before there are any clinical manifestations. A biomarker that provides a quantitative measure of changes in the brain in the early stages of AD would therefore be useful for early diagnosis. However, this would involve dealing with large numbers of people because up to 50% of dementia sufferers do not receive a formal diagnosis. Thus, there is a need for accurate, low-cost, robust, and easy to use biomarkers that can be used to detect AD in its early stages. Recent guidelines promote the use …

Neural Correlates Of Weighted Reward Prediction Error During Reinforcement Learning Classify Response To Cognitive Behavioral Therapy In Depression, Filippo Queirazza, Elsa Fouragnan, J. Douglas Steele, Jonathan Cavanagh, Marios G. Philiastides
School of Psychology
While cognitive behavioral therapy (CBT) is an effective treatment for major depressive disorder, only up to 45% of depressed patients will respond to it. At present, there is no clinically viable neuroimaging predictor of CBT response. Notably, the lack of a mechanistic understanding of treatment response has hindered identification of predictive biomarkers. To obtain mechanistically meaningful fMRI predictors of CBT response, we capitalize on pretreatment neural activity encoding a weighted reward prediction error (RPE), which is implicated in the acquisition and processing of feedback information during probabilistic learning. Using a conventional mass-univariate fMRI analysis, we demonstrate that, at the group …
