Arrests As Guilt, Anna Roberts Jan 2019

Arrests As Guilt, Anna Roberts

Faculty Articles

An arrest puts a halt to one’s free life and may act as prelude to a new process. That new process—prosecution—may culminate in a finding of guilt. But arrest and guilt—concepts that are factually and legally distinct—frequently seem to be fused together. This fusion appears in many of the consequences of arrest, including the use of arrest in assessing “risk,” in calculating “recidivism,” and in identifying “offenders.” An examination of this fusion elucidates obstacles to key aspects of criminal justice reform. Efforts at reform, whether focused on prosecution or defense, police or bail, require a robust understanding of the differences …

Kondo-Ing Steele V. Bulova: The Lanham Act’S Extraterritorial Reach Via The Effects Test, Margaret Chon Jan 2019

Kondo-Ing Steele V. Bulova: The Lanham Act’S Extraterritorial Reach Via The Effects Test, Margaret Chon

Faculty Articles

An update of the 1952 decision by the U.S. Supreme Court, Steele v. Bulova, is arguably overdue in an era of intense globalization of commerce, especially considered in light of the changes to jurisdictional and extraterritoriality doctrines. It has been almost seventy years since the Supreme Court has taken a hard look at the issue of the extraterritorial reach of the Lanham Act. During that period, the Court has shifted the procedural basis for extraterritorial analysis; the development of the so-called “effects test” for extraterritoriality has resulted in some doctrinal unruliness among the circuit courts; and Congress has amended the …

Adolescent Girls Of Color And Leadership Development, Veronda Lea Rooks-Price Jan 2019

Adolescent Girls Of Color And Leadership Development, Veronda Lea Rooks-Price

Walden Dissertations and Doctoral Studies

Adolescent girls of color (GOC) experience significant changes in social expectations during puberty based on gender and racial inequity. This divergence usually changes the trajectory for GOC relative to leadership development and may affect their career choices, life decisions, and overall directions for growth. This qualitative study explored the experiences of women of color (WOC) who hold senior leadership positions in Fortune 500 companies. Critical theory grounded this study as its aim is to identify marginalization of any kind and determine ways to free those who are oppressed. Research questions focused on the perceived challenges the participants experienced during adolescence …

Developmental Disruptions And Substance Use In An Emerging Adult Sample, Nena N. Mcgath Jan 2019

Developmental Disruptions And Substance Use In An Emerging Adult Sample, Nena N. Mcgath

Cal Poly Humboldt theses and projects

Recent substance use reports indicate a rise in use-related deaths. Emerging adults are identified as the most prevalent users of substances when compared to other age groups. Current intervention methods are not universally effective, with relapse rates varying by treatment model. The poor efficacy of interventions may be due to a lack of models using a developmental focus. For example, previous research highlights the influence of adverse childhood experiences (ACEs) on negative adult outcomes such as excessive substance use. ACEs may trigger a cascade of adaptation failures, disrupting attachment bonds between caregiver and child, and later influencing the development of …

Analysis Of Crush Resistance And Mississippi-Sourced Sands To Determine Potential As Proppant Sands, Ryann C. Lam Jan 2019

Analysis Of Crush Resistance And Mississippi-Sourced Sands To Determine Potential As Proppant Sands, Ryann C. Lam

Honors Theses

Proppant is a media used in hydraulic fracturing to bear in-situ stresses in order to maintain fracture networks, which act as highly permeable pathways for hydrocarbon recovery. Proppant can be made from a variety of materials such as glass, ceramic beads, sand particles, and more. Proppants are characterized by their size, sorting, roundness, and sphericity. These properties help determine the compressive strength of the pack proppant. This study focuses on these properties for natural sand. The purpose of this study is to evaluate the viability of lower-quality sands as proppant sands by testing the affect these properties have on the …

This Is Your Brain On Music: The Study Of Musical Influence On The Cognitive Mindset And Learning, Allysa N. Lipsey

Honors Theses

This thesis examines the use of musical influence on the brain with an emphasis on the effects on cognitive mindset and learning in mathematics education. It explores the idea of the use of different trials and methods to potentially unlock new knowledge about the brain through listening to music during in-class group work, individual work, and class assessments. It allows for an analysis of the music’s effect on the brain and creates discussion in multiple classrooms and age groups through the eyes of a participant observer in an ethnographic research scenario. By analyzing behaviors of body language, musical taste and …

An Analysis Of Key Financial Accounting Topics, Farris Abu-Saoud Jan 2019

An Analysis Of Key Financial Accounting Topics, Farris Abu-Saoud

Honors Theses

The purpose of this paper is to analyze twelve key financial reporting issues and principles using case studies. These issues and principals include revenue recognition, deferred income taxes, common stock, long-term debt, U.S. GAAP, statement of cash flows, profitability, and investment decisions. Working through these case studies and analyzing these key financial reporting topics has provided a greater understanding of financial accounting and U.S. GAAP; an understanding that goes well beyond what was learned through lectures and exams.

A Study Of The Kratom Alkaloids And Their Binding To The Μ-Opioid Receptor, Reba Elizabeth Ann Chamblee Jan 2019

A Study Of The Kratom Alkaloids And Their Binding To The Μ-Opioid Receptor, Reba Elizabeth Ann Chamblee

Honors Theses

Kratom, a plant commonly found in southeast Asia, has traditionally been used for medicinal treatments. Recently, however, the popularity of the drug has significantly increased due to its euphoric effects, leading to it being used as an alternative to illegal opioids. Several alkaloid compounds have been isolated from the leaves of the plant. The main alkaloids seen are the following five alkaloids: mitragynine, 7-hydroxymitragynine, speciociliatine, speciogynine, and paynantheine. Two alkaloids, mitragynine and 7-hydroxymitragynine, have exhibited high potencies and are potentially even more potent than morphine. Previous studies have indicated that the main mediator of the psychoactive effects is the opioid …

Institutional Divides: How Democracy Affects Economic Complexity In The Transition Economies Of Eastern Europe And Central Asia, Mary Frances Holland Jan 2019

Institutional Divides: How Democracy Affects Economic Complexity In The Transition Economies Of Eastern Europe And Central Asia, Mary Frances Holland

Honors Theses

The transition economies, in making their way from a command economy to an integrated market economy, experience vastly different levels of development. This work proposes an influence of inclusive, democratic institutions on increased economic complexity. This project reviews the history of diverging political and economic policy decisions across the region. Case studies for Poland, Ukraine, and Kazakhstan review trade data and democratic policies to better understand groups of development across the region. This paper utilizes Daron Acemoglu and James A. Robinson’s institutional developmental theory as a basis for the creation and sustainability of democratic and economically diverse structures.

Renewables & Refugees: A Solution For Jordan, Lauren Burns Jan 2019

Renewables & Refugees: A Solution For Jordan, Lauren Burns

Honors Theses

As the Hashemite Kingdom of Jordan continues to host the third largest Syrian refugee population in the world, the state’s infrastructure and its people are taking a toll. Before the war in Syria began, Jordan was already suffering from a weak economy, resource scarcity, and an enormous population boom. Since accepting nearly 2.5 million refugees, these issues have compounded year after year—nearly reaching a breaking point. I propose an unconventional solution to some aspects of the refugee crisis: renewable energy. Renewables are cheaper than fossil fuels, consume less water in electricity generation, emit fewer greenhouse gases, and promote job creation …

Protein Templated Silver Nanoclusters, Greyson Keel Jan 2019

Protein Templated Silver Nanoclusters, Greyson Keel

Honors Theses

Nanoclusters are smaller than their nanoparticle counterparts and have unique properties. Most research has been done on gold nanoclusters, but silver nanoclusters are said to be more robust. During the process of trying to create nanoclusters, several methods in the procedure were changed when gathering data: determining a successful silver concentration, working with the correct buffer, mixing gold and silver metals together, observing the effects of pH, and finding a good reducing agent. After experimenting with those changes, a successful protocol was adapted and modified from literature (Journal of Materials Chemistry, 2011, 21, 11205-11212) to produce the protein-templated Ag clusters. …

Economic Advancement Across The European Playing Field, Zac Herring Jan 2019

Economic Advancement Across The European Playing Field, Zac Herring

Honors Theses

This project seeks to examine the relationship between economic history, soccer, and economic institutions in countries who have attained varying levels of success on the soccer field and economically. The work of several influential scholars in recent decades has drawn attention to the need for a shift in the goal for economic achievement from industrialization to institutional effectiveness. This study develops a model to further understand the relationship between economic achievement and soccer success. It then includes case studies of three countries from the model in order to further understand the impact of the institutions that have a significant presence …

Japanese Mascots: Diplomatic Tool, Domestic Escapism, Gwenafaye Mccormick Jan 2019

Japanese Mascots: Diplomatic Tool, Domestic Escapism, Gwenafaye Mccormick

Honors Theses

In Japan, mascots are not only representatives of sports teams and sugary cereals, but are vital diplomatic tools of communication and domestic tools of escapism. Though a multitude of mascots exist, scholarship on the topic tends to portray the body of mascots as one-dimensional. This thesis analyzes the modern mascot field and provides previously undefined categories for mascots based on their application, as their absence hinders further analysis. These definitions also describe the subversive social space that mascots inhabit in Japanese society and allow the thesis to examine consumers’ relationships with mascots. An analysis of the U.S. and Israeli embassy …

Tracking Using Fusion Of Multiple Inertial Measurement Units, Jacob Reed Mccall Jan 2019

Tracking Using Fusion Of Multiple Inertial Measurement Units, Jacob Reed Mccall

Honors Theses

The objective of this thesis is to determine the effectiveness of fusing data from multiple inertial measurement units (IMU) to reduce bias and noise with an overall goal of achieving accurate tracking, which is the process of locating a body as it moves in a fixed environment. Every sensor is subject to noise, and each sensor has its own unique set of biases. The thesis presents a systematic overview of the sensors used in this research, which feature linear acceleration, angular acceleration, and a directional sensor, to form an inertial navigation system (INS). Sources of noise and bias that affect …

A Comprehensive Review Of Accounting And Financial Reporting Principles, Nicholas Egorshin

Honors Theses

The following Thesis is comprised of twelve case studies that were completed over one year in the course ACCY 420. This course, led by Dr. Victoria Dickinson, challenged students to dive deeper into accounting concepts and principles through the analysis of financial statements presented from real companies. The companies analyzed do business in a variety of industries and disciplines, so students were able to see the accounting process through a multitude of lenses. Some companies examined used foreign currency and adhered to International Accounting policies, so analysis and critical thinking skills were necessary in truly understanding the significance of the …

Rice Bunnies In China's #Metoo: Discussion Of A Feminist Movement Under Censorship, Tyler Caple Jan 2019

Rice Bunnies In China's #Metoo: Discussion Of A Feminist Movement Under Censorship, Tyler Caple

Honors Theses

This paper aims to assess the reception of the currently developing #MeToo movement in China from the perspective of Chinese internet users, feminists, and the state government as well as how censorship affects the way in which these individuals express their opinions on gendered sexual violence in Chinese society. By using a qualitative content analysis to comb through Chinese social media posts, Chinese state- sponsored news articles, and Western news articles, findings suggest that Chinese netizens are engaging with societal concerns over #MeToo and sexual assault, but do not define their grievances as being within a movement presumably to avoid …

The Effects Of Acute Exercise Intensity On Episodic Memory And False Memory, Emma Kate Dilley Jan 2019

The Effects Of Acute Exercise Intensity On Episodic Memory And False Memory, Emma Kate Dilley

Honors Theses

Previous experimental work demonstrates that acute exercise may enhance episodic memory performance. However, limited research has examined the extent to which acute exercise influences false memory production, and no studies, to date, have examined whether there is an intensity-specific effect of acute exercise and true and false memories. Thus, the present experiment evaluated the effects of acute exercise on episodic memory and false memory. A three-arm, parallel, between-group randomized controlled trial was employed, with participants (Mage = 20.8 years) randomized into a moderate-intensity exercise group (15-minute bout of treadmill exercise at 50% Heart Rate Reserve; N = 20), a high-intensity …

Dworkinian Liberalism, The Right To Pornography, And The Internet, Will Nowell Jan 2019

Dworkinian Liberalism, The Right To Pornography, And The Internet, Will Nowell

Honors Theses

In a 1981 journal article, “Is There A Right to Pornography?,” Ronald Dworkin argues that we have a right to ethical independence that includes the right to consume pornography. The purpose of this thesis is to inquire as to whether Dworkinian liberalism does entail a right to specifically internet pornography. This research is primarily focused on Ronald Dworkin’s writings in Justice for Hedgehogs, Sovereign Virtue: The Theory and Practice of Equality, and Taking Rights Seriously to describe the principles and character of Dworkinian liberalism and its philosophical relationship to the question of the right to pornography. This thesis considers contemporary …

Interactions Between Contextual And Phonetic Information In Children’S And Adults’ Perception Of Non-Native Speech, Alexis P. Zosel Jan 2019

Interactions Between Contextual And Phonetic Information In Children’S And Adults’ Perception Of Non-Native Speech, Alexis P. Zosel

Honors Theses

Phoneme categorization (i.e., the ability to differentiate between different speech sounds) is not an easy task, as individuals must integrate multiple sources of information, including both acoustic and contextual information. When a talker has a foreign accent, the listener may place more weight on sentential context because of the ambiguity of the acoustic/phonetic information. For example, listeners are more likely to classify a word that is phonetically ambiguous between goat and coat as goat if the sentential context is “The boy milked the ___,” and this is especially the case when listening to a non-native (compared to native) talker (Schertz …

Introduction To Community Psychology: Becoming An Agent Of Change, Leonard A. Jason, Olya Glantsman, Jack F. O'Brien, Kaitlyn N. Ramian Jan 2019

Introduction To Community Psychology: Becoming An Agent Of Change, Leonard A. Jason, Olya Glantsman, Jack F. O'Brien, Kaitlyn N. Ramian

College of Science and Health Full Text Publications

Introduction to Community Psychology: Becoming an Agent of Change tells the story of community psychologists, who view social problems as being due to the unequal distribution of resources, which causes poverty, homelessness, unemployment, and crime. In addition, because no condition or disease has ever been eliminated by just dealing with those with the problem, community psychologists focus their work on prevention. Finally, community psychology shifts the power dynamics so that community members are equal members of the team, as they provide unique points of view about barriers that need to be overcome in working toward social justice. In a sense, …

Law And Norms In The Market Response To Discrimination In The Sharing Economy, Naomi Schoenbaum Jan 2019

Law And Norms In The Market Response To Discrimination In The Sharing Economy, Naomi Schoenbaum

GW Law Faculty Publications & Other Works

Published by De Gruyter May 11, 2019, https://www.degruyter.com/document/doi/10.1515/lehr-2019-0001/html

Sharing-economy firms have opposed the application of antidiscrimination law to their transactions. At the same time, these firms have heralded their ability to achieve antidiscrimination aims without the force of law, and have adopted various measures to address discrimination. This Article documents and assesses these measures, focusing on the relationship between law and norms. Relying on the sharing economy as a case study, this Article shows how law can play a crucial role in spurring antidiscrimination efforts by firms that it does not regulate, but also how antidiscrimination law might nonetheless be …
