Copyright And Geoblocking: The Consequences Of Eliminating Geoblocking, Marketa Trimble Jan 2019

Copyright And Geoblocking: The Consequences Of Eliminating Geoblocking, Marketa Trimble

Scholarly Works

Geoblocking has become a common companion of copyrighted content on the internet; even streaming services can make streamed copyrighted content available or unavailable according to the location of their users. There are various reasons for geographical restrictions on access to content; copyright issues are not the only reasons, but territorial limitations associated with copyright are significant – and sometimes the primary – reasons for implementing geoblocking. This article reviews the current relationship between copyright and geoblocking, particularly the role attributed to geoblocking in copyright law and law of personal jurisdiction in the United States and the European Union; it considers …

Enforcement Of Intellectual Property Rights At Trade Shows: A Review And Recommendations, Marketa Trimble Jan 2019

Enforcement Of Intellectual Property Rights At Trade Shows: A Review And Recommendations, Marketa Trimble

Scholarly Works

Trade shows (also referred to as trade fairs or exhibitions) are venues for the exchange of information about the newest intellectual property ("IP") and can also be venues where disputes over IP rights arise or escalate. When trade shows become arenas for such disputes, IP right owners seek means to stop infringements of their IP rights on site-at the trade show and with immediate effect. This article reviews from a comparative perspective the options that IP right owners have for immediate relief at trade shows. After considering the limitations that current law imposes on temporary restraining orders in the United …

The Masculinity Mandate: #Metoo, Brett Kavanaugh, And Christine Blasey Ford, Ann C. Mcginley Jan 2019

The Masculinity Mandate: #Metoo, Brett Kavanaugh, And Christine Blasey Ford, Ann C. Mcginley

Scholarly Works

In fall 2019, the Senate Judiciary Committee held hearings involving Dr. Christine Blasey Ford's testimony about then-Judge Brett Kavanaugh's alleged behavior at a high school party gone awry.

This essay uses identity performance and multidimensional masculinities theories to analyze the hearings, specifically to consider the gender, race, and class performances of the participants, and how partisans and non-partisans interpreted those performances. This examination demonstrates that the judgment concerning masculinity and femininity performances and their appropriateness is, to a certain extent, in the eye of the beholder. By the same token, public interpretations are not arbitrary. Rather, at least in this …

Considering Reconsidering Judicial Independence, Charles G. Geyh Jan 2019

Considering Reconsidering Judicial Independence, Charles G. Geyh

Articles by Maurer Faculty

In Reconsidering Judicial Independence, Professor Stephen Burbank revisits the nature of the relationship between judicial independence and judicial accountability—a relationship that he has elucidated over the course of an illustrious career. As Burbank emphasizes, the continuing success of this dichotomy depends on preserving a balance between its halves. But forces generations in the making have led to a new assault on the independence of the judiciary in the age of Trump, which has put the future of the independence–accountability balance in doubt. The age-old rule-of-law paradigm, which posits that independent judges put aside their personal biases and follow the law, …

Intellectual Property Law And The Right To Repair, Leah Chan Grinvald, Ofer Tur-Sinai Jan 2019

Intellectual Property Law And The Right To Repair, Leah Chan Grinvald, Ofer Tur-Sinai

Scholarly Works

This Article posits that intellectual property law should accommodate consumers’ right to repair their products. In recent years, there has been a growing push towards state legislation that would provide consumers with a “right to repair” their products. Currently, twenty states have pending legislation that would require product manufacturers to make available replacement parts and repair manuals. Unfortunately, though, this legislation has stalled in many of the states. Manufacturers have been lobbying the legislatures to stop the enactment of these repair laws based on different concerns, including how these laws may impinge on their intellectual property rights. Indeed, a right …

Academic Librarians’ Experiences As Faculty Developers: A Phenomenographic Study, Michael Flierl, Clarence Maybee, Rachel Fundator Jan 2019

Academic Librarians’ Experiences As Faculty Developers: A Phenomenographic Study, Michael Flierl, Clarence Maybee, Rachel Fundator

Communications in Information Literacy

Academic libraries are integral to the teaching and learning missions of colleges and universities. Yet, libraries continue to face substantial challenges in their work to advance student learning, especially regarding the sustainability and scalability of their instructional efforts. This paper describes a phenomenographic research project that investigated the varied experiences of Purdue University Libraries faculty members participating in the IMPACT faculty development program. The findings suggest that academic librarians are capable of acting as faculty developers who can engage faculty in conversations, which may or may not relate to information literacy, to advance student-centered teaching and learning environments.

Initial Development Of The Perception Of Information Literacy Scale (Pils), Matthew Doyle, Britt Foster, Mariya A. Yukhymenko-Lescroart

Communications in Information Literacy

The ACRL Framework for Information Literacy for Higher Education has provided academic librarians a guiding document to facilitate the development of information literacy skills in students. Despite widespread adoption of the Framework in academic libraries, a lack of valid and reliable Framework-based scales for assessing students’ knowledge practices and dispositions hinders further understanding of student information literacy. The current article describes the development and testing of the Perception of Information Literacy Scale (PILS). The participants in this study were 443 graduate students. The resulting scale is made up of 36 items that measure seven distinct constructs of information literacy. …

No-Reference Image Denoising Quality Assessment, Si Lu Jan 2019

No-Reference Image Denoising Quality Assessment, Si Lu

Computer Science Faculty Publications and Presentations

A wide variety of image denoising methods are available now. However, the performance of a denoising algorithm often depends on individual input noisy images as well as its parameter setting. In this paper, we present a noreference image denoising quality assessment method that can be used to select for an input noisy image the right denoising algorithm with the optimal parameter setting. This is a challenging task as no ground truth is available. This paper presents a data-driven approach to learn to predict image denoising quality. Our method is based on the observation that while individual existing quality metrics and …

Environmental Science and Management Faculty Publications and Presentations

Forest fires are increasing across the American West due to climate warming and fire suppression. Accelerated snow melt occurs in burned forests due to increased light transmission through the canopy and decreased snow albedo from deposition of light-absorbing impurities. Using satellite observations, we document up to an annual 9% growth in western forests burned since 1984, and 5 day earlier snow disappearance persisting for >10 years following fire. Here, we show that black carbon and burned woody debris darkens the snowpack and lowers snow albedo for 15 winters following fire, using measurements of snow collected from seven forested sites that …

Inquiry Into The Correlation Between Burnout And Depression, Irvin Sam Schonfeld, Jay Verkuilen, Renzo Bianchi Jan 2019

Inquiry Into The Correlation Between Burnout And Depression, Irvin Sam Schonfeld, Jay Verkuilen, Renzo Bianchi

Publications and Research

The extent to which burnout refers to anything other than a depressive condition remains an object of controversy among occupational health specialists. In three studies conducted in two different countries and two different languages, we investigated the discriminant validity of burnout scales by evaluating the magnitude of the correlation between (latent) burnout and (latent) depression. In Study 1 (N = 911), burnout was assessed with the Maslach Burnout Inventory–General Survey’s Exhaustion subscale and depression with the depression module of the Patient Health Questionnaire (PHQ). In Study 2 (N = 1,386), the Shirom–Melamed Burnout Measure was used to assess burnout and …

The workshop’s goal was to bring together researchers whose fields did not always overlap and who could learn from each other’s insights. In attendance were linguists working on …

Departments And Disciplinary Gatekeeping: The Sociolinguistics Of Spanish In Us Academia, José Del Valle Jan 2019

Departments And Disciplinary Gatekeeping: The Sociolinguistics Of Spanish In Us Academia, José Del Valle

Publications and Research

José del Valle, in his contribution to our “Sociolinguistic Frontiers” series, looks at the intersection of the sociolinguistic study of Spanish in the US and the transformations of Spanish language departments in higher education. Del Valle traces the history of the institutionalization of Spanish teaching and study and its effects on linguistic research’s position within Spanish departments. Shifts in approaches to the use of language in social practice, and the growing demands on language units to act as service departments for language learners, has isolated scholars in those institutional homes from broader integration into sociolinguistic research.

Technological Encounters In The Interculturality Of Istanbul's Recording Studios, Eliot Bates Jan 2019

Technological Encounters In The Interculturality Of Istanbul's Recording Studios, Eliot Bates

Publications and Research

This essay questions what is cultural within a recording studio, and the extent to which interculturality could be a useful lens for examining studio encounters and by extension other forms of artistic-technological labor. As I will show, when the concept of interculturality surfaces it rarely is accompanied by a sufficiently nuanced concept of "culture", and additionally relies upon an assumption that the "inter-" is mapping an encounter between individuals representing discrete cultural units, typically defined in reductive demographic terms. Interculturality may be able to be partly recuperated, however, through a more flexible and realistic conceptualization of culture that is more …

Hardly Habitual: Chimpanzees And Gorillas Show Flexibility In Their Motor Responses When Presented With A Causally-Clear Task, Sarah L. Jacobson, Lydia M. Hopper Jan 2019

Hardly Habitual: Chimpanzees And Gorillas Show Flexibility In Their Motor Responses When Presented With A Causally-Clear Task, Sarah L. Jacobson, Lydia M. Hopper

Publications and Research

In contrast to reports of wild primates, studies of captive primates' flexibility often reveal conservatism: individuals are unable to switch to new and more efficient strategies when task demands change. We propose that such conservatism might be a result of task design and hypothesize that conservatism might be linked to primates' lack of causal understanding in relation to experimental apparatuses. We investigated if chimpanzees (Pan troglodytes) and western lowland gorillas (Gorilla gorilla gorilla) would show greater flexibility when presented with a causally-clear task. We presented six chimpanzees and seven gorillas with a clear tube from which …

Large Pelvic Tubercle In Orangutans Relates To The Adductor Longus Muscle, Brian M. Shearer, Magdalena Muchlinski, Ashley S. Hammond Jan 2019

Large Pelvic Tubercle In Orangutans Relates To The Adductor Longus Muscle, Brian M. Shearer, Magdalena Muchlinski, Ashley S. Hammond

Publications and Research

Orangutan pelves commonly exhibit a large, projecting tubercle in the iliopubic region, historically assumed to homologous to the pubic tubercle in humans. However, it is not clear whether this tubercle is a unique feature of Pongo, or if it is anatomically homologous with the human pubic tubercle when considered as a soft tissue attachment point. To clarify this issue, we dissected orangutan and other ape cadaveric specimens to evaluate the pelvic brim soft tissues and how they may relate to the tubercle (when present). We additionally conducted a broad osteological survey of pelvic brim morphology across 28 primate genera …

Modern Theoretical Approaches To Medieval Translation, Michelle R. Warren Jan 2019

Modern Theoretical Approaches To Medieval Translation, Michelle R. Warren

Dartmouth Scholarship

This chapter explores some of the ways in which modern literary theory opens insights into medieval European translations. Rather than drawing a distinction between theoretical approaches that apply to medieval studies and those that do not, I will explore a few examples that might in turn inspire readers to their own insights. It is my hope that over time readers of this Companion to Medieval Translation will posit many more modern theoretical approaches to medieval translation than can be suggested here. We might even imagine that some of the particularities of medieval European theories of translation could themselves be codified …

How Much Do Emotional, Behavioral, And Cognitive Factors Actually Impact College Student Attitudes Towards English Language Learning? A Quantitative And Qualitative Study, Xin Zuo, Regina D. Weaver, Julia Macrae, Limin Wang

Intensive English Language Program Faculty Publications and Presentations

Researchers have proposed many multidimensional frameworks to identify significant and potential factors, e.g., educational background, positive feelings and career aspirations, that impact English learning attitude in second language acquisition. Yet, there is still very little research to graphically describe the interactions between these factors and how these factors directly or indirectly impact learning attitude. To this end, a questionnaire survey was conducted in Changchun University of Technology. Statistical measures and Bayesian network analysis were introduced to quantitatively and qualitatively analyze the collected data. Furthermore, the significant attitudinal differences between students majoring in the Liberal Arts or Sciences were investigated for …
