Mens Rea Reform As A Demand-Side Solution To The Problem Of Sex Trafficking, Daniel Michael Criswell Jan 2019

Mens Rea Reform As A Demand-Side Solution To The Problem Of Sex Trafficking, Daniel Michael Criswell

Case Western Reserve Journal of International Law

Trafficking in persons has existed around the world for many years, yet the United States has only begun to take this modem form of slavery seriously in the last two decades. The nature of sex trafficking has caused confusion for the United States and others around the globe regarding how to best deal with the commercial sex industry. The failure to reduce the commercial sex industry through traditional means of prosecuting the traffickers and their victims has motivated Sweden, and consequently the United States, to pursue a different strategy: reducing the demand through the prosecution of the buyers of commercial …

World War Web: Rethinking "Aiding And Abetting" In The Social Media Age, Rebecca J. Cambron

Case Western Reserve Journal of International Law

ISIS's use of social media presents a new challenge for counterterror efforts. The organization aims to recruit followers and incite violence through social media. Given that this is a new medium for terrorist organizations, social media companies have come under fire for indirectly providing ISIS with farreaching platforms to spread its content. The companies, as well as national governments and international entities, have attempted to respond to the threat posed by such content. These responses, however, have proven ineffective. This Note argues that to effectively respond to and combat the threat posed by terrorist speech, national governments should adopt a …

An Institutional Theory Of Corporate Regulation, Iris H-Y Chiu Jan 2019

An Institutional Theory Of Corporate Regulation, Iris H-Y Chiu

Northwestern Journal of International Law & Business

The regulation of corporate behavior has persisted in spite of peaks of neo-liberalism in many developed jurisdictions of the world, including the U.K. This paradox is described as “regulatory capitalism” by a number of scholars. Of particular note is the proliferation of corporate regulation to govern “socially responsible” behavior in recent legislative reforms in the EU and U.K. In seeking to answer the broader question of whether corporate regulation indeed effectively governs and moderates corporate behavior, this paper focuses on the nature of corporate regulation. Although different pieces of corporate regulation purport to achieve different objectives and impose different types …

Crouching Tigers And Hidden Dragons On The Great Wall Street: Decoding The Corporate Goverance Of Chinese Commercial Banks, Yueh-Ping (Alex) Yang Jan 2019

Crouching Tigers And Hidden Dragons On The Great Wall Street: Decoding The Corporate Goverance Of Chinese Commercial Banks, Yueh-Ping (Alex) Yang

Washington International Law Journal

As China’s economic influence on the world grows, its system of state capitalism is likewise receiving increasing scrutiny. Behind the state capitalism, China’s banking sector, the “Great Wall Street”—parallel to the “Wall Street” in the United States—plays a fundamental role in financing and supporting China’s economy. Contemporary studies of China’s state capitalism, however, focus mainly on Chinese state-owned enterprises, leaving less attention specific to China’s state-owned banking sector which adopts a rather different corporate governance practice. In this paper, I conduct a comprehensive and critical review of the bank governance practice in China. Statutorily, Chinese commercial banks generally follow corporate …

Uniform Interpretation Of Cisg Jan 2019

Uniform Interpretation Of Cisg

The International Lawyer

This UN Convention on Contracts for the International Sale of Goods (CISG) has been U.S. law for a generation and requires that it be interpreted “to promote uniformity in its application”. This article argues that uniform interpretation is impractical because 1) it is written in six official languages which do not always mean the same thing; 2) with more than 90 countries’ courts and arbitrators applying CISG, each in its own language, some of which do not regularly print their opinions, it is difficult to access all opinions on a single point; 3) since Civil Law countries consider the writings …

Two- And Three-Year-Olds Consider Ownership When Selecting And Allocating Resources, M Petrowski, Patricia Kanngiesser, Ori Friedman Jan 2019

Two- And Three-Year-Olds Consider Ownership When Selecting And Allocating Resources, M Petrowski, Patricia Kanngiesser, Ori Friedman

School of Psychology

In three experiments, we investigated whether 2- and 3-year-olds (N = 240) consider ownership when taking resources for themselves and allocating resources to another agent. When selecting resources for themselves, children generally avoided taking resources that belonged to another agent and instead favored their own resources (Experiments 1 and 2). However, they did not avoid taking the agent’s resources when the only other resources available were described as not belonging to the agent (Experiment 3). Children also selected fewer of the agent’s resources when taking for themselves than when giving to the agent (Experiments 2 and 3). In giving to …

Life Cycle Analysis (Lca) Models And Their Value For Solid Waste Planning, David J. Tonjes Jan 2019

Life Cycle Analysis (Lca) Models And Their Value For Solid Waste Planning, David J. Tonjes

Technology & Society Faculty Publications

Solid waste management is a complex undertaking that addresses a basic human need. Wastes can affect human health and the environment. Managing them so as to reduce and minimize these impacts requires expending physical and human resources. Often there are trade-offs among the effects associated with technological and policy choices.

Generally, understanding the effects of the various choices requires expanding scope beyond the immediate issue. Recycling, for instance, reduces disposal needs. It also affects the inputs to manufacturing processes, and can reduce the demand to extract natural resources. A larger perspective on recycling can provide justifications for increasing diversion efforts. …

Modeling And Control Of The Ugv Argo J5 With A Custom-Built Landing Platform, Mohammed Aldaoseri Alghanim

Electronic Theses and Dissertations

This thesis aims to develop a detailed dynamic model and implement several navigation controllers for path tracking and dynamic self-leveling of the Argo J5 Unmanned Ground Vehicle (UGV) with a custom-built landing platform. The overall model is derived by combining the Argo J5 driveline system with the wheelsterrain interaction (using terramechanics theory and mobile robot kinetics), while the landing platform model follows the Euler-Lagrange formulation. Different controllers are, then, derived, implemented to demonstrate: i.) self-leveling accuracy of the landing platform, ii.) trajectory tracking capabilities of the Argo J5 when moving in uneven terrains. The novelty of the Argo J5 model …

The Impact Of University Writing Curriculum On Preservice Teachers' Praxis I Scores, Virginia Ann Braithwaite

Walden Dissertations and Doctoral Studies

Until 2014, admission requirements for the educator preparation program at a university in the north central United States included a minimum competency level on the Praxis I basic skills writing test and completion of one general education writing course. However, evidence from the university's ETS reports showed that less than 60% of students as first-time test-takers met the required score. The purpose of this study was to assess the effectiveness of the required writing course in assisting students to meet the Praxis I writing competencies. In 2014, the ETS Core Academic Skills for Educators test replaced the Praxis I. Because …

Preparing Pre-Service Teachers To Teach Media Literacy: A Response To “Fake News”, Todd S. Cherner, Kristal Curry

Educational Sciences and Organizations

The call for integrating media literacy into public education is not new. However, with the rise of “fake news” and sensationalism along with technology’s ever-growing role in society, media literacy offers teachers and students a set of skills to analyze, critique, and respond to the information that appears before them in the digital texts they read, the television shows they watch, and their social media feeds. As multiple case studies have identified ways teachers are already blending media literacy into their instruction, this case study used a lesson plan assignment coupled with a survey to analyze how pre-service teachers enrolled …

Kurdish Culture And Identity: Building The Homeland In Tennessee, Steve Wininger

All-Inclusive List of Electronic Theses and Dissertations

The Kurds are the largest ethnic group in the world without their own state, and are one of the most controversial, overlooked and understudied ethnic groups in academic research. In the field of communication, there is very little research of the Kurdish diaspora in the United States. Identity is a complex subject in itself, but for the Kurds it is even more complicated because of the controversy surrounding them, their claims, and their status as a stateless ethnic group. The necessity for the Kurds to keep their culture and identity has cost them their freedom, homes, and lives, yet they …

The Effects Of Academic Success Coaching On First-Year Students, Mark A. Minglin

All-Inclusive List of Electronic Theses and Dissertations

Student retention has been of increasing concern for college and university administrators for over the last 20 years, but the need for more effective strategies to address retention issues has never been more of a pressing matter than it is today (Allen, D. F. & Bir, 2012). Some research (Bettinger & Baker, 2011; Dansinger, 2000; Griffiths, 2012; Knight, 2012) has identified peer academic success coaching as potential intervention strategy to address the retention issue in higher Education. Relatively few studies have addressed the assessment of these coaching interventions and the majority have been qualitative in nature. The purpose of this …

Dialogic Teaching In A Detracked High School Ela Class: "We Talk Here", Signy Emler Jan 2019

Dialogic Teaching In A Detracked High School Ela Class: "We Talk Here", Signy Emler

Theses & Dissertations

This dissertation combines the two fields of dialogic teaching and detracking in a study of one teacher’s English Language Arts high school classroom. The policy of tracking students into separate academic classes perpetuates segregation and is antithetical to the principles of democracy. Dialogic teaching is where students and the teacher engage in inquiry and exploratory talk to co-construct knowledge, and all students are provided with frequent opportunities to express their voices. Grounded in theory that views language and identity as socially constructed and situated, this qualitative case study examined how students from different racial, socio-economic, political and cultural backgrounds worked …
