How New York Drinks: If And How Third-Party Providers Can Integrate With The Three-Tier System, Alexa Bordner Dec 2018

How New York Drinks: If And How Third-Party Providers Can Integrate With The Three-Tier System, Alexa Bordner

Brooklyn Law Review

Thanks to a surge of new companies that facilitate home delivery, it has become increasingly common for consumers to make purchases online. In the case of alcohol sales, however, convenience cannot be the only consideration. New York (and a majority of other states) regulates the distribution of alcoholic beverages through a three-tier licensing system of producers, wholesalers, and retailers. The question that then arises is whether the non-licensed, third-party entities that work with licensees in a variety of ways, including by providing retail licensees with a platform for making Internet sales, fit into the regulatory scheme. While consumer demand has …

The Duke Model: A Performance-Based Solution For Compensating College Athletes, David A. Grenardo Dec 2018

The Duke Model: A Performance-Based Solution For Compensating College Athletes, David A. Grenardo

Brooklyn Law Review

The recent $8.8 billion extension of the NCAA men’s basketball tournament with TV networks CBS Sports and Turner Broadcasting System Inc. illustrates how in recent years the business of college athletics—specifically, of Division I football and men’s basketball programs—has evolved considerably, exploding into a multibillion dollar annual enterprise. There has been no commensurate change, however, in the compensation structure for the college athletes driving these colossal profits; they are still prohibited from being paid under NCAA rules and are compensated solely through the award of athletic scholarships, as has been the case for decades. This article argues that the jurisprudence …

Continuous Glucose Monitoring: An Overview For Nurse Practitioners, Casey Neeley, Donna Freeborn Dec 2018

Continuous Glucose Monitoring: An Overview For Nurse Practitioners, Casey Neeley, Donna Freeborn

Student Works

Continuous glucose monitoring (CGM) is a revolutionary addition to diabetic management for patients with type 1 diabetes mellitus (T1DM). CGM, when used properly, improves overall glycemic control. In the short term, CGM decreases incidences of hypoglycemic events and improves day to day blood glucose control. In the long term, CGM decreases hemoglobin A1c levels and decreases incidences and severity of long term complications of diabetes. When patients are educated and supported by providers on the use of CGM, patients with T1DM can achieve optimal glycemic control.

Developing A Critical Perspective Of Creative Agency In Digital Environments, Nicholas G. Leonard Dec 2018

Developing A Critical Perspective Of Creative Agency In Digital Environments, Nicholas G. Leonard

Student Projects

Previous understandings of creativity have focused on the individual, and digital technologies as static tools. Since then, our understanding of creativity has developed through a social psychology understanding to link creative behaviors to the environment. Digital technologies have also developed expodentially with the introduction of neural networks, deep learning, and artificial intelligence. By addressing the environment to support creative behaviors through a social psychology perspective while simultaneously breaking away from a traditional Instrumental Theory of Technology to view digital technologies as having agency, arguments can be made for critically reviewing our relationships with technology to better support creative behaviors though …

Does International Law Change State Behavior?, Brett Franzie Dec 2018

Does International Law Change State Behavior?, Brett Franzie

Honors Program Theses and Projects

Human rights treaties are the main legal instrument used by the United Nations to advance human rights. While many treaties are ratified by the world, rights violations still happen, especially for women. The purpose of this study is to discover if states obey and follow international human rights law on women’s rights and protect the rights defined in the Convention on the Elimination of All Forms of Discrimination Against Women. This analysis employed a case study methodology that compares four states: Sweden, Latvia, Libya, and the United Arab Emirates and their women’s rights practices. The United Nations Universal Periodic Review …

Antecedents Of Word-Of-Mouth Communication And Purchase Intention On Facebook, Bogdan Anastasiei, Ana Raluca Chiosa Dec 2018

Antecedents Of Word-Of-Mouth Communication And Purchase Intention On Facebook, Bogdan Anastasiei, Ana Raluca Chiosa

Journal of Marketing and Consumer Behaviour in Emerging Markets

More and more business customers use social media to express their opinions about products, services and brands. This study aims to make a step further in understanding consumer engagement in electronic word of mouth (eWOM) on Facebook and its impact on recommending and purchasing products. To test our conceptual framework, structural equation modeling techniques have been applied to data collected through a self-administrated survey addressed to 640 Facebook users from Romania. Our model shows that Facebook’s perceived usefulness infl uences customer brand engagement, which in turn has an important effect on the intention to purchase the brand and recommend it …

Poverty And Eastern Kentucky School Districts: An Analysis Of Effective Interventions That Lead To Academic Success, Jessica Dobbs Dec 2018

Poverty And Eastern Kentucky School Districts: An Analysis Of Effective Interventions That Lead To Academic Success, Jessica Dobbs

Honors Theses

Poverty is a persistent cycle that plagues the United States, but specifically Eastern Kentucky. This is especially evident within the school districts there. This data was collected in order to help highlight the magnitude of poverty within Eastern Kentucky and its’ impact on the academic success of the students. When analyzing data from the Kentucky School Report Card from the 2016-2017 school year, twenty-four counties were identified as having at least 75% of the student population within the district qualifying for free & reduced lunch. After the identification of those twenty-four counties, the elementary K-Prep Proficiency and Distinguished scores for …

Shedding Light On The Role Of Opaque1 In Asymmetric Cell Division In Maize, Janette Yuseil Mendoza Dec 2018

Shedding Light On The Role Of Opaque1 In Asymmetric Cell Division In Maize, Janette Yuseil Mendoza

Biology ETDs

Asymmetric cell division (ACD) is important for cell fate and tissue patterning. Many aspects of ACD in plants, however, are still unclear. The process of ACD can be broadly broken down into three phases: (1) cell polarization, (2) division plane establishment and maintenance, and (3) cell division and cytokinesis. Stomatal development in maize has proven to be a useful model for understanding the ACD mechanism. Previous studies have identified several proteins important for all three phases of ACD. Actin is important in each of the phases of ACD, suggesting an actin motor such as myosin may also be important for …

Physella Acuta, Comparative Immunology And Evolutionary Aspects Of Gastropod Immune Function, Jonathan H. Schultz Dec 2018

Physella Acuta, Comparative Immunology And Evolutionary Aspects Of Gastropod Immune Function, Jonathan H. Schultz

Biology ETDs

Gastropod immunobiology has benefitted from investigations focused on the planorbid snail Biomphalaria glabrata, intermediate host for the human parasite Schistosoma mansoni. Though such concentrated efforts have elucidated fascinating aspects of invertebrate immunity, they have not provided full knowledge regarding the evolution of immune function among other gastropod species. This dissertation presents the importance of making strategic choices regarding which organisms to select for comparative immunology. Herein, the choice was made to investigate the immunobiology of Physella acuta, a freshwater snail species of the Physidae, a sister family to Planorbidae to which B. glabrata belongs. Benefiting greatly from …

Effect Of Temperature Change On Synaptic Transmission At Crayfish Neuromuscular Junctions, Yuechen Zhu, Leo De Castro, Robin L. Cooper Dec 2018

Effect Of Temperature Change On Synaptic Transmission At Crayfish Neuromuscular Junctions, Yuechen Zhu, Leo De Castro, Robin L. Cooper

Biology Faculty Publications

Ectothermic animals in areas characterised by seasonal changes are susceptible to extreme fluctuations in temperature. To survive through varied temperatures, ectotherms have developed unique strategies. This study focuses on synaptic transmission function at cold temperatures, as it is a vital component of ectothermic animals' survival. For determining how synaptic transmission is influenced by an acute change in temperature (20°C to 10°C within a minute) and chronic cold (10°C), the crayfish (Procambarus clarkii) neuromuscular junction (NMJ) was used as a model. To simulate chronic cold conditions, crayfish were acclimated to 15°C for 1 week and then to 10°C for …

The gamma-ray sky has been observed with unprecedented accuracy in the last decade by the Fermi -large area telescope (LAT), allowing us to resolve and understand the high-energy Universe. The nature of the remaining unresolved emission [unresolved gamma-ray background (UGRB)] below the LAT source detection threshold can be uncovered by characterizing the amplitude and angular scale of the UGRB fluctuation field. This Letter presents a measurement of the UGRB autocorrelation angular power spectrum based on eight years of Fermi-LAT Pass 8 data products. The analysis is designed to be robust against contamination from resolved sources and noise systematics. The sensitivity …

Recreational drug use and the opiate epidemic have taken a great toll on the human population of the United States and beyond. Year over year, deaths from synthetic opioids—of which fentanyl ranks as the most prevalent—have skyrocketed, reaching 29,406 in 2017. Environmental transfer of drugs of human addiction to horses is nothing new. Cocaine and its primary metabolite, benzoylecgonine, have long been identified as environmental substances in post-race samples, and many jurisdictions have screening limits in place as a result. More recently, methamphetamine has begun to show up in post-race samples, reflecting the increasing addiction problem associated with this drug. …

The Shortcomings Of The Philosopher President: Sun Yat-Sen’S Provisional Presidency Of 1912, Sean Gray Dec 2018

The Shortcomings Of The Philosopher President: Sun Yat-Sen’S Provisional Presidency Of 1912, Sean Gray

History & Classics Student Scholarship

As the twentieth century began, the Qing dynasty found itself besieged by foreign powers. Critically examining these powers, such as the United States and Great Britain, Chinese thinkers found themselves in a paradox regarding the country’s future. On one hand, China could adhere to Confucian tradition, rebuke Western ideals, and maintain its distinct culture. On the other, these foreign nations had swept into China, pillaged its treasuries, and slaughtered its armies. These nations clearly had great power, which some argued stemmed from their modernization and political structure. To modernize, these would-be revolutionaries thought that the country should adopt Western principles. …
