Evaluating The Legality Of Age-Based Criteria In Health Care: From Nondiscrimination And Discretion To Distributive Justice, Govind Persad
Evaluating The Legality Of Age-Based Criteria In Health Care: From Nondiscrimination And Discretion To Distributive Justice, Govind Persad
Sturm College of Law: Faculty Scholarship
Recent disputes over whether older people should pay more for health insurance, or receive lower priority for transplantable organs, highlight broader disagreements regarding the legality of using age-based criteria in health care. These debates will likely intensify given the changing age structure of the American population and the turmoil surrounding the financing of American health care. This Article provides a comprehensive examination of the legality and normative desirability of age-based criteria. In the Article, I defend a distributive justice approach to age-based criteria. Rather than viewing age as a personal characteristic akin to race or religion, the distributive justice approach …

Vortex Motions Around A Vertically Vibrating Cylinder In Oscillatory Flows, Symphony Chakraborty, Tzu-Wen Lin, Ming-Jyh Chern
Vortex Motions Around A Vertically Vibrating Cylinder In Oscillatory Flows, Symphony Chakraborty, Tzu-Wen Lin, Ming-Jyh Chern
Journal of Marine Science and Technology–Taiwan
Numerical simulations of the vortex-induced vibration (VIV) on a circular cylinder in an oscillatory flow were conducted using the direct-forcing immersed boundary (DFIB) method. VIV of structures is a practical engineering problem. Many engineers have devoted themselves to research on the prevention of VIV, which can cause severe damage to offshore construction equipment and structures. Fluctuating hydrodynamic force induces vibration of structures because of the vortex around the structure. This vibration causes structural failure due to the lock-in phenomenon. A phenomenon termed “springing” (a secondorder wave effect caused by superposition of the incident waves and the reflected waves or other …
Pharmaceutical Territories: Contested Pharmacopoeias And Environmental Debates In Brazil, Kerri Brown
Pharmaceutical Territories: Contested Pharmacopoeias And Environmental Debates In Brazil, Kerri Brown
Anthropology Theses and Dissertations
Over the past 30 years, emergent global health and trade policies have transformed "traditional medicine" into a contested biomedical endeavor. Brazil has been particularly affected by these policies due to its vast biodiversity and numerous labelled as traditional. As a result, the country has implemented strict intellectual property laws, has begun to invest in federal research on medicinal plants and other forms of traditional medicine, and in 2009 established its National Program of Medicinal Plants and Phytotherapeutics based on the World Health Organization's traditional medicine program, integrating medicinal plants into Brazil's national healthcare system. This multi-sited ethnographic project compares the …
Dignity In Decision-Making: Modernity And Social Navigation Among Rural French Polynesian Youth, Laura Jarvis
Dignity In Decision-Making: Modernity And Social Navigation Among Rural French Polynesian Youth, Laura Jarvis
Anthropology Theses and Dissertations
This research examines critical questions about the experiences of youth through the lenses of modernity, subjectivity, and the lifecourse. Growing up in a (post)colonial context of shifting definitions of adulthood, youth from the rural island of Rurutu, French Polynesia must navigate various decisions and transformations with little information to base their future aspirations on. This dissertation identifies dignity as the main motivating factor in youth decision-making, one that is constantly redefined as youth navigate shifting social fields. Dignity, as used here, is a target youth strive for in order to contest feelings of social precarity stemming from unaccommodating education systems …
Hydrodynamic Analysis Of Underwater Glider With Diamond Wing In Unsteady And Nonuniform Flow Field, Chen-Wei Chen, Zhuo Feng, Xu Liang
Hydrodynamic Analysis Of Underwater Glider With Diamond Wing In Unsteady And Nonuniform Flow Field, Chen-Wei Chen, Zhuo Feng, Xu Liang
Journal of Marine Science and Technology–Taiwan
In this study, the hydrodynamic performance of a proposed underwater glider (UG) that utilizes a diamond wing was analyzed and its gliding ability in undersea environments with both steady and uniform and unsteady and nonuniform oceanic currents optimized. The flow field around the UG was analyzed using the software package RANS CFD. Under conditions where the current varied linearly both with water depth and time, the UG exhibited harmonically heaving and pitching motions, with a constant acceleration incident flow. The dynamic lifting and drag forces acting on the diamond wing and the dynamic heaving force and pitching moment acting at …
Maroon Archaeology Beyond The Americas: A View From Kenya, Lydia Wilson Marshall
Maroon Archaeology Beyond The Americas: A View From Kenya, Lydia Wilson Marshall
Sociology & Anthropology Faculty publications
Archaeological research on Maroons—that is, runaway slaves—has been largely confined to the Americas. This essay advocates a more global approach. It specifically uses two runaway slave communities in 19th-century coastal Kenya to rethink prominent interpretive themes in the field, including “Africanisms,” Maroons’ connections to indigenous groups, and Maroon group cohesion and identity. This article’s analysis demonstrates that the comparisons enabled by a more globalized perspective benefit the field. Instead of eliding historical and cultural context, these comparisons support the development of more localized and historically specific understandings of individual runaway slave communities both in Kenya and throughout the New World.

Measuring Housing And Population Densities In Dublin City & County, Paul J. Lawlor Mr, Max Mcgovern, Hugo Fitzpatrick, Carl Wessels
Articles
A key strategic objective of Irelands national land use plan (known as the National Planning Framework) is to accommodate a significant increase in population in Irish cities in more concentrated settlement patterns and at higher residential densities. This is to be achieved by requiring 50% of new residential developments to be located in infill and brownfield locations in cities such as Dublin. This paper explores the implications of this policy by examining existing housing and population density in Dublin using CSO data and mapping tools to measure densities throughout the City and County. A ranking of areas with the highest …

Detection, Containment And Scaling Relations Of Near Source Explosionsin Granite Through Moment Tensor Representations, Mason Macphail
Earth Sciences Theses and Dissertations
The Source Phenomenology Experiment (SPE) was a series of nine, single-fired chemical explosions within the Morenci Copper mine in Arizona. Its purpose was to design, detonate, record and analyze seismic waveforms from these single-fired, partially and fully contained explosions. Ground motion data from the SPE are analyzed in this study to assess the uniqueness of the source representation of these explosions and its ability to resolve yield and depth when containment and geology or physical parameters of the source region may have a range of possible values. The P-wave velocities (Vp) at the test site are well constrained …

Palynology Of The Cenomanian Woodbine Group, Marlee Cloos
Earth Sciences Theses and Dissertations
This study explores the palynology of the Cenomanian Woodbine Group in order to answer questions about the paleoecology of North Texas during the Cenomanian and how palynofloras vary at different localities with different facies, as well as the radiation of angiosperms in the Late Cretaceous. This study also helps our understanding of the paleoecology after the Albian Trinity Group in Texas. Three localities in North Texas were sampled and a total of seventeen productive samples were analyzed for palynological data. Pollen was extracted from mudstones from two depositional environments: lower delta plain marshes and a meandering river system. The palynomorphs …

Measuring Teen Dating Violence Perpetration: A Comparison Of Cumulative And Single Assessment Procedures, Alison Krauss, Ernest N. Jouriles, David Rosenfield, Renee Mcdonald
Psychology Theses and Dissertations
Teen dating violence (TDV) is a widespread and harmful public health concern. The measurement of TDV has undergone some debate, with some researchers suggesting current measurement methods are suboptimal. The current study evaluates the use of cumulative assessments, a measurement method used previously in research on mental health and TDV victimization, to measure TDV perpetration. We hypothesized prevalence of frequency estimates of TDV perpetration would be higher when measured with cumulative assessments compared to a single report. Additionally, we hypothesized TDV perpetration measured cumulatively would more strongly relate to criterion variables than TDV perpetration measured with a single report. A …
Measuring Hpv Vaccine Worry: Development And Validation Of A Scale In Parents With Hpv Vaccine Eligible Children, Catherine Rochefort
Measuring Hpv Vaccine Worry: Development And Validation Of A Scale In Parents With Hpv Vaccine Eligible Children, Catherine Rochefort
Psychology Theses and Dissertations
Worry is a negatively-valenced emotion associated with risk-related cognitions. In the context of HPV vaccination, it is likely that parents worry about giving their child the vaccine because some vaccine outcomes may be perceived as uncertain. Therefore, worry may be an important factor predicting HPV vaccination outcomes. This study’s purpose was to (1) develop a measure of HPV vaccine worry, (2) examine whether parents worry more about the HPV vaccine than other adolescent vaccines, and (3) determine whether HPV vaccine worry is associated with HPV vaccination intentions. In Study 1, a HPV vaccine worry item pool based on the three-process …
Fast Forward-Backward Channel Estimation For Mimo Stbc-Ofdm Systems, Lena Chang
Fast Forward-Backward Channel Estimation For Mimo Stbc-Ofdm Systems, Lena Chang
Journal of Marine Science and Technology–Taiwan
In the study, we develop a fast forward-backward estimation (FFBE) method for multiple input multiple output (MIMO) space time block code (STBC) orthogonal frequency division multiplexing (OFDM) systems. We examined the matrix structure of the forward-backward (FB) correlation matrix and observed this matrix possessing permutation invariant (PI) property. We also investigated the eigen-property of a matrix with PI property and proved its eigenvectors possessing symmetric property, which can be calculated from two half dimensionality submatrices. Based on these analyses, we propose a fast eigen-decomposition algorithm to reduce the computations required in the eigendecomposition of FB correlation matrix. Then, the symmetric …
Mercury In Big Cypress Bayou And Caddo Lake Watersheds In Marion And Harrison Counties Texas, Joseph Watkins
Mercury In Big Cypress Bayou And Caddo Lake Watersheds In Marion And Harrison Counties Texas, Joseph Watkins
Electronic Theses and Dissertations
Caddo Lake has been included on the Texas Commission on Environmental Quality 303(d) list for impairment due to mercury (Hg) content since 1996. One of the primary tributaries, Big Cypress Bayou, flows across Eocene-aged rocks and sediments associated with the Wilcox Group; the Wilcox is of interest because it contains lignite coal, which has a direct link to mercury. Previous research has focused on dry deposition from fossil fuel combustion as the primary source of mercury but has not addressed the potential watershed contribution to mercury concentrations in Caddo Lake.
Big Cypress Bayou flows through Harrison and Marion counties in …
Establishment Of Turfgrass From Seed And Sod In Sand Based Systems Combining Sprinkler And Subsurface Drip Irrigation Systems, Roshaan Ahmed Khan Niazi
Establishment Of Turfgrass From Seed And Sod In Sand Based Systems Combining Sprinkler And Subsurface Drip Irrigation Systems, Roshaan Ahmed Khan Niazi
Electronic Theses and Dissertations
The establishment of turfgrass using subsurface drip irrigation (SDI) in sand based media has limited success. However, it is unknown if starting with overhead (sprinkler) irrigation and transitioning to SDI can enhance turfgrass establishment. Two experiments were conducted at Stephen F. Austin State University (SFASU) to investigate the establishment of “L-93” creeping bentgrass (Agrostis stolonifera) from seed and “TifEagle” ultra dwarf hybrid bermudagrass (Cynodon dactylon x Cynodon transvaalensis) from sod using sand based media. Each experiment consisted of two trials conducted in summer 2017 and spring 2018. Both creeping bentgrass trials and the spring ultra dwarf …
Art In The Stages Of Suffering And Death, Joanna Aramini
Art In The Stages Of Suffering And Death, Joanna Aramini
Visual Arts Department Student Scholarship
There has always been a strong link between art and the study of science and medicine, and one of the most iconic images of suffering and death in history to date is Christ suffering on the cross. In this thesis, I examine if and how art can make it possible to transcend human pain and overcome suffering, especially in our modern society where pain is seen as something we cannot deal with, and where we look to medicine and prescriptions to diminish it. I argue that art in the states of suffering and death, closely examining Michelangelo’s La Pieta and …

Fundraising Managers’ Perceptions Of Online Education’S Influence On Fundraising Practices And Giving, Peter J. Szucs
CUP Ed.D. Dissertations
The influence of online education on higher education fundraising practices and giving patterns is not well understood. This qualitative case study explored how fundraising managers perceived the impact of online education on higher education fundraising. To explore this phenomenon, the researcher interviewed fundraising managers at private, nonprofit colleges and universities in the western United States, and reviewed publicly available documents on the participant schools fundraising and financial information. The interviews demonstrated that study participants were concerned about connecting with graduates of online programs, and perceived that online students may have less affinity for their alma mater than on-ground alumni. The …
