Is A Delayed Result A Just Result? The Use Of Laches As An Equitable Defense To Remedial Back Pay Under The Eeoc's Sovereignty, Ruth Ann Mueller

The equitable defense of laches generally cannot be used against the sovereign. This broad proposition, adopted from English Courts of Equity, cements itself in United States federal case law. It is a longstanding principle that the federal government protects the public good and must be exempt from the defenses that could be brought up in a private suit. Administrative agencies bear a similar role, and exemption, when litigating as the United States on behalf of the public.
However, courts do not affirmatively restrict the use of laches against administrative agencies who may be acting on behalf of a private litigant. …

We measure the branching fraction and time-dependent CP-violating asymmetry for B0 → J=ψπ0 decays using a data sample of 711 fb−1 collected on the ϒ(4S) resonance by the Belle experiment running at the KEKB e+e− collider. The branching fraction is measured to be B(B0 → J/ψπ0) ¼ [1.62 ± 0.11(stat) ± 0.06(syst) × 10−5, which is the most precise measurement to date. The measured CP asymmetry parameters are S =−0.59 ±0.19(stat) 0.03(syst) and A = −0.15 ± 0.14(stat) +0.04 −0.03 (syst). The mixing-induced CP asymmetry (S) differs …

Background: The United Nation's Sustainable Development Goals encompass lifelong learning from birth to youth to adulthood (Goal 4) and economic opportunities for young people (Goal 8). The targets include improving access to quality early childhood care and education (ECCE) as well as learning and training opportunities for adolescents and youth. Cross-generational models for young children and youth may offer opportunities to address the interconnections between goals and targets for the next generation. We investigated whether an ECCE programme for young children (3.5-6.5 years) delivered by female youth (18-24 years) in rural Pakistan would be effective on children's school readiness.

This paper describes an independent study performed in the Spencer Lake lab in Musculoskeletal Soft Tissue Mechanics from August-December of the 2018-2019 academic year. The project was determining mechanical properties of mice ACL with different genetic makeups. Knowing mechanical properties is a major step to repairing torn ligaments in humans bringing them back to full strength and functionality using tissue engineering. Continuing research from over the Summer, a finalized dissection method and protocol for isolating a mouse ACL and performing mechanical testing was created. This semester I constructed an activity monitoring arena and determined the appropriate data acquisition settings. Videos are recorded and processed at 30 frames per seconds and a “minimum distance travelled filter” is used to eliminate any motion that does not require the animal to take a step. The filter does capture any movements that do require a step, so we will be able to determine an average degree of activity during the animal’s session of free cage activity.

This fact sheet presents data on drug possession arrests by type of drug and sex of arrestee as reported by Alaska law enforcement agencies for the 32-year period 1986 to 2017. Types of drugs include narcotics, synthetic narcotics, marijuana, and other non-narcotic drugs. Overall, males comprise roughly four out of five drug possession arrests in the state of Alaska. The female and male rates parallel one another in that they rise and fall at the same points in most years. Rationale The species‐specific relationship between phosphate (δ18OP values) and structural carbonate (δ18OC values) oxygen isotope ratios has been established for several modern and fossil animal species but until now it has not been investigated in European fallow deer (Dama dama dama). This study describes the relationship between phosphate and structural carbonate bioapatite in tooth enamel of extant fallow deer, which will help us further understand the species' unique environmental and cultural history. Methods The oxygen isotope composition of phosphate (δ18OP value) and structural carbonate (δ18OC value) of hydroxylapatite was determined in 51 modern fallow deer tooth enamel samples from across …

Agent-based models are a tool that can be used to better understand the dynamics of an infectious disease outbreak. An infectious disease outbreak is influenced by many factors including vaccination or immunity levels, population density, and the age structure of the population. We hypothesize that these factors along with interactions of factors and the actions of individuals would lead to outbreaks of different size and severity even in two towns that appear similar on paper. Polycystic ovary syndrome (PCOS) is a disorder characterized by hyperandrogenism, ovulatory dysfunction and polycystic ovarian morphology. Affected women frequently have metabolic disturbances including insulin resistance and dysregulation of glucose homeostasis. PCOS is diagnosed with two different sets of diagnostic criteria, resulting in a phenotypic spectrum of PCOS cases. The genetic similarities between cases diagnosed based on the two criteria have been largely unknown. Previous studies in Chinese and European subjects have identified 16 loci associated with risk of PCOS. We report a fixed-effect, inverse-weighted-variance meta-analysis from 10,074 PCOS cases and 103,164 controls of European ancestry and characterisation of PCOS related …

The purpose of this study was to develop and validate an instrument that can measure how senior chemical engineering students make process safety decisions. The Engineering Process Safety Research Instrument (EPSRI) contains dilemmas that represent process safety scenarios, followed by three decision options, and 12-15 considerations that fall into pre-conventional, conventional, or post-conventional forms of reasoning. Three studies were completed as a part of this research. The content validation study ensured the dilemmas represented process safety scenarios, the considerations matched their perceived theoretical definitions, and that no content areas were omitted. Black women are three to four times more likely to die from pregnancy- or childbirth-related causes in the United States. There are a few factors that play into this statistic, including genetic health conditions and socioeconomic issues. However, racism and unfair treatment towards black women is at the heart of the problem. This issue of racism in the health care system is atrocious for a few reasons — first, because racism is never acceptable in any form and should be eliminated in any and all situations. Sometimes, despite all our efforts, projects fail. We’re here to tell you that’s okay. In 2017, the University of Nebraska at Omaha's Criss Library created a Textbook Reserves Pilot Project. At the time we weren’t sure it would work out. We were optimistic, though. After all, we had plenty of evidence that said it would work: our literature review had examples of successful textbook programs. Our data showed textbook prices rising. We met with advisors across our campus who said students desperately needed textbooks to succeed. Background and Objectives: Proxy decision-making may be flawed by inaccurate perceptions of risk. This may be particularly true when older adults are the targets of the decisions, given the pervasive negative stereotypes about older adults. Methods: In study 1, individuals aged 18- to 87 years (as target persons) as well as one of their close social partners (as informants) reported on the risks they perceived for the target person in various life domains. Over the last sixty years, courts and the USPTO have engaged in an ill-advised expansion of trademark subject matter. Where once only words or emblems attached to a product could serve as a trademark, today a product’s design or packaging itself may receive such protection. This expansion was and is a mistake. There may indeed be rare cases where a product’s design or packaging conveys brand-specific information and could receive protection without impairing competitor’s ability to offer substitutes. This chapter criticizes the protection of non-traditional trademarks (NTTMs) by focusing on three specific examples from the fashion industry: Louboutin, Gucci, and Bottega Veneta. In particular, besides repeating that granting exclusive rights to NTTMs equates in foreclosing competitors and third parties from using any identical and similar product design and products feature, this chapter highlights an additional problem related to the protection of NTTMs. Notably, that, by recognizing and protecting as marks elements that are product design and aesthetic product features, protecting these marks supports a system of intellectual property protection that promotes standardization, rather than creativity and innovation, in …
