Intergovernmental Federalism Disputes, Lochlan F. Shelfer
Intergovernmental Federalism Disputes, Lochlan F. Shelfer
Georgia Law Review
Constitutional litigation is increasingly being waged
between governments, in both suits between a state and
the United States, and suits between two or more states.
The jurisdictionof the Federalcourts to hear such suits,
however, is disputed. The Supreme Court's cases are
famously difficult to reconcile, with some denying
jurisdiction and other seemingly identical cases
addressing the merits without discussing jurisdiction.
Some scholars have argued that intergovernmental
disputes over political jurisdiction historically are not
justiciableand that it is constitutionally illegitimate for
the Court to hear them. Recently, some scholars have
argued that the Court should hear such cases, but have
assumed …
A Single Symbolic Dollar: How Nominal Damages Can Keep Lawsuits Alive, Megan E. Cambre
A Single Symbolic Dollar: How Nominal Damages Can Keep Lawsuits Alive, Megan E. Cambre
Georgia Law Review
The Eleventh Circuit's August 2017 opinion in
Flanigan's Enterprises v. City of Sandy Springs
deepened a circuit split regarding the role of
nominal damages in the justiciabilityanalysis. The
critical question is whether, in cases involving
constitutional violations, a claim for nominal
damages alone suffices to confer standing or to
defeat mootness when other forms of relief are
unavailable or moot. The Second, Fifth, and Ninth
Circuits have all held that nominal damages alone
are enough, but not without contention from
dissenting judges. The First, Third, Fourth,
Seventh, Eighth, and D.C. Circuitshave considered
the question-but have not conclusively decided its
answer. …

Keynote Speech: Walking The Line: Modern Gerrymandering And Partisanship, Nicholas O. Stephanopoulos
Georgia Law Review
INTRODUCTION I am going to be discussing an ongoing project of mine that I call hyperpartisan election law. I make three main arguments in this project. The first is that almost all of election law was created during an unusually nonpartisan period in the 1960s, 1970s, and 1980s. Consistent with this period's very low level of partisanship, election law originally did not intend to, and did not actually have the effect, of addressing partisan cleavages. The second claim is that as the country's voters and politicians have become ever more partisan over the last generation, election law has adapted in …
Non-Alj Adjudicators In Federal Agencies: Status, Selection, Oversight, And Removal, Kent H. Barnett, Russell Wheeler
Non-Alj Adjudicators In Federal Agencies: Status, Selection, Oversight, And Removal, Kent H. Barnett, Russell Wheeler
Georgia Law Review
This article republishes—in substantively similar form—our 2018 report to the Administrative Conference of the United States (ACUS) concerning federal agencies’ adjudicators who are not administrative law judges (ALJs). (We refer to these adjudicators as “non-ALJ Adjudicators” or “non-ALJs.”) As our data indicate, non-ALJs significantly outnumber ALJs. Yet non-ALJs are often overlooked and difficult to discuss as a class because of their disparate titles and characteristics. To obtain more information on non-ALJs, we surveyed agencies on non-ALJs’ hearings and, among other things, the characteristics concerning non-ALJs’ salaries, selection, oversight, and removal. We first present our reported data on these matters, which …
The Sec Rides Into Town: Defining An Ico Securities Safe Harbor In The Cryptocurrency “Wild West”, C. Daniel Lockaby
The Sec Rides Into Town: Defining An Ico Securities Safe Harbor In The Cryptocurrency “Wild West”, C. Daniel Lockaby
Georgia Law Review
This Note recommends a viable way for the Securities and Exchange Commission (SEC) to apply the Regulation S foreign-issuer safe harbor to Initial Coin Offerings (ICOs). In the last two years, cryptocurrencies and blockchain-based companies have witnessed dramatic rises in price and value. New entrants to the crypto-markets often use ICOs as virtual public offerings to earn capital and develop their projects.
The SEC has signaled that they plan to fold ICOs and blockchain offerings into existing securities law. How these new virtual capital-raising mechanisms will fit into this framework is still largely unknown. As a defensive measure, many ICOs …

Saving Face On Facebook: Privacy Concerns, Social Benefits, And Impression Management, Jeffrey G. Proudfoot, David W. Wilson, Joseph S. Valacich, Michael D. Byrd
Faculty Publications
The nearly ubiquitous use of online social networks generally entails substantial personal disclosure and elicits significant privacy concerns. This research uses Social Exchange Theory and the impression management (IM) literature to examine how privacy concerns can be counterbalanced by the perceived social benefits afforded by a social network’s ability to support IM. We frame social network use as an attempt to engage in IM, and we highlight the importance of a social network’s IM affordances in predicting social benefits from, and disclosure through, a social network. We test our model with a sample of 244 Facebook users, finding support for …

Communicate With Your Audience: Intro To Rmarkdown, Joseph A. Stanley

So far, most of what you’ve done in R has been with R scripts, which is perfectly fine. But sometimes if you’re working on a particular project you might end up with one very long script. You might add some structure to the script using headers, and you can add comments to explain what code does, but after a while it can get unwieldy because there’s no narrative in your script. You forget why do did what you did and what things you learned from it. For many of my projects, I have an accompanying file where keep all my …

Turkish Family Life: A Study Of Family Leisure, Family Functioning, And Family Satisfaction, Ramon Zabriskie, Nese Aslan, Mikale Williamson
Faculty Publications
The purpose of this study was to examine the contribution of family leisure involvement and family leisure satisfaction to the explanation of variance in family functioning and satisfaction with family life among Turkish families using the core and balance framework. The sample (n D 509) consisted of families (parents and youth ages 11–16 years) from Izmir, Turkey. Findings indicate significant positive relationships between family leisure variables and all family functioning and satisfaction variables from both the parent and youth perspectives. These findings are similar to those from family samples in other Western/industrialized countries, emphasizing the significant role of family leisure …

The Power Of Myths And Storytelling In Nation Building: The Campaign For The Independence Of Catalonia From Spain (2012-2015), César García
All Faculty Scholarship for the College of Arts and Humanities
Background There is no nation without its origin story. The recent success of the Catalan campaign for independence (2012–2015) can be explained by a strong capacity to build and convey a story capable of informing, persuading, and eliciting emotional responses from Catalans and other Spaniards.
Analysis The recent Catalan nationalism narrative has been forged by updating the foundational myths of Catalan nationalism through four main plots—quest, escape, revenge, and transformation—that with a pragmatic character have been able to integrate current affairs into the old myths.
Conclusion and implications This article explores the elements of the new Catalan nationalism narrative by …

Technoference: Parent Distraction With Technology And Associations With Child Behavior Problems., Brandon T. Mcdaniel Phd, Jenny S Radesky
Health Services and Informatics Research
Heavy parent digital technology use has been associated with suboptimal parent-child interactions, but no studies examine associations with child behavior. This study investigates whether parental problematic technology use is associated with technology-based interruptions in parent-child interactions, termed "technoference," and whether technoference is associated with child behavior problems. Parent reports from 170 U.S. families (child age = 3.04 years) and actor-partner interdependence modeling showed that maternal and paternal problematic digital technology use predicted greater technoference in mother-child and father-child interactions; then, maternal technoference predicted both mothers' and fathers' reports of child externalizing and internalizing behaviors. Results suggest that technological interruptions are …
Evaluation Of Different Management Options Of Fall Armyworm, (J.E. Smith) (Lepidoptera: Noctuidae) And Assessment Of Its Parasitoids In Some Parts Of Ethiopia, Birhanu Sisay
All Master’s Theses
The fall armyworm (FAW) is a major pest of maize in America and its outbreaks in 2017 in Africa threatened maize, a staple food crop in the region. The effect of parasitoids, nine synthetic insecticides, eleven botanicals, five entomopathogens and pheromone lures have been studied against FAW in 2017 and 2018. Survey conducted in Jimma, Awash Melkasa, Hawasa, East and West Gojam identified three different species of parasitoids from FAW larvae belonging to Hymenoptera and Diptera. Cotesia icipe (Braconidae) was the dominant larval parasitoid in Hawassa, Jimma and Awash Melkassa with parasitism ranging from 33.8 to 45.3%. Tachinid fly, Palexorista …
The Impact Of Push-Pull Technology On Incidence And Severity Of Maize Ear Rots And Mycotoxins In Western Kenya, Owuor Maxwell Juti
The Impact Of Push-Pull Technology On Incidence And Severity Of Maize Ear Rots And Mycotoxins In Western Kenya, Owuor Maxwell Juti
All Master’s Theses
Soil is the primary reservoir for fungi of which Aspergillus and Fusarium species are the main causal agents of maize ear rot and mycotoxin production. Season and cropping systems are known to influence soil fungal community structure. It is imperative to establish the distribution and density of soil fungal communities as a requisite for formulating strategies for management of ear rot infections and mycotoxin contamination. The current study was carried out to investigate the distribution of Aspergillus and Fusarium fungi causing ear rots and producing mycotoxins from soil collected from maize fields under push-pull and maize monocrop systems in three …

Work Only We Can Do: Professional Responsibility In An Age Of Automation, Sherman J. Clark
Articles
Automation can help us do our work as lawyers; but in the process, it should also force us to be more thoughtful about what our work really is or ought to be.' The challenge for the profession, as I see it, is not simply to survive the advent of new technology, nor even merely to make effective use of new tools. While addressing those immediate concerns, we should also welcome the concomitant opportunity to develop and refine our understanding of what it means to be a good and ethical lawyer. As technological developments free us from and prevent us from …

Faculty Perceptions Of What Makes A Student Successful In The Mathematical Sciences, Casey E. George, Lisa Skultety, Randi Congleton
Journal of Excellence in College Teaching and Learning
Faculty members play a key role in facilitating student outcome, including their learning, persistence, and degree completion. Through analyses of online survey data, this study investigates the views of faculty mentors involved in a nationwide mentoring program that aims to support underrepresented students' transition from undergraduate to graduate studies in the mathematical sciences. Specifically, faculty member's perceptions of what factors contribute to students' success or lack of success in mathematics, statistics, and biostatistics are examined. Reasons for success cited by faculty are highly individualized, such as innate ability, motivation, and dedication, yet some contextual and structural factors, including research opportunities …
Representations Of Health And Wellness In Children's Literature, Emily Kate Murphy
Representations Of Health And Wellness In Children's Literature, Emily Kate Murphy
Honors Program Theses
The term health is multifaceted. Health can refer to one’s physical, spiritual, or mental state, among other things. The goal of this study was to determine how educators can use children’s literature to support students being introduced to healthy habits regarding these aspects at a young age, through children’s literature. A content analysis was conducted over a selection of 16 children’s literature texts. It was organized by thematic categories matching the aforementioned facets of health and assessed through a Likert scale. This analysis resulted in the development of a website intended to serve as a tool for teachers to implement …
