Library Philosophy and Practice (e-journal)

In this era of Cyberage, the information needs of the users have grown so enormously that no individual library can fulfill their information needs on its own. This has urged the need for cooperation between libraries and information centers for sharing of available resources and information through networking. Thus consortia are considered as a vital move towards library cooperation. A library consortium combines the purchasing power of its members and reduces the repetitive, laborious process of acquiring resources from each member. In a short span of time, numerous consortia have been formed all over the globe. As more and more …

Presenting A Critical Perspective On “Economic Efficiency” In Law And Economics Courses, Gregory S. Crespi Jan 2018

Presenting A Critical Perspective On “Economic Efficiency” In Law And Economics Courses, Gregory S. Crespi

SMU Law Review

“Law and Economics” courses are sometimes criticized for inadequately explaining the normative criterion of “economic efficiency” and then applying this criterion throughout the course in a superficial and biased manner that pejoratively labels most governmental market interventions and wealth redistribution measures as inefficient. These criticisms have merit, and in this article I point out a number of conceptual problems, empirical difficulties, and normative shortcomings of the economic efficiency criterion that students need to understand in order to be able to effectively counter policy arguments that rest upon dubious efficiency assessments.

The eight specific shortcomings of the economic efficiency criterion that …

From Texas Gulf Sulphur To Laudato Si’: Mining Equitable Principles From Insider Trading Law, Michael J. Kaufman

SMU Law Review

In SEC v. Texas Gulf Sulphur, the Second Circuit declared that all investors trading on impersonal exchanges should have equal access to material information, and therefore anyone who possesses material inside information must either turn it over to the investing public or not trade. The broad reach of that insider trading prohibition sent shock waves throughout the financial markets and encountered significant judicial resistance from the Supreme Court.

Although the Supreme Court initially rejected the insider trading prohibition announced in Texas Gulf Sulphur, the fundamental equitable trading principles underlying that decision have endured. This article shows that TGS was …

Disgorgement In Insider Trading Cases: Fy2005-Fy2015, Verity Winship

SMU Law Review

For about 50 years—at least since Texas Gulf Sulphur—the SEC has ordered defendants to disgorge their profits from transactions that violated the securities laws. Despite disgorgement’s long history, in its 2017 opinion in Kokesh v. SEC, the U.S. Supreme Court put two aspects of the remedy on the table. It applied a five-year statute of limitations to disgorgement. It also reopened old questions about agencies’ power to seek remedies not specified in statute. This article provides data to inform these debates over the agency’s use of disgorgement and the effects of Kokesh. It reports the results of an empirical study …

The Icarus Syndrome: How Credit Rating Agencies Lost Their Quasi Immunity, Norbert Gaillard, Michael Waibel Jan 2018

The Icarus Syndrome: How Credit Rating Agencies Lost Their Quasi Immunity, Norbert Gaillard, Michael Waibel

SMU Law Review

Subsequent to the 2007–2008 subprime crisis, the SEC and the US Senate discovered that it was common practice for major credit rating agencies (CRAs) to produce inflated and inaccurate structured finance ratings. A host of explanations were posited on how this was able to happen from the “issuer pays” model of CRAs and conflicts of interest to underscoring the CRA’s regulatory license and their ensuing insulation from legal liability. Historically, credit ratings were akin to opinions. However, when courts started to consider structured finance ratings as commercial speech in the 2000s, CRAs became more vulnerable to litigation. This article studies …

Evaluating Wildlife Vulnerability To Mercury Pollution From Artisanal And Small-Scale Gold Mining In Madre De Dios, Peru, K. E. Markham, Florencia Sangermano Jan 2018

Evaluating Wildlife Vulnerability To Mercury Pollution From Artisanal And Small-Scale Gold Mining In Madre De Dios, Peru, K. E. Markham, Florencia Sangermano

Geography

Illegal, artisanal and small-scale gold mining (ASGM) often occurs in remote highly biodiverse areas, such as the Madre de Dios region of Peru. Mercury used in gold mining bioaccumulates in the environment and poses developmental, hormonal, and neurological threats to wildlife. The impact of ASGM on biodiversity remains largely unknown. We used geographic information science to create a spatial model of pollution risk from mining sites, in order to predict locations and species assemblages at risk. Multicriteria evaluation was used to determine how flow accumulation, distance from mining areas, total suspended sediment load, and soil porosity influenced the vulnerability of …

Glacier Recession And The Response Of Summer Streamflow In The Pacific Northwest United States, 1960–2099, Chris Frans, Erkan Istanbulluoglu, Dennis P. Lettenmaier, Andrew G. Fountain, Jon L. Riedel

Geology Faculty Publications and Presentations

The Pacific Northwest is the most highly glacierized region in the conterminous United States (858 glaciers; 466 km2). These glaciers have displayed ubiquitous patterns of retreat since the 1980s mostly in response to warming air temperatures. Glacier melt provides water for downstream uses including agricultural water supply, hydroelectric power generation, and for ecological systems adapted to cold reliable streamflow. While changes in glacier area have been studied within the region over an extended period of time, the hydrologic consequences of these changes are not well defined. We applied a high‐resolution glacio‐hydrological model to predict glacier mass balance, glacier area, and …

A Simplified, Object-Based Framework For Efficient Landslide Inventorying Using Lidar Digital Elevation Model Derivatives, Michael D. Bunn, Ben A. Leshcinsky, Michael J. Olsen, Adam M. Booth

Geology Faculty Publications and Presentations

Landslide inventory maps are critical to understand the factors governing landslide occurrence and estimate hazards or sediment delivery to channels. Numerous semi-automated approaches for landslide inventory mapping have been proposed to improve the efficiency and objectivity of the process, but these methods have not been widely adopted by practitioners because of the use of input parameters without physical meaning, a lack of transparency in machine-learning based mapping techniques, and limitations in resulting products, which are not ordinarily designed or tested on a large-scale or in diverse geologic units. To this end, this work presents a new semi-automated method, called the …

Assessing The Interaction Between Mountain Forests And Snow Avalanches At Nevados De Chillán, Chile And Its Implications For Ecosystem-Based Disaster Risk Reduction, Alejandro Casteller, Thomas Häfelfinger, Erika Cortés Donoso, Karen Podvin, Dominik Kulakowski, Peter Bebi Jan 2018

Assessing The Interaction Between Mountain Forests And Snow Avalanches At Nevados De Chillán, Chile And Its Implications For Ecosystem-Based Disaster Risk Reduction, Alejandro Casteller, Thomas Häfelfinger, Erika Cortés Donoso, Karen Podvin, Dominik Kulakowski, Peter Bebi

Geography

Gravitational natural hazards such as snow avalanches, rockfalls, shallow landslides and volcanic activity represent a risk to mountain communities around the world. In particular, where documentary records about these processes are rare, decisions on risk management and land-use planning have to be based on a variety of other sources including vegetation, tree-ring data and natural hazard process models. We used a combination of these methods in order to evaluate dynamics of natural hazards with a focus on snow avalanches at Valle Las Trancas, in the Biobío region in Chile. Along this valley, natural hazards threaten not only the local human …

Geography

Increasing evidence indicates that forest disturbances are changing in response to global change, yet local variability in disturbance remains high. We quantified this considerable variability and analyzed whether recent disturbance episodes around the globe were consistently driven by climate, and if human influence modulates patterns of forest disturbance. We combined remote sensing data on recent (2001–2014) disturbances with in-depth local information for 50 protected landscapes and their surroundings across the temperate biome. Disturbance patterns are highly variable, and shaped by variation in disturbance agents and traits of prevailing tree species. However, high disturbance activity is consistently linked to warmer and …
