Contradictions In Missouri: Do Apologies Really Matter In Criminal Sentencing?, Grant J. Shostak, Ryan V. Guffey
Contradictions In Missouri: Do Apologies Really Matter In Criminal Sentencing?, Grant J. Shostak, Ryan V. Guffey
Missouri Policy Journal
Conventional wisdom provides that a criminal defendant who apologizes for wrongful actions committed may be shown mercy by the sentencing court. While some studies support the conventional wisdom, an apology sometimes has the opposite effect and results in a more severe sentence for the defendant. This study attempted to examine the effect a defendant’s apology had on a sentence handed down by a judge or commissioner sitting in the Circuit Courts of St. Charles County, St. Louis City, and St. Louis County, Missouri.

Collateral Consequences And Criminal Justice: Future Policy And Constitutional Directions
Collateral Consequences And Criminal Justice: Future Policy And Constitutional Directions
Marquette Law Review
National policy with respect to collateral consequences is receiving more attention than it has in decades. This article outlines and explains some of the reasons for the new focus. The legal system is beginning to recognize that for many people convicted of crime, the greatest effect is not imprisonment, but being marked as a criminal and subjected to legal disabilities. Consequences can include loss of civil rights, loss of public benefits, and ineligibility for employment, licenses, and permits. The United States, the 50 states, and their agencies and subdivisions impose collateral consequences—often applicable for life—based on convictions from any jurisdiction. …

All Eyez On Me': America's War On Drugs And The Prison-Industrial Complex, André Douglas Pond Cummings
All Eyez On Me': America's War On Drugs And The Prison-Industrial Complex, André Douglas Pond Cummings
Law Faculty Scholarship
In 1971, President Richard Nixon named drug abuse as “public enemy number one” in the United States. Since that time, an explicit “War on Drugs” has dominated the political imagination of the United States. Since declaring a War on Drugs, domestic incarceration rates have exploded, particularly in the African-American and Latino populations. Politicians such as Nixon, Barry Goldwater, and Nelson Rockefeller each advocated for harsh drug laws and severe criminal sanctions because they argued a strong correlation existed between drug addiction and crime. These claims have dominated legislative enactments since the 1970s, virtually ignoring those who argue that drug addiction …

Racial Differences In The Effect Of Marriageable Males On Female Family Headship, Terry Ann Craigie, Samuel L. Myers, William A. Darity
Racial Differences In The Effect Of Marriageable Males On Female Family Headship, Terry Ann Craigie, Samuel L. Myers, William A. Darity
Economics: Faculty Publications
Female family headship has strong implications for endemic poverty in the United States. Consequently, it is imperative to explore the chief factors that contribute to this problem. Departing from prior literature that places significant weight on welfare-incentive effects, our study highlights the role of male marriageability in explaining the prevalence of never-married female family headship for blacks and whites. Specifically, we examine racial differences in the effect of male marriageability on never-married female headship from 1980 to 2010. By exploiting data from IPUMS-USA (N = 4,958,722) and exogenous variation from state-level sentencing reforms, the study finds that the decline in …
Cross-Race Effect Of African-Americans And Caucasians, Bianca Vidal
Cross-Race Effect Of African-Americans And Caucasians, Bianca Vidal
Dissertations, Theses, and Capstone Projects
Studies have shown that eyewitnesses are less accurate when the accused and foils (i.e., non-suspects in a lineup) are of a different race from the eyewitness than when of the same race. This has been termed the Cross-Race Effect (CRE). To study the CRE in eyewitness identifications, this experiment used a 4x2x2 between-subjects design with 492 participants. Participants watched a film act in which an African-American (AA) or Caucasian (C) either stole or recovered a cell phone. Afterwards they had to identify the person as well as answer a series of questions. There were 4 perpetrators for each race (4 …

The Social Construction Of Protest: Print Media Coverage Of The 2004 Republican National Convention And The 2011 Occupy Wall Street Protests In New York City, Kirsten Christiansen
Dissertations, Theses, and Capstone Projects
Majoritarian democracies are founded on the idea that the governance of society will reflect the needs and desires of the majority of the people and that all citizens are given a voice. Public protest activity is one of the ways in which social movement organizations as claims-makers can reach an audience to attempt to convince a majority to effect social change. The mainstream news media can disseminate information about protest messages and activity beyond the local. However, the mainstream news media filters information in its own way, influenced in part because of traditional news routines but also potentially by the …

Reviewing Leniency: Appealability Of 18 Usc § 3582(C)(2) Sentence Modification Motions, Sarah E. Welch
University of Chicago Law Review
In ordinary circumstances, criminal defendants get only one shot at sentencing. But in a few cases, defendants have a second chance at a more lenient sentence. This Comment considers one of those circumstances: motions under 18 USC § 3582(c)(2) for sentence reduction after retroactive downward adjustment of the Sentencing Guidelines. Specifically, this Comment considers the circuit split over when those motions are appealable. Courts disagree about which statute governs appellate jurisdiction: the general jurisdictional statute permitting appeal of any final decision of a district court (28 USC § 1291) or the specific sentencing jurisdictional statute restricting appeal of otherwise final …
State Bureaucratic Undermining, Justin Weinstein-Tull
State Bureaucratic Undermining, Justin Weinstein-Tull
University of Chicago Law Review
Our federal rights are failing, and the inner workings of state government provide an explanation. States administer more federal rights than ever before; administering those rights requires intrastate coordination both horizontally (across cabinet-level state actors, agencies, and commissions) and vertically (with local governments like counties and towns). That coordination undermines federal law by creating bureaucratic barriers to full compliance. I unearth and identify three of these barriers—agency alienation, agency conflict, and role confusion—by surveying remedies in recent suits against state actors. These remedies take the form of choreography: they specify how internal state actors must work together to vindicate federal …
