The Right To Public Education And The School To Prison Pipeline, Areto A. Imoukuede Jan 2018

The Right To Public Education And The School To Prison Pipeline, Areto A. Imoukuede

Journal Publications

The school-to-prison. pipeline is a controversial concept and a disappointing reality. It refers to the draconian disciplinary "trend of schools directly referring students to law enforcement or creating conditions under which students are more likely to become involved in the justice system-such as suspending or expelling them." Public schools are intended to primarily be institutions for public education. It is clear that serving as a pipeline to prison is not the central purpose of the public school. The purpose of public education is to provide students an opportunity to develop their capabilities and grow as individuals. Public education is intended …

Racial Equity In Algorithmic Criminal Justice, Aziz Z. Huq Jan 2018

Racial Equity In Algorithmic Criminal Justice, Aziz Z. Huq

Public Law and Legal Theory Working Papers

Algorithmic tools for predicting violence and criminality are being used more and more in policing, bail, and sentencing. Scholarly attention to date has focused on their procedural due process implications. My aim here is to consider these instruments’ interaction with the enduring racial legacies of the criminal justice system There are two competing lenses for evaluating the racial effects of algorithmic criminal justice: constitutional doctrine and emerging technical standards of “algorithmic fairness.” I argue first that constitutional doctrine is poorly suited to the task. It will often fail to capture the full range of racial issues that potentially arise in …

Testimonial Injustice In International Criminal Law, Shannon Fyfe Jan 2018

Testimonial Injustice In International Criminal Law, Shannon Fyfe

Scholarly Articles

In this article, I consider the possibilities and limitations for testimonial justice in an international criminal courtroom. I begin by exploring the relationship between epistemology and criminal law, and consider how testimony contributes to the goals of truth and justice. I then assess the susceptibility of international criminal courts to the two harms of testimonial injustice: epistemic harm to the speaker, and harm to the truth-seeking process. I conclude that international criminal courtrooms are particularly susceptible to perpetrating testimonial injustice. Hearers in the international criminal courtroom should practice testimonial justice, but the institution is not structured in a way that …

Collective Bargaining Rights And Police Misconduct: Evidence From Florida, Dhammika Dharmapala, Richard H. Mcadams, John Rappaport Jan 2018

Collective Bargaining Rights And Police Misconduct: Evidence From Florida, Dhammika Dharmapala, Richard H. Mcadams, John Rappaport

Public Law and Legal Theory Working Papers

Growing controversy surrounds the impact of labor unions on law enforcement behavior. Critics argue that unions impede organizational reform and insulate officers from discipline for misconduct. Yet collective bargaining tends to increase wages, which could improve officer behavior. We provide quasi-experimental empirical evidence on the effects of collective bargaining rights on violent incidents of misconduct. Our empirical strategy exploits a 2003 Florida Supreme Court decision (Williams), which conferred collective bargaining rights on sheriffs’ deputies, resulting in a substantial increase in unionization among these officers. Using a Florida state administrative database of “moral character” violations reported by local agencies between 1996 …

The "Scourge" Of Armed Check Fraud: A Constitutional Framework For Prohibited Possessor Laws, Jeffrey Giancana Jan 2018

The "Scourge" Of Armed Check Fraud: A Constitutional Framework For Prohibited Possessor Laws, Jeffrey Giancana

University of Michigan Journal of Law Reform

Prohibited possessor statutes have been a part of American law for decades. Put simply, these laws prohibit any person who has been convicted of a felony from possessing a firearm, a prohibition that lasts for the felon’s entire life. The Supreme Court’s modern Second Amendment jurisprudence has held that the right to possess a firearm is a fundamental individual right. In light of this new paradigm, the constitutionality of such broad prohibitions must be called into question—despite the eagerness of courts across the country to dismiss such challenges by pointing to a single line in Heller. This Note challenges the …

Thinking Outside The Building: Developing A Library Ambassador Program Across Campus(Es), Lydia C. Gwyn

ETSU Faculty Works

In an effort to address declining university retention rates and to reach students who may not make it to the library for research help, the Sherrod Library at East Tennessee State University (ETSU) is in the process developing a peer-mentoring program. This program is one way the library can help the institution in its efforts raise student retention rates and improve student success. Peer learning programs have proven successful in tutoring centers and elsewhere in the university for decades, and research has shown that trained undergraduates are ideal candidates for delivering general reference and information literacy instruction to their peers …

Intersectional Resistance: A Case Study On Crimmigration And Lessons For Organizing In The Trump Era, Robin Pomerenke Jan 2018

Intersectional Resistance: A Case Study On Crimmigration And Lessons For Organizing In The Trump Era, Robin Pomerenke

UC Law SF Journal on Gender and Justice

Increasingly, the federal government has sought to utilize local law enforcement’s proximity to and intimacy with local communities to detain and deport immigrants. The resultant growth of crimmigration—the simultaneous enforcement of immigration law and criminal law—has sparked a large-scale social movement in California over the last ten years. This movement has built connections and solidarities among actors across communities and issue areas, including the faith community, the legal community, [etc.]. Using the response to crimmigration as a case study, this Note examines the potentials for intersectional resistance. What role has an awareness of intersectionality played in the fight against crimmigration? …

Collateral Consequences For Justice-Involved Youth: A Model Approach To Reducing The Number Of Collateral Consequences, Jennica Janssen Jan 2018

Collateral Consequences For Justice-Involved Youth: A Model Approach To Reducing The Number Of Collateral Consequences, Jennica Janssen

Marquette Benefits and Social Welfare Law Review

Collateral consequences—stigma and disadvantages individuals face after becoming entangled in the legal system—for justiceinvolved youth differ by jurisdiction and number in the thousands. Although the American Bar Association (ABA) and the Office of Juvenile Justice and Delinquency Prevention (OJJDP) advocated for the reduction of juvenile collateral consequences over five years ago, after an initial surge in activism, the movement lost momentum. The Federal Advisory Committee on Juvenile Justice and several non-profit, public interest law firms, continue to advocate for the clarification of juvenile collateral consequences and the elimination of specific sanctions. This Note recognizes the importance of gathering juvenile collateral …

Racial Attitudes In The Workplace Among Age Groups Of African American Women, Ladonna S. Cooper Jan 2018

Racial Attitudes In The Workplace Among Age Groups Of African American Women, Ladonna S. Cooper

Walden Dissertations and Doctoral Studies

Limited research exists on the impact of racial attitudes upon varying age groups of African American women in the workplace. The factors of conformity, dissonance, resistance, and internalization among African American women of accumulated negative experiences may affect their performance in the workplace. The purpose of this comparative descriptive quantitative study was to use the PRIAS and OCB scales to examine the impact of generational status and racial attitudes on organizational citizenship behavior in a sample of African American women. The study was guided by the theoretical framework of Ajzen's theory of planned behavior. Participants in the study consisted of …

The Charter School Network: The Disproportionate Discipline Of Black Students, Mikailla Carwin Jan 2018

The Charter School Network: The Disproportionate Discipline Of Black Students, Mikailla Carwin

City University of New York Law Review

While the charter school movement has gained traction and grown extensively throughout the United States, its disciplinary practices are controversial. The “zero-tolerance” policies used in charter schools, which include exclusionary disciplinary methods such as suspension, causes damage to the student’s self-esteem, reputation amongst their peers, academic performance, and attitude toward attending school. Studies and statistics show that charter schools disproportionately punish Black students more than any other race. This article explores: a brief history of the charter school movement and charter school law, general disciplinary practices within charter schools, and how the law allows black students in the charter school …

Geografía Abolicionista Y El Problema De La Inocencia, Ruth Wilson Gilmore Jan 2018

Geografía Abolicionista Y El Problema De La Inocencia, Ruth Wilson Gilmore

Publications and Research

Rethinking Cannabis Legislation: Insights From Advocacy Groups, Christopher Hunter Tramel

Honors Theses

Prohibition and regulation of substances in the United States transformed throughout the 20th century namely through the Pure Food and Drug Act, the prohibition of alcohol, the Marihuana Tax Stamp Act, and the Controlled Substances Act, with each further expanding the number of substances regulated and the consequences of breaking the regulations. The first chapter will briefly outline major events and legislation from 1937 to the present day and how such events and legislation set the stage for grassroots initiatives on the state level seeking to take advantage of the medicinal properties of Cannabis sativa and its impact on relative …

Preschool Teachers' Decision-Making Process In Reporting Child Abuse, Mytra Thi Nguyen-Vu Jan 2018

Preschool Teachers' Decision-Making Process In Reporting Child Abuse, Mytra Thi Nguyen-Vu

Walden Dissertations and Doctoral Studies

Despite being mandated reporters by law, preschool teachers often fail to report suspicion of child abuse or neglect. Although research has been conducted regarding reasons why teachers do not report, no study has yet examined preschool teachers' thinking as decisions are being made. Therefore, the purpose of the study was to examine the in-the-moment decision-making process of preschool teachers to report or not report cases of suspected child abuse or neglect. Three research questions guided this exploration of teachers' responses to cases of possible child abuse or neglect, the reasons teachers give for their responses, and their confidence in the …

The Effect Of Gender And Narcotic Or Stimulant Abuse On Drug-Related Locus Of Control, Yolanda Rene Travis Jan 2018

The Effect Of Gender And Narcotic Or Stimulant Abuse On Drug-Related Locus Of Control, Yolanda Rene Travis

Walden Dissertations and Doctoral Studies

Substance use disorders cause significant neurological damage, cognitive impairment, and maladaptive behaviors that negatively affect a person's quality of life. The purpose of this study was to explore the effect gender and primary drugs have on locus of control. Generalized expectancy theory helped to explain the behavior of patients diagnosed with substance use disorders and their inability to control ongoing drug use. The research question focused on to what extent drug-related locus of control scores differ by primary drug (narcotic vs. stimulant), gender (male vs. female), and their interaction. Data measuring locus of control from 553 participants provided a subset …
