Political Rhetoric And Minority Health: Introducing The Rhetoric-Policy-Health Paradigm, Kimberly Cogdell Grainger Jan 2018

Political Rhetoric And Minority Health: Introducing The Rhetoric-Policy-Health Paradigm, Kimberly Cogdell Grainger

Saint Louis University Journal of Health Law & Policy

Rhetoric is a persuasive device that has been studied for centuries by philosophers, thinkers, and teachers. In the political sphere of the Trump era, the bombastic, social media driven dissemination of rhetoric creates the perfect space to increase its effect. Today, there are clear examples of how rhetoric influences policy. This Article explores the link between divisive political rhetoric and policies that negatively affect minority health in the U.S. The rhetoric-policy-health (RPH) paradigm illustrates the connection between rhetoric and health. Existing public health policy research related to Health in All Policies and the social determinants of health combined with rhetorical …

A Mixed Method Analysis Of Child Sexual Abuse And Risky Sexual Behaviours Among University Students In Malaysia / Ashvini Jayapalan, Jayapalan Ashvini Jan 2018

A Mixed Method Analysis Of Child Sexual Abuse And Risky Sexual Behaviours Among University Students In Malaysia / Ashvini Jayapalan, Jayapalan Ashvini

Student Works (2010-2019)

Many previous studies have showed that child sexual abuse (CSA) is associated with risky sexual behaviours (RSB). Additionally, there have been many misconceptions in understanding sexual abuse among the public. The lack of awareness and various views on perceiving sexual abuse among people of different ethnic minorities warrants in-depth understanding. The quantitative phase aimed to determine the prevalence of CSA experience and its association with unprotected sex during first sexual intercourse (RSB 1), unprotected sex throughout subsequent sexual intercourse (RSB 2) and multiple sexual partners (RSB 3). The purpose of the qualitative phase was to gain in-depth understanding of multi-ethnic …

Breaking Chains Of Oppression: Popular Culture And The Plundering Of Blackness, Corina Sacajawea Ambrose Jan 2018

Breaking Chains Of Oppression: Popular Culture And The Plundering Of Blackness, Corina Sacajawea Ambrose

Graduate Student Theses, Dissertations, & Professional Papers

This thesis focuses on the ways in which white supremacy created mass incarceration, specifically mass incarceration of black individuals, and how this continues to perpetuate a racial caste system in the United States. First, I examine contemporary novelist Colson Whitehead‘s The Underground Railroad to provide a historical background of white supremacy and slavery. Then, I argue that pop culture is one area in which artists are focused on the abolition of the prison-industrial complex and ending mass incarceration. Finally, I focus on JAY-Z‘s music video “The Story of O.J.“ and Beyoncé‘s visual album Lemonade and her 2018 Coachella performance to …

The Formation Of A Citizen-Police Encounter And Its Effect On Dispositional Outcomes For Traffic Stops In A City And County Jurisdiction, Darby A. Semenza Jan 2018

The Formation Of A Citizen-Police Encounter And Its Effect On Dispositional Outcomes For Traffic Stops In A City And County Jurisdiction, Darby A. Semenza

Graduate Student Theses, Dissertations, & Professional Papers

This research extends Donald Black’s (1976) theory of law to a large, more diverse sample of traffic stops than previous research. The theory suggests that with every citizen-police encounter, there is social distance separating the two parties. This distance is based on observable characteristics of both the officer and citizen involved. Specifically, their gender, age, race, demeanor, and whether they differ across these variables or not. A large difference in “social distance” increases the likelihood that an officer will cite a motorist; while a small distance reduces this likelihood. Social distance is the amount of diversity between two parties in …

How Anthropogenic Climate Change Exacerbates Vulnerability In Prison Communities; A Critical Environmental Justice Analysis, John L. Veit Jan 2018

How Anthropogenic Climate Change Exacerbates Vulnerability In Prison Communities; A Critical Environmental Justice Analysis, John L. Veit

Cal Poly Humboldt theses and projects

This thesis examines the link between anthropogenic climate change and mass incarceration by examining how governments address conditions in and around prisons resulting from hurricanes and wildfires. Critical Environmental Justice, Treadmill of Production and Destruction theories are synthesized using what is debuted here as an intersectional camera based on the theory of intersectionality. It examines how Trump administration policies will greatly exacerbate dangers caused by climate change and increase risks and dangers caused by mass incarceration. In addition to being a call to action, this project is intended to serve as a resource for prisoner rights activists. Prisons have become …

Evolutionary Theory And Criminology, Anthony Walsh, Cody Jorgensen

Criminal Justice Faculty Publications and Presentations

In this chapter, we (a) demonstrate the relevance of evolutionary theory to criminology, (b) discuss the evolutionary origins of both prosocial and antisocial traits, and (c) show that evolutionary theory is invaluable to understanding two key issues that have been impervious to solution using the standard social science model—the sex ratio in criminal offending and the age-crime curve.

Criminalizing (Poor) Fatherhood, Cortney E. Lollar Jan 2018

Criminalizing (Poor) Fatherhood, Cortney E. Lollar

Law Faculty Scholarly Articles

States prosecute and incarcerate thousands of fathers every year for failing to pay their child support obligations. Ostensibly, these prosecutions aim to foster the health and well-being of children without requiring the child’s mother to bear the costs of raising the child alone. What may appear on the surface to be a system that balances out inequities is actually a deeply flawed government program—one that promotes criminal recidivism and reinforces the poverty of indigent fathers. Contrary to the common image of a “deadbeat dad” raking in money and staying on the lam to avoid helping a mother raise their child, …

Evaluating Fidelity To A Modified Niatx Process Improvement Strategy For Improving Hiv Services In Correctional Facilities, Jennifer Pankow, Jennifer Willett, Yang Yang, Holly Swan, Richard Dembo, William M. Burdon, Yvonne Patterson, Frank S. Pearson, Steven Belenko, Linda K. Frisman

Criminology Faculty Publications

In a study aimed at improving the quality of HIV services for inmates, an organizational process improvement strategy using change teams was tested in 14 correctional facilities in 8 US states and Puerto Rico. Data to examine fidelity to the process improvement strategy consisted of quantitative ratings of the structural and process components of the strategy and qualitative notes that explicate challenges in maintaining fidelity to the strategy. Fidelity challenges included (1) lack of communication and leadership within change teams, (2) instability in team membership, and (3) issues with data utilization in decision-making to implement improvements to services delivery.

The First Pride Was A Riot: How Queer Activism Has Partnered With Police To Hurt The Community’S Most Vulnerable, Delaney Nevius Jan 2018

The First Pride Was A Riot: How Queer Activism Has Partnered With Police To Hurt The Community’S Most Vulnerable, Delaney Nevius

UC Law SF Journal on Gender and Justice

Summarizing the history and development of queer rights activism in San Francisco, this article reflects upon the legal goals of the queer community in San Francisco from 1960 to the present, observing a movement away from law enforcement resistance and towards collaboration and placing the community’s most vulnerable, queer people of color, at risk. The author outlines and problematizes three potential legal goals for the queer community moving forward: a constitutional claim of police misconduct, hate crime legislation, and police reform tactics.

How Federal Work-Study Affects The College Student Experience, Cole William Kallio-Crotteau Jan 2018

How Federal Work-Study Affects The College Student Experience, Cole William Kallio-Crotteau

Masters Theses

By creating a quantitative assessment and using one on one interviews, participants were asked to describe their collegiate experience as it has changed and evolved while enrolled in the Federal Work-Study (FWS) program. To achieve the greatest amount of data, four participants were individually interviewed who currently held FWS-funded positions and determined the affects the program had on their time at the Midwestern institution. All participants perceived college experiences were impacted in some way positively, citing multiple examples of growth and development throughout their time involved.

Examination Of The Role Of Dehumanization As A Potential Mechanism Underlying The Racial Disparities In School Disciplinary Measures., Ebony A. Lambert Jan 2018

Examination Of The Role Of Dehumanization As A Potential Mechanism Underlying The Racial Disparities In School Disciplinary Measures., Ebony A. Lambert

Theses and Dissertations

Schools should be safe and supportive spaces for all students, yet Black students tend to face biased treatment in the education system, which often results in harsh disciplinary measures. This research examined the role of animalistic dehumanization (i.e., perceiving others as animal-like and uncultured and denying uniquely human characteristics), in predicting choice of harsher disciplinary measures for Black students as opposed to White students. It was hypothesized that individuals who dehumanize Black students to a greater degree would be more likely to believe that Black students need to be disciplined through harsher measures. Additionally, it was hypothesized that the link …

General Principles Of Procedural Law And Procedural Jus Cogens, S. I. Strong Jan 2018

General Principles Of Procedural Law And Procedural Jus Cogens, S. I. Strong

Faculty Publications

General principles of law have long been central to the practice and scholarship of both public and private international law. However, the vast majority of commentary focuses on substantive rather than procedural concerns. This Article reverses that trend through a unique and innovative analysis that provides judges, practitioners, and academics from around the world with a new perspective on international procedural law. The Article begins by considering how general principles of procedural law (international due process) are developed under both contemporary and classic models and evaluates the propriety of relying on materials generated from international arbitration when seeking to identify …

The Aba Rule Of Law Initiative Celebrating 25 Years Of Global Initiatives, M. Margaret Mckeown Jan 2018

The Aba Rule Of Law Initiative Celebrating 25 Years Of Global Initiatives, M. Margaret Mckeown

Michigan Journal of International Law

Relying on extensive reports, program documentation, and interviews with important actors in the rule of law movement, this article will explore how one key player in the international-development field—the ABA—has furthered rule of law values through its global programs. The first half of the article surveys the ABA’s involvement in rule of law initiatives. Part I explores the origins of the ABA’s work in this field, which date back to the organization’s founding and took shape after the demise of the former Soviet Union. Part II surveys the expansion of the ABA’s programs beyond Eastern Europe to other regions—a growth …

Expanding Printz In The Sanctuary City Debate, Hannah Michalove Jan 2018

Expanding Printz In The Sanctuary City Debate, Hannah Michalove

Campbell Law Review

American attitudes toward immigration shift with changes in the nation's economic and political climate. While waves of immigration to the United States are motivated by various factors, the extent to which immigrants are welcomed in the country does not consider these motivations. Rather, American perspectives of immigration vary by region and are informed by local economies and ideological majorities. Thus, while some localities work closely with federal immigration officials to facilitate federal regulatory schemes, other localities adopt policies that prohibit cooperation with federal immigration law, becoming "sanctuary cities" for undocumented immigrants. This Comment explores the constitutionality of a federal provision …

Corporate Liability For Human Rights Violations: The Future Of The Alien Tort Claims Act, Milena Sterio

Law Faculty Articles and Essays

This paper addresses complex legal issues in light of and in the context of Jesner v. Arab Bank, a case involving the scope of corporate liability for human rights abuses under the Alien Tort Claims Act (ATCA). Part I provides a brief overview of the Jesner case. Part II outlines the case Kiobel v. Royal Dutch Petroleum Co. and its holding. Part III discusses Kiobel's shortcomings, including the vagueness of its "touch and concern" test and its failure to specify which law—international or domestic—applies to the issue of corporate liability under the ATCA. Part IV then proposes other …

Sequencing Peace And Justice In Syria, Milena Sterio Jan 2018

Sequencing Peace And Justice In Syria, Milena Sterio

Law Faculty Articles and Essays

Since 2011, the conflict in Syria has caused the death of hundreds of thousands of individuals and the displacement of millions. Efforts to refer the Syrian situation to the International Criminal Court (ICC) have consistently failed despite well-documented reports about the commission of serious crimes in Syria, including the use of chemical weapons against civilians, torture, the use of child soldiers, and crimes of sexual violence.

This Article explores whether the dual goals of peace and justice can be reconciled in the Syrian context and how these goals may be properly sequenced in order to potentially achieve long-lasting peace in …

Who Gets What, When, How? Power, Organization, Markets, Money And The Allocation Of Resources, Martin Shubik Jan 2018

Who Gets What, When, How? Power, Organization, Markets, Money And The Allocation Of Resources, Martin Shubik

Cowles Foundation Discussion Papers

Money is a mystery and financial institutions are often regarded as guardians and promoters of the mystery. These sketches are designed to help an individual interested in, but not technically trained in economics, understand markets, money, credit and the evolution of a mass market system embedded in the rich context of its political environment and society. The efficient functioning of a dynamic economy requires the presence of money and financial institutions. The great variety of financial institutions in any advanced economy requires that a synthetic approach is used to understand what the whole looks like. Verbal description provides an overarching …
