This Article represents the first attempt to systematically assess and compare the goals of international criminal courts to one another. To compare them, it focuses on their expected value. This is the value of the benefit that would occur if the goal were to be achieved, multiplied by the likelihood that it will be achieved. This approach allows for goals of differing value and likelihood of achievement to be compared to one another. The goal with the highest expected value is the goal that is most important and that international criminal courts should prioritize.
This Article demonstrates that it is …

Attitudinal Trends In Support For Police Use Of Force Before And After Ferguson, Tashanda Dennison
Attitudinal Trends In Support For Police Use Of Force Before And After Ferguson, Tashanda Dennison
Electronic Theses and Dissertations
Since the 2014 death of an unarmed black teenager, Michael Brown by a white Ferguson police officer, there has been a string of similar incidents that have occurred in a relatively short period of time. These high profile incidents of police officers using questionable amounts of force have shaken public trust in law enforcement. Studies have shown that public confidence in law enforcement often erodes drastically following heavily publicized, controversial media reports of police misconduct (Tuch and Weitzer 1997; Weitzer 2002). The current levels of public outrage in response to allegations of police brutality have surpassed the levels of outrage …

A Grounded Theory Investigation Of Adaptations To Adverse Childhood Experiences, Jeffrey Michael Friedman
A Grounded Theory Investigation Of Adaptations To Adverse Childhood Experiences, Jeffrey Michael Friedman
Department of Family Therapy Dissertations and Applied Clinical Projects
Adverse childhood experiences (ACEs) include childhood sexual abuse, physical abuse, emotional abuse, physical neglect, emotional neglect, and household dysfunction. Much has been reported about the detrimental outcomes associated with these experiences. The associated negative outcomes of ACEs can include addiction, suicide, disability, teenage pregnancy, and early death. However, it is well known that many people experience ACEs and do very well. Rather than viewing negative outcomes only as symptoms of trauma and positive outcomes only as signs of resilience, it is possible to consider adaptations. This study focused on how adults adapted to their adverse childhood experiences. Data were collected …

Impact Of Individual Differences On Faking Behavior, Norah Beverly Kerubo Orina
Impact Of Individual Differences On Faking Behavior, Norah Beverly Kerubo Orina
Electronic Theses and Dissertations
Despite the widespread use of personality tests over the past decades for personnel selection, personality tests are known to be fakable by applicants. Professionals often design interventions during the selection process to reduce applicant faking. The current research examined the impact of individual differences faking behavior that are known to be associated with faking behavior in applicants. They included integrity, selfcontrol, self-monitoring, narcissism, impulsivity and external locus of control. This research tested hypotheses that applicants would fake differently on the various individual difference variables and whether the relationship between faking behavior and individual differences would be consistent across sex and …

The Right To Counsel In Criminal Cases: Still A National Crisis, Mary Sue Backus, Paul Marcus
The Right To Counsel In Criminal Cases: Still A National Crisis, Mary Sue Backus, Paul Marcus
Faculty Articles
In 1963, Gideon v. Wainwright dramatically changed the landscape of criminal justice with its mandate that poor criminal defendants be entitled to legal representation funded by the government. As scholars and practitioners have noted repeatedly over more than fifty years, states have generally failed to provide the equal access Gideon promised. This Article revisits the questions raised by the authors over a decade ago when they asserted that a genuine national crisis exists regarding the right to counsel in criminal cases for poor people. Sadly, despite a few isolated instances where litigation has sparked some progress, the issues remain the …
Carpenter V. United States And The Fourth Amendment: The Best Way Forward, Stephen E. Henderson
Carpenter V. United States And The Fourth Amendment: The Best Way Forward, Stephen E. Henderson
Faculty Articles
We finally have a federal ‘test case.’ In Carpenter v. United States, the Supreme Court is poised to set the direction of the Fourth Amendment in the digital age. The case squarely presents how the twentieth-century third party doctrine will fare in contemporary times, and the stakes could not be higher. This Article reviews the Carpenter case and how it fits within the greater discussion of the Fourth Amendment third party doctrine and location surveillance, and I express a hope that the Court will be both a bit ambitious and a good measure cautious. As for ambition, the Court …

Inclusive Immigrant Justice: Racial Animus And The Origins Of Crime-Based Deportation, Alina Das
Faculty Articles
The merger of immigration and criminal law has transformed both systems, amplifying the flaws in each. In critiquing this merger, most scholarly accounts begin with legislative changes in the 1980s and 1990s that vastly expanded criminal grounds of deportation and eliminated many forms of discretionary relief. As a result of these changes, immigrant communities have experienced skyrocketing rates of detention and deportation, with a disparate impact on people of color. Despite increasing awareness of the harshness of the modern system, however, many people still view criminal records as a relatively neutral mechanism for identifying immigrants as priorities for detention and …
Reflections On The Sandra Lockett Case, Peggy C. Davis
Reflections On The Sandra Lockett Case, Peggy C. Davis
Faculty Articles
Criminal justice systems are too often recklessly driven by crude, fearful and vengeful responses to tragic events. The story of Sandra Lockett reminds us that the law should moderate those responses and give each criminal defendant the equal respect that her life commands.

Health Justice In The Age Of Alternative Facts And Tax Cuts: Value-Based Care, Medicaid Reform, And The Social Determinants Of Health, Elizabeth Tobin-Tyler
Health Justice In The Age Of Alternative Facts And Tax Cuts: Value-Based Care, Medicaid Reform, And The Social Determinants Of Health, Elizabeth Tobin-Tyler
Saint Louis University Journal of Health Law & Policy
Some provisions of the Patient Protection and Affordable Care Act of 2010 (ACA) as well as regulatory policies under the Obama administration reflected the overwhelming evidence that to reduce health care costs, and to improve quality of care and population health, the social determinants of health (SDOH) must be addressed. These policies included funding for partnerships between public health agencies, community organizations, and health care institutions, promotion of value-based payment models that incentivize integrated health and social care delivery, and support for Medicaid program innovations that directly address social needs as part of health care. The Trump administration, through a …
What Hope For Health In All Policies’ Addition And Multiplication Of Equity In An Age Of Subtraction And Division At The Federal Level?: The Memphis Experience, Amy T. Campbell
Saint Louis University Journal of Health Law & Policy
Increasingly, people recognize that social factors, such as poverty, the living environment, and educational status, substantially affect health outcomes. A “health in all policies approach” (HiAP) seeks structural reform of policymaking to require purposeful consideration, across an interconnected range of public sector actors, of the health equity and justice policy-level considerations of these factors. With the election of Donald J. Trump as 45th President in the United States, however, the U.S. entered a world where the math of the day is division and subtraction, rather than addition or multiplication. And yet, hope in HiAP remains through examples of innovative approaches …
