“Insensitive Advertising” Of Foreign Domestic Workers In Singapore: A Violation Of Human Dignity, Benjamin Joshua Ong Dec 2018

“Insensitive Advertising” Of Foreign Domestic Workers In Singapore: A Violation Of Human Dignity, Benjamin Joshua Ong

Research Collection Yong Pung How School Of Law

Singapore’s Ministry of Manpower has suspended the licence of an employment agency for advertising the services of foreign domestic workers in an “insensitive” manner which portrayed the workers as a “commodity that can be bought and sold”. It also prosecuted the agency and the employee responsible for the advertisements; the employee has pleaded guilty. The Ministry’s actions are a welcome development in the evolution of the concept of a right to human dignity in Singapore law.

Conspiracy: Contemporary Gang Policing And Prosecutions, Keegan Stephan Dec 2018

Conspiracy: Contemporary Gang Policing And Prosecutions, Keegan Stephan

Cardozo Law Review

Part I of this Note reviews gang policing before Morales, explains the vagueness, equal protection, and policy and custom doctrines that helped shape gang policing, and details the practices of contemporary gang policing. Part II argues that contemporary gang policing violates equal protection under the innovative showing of discriminatory intent found in Floyd v. City of New York, and that contemporary gang policing violates both prongs of the vagueness doctrine when viewed in its totality-at least where it is proscribed by statute. Part III notes that the vagueness doctrine has historically been applied only to statutory law and …

Revolution In Crime: How Cryptocurrencies Have Changed The Criminal Landscape, Igor Groysman Dec 2018

Revolution In Crime: How Cryptocurrencies Have Changed The Criminal Landscape, Igor Groysman

Student Theses

This thesis will examine the ways in which various cryptocurrencies have impacted certain traditional crimes. While crime is always evolving with technology, cryptocurrencies are a game changer in that they provide anonymous and decentralized payment systems which, while they can be tracked in a reactive sense via the blockchain, are seen by criminals as having better uses for them than traditional fiat currencies, such as the ability to send money relatively fast to another party without going through an intermediary, or the ability to obscure the origin of the money for money laundering purposes. Every week there are new cryptocurrencies …

Differences In Psychopathy And Associated Traits By Police Officer Rank, Rosanne Libretti Dec 2018

Differences In Psychopathy And Associated Traits By Police Officer Rank, Rosanne Libretti

Student Theses

Most psychopathy research focuses on its manifestation in forensic populations, however these results may not generalize onto noncriminal, or “successful,” psychopaths. Lykken (1995) conjectured that socialization may enable “heroes,” like law enforcement, to utilize the interpersonal and affective aspects of psychopathy in a manner that benefits society. Previous research (Falkenbach et al., 2018a) suggests that psychopathy and its correlates differ between police recruits and individuals in the community. It is necessary to continue this work with other groups in the police force to see if the patterns found in these studies generalize to veteran officers who have worked in law …

Detection Of In Utero Cannabis Exposure By Umbilical Cord Analysis, Jiyoung Kim Dec 2018

Detection Of In Utero Cannabis Exposure By Umbilical Cord Analysis, Jiyoung Kim

Student Theses

According to 2018 National Survey on Drug Use and Health, 7.1% of pregnant women smoked marijuana in the past month in 2017. Although this prevalence is expected to increase as a growing number of states and countries are now considering legalization, there are scarce data on effects of in utero cannabis exposure. For the monitoring of fetal cannabis exposure, two methods are employed; self-report and the analysis of biological matrix. Due to inaccuracy of self-report, the analysis of neonatal matrixes such as meconium, hair, and urine is perferred. Although umbilical cord is becoming a useful objective tool to detect in …

Bumbling In The Dark: The Effect Of The Dark Triad, Online Dating, And Gender On Risky Sexual Behaviors, Rebecca Boudreau Dec 2018

Bumbling In The Dark: The Effect Of The Dark Triad, Online Dating, And Gender On Risky Sexual Behaviors, Rebecca Boudreau

Student Theses

The Dark Triad is used to describe three distinct yet related personality traits: psychopathy, narcissism, and Machiavellianism, which share several characteristics such as manipulation, exploitation, emotional coldness, and lack of empathy. The Dark Triad has been associated with several negative behaviors including infidelity and risky sexual behavior, however most of the current research focuses only on males high on the Dark Triad traits. The present study seeks to expand the literature by studying how the Dark Triad traits and online dating usage relate to the composite score of risky sexual behaviors. Further, we seek to examine if gender moderates this …

The Bully And The Beast: Correlations Between Psychopathic Traits And Bullying In A Sample Of University Students, Nascha Streng Dec 2018

The Bully And The Beast: Correlations Between Psychopathic Traits And Bullying In A Sample Of University Students, Nascha Streng

Student Theses

Bullying is a concept mostly investigated in children, teenagers, and adults within the workplace. While there is research on bullying in college in general, gaps in the literature remain considering how personality characteristics in bullies relate directly to psychopathy and specific psychopathy traits. Although the literature suggests bullies have a tendency towards psychopathic traits such as violence, impulsivity, egocentricity, manipulativeness, rule-breaking, and intolerance, researchers have yet to assess the connection between college students who bully and psychopathy. The research on psychopathy suggests that those high on psychopathic traits may be more prone to use bullying as an apathetic means to …

The Effect of Digital Storytelling on Academic Performance, Interest and Motivation of Police Cadets in a Law Enforcement Academy. Doctor of Education (Ed.D.), December 2018, 93pp., 6 tables, 83 references, 5 appendices. With increasing criticism concerning police interactions with the public and the use-of-force decisions, the importance of preservice law enforcement instruction is an ongoing concern for both police practitioners and the public. Law enforcement education can benefit from the integration of new instructional strategies that can increase comprehension and long-term knowledge retention transferable into the field. Digital storytelling has been proffered as an effective cross-cultural communication tool and has …

Straining To Prevent The Rohingya Genocide: A Sociology Of Law Perspective, Katherine Southwick Dec 2018

Straining To Prevent The Rohingya Genocide: A Sociology Of Law Perspective, Katherine Southwick

Genocide Studies and Prevention: An International Journal

This paper analyzes the generally muted international response to the protracted plight of the Rohingya, a persecuted Muslim minority in Myanmar, from the perspective of sociology of law. The first part provides background on the Rohingya crisis and discusses relevant international legal frameworks relating to crimes against humanity and genocide. The second part adapts analytical frameworks developed by Felstiner, Abel, and Sarat on the emergence and transformation of disputes, in order to examine some of the factors that frustrate the processes of naming crimes, blaming perpetrators, and claiming rights and protection for the Rohingya minority in the international context. Work …

"I Just Got Out; I Need A Place To Live": A Business Plan For Transitional Housing, Walker Beverly V Dec 2018

"I Just Got Out; I Need A Place To Live": A Business Plan For Transitional Housing, Walker Beverly V

Electronic Theses, Projects, and Dissertations

The United States has a serious epidemic of mass incarceration and high recidivism rates. The U. S. must act on these high recidivism rates by implementing social services programs that help the formerly incarcerated stop committing crimes. The formerly incarcerated are being oppressed by a historic process that has continued to incarcerate and control them, even after they had served their time for their crimes. This project attempts to assist in reducing the high recidivism rates by creating an education-based transitional housing facility with a plethora of supportive services that will be open to formerly incarcerated individuals. This project sheds …

The Right To Be Human: Universal Design For Learning And Literacy Sponsorship As Liberatory Pedagogy, Jeremy Lunasco Dec 2018

The Right To Be Human: Universal Design For Learning And Literacy Sponsorship As Liberatory Pedagogy, Jeremy Lunasco

Electronic Theses, Projects, and Dissertations

This project explores the possibilities of implementing a critical and liberatory pedagogy within the confines of the prison. Building upon the fields of critical prison theory, literacy studies, and (dis)ability studies, I assert that implementing small, organic, and tactical changes though the principles of Universal Design for Learning allows the prison educator to make impactful moves with liberatory goals. I conclude by reimagining what a prison education mission statement that takes this perspective looks like then imagine the liberatory applications of the principles of universal design for learning within the prison.

Comment On 'Judicial Compensation And Performance', J.J. Prescott Dec 2018

Comment On 'Judicial Compensation And Performance', J.J. Prescott

Articles

The most significant challenges to better understanding judicial behavior are lack of data and the absence of plausible exogenous variation in judicial environments. The random assignment of judges to cases has admittedly been helpful in gaining traction on the effects of judicial decisions (e.g., Dobbie, Goldin, and Yang 2018). Yet developing a full empirical account of “what judges maximize” (Posner 1993) would require a setting in which judges are randomly subjected to a wide variety of (real-world) environments with different costs, constraints, and rewards. This prospect remains pie in the sky, but that does not mean that we have not …

Pathways Of Psychopathic Traits To Aggression Through Affective Correlates, Olivia C. Preston Dec 2018

Pathways Of Psychopathic Traits To Aggression Through Affective Correlates, Olivia C. Preston

Master's Theses

This thesis project examines the roles of empathy facets and emotion dysregulation in the relationship between psychopathic personality traits and aggression within an undergraduate sample. The project addresses three gaps in research – how psychopathic personality traits relate to empathy facets from a recently developed measure of empathy (Affective and Cognitive Measure of Empathy [ACME]; Vachon & Lynam, 2016); how psychopathic traits indirectly affect aggression functions (i.e., reactive, proactive) through empathy facets; and how emotion regulation contributes to these relations, above and beyond empathy. The sample was comprised of 368 university students. Findings indicated that largely all psychopathic traits were …

Public Dollars, Private Discrimination: Protecting Lgbt Students From School Voucher Discrimination, Adam Mengler Dec 2018

Public Dollars, Private Discrimination: Protecting Lgbt Students From School Voucher Discrimination, Adam Mengler

Fordham Law Review

More than a dozen states operate school voucher programs, which allow parents to apply state tax dollars to their children’s private school tuition. Many schools that participate in voucher programs are affiliated with religions that disapprove of homosexuality. As such, voucher-accepting schools across the country have admissions policies that discriminate against LGBT students and students with LGBT parents. Little recourse exists for students who suffer discrimination at the hands of voucher-accepting schools. This Note considers two ways to provide protection from such discrimination for LGBT students and ultimately argues that the best route is for an LGBT student to bring …

Political Competition And Predictors Of Hate Crime: A County-Level Analysis, Eaven Holder Dec 2018

Political Competition And Predictors Of Hate Crime: A County-Level Analysis, Eaven Holder

Electronic Theses and Dissertations

Research on hate crime has tended to utilize sociological frameworks to best explain the incidence of such offending, but little research has been conducted to determine whether political factors may play a role. Although Olzak (1990) touched upon the relationship between racial violence and third-party politics during the American Progressive era (1882-1914), the research did not fully articulate how political competition may influence the commission of hate crime. The current study seeks to fill this gap, while also extending concepts associated with social disorganization theory and the defended communities perspective. It does so by utilizing a longitudinal research design to …

All That Glitters Is Not Gold: Media Coverage Of The Golden State Killer, Lasherica Thornton Dec 2018

All That Glitters Is Not Gold: Media Coverage Of The Golden State Killer, Lasherica Thornton

Honors Theses

This thesis focused on the media’s extensive coverage of serial killers and, thus, how it could propel them to a state of fame. It discusses that no matter a serial killer’s circumstance, the media typically finds a story. For example, a serial killer can be on a rampage or can be dormant, but in subsequent stories, the media will center a story around the killer’s first and/or recent crimes, his identity, or his possible next move. The New York Times and Los Angeles Times coverage of the Golden State Killer frames the analysis of this manuscript. The purpose was to …

Ethical Cannabis Lawyering In California, Francis J. Mootz Iii Dec 2018

Ethical Cannabis Lawyering In California, Francis J. Mootz Iii

St. Mary's Journal on Legal Malpractice & Ethics

Cannabis has a long history in the United States. Originally, doctors and pharmacists used cannabis for a variety of purposes. After the Mexican Revolution led to widespread migration from Mexico to the United States, many Americans responded by associating this influx of foreigners with the use of cannabis, and thereby racializing and stigmatizing the drug. After the collapse of prohibition, the federal government repurposed its enormous enforcement bureaucracy to address the perceived problem of cannabis, despite the opposition of the American Medical Association to this new prohibition. Ultimately, both the states and the federal government classified cannabis as a dangerous …

Autonomy Isn't Everything: Some Cautionary Notes On Mccoy V. Louisiana, W. Bradley Wendel Dec 2018

Autonomy Isn't Everything: Some Cautionary Notes On Mccoy V. Louisiana, W. Bradley Wendel

St. Mary's Journal on Legal Malpractice & Ethics

The Supreme Court’s May 2018 decision in McCoy v. Louisiana has been hailed as a decisive statement of the priority of the value of a criminal defendant’s autonomy over the fairness and reliability interests that also inform both the Sixth Amendment and the ethical obligations of defense counsel. It also appears to be a victory for the vision of client-centered representation and the humanistic value of the inherent dignity of the accused. However, the decision is susceptible to being read too broadly in ways that harm certain categories of defendants. This paper offers a couple of cautionary notes, in response …

Differences Between Physical Vs. Non-Physical Activity Rewards On The Behavior Of K-8 Students With Emotional And Behavioral Disorders, John Trevor Guerra Dec 2018

Differences Between Physical Vs. Non-Physical Activity Rewards On The Behavior Of K-8 Students With Emotional And Behavioral Disorders, John Trevor Guerra

Doctoral Dissertations and Projects

Students with Emotional and Behavioral Disorders (EBD) face many challenges in the classroom, including the propensity to act-out in class with externalizing behavior such as work avoidance, off-task behavior, refusal to follow rules, and aggression. Past research has focused on the benefits of using reward systems within the classroom, with evidence that those who teach using some form of reward system as a motivator often meet with success. Rewards driven by Token Economies have specifically shown promising results when used with students with disabilities who display challenging behaviors. The purpose of this study was to measure the effects of using …

Analysis Of Synthetic Opioids In Postmortem Blood, Vitreous Humor, And Brain Tissue, Rachel K. Chesser Dec 2018

Analysis Of Synthetic Opioids In Postmortem Blood, Vitreous Humor, And Brain Tissue, Rachel K. Chesser

Student Theses

In the United States, the use of new synthetic opioids (e.g. fentanyl and derivatives) has become an increasing health issue with thousands of overdose deaths being observed since 2013. With the high mortality rate associated with these substances, postmortem analyses and interpretation of synthetic opioids has become extremely important. However, due to the novelty of these compounds, the available data is limited and provides challenges to toxicologists. The focus of this project was to examine the postmortem distribution of new synthetic opioids in blood, vitreous humor, and brain tissue. New methods were developed and validated to quantify 13 synthetic opioids …
