Disruptive Innovation In Criminal Defense: Demanding Corporate Criminal Trials, Ellen S. Podgor May 2018

Disruptive Innovation In Criminal Defense: Demanding Corporate Criminal Trials, Ellen S. Podgor

Mercer Law Review

Perhaps the least sympathetic party in a corporate criminal matter is a corporate entity that has engaged in criminal conduct. If the corporation is large, subject to third party civil actions, and especially in an industry dependent upon a public perception of ethical behavior, a criminal indictment can destroy the entity, and few in society are likely to be concerned. To ameliorate the collateral consequences of an indictment, corporations are quick to cooperate with the government by signing onto non-prosecution, deferred prosecution, or plea agreements. The government secures a hefty fine and obtains from the entity the names and evidence …

Accelerated Creative Problem Solving And Product Improvement Applied To Experimental Devices In A Bloodstain Pattern Interpretation Class--Improving The Role Of Insight Development Tools As A Generator Of New Ideas In Novel Situations, Douglas Ridolfi

Creativity and Change Leadership Graduate Student Master's Projects

This project uses an action research centered study protocol to examine the effects of a problem-based learning exercise related to bloodstain pattern interpretation in a crime scene processing and general criminalistics class taught as part of an upper division forensic chemistry major in a four year college. The goal is to apply design principles and creative problem solving methods directly adapted to a project involving interpreting a set of crime scene photographs depicting blood spatter and with the aid of guided exercises in ideation and design, lead students into the development of alternate theories of how the bloodstains were created …

Examining The Gendered Effects Of Prior Victimization On Delinquency Type Among Justice-Involved Youth, Calli M. Cain May 2018

Examining The Gendered Effects Of Prior Victimization On Delinquency Type Among Justice-Involved Youth, Calli M. Cain

Criminology and Criminal Justice Theses and Dissertations

The purpose of this dissertation is to examine the manner in which different types of prior victimization affect juveniles’ offense type. There is a strong relationship between victimization and offending, meaning that victims are more likely to be offenders and offenders are more likely to be victims, but the exact nature of this relationship remains imprecise. Youth with a history of victimization have an increased risk of delinquency and justice system involvement during adolescence and adulthood. Additionally, a majority of incarcerated youth report having experienced at least one type of victimization before their system involvement and youths’ victimization experiences tend …

Born Free: Toward An Expansive Definition Of Sex, Laura Palk, Shelly Grunsted May 2018

Born Free: Toward An Expansive Definition Of Sex, Laura Palk, Shelly Grunsted

Michigan Journal of Gender & Law

The State of New York recently issued its first physician-certified “intersex” birth certificate, correcting a 55-year-old’s original birth certificate. This is a positive step towards eliminating the traditional binary approach to a person’s birth sex, but it creates potential uncertainties in the employment discrimination context. Over the past several years, the definition of what constitutes “discrimination on the basis of sex” has both expanded (with the legalization of same-sex marriage) and narrowed (restricting the use of gender specific bathrooms). Until recently it appeared that a broader definition of the term “sex” would become the judicial—and possibly legislative—norm in a variety …

Removing Camouflaged Barriers To Equality: Overcoming Systemic Sexual Assault And Harassment At The Military Academies, Rebecca Weiant May 2018

Removing Camouflaged Barriers To Equality: Overcoming Systemic Sexual Assault And Harassment At The Military Academies, Rebecca Weiant

Michigan Journal of Gender & Law

The Education Amendments of 1972 introduced requirements to protect female students from discriminatory policies at post-secondary institutions. A portion of those amendments, commonly known as Title IX, require that no students be subjected to discrimination based on their sex by any educational institution or activity receiving federal financial assistance. An exemption under § 1681(a)(4), however, explicitly prohibits application of Title IX to any educational institution whose primary purpose is to train individuals for military service or the merchant marine. Although those students are still subject to stringent conduct standards, the service academies themselves are tethered to sex discrimination policies only …

A Surging Drug Epidemic: Time For Congress To Enact A Mandate On Insurance Companies And Rehabilitation Facilities For Opioid And Opiate Addiction, Alanna Guy

Journal of Law and Health

This Note begins with a discussion of both the national opioid problem as well as the specific epidemic in Ohio as an example of how it has grown within all of the states. Part II discusses the differences between prescription opioids and opiates, how they can be obtained, what effects they have on the human body, and why the government has an interest in this growing problem. Next, this Note explains how and why there was an increase in access and addiction to prescription opioid pain medication. Following this explanation, the steps the government has taken to try to rectify …

Juvenile Corrections In The Era Of Reform: A Meta-Synthesis Of Qualitative Studies, Anne M. Nurse, Jub Sankofa, Alexandra Cox, Jamie Fader, Michelle Inderbitzin, Laura Abrams

All Faculty Articles

In this article, the authors synthesize knowledge from select qualitative studies examining rehabilitation-oriented juvenile residential corrections and aftercare programs. Using meta-synthesis methodology, the authors extracted and coded content from 10 research studies conducted by five authors across criminology, sociology, and social welfare disciplines. The total number of published works based on those studies analyzed was 18. Collectively, these studies offer insight into three major components of the juvenile correctional experience: therapeutic treatment and evidence-based practices, the shaping of identities and masculinities, and preparation for reentry. This analysis is particularly important as the United States is currently in an era of …

Race, Class And Attitudes Towards Use Of Force By Police, Christopher Everett Robertson May 2018

Race, Class And Attitudes Towards Use Of Force By Police, Christopher Everett Robertson

Sociology & Anthropology Theses - Archive

Another unarmed victim of police violence. Another acquitted officer. In recent years, this tragic course of events has repeated itself on multiple occasions in courtrooms, living rooms and social media spaces throughout the nation. Each new, widely-publicized fatal police encounter has added to an ongoing and contentious national debate around policing and minority rights. This intractable debate, which has been argued along racial lines, seems to be at an indefinite impasse. But what if this debate persists because we have not accounted for the role that both race and class play in shaping views towards use of force? Therefore, this …

Crossover Youth Prevention: Predictors Of Youth Crossover From Child Welfare To Juvenile Justice, Marcus R. Crawford May 2018

Crossover Youth Prevention: Predictors Of Youth Crossover From Child Welfare To Juvenile Justice, Marcus R. Crawford

Social Work Dissertations - Archive

By some estimates, as many as 60% of youth in the juvenile justice system have previous experience in the child welfare system, with delinquency rates among youth in foster care about 50% higher than among youth not involved in foster care (Ryan & Testa, 2005; Sickmund & Puzzanchera, 2014). Identifying factors that impact crossing over from the child protective system into the juvenile justice system is essential to developing interventions targeting youth success and derailing the criminal pathway of many United States adolescents. Decades of research have shown that youth who enter foster care are at an increased risk for …

Confidence In The Police Among Caribbean Countries., Hyunin Baek May 2018

Confidence In The Police Among Caribbean Countries., Hyunin Baek

Electronic Theses and Dissertations

This dissertation identifies public confidence in the police in contemporary policing, in particular among Caribbean countries. Law enforcement agencies in Caribbean countries have failed to earn confidence from the public. Citizens with a lower level of confidence in the police are unwilling to cooperate and support policing activities, making initiatives of law enforcement agencies difficult to achieve. In order to improve the public-police relationship in Caribbean countries, examinations of public confidence in the police are required. Researchers have developed two theoretical frameworks, the instrumental and expressive models, to explain key factors associated with public confidence in the police. In order …

Family Courts As Certifying Agencies: When Family Courts Can Certify U Visa Applications For Survivors Of Intimate Partner Violence, Sylvia Lara Altreuter May 2018

Family Courts As Certifying Agencies: When Family Courts Can Certify U Visa Applications For Survivors Of Intimate Partner Violence, Sylvia Lara Altreuter

Fordham Law Review

Undocumented intimate partner violence survivors living in the UnitedStates have limited options for immigration relief. One of the only avenuesopen to them is the U Visa: a nonimmigrant visa established by the BatteredImmigrant Women Protection Act of 2000. To apply for a U Visa, a survivormust prove to immigration authorities that she was the victim of a crime;suffered substantial abuse; and was, is,or is likely to be helpful in theinvestigation of her abuser. The statute requires that all U Visa applicationsbe certified by an appropriate officialwho testifies to the applicant’shelpfulness with the investigation. This certification is a tremendous obstaclefor survivors: …

On The Development Of Self-Control And Deviance From Preschool To Middle Adolescence, Alexander T. Vazsonyi, Gabriela Ksinan Jiskrova May 2018

On The Development Of Self-Control And Deviance From Preschool To Middle Adolescence, Alexander T. Vazsonyi, Gabriela Ksinan Jiskrova

Family Sciences Faculty Publications

Purpose
The study tested whether developmental changes in self-control stabilize by late childhood (age 10) or continue into early and middle adolescence. Second, it tested the bidirectional, longitudinal relationship between self-control and deviance over an 11-year period.

Methods
Children (N = 1159) from the longitudinal NICHD Study of Early Child Care and Youth Development (SECCYD) were assessed six times, ages 4.5 to 15 years. Latent growth models tested self-control and deviance trajectories, using competing growth functions to capture change over time. The longitudinal, bidirectional self-control-deviance links were examined in a cross-lagged latent model.

Results
Findings showed that children's self-control …

Predictors Of Different Types Of Victim-Trafficker Relationships: An Intersectionality-Informed Analysis, Mary K. Twis May 2018

Predictors Of Different Types Of Victim-Trafficker Relationships: An Intersectionality-Informed Analysis, Mary K. Twis

Social Work Dissertations - Archive

Domestic minor sex trafficking (DMST) is the commercial sexual exploitation of a minor citizen or legal resident within United States borders. The literature about the experiences of DMST victims is an amalgamation of force, exploitation, and sometimes the exercise of personal, if constrained, agency in the decision to exchange sex for money or goods. Unfortunately, federal and local policies do not make much room for the nuances of victim experience, in which multiple oppressive factors may contribute to DMST victimization, or different types of DMST victimization. Instead, officials tend to view DMST as a monolithic crime, rather than a problem …

Mental Health Screening For Prisoners Upon Entrance To State Prisons, Illandra Denysschen May 2018

Mental Health Screening For Prisoners Upon Entrance To State Prisons, Illandra Denysschen

Criminology & Criminal Justice Theses - Archive

The prison system has left a penal system that strives to rehabilitate an offender, for one that simply punishes. This is detrimental for prisoners with mental disorders, as their condition may worsen exponentially with incarceration. This research examines the mental health screening processes for prisoners upon entrance to state prisons across the United States, by identifying the screening process via state policies. State policies were identified by going onto the respective DOC websites for every state, and reading through the mental health/health policy in order to identify whether or not there were mental health screening processes in place. The resulting …

Does The Death Penalty Deter Homicides?, Lorenzo A. Mendoza Valles May 2018

Does The Death Penalty Deter Homicides?, Lorenzo A. Mendoza Valles

Criminology & Criminal Justice Theses - Archive

This study assessed the long debated question over the death penalty’s deterrent effects. The majority of the empirical research on this topic is dated and does not display the current status of capital punishment. The death penalty argument is divided between criminologists who suggest that capital punishment holds no deterrent effects and criminologists who suggest that it does. This examination revisits the argument with an analysis of state panel data and executions between the years of 2000 and 2014. The findings suggest that the application of the death penalty does not deter would be offenders from committing homicide.

Utilization Of Telehealth Technology In Addiction Treatment In Colorado, J. Michael Faragher, Ying Shan Doris Zhang, Virginia Low, Demi Folds, Mita Johnson

Counseling Psychology: Faculty Scholarship

The growing presence of electronic technology in the health service professions is redefining the boundaries of counseling services. Commonly referred to as telehealth, utilization of electronic communication strategies to expand connectedness has opened new frontiers in behavioral health through applications ranging from digital phones, interactive video sessions, to virtual supervision. Substantial research suggests that telehealth is generally equal in effectiveness to traditional forms of treatment, especially for those individuals struggling with substance abuse problems. Unfortunately, research also suggests that telehealth is often underutilized when it comes to providing addiction treatment services. Telehealth trends in Colorado were examined using a Telehealth …

Righting Categorical Wrongs: A Holistic Solution To Rule 8(A)’S Same-Or-Similarcharacter Prong, Matthew Deates

University of Chicago Law Review

More than half of federal criminal defendants are charged with multiple offenses in a single indictment. These defendants are more likely to be convicted on at least one charge than defendants who receive separate trials for each charge. Joinder has been both lauded for increasing the efficiency of the federal criminal justice system and criticized for unfairly prejudicing criminal defendants. Federal Rules of Criminal Procedure 8(a) and 14 govern the joinder of offenses in the federal system. Rule 8(a) permits offenses of the “same or similar character” to be joined against a single defendant while Rule 14 allows district courts …

Rethinking Family-Court Prosecutors: Elected And Agency Prosecutors And Prosecutorial Discretion In Juvenile Delinquency And Child Protection Cases, Josh Gupta-Kagan May 2018

Rethinking Family-Court Prosecutors: Elected And Agency Prosecutors And Prosecutorial Discretion In Juvenile Delinquency And Child Protection Cases, Josh Gupta-Kagan

University of Chicago Law Review

Like criminal prosecutors, family-court prosecutors have immense power. Determining which cases to prosecute and which to divert or dismiss goes to the heart of the delinquency system’s balance between punishment and rehabilitation of children and the child protection system’s spectrum of family interventions. For instance, the 1990s shift to prosecute (rather than dismiss or divert) about 10 percent more delinquency cases annually is as significant a development as any other. Yet scholars have not examined the legal structures for these charging decisions or family-court prosecutors’ authority in much depth.

This Article shows how family-court prosecutors’ roles have never been fully …

Four Decades Of The Journal Law And Human Behavior: A Content Analysis, Lindsey E. Wylie, Katherine P. Hazen, Lori A. Hoetger, Joshua A. Haby, Eve M. Brank

Department of Psychology: Faculty Publications

Although still relatively young, the journal Law and Human Behavior (LHB) has amassed a publication history of more than 1300 full-length articles over four decades. Yet, no systematic analysis of the journal has been done until now. The current research coded all full-length articles to examine trends over time, predictors of the number of Google Scholar citations, and predictors of whether an article was cited by a court case. The predictors of interest included article organization, research topics, areas of law, areas of psychology, first-author gender, first-author country of institutional affiliation, and samples employed. Results revealed a vast …

Justice In Syria: Individual Criminal Liability For Highest Officials In The Assad Regime, Seema Kassab

Michigan Journal of International Law

Seven years have passed since revolution broke out in Syria in March of 2011. During those six years, hundreds of thousands of Syrians lost their lives, millions of Syrians were internally displaced or left the country seeking refuge, and a beautiful and diverse country was hijacked and terrorized by civil war. Every day in Syria, people are detained, tortured, raped, and killed. Attacks on homes, hospitals, markets, and schools are common occurrences. At this stage of the conflict, there is little doubt that it is the most horrific and dire humanitarian crisis since World War II. The conflict began as …
