The Institutions Of Innocence Review: A Comparative Sociological Perspective, Jessica A. Roth Jul 2018

The Institutions Of Innocence Review: A Comparative Sociological Perspective, Jessica A. Roth

Articles

The last three decades have seen the rise of an international innocence movement that has forced participants in diverse criminal justice systems to confront their systems’ fallibility, previously thought more theoretical than real. The public acknowledgment of that fallibility has led to the creation of new institutional mechanisms to re-examine old convictions. This short essay prepared for a symposium issue of the Rutgers University Law Review on the theory of criminal law reform compares the error correction institutions created in the United Kingdom, Canada, and the United States, three English-speaking countries with common law roots and an adversarial structure, through …

Risk As Reward: Reinforcement Sensitivity Theory And Psychopathic Personality Perspectives On Everyday Risk-Taking, Liam P. Satchell, L.P., Alison M. Bacon, Jennifer L. Firth, Philip J. Corr Jul 2018

Risk As Reward: Reinforcement Sensitivity Theory And Psychopathic Personality Perspectives On Everyday Risk-Taking, Liam P. Satchell, L.P., Alison M. Bacon, Jennifer L. Firth, Philip J. Corr

School of Psychology

This study updates and synthesises research on the extent to which impulsive and antisocial disposition predicts everyday pro- and antisocial risk-taking behaviour. We use the Reinforcement Sensitivity Theory (RST) of personality to measure approach, avoidance, and inhibition dispositions, as well as measures of Callous- Unemotional and psychopathic personalities. In an international sample of 454 respondents, results showed that RST, psychopathic personality, and callous-unemotional measures accounted for different aspects of risk-taking behaviour. Specifically, traits associated with ‘fearlessness’ related more to ‘prosocial’ (recreational and social) risk-taking, whilst traits associated with ‘impulsivity’ related more to ‘antisocial’ (ethical and health) risk-taking. Further, we demonstrate …

Risk Factor Profile Of Youth Incarcerated For Child To Parent Violence: A Nationally Representative Sample, Gaylene Armstrong, Calli Cain, Lindsey Wylie, Lisa Muftic, Leana A. Bouffard

Criminology and Criminal Justice Faculty Publications

Purpose

Intra-familial violence occurs in many forms yet few researchers examine child to parent violence (CPV), which occurs in almost 20% of single parent homes. Studies have neither developed a risk factor profile for youth involved in the most severe cases of CPV resulting in incarceration, nor included a comparison of gender-specific correlates.

Methods

Data from the Survey of Youth in Residential Placement (SYRP) 2003, a large-scale, nationally representative sample of justice-involved youth between the ages of 10 and 20 who were survey using a multi-stage cluster sampling procedure is utilized.

Results

Youth incarcerated for CPV are typically white and …

Analysis Of Tweets Mentioning Scholarly Works From An Institutional Repository, Ashley D.R. Sergiadis Jun 2018

Analysis Of Tweets Mentioning Scholarly Works From An Institutional Repository, Ashley D.R. Sergiadis

ETSU Faculty Works

Altmetrics derived from Twitter have potential benefits for institutional repository (IR) stakeholders (faculty, students, administrators, and academic libraries) when metrics aggregators (Altmetric, Plum Analytics) are integrated with IRs. There is limited research on tweets mentioning works in IRs and how the results impact IR stakeholders, specifically libraries. In order to address this gap in the literature, the author conducted a content analysis of tweets tracked by a metrics aggregator (Plum X Metrics) in a Digital Commons IR. The study found that the majority of tweets were neutral in attitude, intended for a general audience, included no hashtags, and were written …

Race And Gender In (Re)Integration Of Victim-Survivors Of Csec In A Community Advocacy Context, Joshlyn Lawhorn Jun 2018

Race And Gender In (Re)Integration Of Victim-Survivors Of Csec In A Community Advocacy Context, Joshlyn Lawhorn

USF Tampa Graduate Theses and Dissertations

In this thesis, I use feminist ethnography at a nonprofit organization to analyze the racialized gender in (re)integration of victim-survivors of commercial sexual exploitation of children (CSEC). Critical race feminism and intersectionality are the theoretical frameworks to guide the analysis of community advocacy. The analysis considers two themes with various subsections that capture CSEC at the site. The first theme analyzes the definition, challenges, coordination and rhetoric of reintegration at the site. The second theme highlights the site’s racial identity, Black victimhood of victim-survivors of CSEC in the context of community, and racialized gender within reintegration. I discuss the strategic …

Why Is It Wrong To Punish Thought?, Gabriel S. Mendlow Jun 2018

Why Is It Wrong To Punish Thought?, Gabriel S. Mendlow

Articles

It’s a venerable maxim of criminal jurisprudence that the state must never punish people for their mere thoughts—for their beliefs, desires, fantasies, and unexecuted intentions. This maxim is all but unquestioned, yet its true justification is something of a mystery. In this Essay, I argue that each of the prevailing justifications is deficient, and I conclude by proposing a novel one. The proposed justification captures the widely shared intuition that punishing a person for her mere thoughts isn’t simply disfavored by the balance of reasons but is morally wrongful in itself, an intrinsic (i.e., consequence-independent) injustice to the person punished. …

An Evaluation Of Dating Violence Risk Factors For Division Iii Student-Athletes, Nicole Cantor Jun 2018

An Evaluation Of Dating Violence Risk Factors For Division Iii Student-Athletes, Nicole Cantor

Theses and Dissertations

College students are at particular risk for dating violence (DV) perpetration and victimization. One group of college students who may be at increased risk is college student-athletes. Currently, no information exists on the dating and relationship behaviors of both male and female Division III student-athletes. The current study looks to identify both the frequency of DV perpetration and victimization among men and women along with specific risk factors for DV perpetration and victimization. We hypothesize that hazardous drinking and hostile sexism may be risk factors for DV perpetration and victimization among men and women. Among men, both hostile sexism and …

The Role Of Fathers In Behavioral Parent Training: An Exploration Of Parent-Related Factors In Parent And Child Treatment Outcomes, Brittany L. Jordan-Arthur Jun 2018

The Role Of Fathers In Behavioral Parent Training: An Exploration Of Parent-Related Factors In Parent And Child Treatment Outcomes, Brittany L. Jordan-Arthur

USF Tampa Graduate Theses and Dissertations

Despite a well-documented need for parent training in the treatment and prevention of child behavior problems, as well as the well-documented benefit of including fathers in preventative and treatment interventions, surprisingly little clinical intervention research examines the role of fathers in such trainings. This research examined the role of father involvement in behavioral parent training by examining parent-related characteristics in relation to treatment outcomes for both mothers and fathers, examining differences between mothers and fathers, and examining the additive benefit of including fathers in treatment across two studies. Both studies utilized archival data obtained from a university- and community-based parent …

Against Shaming: Preserving Dignity, Decency, And A Moral-Educative Mission In American Schools, Amanda Harmon Cooley

St. John's Law Review

(Excerpt)

While there has been an extensive amount of scholarly discourse regarding the propriety of shaming as a criminal sanction, there has been almost no critical discussion about the validity of shaming punishments as disciplinary measures in schools. This Article is designed to initiate this needed dialogue by arguing for the cessation of school shaming through a legal theory lenses. To accomplish this objective, Part I of this Article provides a definitional foundation of shaming punishments. Part II of the Article presents the normative rejection of school shaming, which is grounded in both legal punishment theory and educational theory. It …

Relations Between Experience With Mental Illness And The Not Guilty By Reason Of Insanity Plea, Madelyn Gero

Electronic Theses and Dissertations Archive

The Not Guilty by Reason of Insanity (NGRI) plea is one of the most controversial defense strategies used in the modern legal system. The aim of this study was to determine whether previous experience with mental illness was a factor in participants' likelihood of assigning a NGRI verdict. Participants (N = 268) read a vignette and assigned a verdict. Items dealing with previous experience with mental illness and other related variables were included. Reliability and validity analyses and an exploratory factor analysis were performed on the previous experience with mental illness measure. Futher, logistic regression analyses were performed using measures …

A Comparison Of The Models And Methods Of Surveillance In East Germany And Northern Ireland And Their Relevance To Modern-Day Securitization Of Society, Cliodhna Pierce Jun 2018

A Comparison Of The Models And Methods Of Surveillance In East Germany And Northern Ireland And Their Relevance To Modern-Day Securitization Of Society, Cliodhna Pierce

Irish Communication Review

Despite increasing awareness of the rise in societal surveillance as a result of leaks by former NSA whistleblower Edward Snowden and subsequent revelations from Wikileaks, the damage of pervasive surveillance practices on the individual and on communities has yet to be measured. As John Gilliom has argued, ‘until we are able to generate sufficient research to make plausible sense of how differently situated people – welfare mothers, prisoners, students, middle-class professionals – speak of and respond to their various surveillance settings, we will be unable to devise a meaningful account of what surveillance is’ (2006, 126). Before we can examine …

Political Decisions On Police Expenditures: Examining The Potential Relationship Between Political Structure, Police Expenditures And The Volume Of Crime Across Us States, Xavier D. Burch

USF Tampa Graduate Theses and Dissertations

The present study was designed to examine the variations in criminal justice expenditures across states in relation to crime, measures of political party membership, and several control variables that also attempt to explain both property and violent crime. The year, 2009, was chosen for the analysis. Data in the present study were collected by Olugbenga Ajilore (2016) for the year 2009 and supplemented with other state level data. The Ajilore dataset is one of the few datasets that has reliable criminal justice expenditure data across states, which is also disaggregated by type. Criminal justice expenditure data is actually quite difficult …

Does Trade Trump Law In The Protection Of Human Rights? International Trade, Law, And Human Rights In South Africa And South Korea, Cristina Campo

University of Miami International and Comparative Law Review

International relations have become categorically dependent on the sophisticated trading systems that interconnect and empower sovereign states. Thus, a state’s focus on protecting the rights of its individuals comprising and affected by that system would appear to come secondary to the economic decisions involved in conducting trade agreements. This article asks whether the international trade regime can be used to further the protection of human rights or whether such protection should be better left in the hands of legal entities in international bodies and sovereign states. I analyze South Korea and South Africa’s legal and trade regimes—two of the world’s …

Pedagogical Design Research For University Police Uniforms, Brooke Brandewie, Injoo Kim, Myoung-Ok Kim, Robin Engel, Kevin Karpiak

DRS Biennial Conference Series

This paper explores issues and opportunities for new university police officer uniform designs by utilizing a User-Centered Design Methods course as a qualitative pedagogical research approach. As a way of introducing problem-based learning, we brought the uniform redesign project to the junior level class in the School of Design. Since the design brief focused on university police, we viewed this as critical since students are key stakeholders of the uniforms. From the students’ interviews with the officers, key themes were identified about the current uniform items (i.e. hats, shirts, vests, pants, hats, and accessories) among other uniform topics. Findings indicated …

"It's Not Equality": How Race, Class, And Gender Construct The Normative Religious Self Among Female Prisoners, Rachel Ellis Jun 2018

"It's Not Equality": How Race, Class, And Gender Construct The Normative Religious Self Among Female Prisoners, Rachel Ellis

Criminology and Criminal Justice Faculty Works

Prior sociological research has demonstrated that religious selves are gendered. Using the case of female inmates—some of the most disadvantaged Americans—this article shows that dominant messages constructing the religious self are not only gendered, but also deeply intertwined with race and class. Data from 12 months of ethnographic fieldwork on religion inside a U.S. state women’s prison reveal that religious volunteers—predominately middle-class African American women—preached feminine submissiveness and finding a “man of God” to marry to embody religious ideals. However, these messages were largely out of sync with the realities of working class and poor incarcerated women, especially given their …
