Evil Nudges, Michal Lavi Jan 2018

Evil Nudges, Michal Lavi

Vanderbilt Journal of Entertainment & Technology Law

The seminal book Nudge by Richard Thaler and Cass Sunstein demonstrates that policy makers can prod behavioral changes. A nudge is "any aspect of the choice architecture that alters people's behavior in a predictable way without forbidding any options or significantly changing their economic incentives." This type of strategy, and the notion of libertarian paternalism at its base, prompted discussions and objections. Academic literature tends to focus on the positive potential of nudges and neglects to address libertarian paternalism that does not promote the welfare of individuals and third parties, but rather infringes on it-a concept this Article refers to …

Designing Effective Tsunami Messages: Examining The Role Of Short Messages And Fear In Warning Response, Jeannette Sutton, Sarah C. Vos, Michele M. Wood, Monique Turner

Communication Faculty Publications

Although tsunamis have the potential to be extremely destructive, relatively little research on tsunami messaging has taken place. Discovering whether tsunami warning messages can be written in a way that leads to increased protective response is crucial, particularly given the increased use of mobile message services and the role they play in notifying the public of imminent threats such as tsunami and other hazards. The purpose of this study was to examine the possibility of designing warning messages for tsunamis that improve upon message style and content used by public alerting agencies to date and to gain insight that can …

UTA Libraries Staff Publications - Archive

The Queer Omaha Archives (QOA) is an ongoing effort by the University of Nebraska at Omaha Libraries' Archives and Special Collections to collect and preserve Omaha's LGBTQIA+ history. This is still a fairly new initiative at the UNO Libraries, having been launched in June 2016. This blog post is adapted and expanded from a presentation entitled "Show Us Your Omaha: Combatting LGBTQ+ Archival Silences" (https://digitalcommons.unomaha.edu/crisslibfacproc/81/), originally given at the June 2017 Nebraska Library Association College & University Section spring meeting. The QOA was only a year old at that point, and now that another year (plus change) has passed, the …

The Resurgence Of American Nativism In The Early-Twentieth Century And Its Effects On Industrial Hemp Production In The United States, Roman King Jan 2018

The Resurgence Of American Nativism In The Early-Twentieth Century And Its Effects On Industrial Hemp Production In The United States, Roman King

Master's Theses or Doctor of Nursing Practice

Congress passed the Marihuana Tax Act on August 2, 1937, which officially made it illegal to handle any form of Cannabis sativa L. without adhering to mandatory taxes and registration forms. The American cultivation of industrial hemp (fibrous, non-psychoactive C. sativa L.), became non-existent by 1958 due to the strict penalties associated with the 1937 Tax Act. Industrial hemp served as a staple of American life from the arrival of the first English colonists in North America up until the textile conquest of King Cotton in the early-nineteenth century. Despite the rise of cotton and the importation of cheap foreign …

Using a mixed-method online survey, this study focuses on undergraduate college students in Sociology 101 courses at the University of Mississippi. The online survey, which has both quantitative and qualitative elements that assess students' sex education experience, what they remember being taught and what they wish they would have been taught. The results of the study highlight important shortcomings in current sex education programs in the deep south, …

Gender Discrimination In Online Markets, Christopher Anthony Cotropia, Jonathan Masur, David L. Schwartz Jan 2018

Gender Discrimination In Online Markets, Christopher Anthony Cotropia, Jonathan Masur, David L. Schwartz

Public Law and Legal Theory Working Papers

We study whether a seller’s gender impacts the bargained-for price in a product market, specifically baseball cards, as well whether any discrimination that might be present is taste-based or statistically-based. We accomplish this by isolating the seller’s gender using an online transaction on eBay where the buyer is exposed to the seller’s gender by only the seller’s hand and name. We test for differential treatment in two environments: a field experiment, in which we actually sell cards on eBay, and a laboratory experiment, in which we conduct surveys via Amazon Mechanical Turk (MTurk). We find that there is consistent differential …

How Constitutional Norms Break Down, Josh Chafetz, David E. Pozen Jan 2018

How Constitutional Norms Break Down, Josh Chafetz, David E. Pozen

Cornell Law Faculty Publications

From the moment Donald Trump was elected President, critics have anguished over a breakdown in constitutional norms. History demonstrates, however, that constitutional norms are perpetually in flux. The principal source of instability is not that these unwritten rules can be destroyed by politicians who deny their legitimacy, their validity, or their value. Rather, the principal source of instability is that constitutional norms can be decomposed—dynamically interpreted and applied in ways that are held out as compliant but end up limiting their capacity to constrain the conduct of government officials.

This Article calls attention to that latent instability and, in so …

Desistance From Crime Of Serious Juvenile Offenders: Examining The Social And Individual Differences, Lisa Dunkley Jan 2018

Desistance From Crime Of Serious Juvenile Offenders: Examining The Social And Individual Differences, Lisa Dunkley

Theses and Dissertations--Early Childhood, Special Education, and Counselor Education

There is an overrepresentation of youths with disabilities in the juvenile justice system. As a result, each year thousands of juvenile offenders despite of the seriousness of the crimes committed, are released from incarceration with the hopes of living a successful life in society. Despite progressive research on identifying factors associated with desistance, it is still unclear what factors contribute to desistance for serious juvenile offenders and especially those with disabilities. The current study investigated the individual differences (e.g., moral disengagement, motivation to succeed and impulse control) and social factors (e.g., employment, education and maternal warmth) that are important in …

A Phenomenological Study Of The Experiences Of Successful Women In Science Fields, Jonathan Hall Jan 2018

A Phenomenological Study Of The Experiences Of Successful Women In Science Fields, Jonathan Hall

Electronic Theses and Dissertations

Girls and women face several forms of gender-based biases and discrimination in the science community. These issues create difficult circumstances for them to develop positive science identities. Since these difficult circumstances exist, science education and sociology researchers have used a deficit model to learn about their experiences, achievements, and attitudes. Understanding the experiences of successful women in science offers insight into how women can navigate the challenges presented by the science community and how science educators can support them. However, research studies that explore the experiences of successful women in science are scant. Therefore, the objective of this study was …

Location-based real-time dating (LBRTD) apps have become an increasingly common way for people to broaden their social network and meet others for the purposes of dating, friendship, and more. This investigation focused on Tinder, presently the most widely-used LBRTD app. Semi-structured interviews were conducted with twenty-three current and recent Tinder users to gain insight into their self-presentation strategies and impressions of others on the app. The questions concentrated around four major topic areas: use of photos, use of bio text, perception of others, and real or imagined deception. A grounded theory approach was used to frame the data. From this, …

A Generative Model Of The Mutual Escalation Of Anxiety Between Religious Groups, F. Leron Shults, Ross Gore, Wesley J. Wildman, Christopher J. Lynch, Justin E. Lane, Monica D. Toft Jan 2018

A Generative Model Of The Mutual Escalation Of Anxiety Between Religious Groups, F. Leron Shults, Ross Gore, Wesley J. Wildman, Christopher J. Lynch, Justin E. Lane, Monica D. Toft

VMASC Publications

We propose a generative agent-based model of the emergence and escalation of xenophobic anxiety in which individuals from two different religious groups encounter various hazards within an artificial society. The architecture of the model is informed by several empirically validated theories about the role of religion in intergroup conflict. Our results identify some of the conditions and mechanisms that engender the intensification of anxiety within and between religious groups. We define mutually escalating xenophobic anxiety as the increase of the average level of anxiety of the agents in both groups overtime. Trace validation techniques show that the most common conditions …

Gender Differences Among Professional Football Fans: Serious Leisure, Emotional Expressivity, And Cognitive Distortions, Megan E. Wolensky Jan 2018

Gender Differences Among Professional Football Fans: Serious Leisure, Emotional Expressivity, And Cognitive Distortions, Megan E. Wolensky

PCOM Psychology Dissertations

Increasingly, people report that leisure activity gives their lives meaning and significantly contributes to the formation of their personal identities. In fact, many individuals rank leisure activities as essential as work, family, and religion. (Gillespie, Leffler, & Lerner, 2010; Stebbins, 1992). Recent research has demonstrated that leisure involvement provides psychological benefits that contribute to wellbeing for both men and women (Caltabiano, 1995; Kim, Heo, Lee, & Kim, 2015). National Football League (NFL) fandom in the U.S. has been identified as a leisure activity that supersedes traditional gender norms and provides opportunities for family and group involvement. Although fandom has been …

Beyond The Guild: Lawyer Organizations And Law Making, Leslie Levin Jan 2018

Beyond The Guild: Lawyer Organizations And Law Making, Leslie Levin

Faculty Articles and Papers

Lawyers throughout the world seek to influence law, not only through their individual actions, but also through lawyer organizations. As interest groups, these organizations often work to affect not only law, but also the justice system and the workings of government. It is no secret that these organizations sometimes try to block legal change or create new legal rules to promote lawyers' own interests.' Lawyer organizations also work to influence law in ways that will benefit their clients. Yet sometimes lawyers' collective actions reflect broader political concerns rather than their clients' or their own self-interest, such as when thousands of …

The New Law Of The Child, Anne Dailey, Laura A. Rosenbury Jan 2018

The New Law Of The Child, Anne Dailey, Laura A. Rosenbury

Faculty Articles and Papers

This Article sets forth a new paradigm for describing, understanding, and shaping children's relationship to law. The existing legal regime, which we term the "authorities framework;' focuses too narrowly on state and parental control over children, reducing children's interests to those of dependency and the attainment of autonomy. In place of this limited focus, we envision a "new law of the child" that promotes a broader range of children's present and future interests, including children's interests in parental relationships and nonparental relationships with children and other adults; exposure to new ideas; expressions of identity; personal integrity and privacy; and participation …

Associations Of Four Community Factors With Longitudinal Change In Hemoglobin A1c Levels In Patients With Type 2 Diabetes, Elizabeth Durden

Faculty Journal Articles

OBJECTIVE

To evaluate associations of community factors with glycated hemoglobin (HbA1c).

RESEARCH DESIGN AND METHODS

We identified patients with type 2 diabetes who had an HbA1c ‡7.5% (58 mmol/mol) and subsequent HbA1c testing within 90–270 days. We used mixed-effect models to assess whether treatment intensification (TI) and community domains (community socioeconomic deprivation [CSD], food availability, fitness assets, and utilitarian physical activity favorability [quartiled]) were associated with HbA1c change over 6 and 24 months, controlling for demographics, HbA1c, BMI, and time with evidence of type 2 diabetes. We evaluated whether community domains modified associa- tions of TI with HbA1c change using …

Who Drives Diaspora Development? Replication Of Mexico’S 3x1 Program In Yucatán, Elizabeth Durden

Faculty Journal Articles

Migration and remittances are increasingly central to development plans and the search for best practices has driven convergence of diaspora development policies. Mexico is often considered a model, particularly its Tres Por Uno or 3×1 Program that offers matching grants to encourage migrant organizations to sponsor development projects in their origin communities. We employ a policy mobilities framework to ask how this program has been positioned as a model and exported from its original contexts. With replication in other high emigration countries possible, we examine internal replication within Mexico to evaluate the model’s possible external relevance. We focus on its …
