Strategies For Motivating A Multigenerational Workforce, Avon Donnell Cornelius Jan 2018

Strategies For Motivating A Multigenerational Workforce, Avon Donnell Cornelius

Walden Dissertations and Doctoral Studies

The multigenerational workforce creates leadership challenges for business managers, and the members of each generational group have different factors that motivate them. Failure to motivate a multigenerational workforce can lead to decreased productivity, increased absenteeism, high turnover rates, and reduced profits. The purpose of this single case study was to explore the strategies that marketing managers in a Maryland-based marketing firm use to motivate a multigenerational workforce using Maslow's hierarchy of needs theory. The study comprised 7 marketing managers who have experience motivating a multigenerational workforce. The data collection process for this study consisted of semistructured interviews, observation, and member …

Strategies For Reducing Employee Turnover In Retail Outlets, Dewayne Wilson

Walden Dissertations and Doctoral Studies

Employee turnover in the retail industry is costly, difficult, and problematic, affecting organizational wages, benefits, and schedules in relation to serving clients, customers, and stakeholders. The purpose of this multiple case study was to explore effective strategies used by retail store owners in the southeastern region of the United States to reduce employee turnover. The target population was 6 successful business owners of 6 small retail businesses in the southeastern United States who had effectively reduced employee turnover. A Regulatory Classification Of Digital Assets: Toward An Operational Howey Test For Cryptocurrencies, Icos, And Other Digital Assets, M. Todd Henderson Jan 2018

A Regulatory Classification Of Digital Assets: Toward An Operational Howey Test For Cryptocurrencies, Icos, And Other Digital Assets, M. Todd Henderson

Public Law and Legal Theory Working Papers

Digital assets are hot right now. Whether cryptocurrencies, like bitcoin, or initial coin offerings and tokens, this new asset class has captured the imagination of American investors. While it remains to be seen if this phenomenon has staying power, there is no doubt that these assets and their promoters have attracted the attention of the Securities and Exchange Commission. But neither Congress nor the SEC has formally elucidated which digital assets are securities and which are not.

This Article seeks to provide clarity in determining which digital assets are securities. It proposes two tests that operationalize the Supreme Court’s test …

Article Ii And Antidiscrimination Norms, Aziz Z. Huq Jan 2018

Article Ii And Antidiscrimination Norms, Aziz Z. Huq

Public Law and Legal Theory Working Papers

The Supreme Court’s judgment in Trump v. Hawai’i validated a prohibition on entry to the United States from several largely Muslim-majority countries, and at the same time repudiated a longstanding precedent associated with the Japanese-American internment of World War II. This Article closely analyzes the relationship of these twin holdings. It uses their dichotomous valances as a lens onto the legal scope for discriminatory action by the federal executive. Parsing the various ways in which the internment of the 1940s and the 2017 exclusion order can be reconciled, the Article identifies a generative tension between the two holdings. Contrary to …

Gender Discrimination In Online Markets, Christopher Anthony Cotropia, Jonathan S. Masur, David L. Schwartz Jan 2018

Gender Discrimination In Online Markets, Christopher Anthony Cotropia, Jonathan S. Masur, David L. Schwartz

Public Law and Legal Theory Working Papers

We study whether a seller’s gender impacts the bargained-for price in a product market, specifically baseball cards, as well whether any discrimination that might be present is tastebased or statistically-based. We accomplish this by isolating the seller’s gender using an online transaction on eBay where the buyer is exposed to the seller’s gender by only the seller’s hand and name. We test for differential treatment in two environments: a field experiment, in which we actually sell cards on eBay, and a laboratory experiment, in which we conduct surveys via Amazon Mechanical Turk (MTurk). We find that there is consistent differential …

Criminal Justice, Inc., John Rappaport Jan 2018

Criminal Justice, Inc., John Rappaport

Public Law and Legal Theory Working Papers

In the past decade, major retailers nationwide have begun to employ a private, for-profit system to settle criminal disputes, extracting payment from shoplifting suspects in exchange for a promise not to call the police. This Article examines what retailers’ decisions reveal about our public system of criminal justice and the concerns of the agents who run it, the victims who rely on it, and the suspects whose lives it alters. The private policing of commercial spaces is well known, as is private incarceration of convicted offenders. This Article is the first, however, to document how industry has penetrated new parts …

The History Of Japanese Racism, Japanese American Redress, And The Dangers Associated With Government Regulation Of Hate Speech, Hiroshi Fukurai, Alice Yang

UC Law Constitutional Quarterly

This Article analyzes the historical roots of the Japanese government's rhetoric of racial supremacy that merged with nationalist agendas to rationalize and promote Japanese colonial aggression, military ventures, and brutal rule in Asia in the first half of the twentieth century. Next, this Article examines the movement in the U.S. to obtain redress for Japanese Americans who suffered mass removal and incarceration during World War II. This Article explores why grassroots activism and political lobbying succeeded in obtaining the passage of American redress legislation in 1988 and the possible lessons of this campaign for other victims of government policies. Finally, …

Racial Media Framing Of Riots And Protests: A Constructionist View, Vanessa Pruitt Jan 2018

Racial Media Framing Of Riots And Protests: A Constructionist View, Vanessa Pruitt

Undergraduate Research Journal

Protests are one way in which minority groups, lacking representation or access to policy making to change their situation, bring attention to social justice issues deeply affecting them. However, although protests are generally an attempt to gain media attention, the media are often unsympathetic to the causes underlying the protests which they support. To the contrary, media tend to discredit these social movements and apply their own agenda to their reporting through a process called framing. Framing is rooted in the theory of social constructionism, wherein the media play a role in constructing our shared social reality. The way most …

The Global Diffusion Of U.S. Legal Thought: Changing Influence, National Security, And Legal Education In Crisis, Fernanda Giorgia Nicola Dr. Jan 2018

The Global Diffusion Of U.S. Legal Thought: Changing Influence, National Security, And Legal Education In Crisis, Fernanda Giorgia Nicola Dr.

Contributions to Books

During the twentieth century, the center of production of legal ideas shifted from France to Germany and then to the United States. Here, the dominant legal reasoning framed the law as a phenomenon of social organization that was not confined to a specific legal system. There were both external and internal factors influencing U.S. legal thought which explain this change of wind from continental Europe to the United States. Externally, after World War II the United States garnered influence by positioning itself for political and economic global leadership. Internally, the critique of social purpose functionalism articulated by the legal realists …

Measurement Equivalence Of English Versus Native Language Versions Of The Kessler 6 (K6) Scale: An Examination In Three Asian American Groups, Yuri Jang, Daniel A. Powers, Hyunwoo Yoon, Min-Kyoung Rhee, Nan Sook Park, David A. Chiriboga Jan 2018

Chiriboga

Social Work Faculty Publications

The use of languages other than English in population-based surveys is necessitated by the linguistic diversities in the United States. However, inclusion of multiple languages in survey data collection raises concerns about whether an instrument administered in different languages functions equivalently across groups. Using the Kessler Psychological Distress Scale 6 (K6), the present study examined differential item functioning (DIF) between surveys conducted either in English or the native language of the groups of Chinese Americans (n = 622), Korean Americans (n = 471), and Vietnamese Americans (n = 513). DIF analyses using a series of multiple-indicator multiple-cause models showed that …

Investigating Chronic Pain As An In-Group Using The Prisoner’S Dilemma, Tracy W. Brown, Cristian M. Botello, Amber L. Harris Bozer Jan 2018

Investigating Chronic Pain As An In-Group Using The Prisoner’S Dilemma, Tracy W. Brown, Cristian M. Botello, Amber L. Harris Bozer

Modern Psychological Studies

Kinship is a strong predictor of altruism. However, chronic pain is a homeostatic threat to survival that creates a social in-group which we predicted would result in increased altruism over and above kinship, because it is driven by shared empathy. Participants included 139 individuals that were divided into a chronic pain or control group. Participants completed six Prisoner’s Dilemma scenarios with a sibling or chronic pain accomplice. Pain altruism and sibling altruism scores were calculated based on decisions to cooperate with or defect on an accomplice. A mixed ANOVA revealed that there were no significant differences between groups. The marginal …

Crisis And Reorganization In Urban Dynamics: The Barcelona, Spain, Case Study, Rafael De Balanzó Joue, Nuria Rodriguez-Planas Jan 2018

Crisis And Reorganization In Urban Dynamics: The Barcelona, Spain, Case Study, Rafael De Balanzó Joue, Nuria Rodriguez-Planas

Publications and Research

We use adaptive cycle theory to improve the understanding of cycles of urban change in the city of Barcelona, Spain, from 1953 to 2016. More specifically, we explore the vulnerabilities and windows of opportunity these cycles of change introduced in the release (Ω) and reorganization (α) phases. In the two recurring cycles of urban change analyzed (before and after 1979), we observe two complementary loops. During the front loop, financial and natural resources are efficiently exploited by homogenous dominant groups (private developers, the bourgeoisie, politicians, technocrats) with the objective of promoting capital accumulation based on private (or private-public partnership) investments. …

Understanding The Academic Motivations Of Students With A History Of Reading Difficulties: An Expectancy-Value-Cost Approach, Bradley W. Bergey, Rauno Parrila, S. Hélène Deacon Jan 2018

Understanding The Academic Motivations Of Students With A History Of Reading Difficulties: An Expectancy-Value-Cost Approach, Bradley W. Bergey, Rauno Parrila, S. Hélène Deacon

Publications and Research

We examined the academic self-efficacy, positive subjective task values, and perceived effort costs of first-year undergraduates with (n = 168) and without (n = 314) a self-reported history of reading difficulty, and further their relations with academic achievement and satisfaction. Students with a self-reported history of reading difficulty described lower academic self-efficacy, earned lower grades, and accrued fewer credits. The groups did not differ significantly in their positive task values, effort costs, academic satisfaction, or institutional retention. Path analyses indicated that for both groups, academic self-efficacy and effort costs were predictive of first-year academic performance while intrinsic value was predictive …

Intellectual Property Channeling For Digital Works, Lucas S. Osborn Jan 2018

Intellectual Property Channeling For Digital Works, Lucas S. Osborn

Scholarly Works

Market economies are based on free competition, which can include copying. Yet intellectual property protection in the United States prohibits copying in certain circumstances to incentivize innovation and creativity. New breeds of digital works are challenging our historical application of intellectual property law. These include certain categories of software programs as well as digital manufacturing files. These new works look deceptively like works from a previous era and thus, courts might languorously treat them as they have older works. This would be a mistake. This Article analyzes these works in terms of existing intellectual property doctrine and constructs a normative …

Explaining Homegrown Western Jihadists: The Importance Of Western Foreign Policy, Clark R. Mccauley Jan 2018

Explaining Homegrown Western Jihadists: The Importance Of Western Foreign Policy, Clark R. Mccauley

Psychology Faculty Research and Scholarship

In both the United States and Europe, explanations of homegrown radicalization emphasize the power of Salafi-jihadist ideology and Muslim experiences of discrimination and socioeconomic deprivation in Western countries. Polls of U.S. and European Muslims, and case histories of jihadist plots for attacks in the United States, indicate that another source of homegrown radicalization is Western foreign policy, especially Western interventions in predominantly Muslim countries. Poll results support a two-factor model in which seeing the war on terrorism as a war on Islam is predicted by both perceived discrimination and grievance related to Western foreign policy. Consistent with this model, UK …
