Palsgraf V. Long Island R.R.: Its Historical Context, Wiiliam E. Nelson

Faculty Articles

One of the most important opinions that Benjamin Cardozo ever wrote was Palsgraf v. Long Island R.R. Unfortunately, the opinion often is misunderstood. By placing the Palsgraf decision in its historical context, this article seeks to show what Chief Judge Cardozo believed his opinion meant and what impact it had over time.

Gender, Parasocial Interaction, And Nonverbal Communication: Testing The Visual Effect Of Sports Magazine Cover Models, Ben Wasike Jan 2018

Gender, Parasocial Interaction, And Nonverbal Communication: Testing The Visual Effect Of Sports Magazine Cover Models, Ben Wasike

Communication Faculty Publications

An experiment examined gender, parasocial interaction, and nonverbal communication regarding sports magazine cover models. Results indicate that a correlation exists among parasocial interaction, nonverbal communication, and gender, with female cover models eliciting larger effects on test subjects. However, gender did not correlate with parasocial interaction or nonverbal communication among the test subjects, contradicting extant literature. Also, the parasocial interaction and nonverbal communication measurement scales positively correlated. In conclusion, static images are reliable experimental stimuli for parasocial interaction studies and nonverbal measurement scales, and sports magazines are better served by featuring more women.

Prostitution And Public Policy. The Nordic Model Versus The Pimping Of Prostitution, Christopher A. Bagley Jan 2018

Prostitution And Public Policy. The Nordic Model Versus The Pimping Of Prostitution, Christopher A. Bagley

Dignity: A Journal of Analysis of Exploitation and Violence

In this review of recent books on public policy and prostitution, Julie Bindel’s The Pimping of Prostitution is sympathetically reviewed. Her thesis, that the libertarian movement seeking to remove prostitution from legal and public policy spheres has done grave harm to the lives of boys, girls and women, is elaborated by quotations from her chapters. This book is an important resource for those who campaign for the rights of women and children to be free of commercial sexual exploitation. The reviewer offers a critical realist perspective on Bindel’s work, in advocating that future scholars should use her extensive research for …

Evaluating The Social And Technological Benefits Of An Intergenerational Program For Older Adults, Itza Serrano Jan 2018

Evaluating The Social And Technological Benefits Of An Intergenerational Program For Older Adults, Itza Serrano

Open Access Master's Theses

Intergenerational programs are on the rise. While studies have shown benefits to participation in these programs, most of the research has been focused on students and less on older adult outcomes (see Andreoletti & Howard, 2016 for a review). Currently, the University of Rhode Island (URI) is host to the Engaging Generations: Cyber-Seniors Program, which connects older adults with undergraduate technology mentors. The aim of this study was to evaluate the outcomes of intergenerational programming participation for older adults related to social isolation, loneliness, social engagement, and digital competency, as measured by the pre/post surveys given to participants. SPSS software …

Neutral Ground Or Battleground? Hidden History, Tourism, And Spatial (In)Justice In The New Orleans French Quarter, Lynnell L. Thomas Jan 2018

Neutral Ground Or Battleground? Hidden History, Tourism, And Spatial (In)Justice In The New Orleans French Quarter, Lynnell L. Thomas

American Studies Faculty Publication Series

In 2017, the city of New Orleans removed four monuments that paid homage to the city’s Confederate past. The removal came after contentious public debate and decades of intermittent grassroots protests. Despite the public process, details about the removal were closely guarded in the wake of death threats, vandalism, lawsuits, and organized resistance by monument supporters. Workers hired to dismantle the monuments did so surreptitiously under the cloak of darkness, protected by a heavy police presence, with their faces covered to conceal their identities. The divisiveness of this debate and the removal lay bare the contestation over public space, historical …

Assessing K12 Online Teachers Knowledge Of Online Student Identities And Characteristics, Brianne L. Jackson

Theses and Dissertations

As K12 online learning continues to grow across the nation, the population of online students, much like the population of face-to face students, continues to change. As the online student population becomes increasingly diverse, not only in terms of race, but in terms of religion, sexual orientation and socioeconomic status, research must be undertaken to assess the level of preparation that K12 online teachers have in terms of teaching this population. This dissertation intends to serve as a baseline analysis, providing information on K12 online teachers' knowledge of the types of student characteristics and identities that may be present in …

Finding Homeplace: Exploring The Experiences Of Black Women In The City Of Richmond, Mariah Williams Jan 2018

Finding Homeplace: Exploring The Experiences Of Black Women In The City Of Richmond, Mariah Williams

Theses and Dissertations

The planning efforts of African-Americans in the United States remained largely hidden throughout much of early planning history. Although African-Americans engaged in unique planning practices of their own, ones that significantly shaped the social and economic fabric within their communities, planning literature has tended to problematize them within the urban environment instead of celebrating their unique differences and experiences. Black women, despite their significant contributions to the urban fabric of numerous American cities, remain even more silenced throughout the planning profession. The unique ways they experience the urban environment, what they value in the built environment and how they speak …

No Laughing Matter: Failures Of Satire During The 2016 Presidential Election, Jamie Noelle Smith Jan 2018

No Laughing Matter: Failures Of Satire During The 2016 Presidential Election, Jamie Noelle Smith

Honors Theses and Capstones

The 2016 presidential election was so full of unusual characters and unprecedented scandals, that media outlets, from the nightly news to late-night, had to adjust to this new normal in politics. Indeed, not even the jokesters on the handful of political satire shows on television were immune to the necessary changes that all the media had to take in covering Donald Trump. Given how many people tuned into to these shows each week, it is no surprise that the role that political satire television may have played in the election results was fodder for those giving post-election hot takes. Many …

Sports Celebrity Influence On The Behavioral Intentions Of Generation Z, Kayla M. Farren

Honors Theses and Capstones

The research is to determine what the effects, if any, professional athlete endorsers or spokespersons have on the generation Z cohort. There is a relative lack of published research that investigated the influence sport celebrity endorsers had on generation Z. This study primarily focused on the exploration of the role sports celebrities play as vicarious role models for members of generation, as well as touched upon whether sports celebrity endorsers affected generation Z’s behavioral intentions. In addition, the influence sports celebrity endorsers had on females in comparison to males was also studied. It was found that sports celebrity spokespersons or …

Preferences For Local And Organic Food: A Comparison Of New Hampshire And Vermont, Victoria Smith Lorvig Jan 2018

Preferences For Local And Organic Food: A Comparison Of New Hampshire And Vermont, Victoria Smith Lorvig

Honors Theses and Capstones

Annies bunnies or Kraft elbows? Supermarket or farmers market? Organic and local foods have been on the rise in the global market since the new millennium began (Darnhofer, 2010: 68, Schupp, 2016: 319). The growth in organic is attributed to consumers wanting their food to be healthier and more environmentally friendly (Aschemann-Witzel et. Al, 2017: 211, Van Doorn et. A, 2011: 167). The appeals of local foods are similar, plus the added component of boosting the local economy and building community (Hempel & Hamm, 2016: 732). Income is not the only factor affecting preferences and willingness to pay (WTP). Actors …

Through studying banlieues , their structures and influence on the individual, this paper will prove physical and structural policies perpetuate racial and economic disenfranchisement in France. In the following sections this paper will briefly inform the reader of France’s current racial climate, and how the most negative eruptions of civil unrest grow in the banlieues , while also commenting on literature surrounding France’s societal and political climate and scholarly work focused on relations studies. The Consensus Myth In Criminal Justice Reform, Benjamin Levin Jan 2018

The Consensus Myth In Criminal Justice Reform, Benjamin Levin

Michigan Law Review

It has become popular to identify a “consensus” on criminal justice reform, but how deep is that consensus, actually? This Article argues that the purported consensus is much more limited than it initially appears. Despite shared reformist vocabulary, the consensus rests on distinct critiques that identify different flaws and justify distinct policy solutions. The underlying disagreements transcend traditional left/right political divides and speak to deeper disputes about the state and the role of criminal law in society.

The Article maps two prevailing, but fundamentally distinct, critiques of criminal law: (1) the quantitative approach (what I call the “over” frame); and …

The Unifying And Divisive Effects Of Social Identities: Religious And Ethnopolitical Identities Among Mindanao Muslims In The Philippines, Ma. Elizabeth J. Macapagal, Jose Jowel P. Canuday, Cristina J. Montiel Jan 2018

The Unifying And Divisive Effects Of Social Identities: Religious And Ethnopolitical Identities Among Mindanao Muslims In The Philippines, Ma. Elizabeth J. Macapagal, Jose Jowel P. Canuday, Cristina J. Montiel

Psychology Department Faculty Publications

The present study looks into the unifying and divisive effects of ethnopolitical and religious social identities, and an emerging superordinate Bangsamoro identity of Muslims in the southern region of the Philippines. We surveyed 394 Muslims with a mean age of 32.6 and standard deviation of 13.3 from the Tausug, Maranao, and Maguindanaoan ethnopolitical affiliations using various measures of social identities. Findings showed that the Muslims in our sample identify themselves more strongly with their religious identity over their ethnopolitical affiliations. Religious identity may thus be a unifying element in the conflict-ridden context of Mindanao, as a significant correlation was also …

Gentrifried: The Foodways Of Neoliberal Urban Redevelopment In St. Louis, Elizabeth Schwartz Jan 2018

Gentrifried: The Foodways Of Neoliberal Urban Redevelopment In St. Louis, Elizabeth Schwartz

Dean James E. McLeod Freshman Writing Prize

Settler-invader colonialism is a type of colonization in which the colonizer displaces those indigenous to the region and then settles in the area, claiming it as their own. In their paper on settler-invader colonies, Johnston and Lawson argue: A key element in settler postcolonial theory is an examination of the processes by which emigrant European settlers ‘displaced’ the indigenous occupants. This displacement took many different forms. It was physical, geographical, spiritual, cultural, and symbolic. Indigenous peoples were characteristically moved from their traditional lands onto less desirable tracts of country…the displacement was, almost as importantly, cultural and symbolic as well as …

Queer As Folklore: How Fun Home Destabilizes The Metronormative Myth, Grace Macarthur Jan 2018

Queer As Folklore: How Fun Home Destabilizes The Metronormative Myth, Grace Macarthur

Dean James E. McLeod Freshman Writing Prize

Imagine a queer person. Imagine what they look like and how they move through space. Now imagine the spaces they move through: where they work, where they go, and where they live. You are constructing a queer geography around your individual, who likely moves through crowded streets, coffee shops, concerts, and dark bars illuminated by weak neon. Our communal conceptualization of queer experience in modern-day America, especially as recorded in queer media, skews heavily towards urban geographies. The constituent “imaginative processes associated with gay migration from rural and suburban areas to cities” (Weston 256) continually construct and reinforce a hegemonic …

Experiences Of Women Stem Professors Who Are Considering Leadership Positions At Research Universities, Cheri Liebow Jan 2018

Experiences Of Women Stem Professors Who Are Considering Leadership Positions At Research Universities, Cheri Liebow

Doctoral Dissertations

Empirical evidence is needed to discern the reasons for inequities among those with doctorates hired in science, technology, engineering, and mathematics (STEM) fields. It is necessary to create a successful and motivational atmosphere for various types of female leaders who are seeking opportunities to become leaders, especially in STEM fields. This qualitative-method study used an exploratory design. The study first sought to gather information about female STEM professors’ experiences through open-ended qualitative interviews to explain gaps in details of women’s experiences as professors in STEM departments of universities. Second, the researcher sought to discern common themes in interview responses for …

Examining The Impact And Influence Of The Leisure Science Literature, Mat D. Duerden, Michael B. Edwards, Michael C. Goates, Justin Dyer Jan 2018

Examining The Impact And Influence Of The Leisure Science Literature, Mat D. Duerden, Michael B. Edwards, Michael C. Goates, Justin Dyer

Faculty Publications

This study explored the impact and influence of the leisure sciences literature through an analysis of highly cited articles. Discriminant function analysis identified whether articles had more exclusive impact inside or outside the field. Research themes and methodologies were examined based on these classifications. Results indicate articles with the greatest impact within the leisure literature tended to be quantitative studies drawing upon survey data and non-experimental designs focused on general leisure and outdoor/forest recreation. Articles with the greatest impact outside the leisure literature were more recent and focused on place attachment, psychological motivation, or community parks and recreation and used …

Sanctifcation And Cheating Among Emerging Adults, Scott Braithwaite, Paige Mcallister, Elena Henderson, Meghan Maddock, Krista Dowdle, Frank D. Fincham

Faculty Publications

Cheating—a general term for extradyadic romantic or sexual behavior that violates expectations in a committed romantic relationship—is common and leads to a number of poor outcomes. Religion has historically infuenced conceptions of romantic relationships, but societal attitudes about religion are in fux as many seek to retain spirituality even as afliations with formal religion decrease. The present study evaluated a potential predictor of cheating that is more spiritual than formally religious, the “psychospiritual” concept of relationship sanctifcation (i.e., the idea that one’s relationship itself is sacred). In a sample of college students in committed relationships (N=716), we found that higher …

Garagecraft: Tinkering In The American Garage, Katherine Erica Mcfadden Jan 2018

Garagecraft: Tinkering In The American Garage, Katherine Erica Mcfadden

Theses and Dissertations

The American garage, whether in the home or larger, communal ventures, has been a site of technological crafting for a variety of people across the twentieth and twenty-first centuries. The garage has been a space in which to both reaffirm the status quo of masculinity, and to discover feminist modes of self sufficiency. It has provided a place to play, experiment, commercialize technology, while also providing a space to create new identities and communal standards. What we make and how we make it is, in the end, more about crafting ourselves than crafting objects.

The Leap In Place: Rethinking Key Concepts In The History Of Composition And The Return Of Lore., David Stubblefield Jan 2018

The Leap In Place: Rethinking Key Concepts In The History Of Composition And The Return Of Lore., David Stubblefield

Theses and Dissertations

This dissertation attempts to affirm a key set of practical terms in order to guide Composition Pedagogy. These terms include error, language, voice, teacher neutrality, and rationality. In recent years, many of these terms have been discredited theoretically; however, they remain dominant in textbooks and in our actual teaching practice. The result has been a significant divide between theory and practice, resulting in a cognitive dissonance between our classroom activities and our scholarly activity. However, by presenting each of these terms as dynamic and performative, this dissertation invites the field to find productive practical possibilities inside of them. Moreover, the …

Fatal Force: A Conversation With Journalists Who Cover Deadly, Highly-Publicized Police Shootings, Denetra Walker

Theses and Dissertations

After the emergence of the Black Lives Matter movement following the deaths of unarmed Black teens Trayvon Martin and Michael Brown, news about police shootings catapulted into the local and national spotlight through videos and messages on social media. Information about police shootings is usually reported to the public through media sources such as television, online/digital news, and social media. This study examines how television news journalists cover the issue of police shootings in the United States. Through 10 in-depth interviews with television journalists who covered highly-publicized police shootings, the author analyzes how race, journalistic norms, technology, and citizen journalists …

Black Power And Neighborhood Organizing In Minneapolis, Minnesota: The Way Community Center, 1966-1971, Sarah Jayne Paulsen Jan 2018

Black Power And Neighborhood Organizing In Minneapolis, Minnesota: The Way Community Center, 1966-1971, Sarah Jayne Paulsen

Theses and Dissertations

The Way Opportunities Unlimited, Inc. was a non-‐profit community center that operated from 1966—1984 in Minneapolis, Minnesota. Inspired by the national black power movement that arose in the 1960s, this community center led a local movement for African American equality. This thesis investigates The Way as a unique example of how black power ideology was implemented at the local level, in a city with a statistically small black population, presenting a northern urban context often overlooked by historians. The Way offered a space where aspiring young black musicians could perform, including Prince.

Male Gender Equality Ideology, Empathy, And Prosocial Bystanding Behaviors And Intentions: A Path To Intimate Partner Violence Prevention On College Campuses, Virginia Diane Woodbrown Jan 2018

Male Gender Equality Ideology, Empathy, And Prosocial Bystanding Behaviors And Intentions: A Path To Intimate Partner Violence Prevention On College Campuses, Virginia Diane Woodbrown

Theses and Dissertations

Objective: The importance of involving young college males as prosocial bystanders who will step in to stop sexual violence on college campuses is acknowledged as an important next step in reducing violence against women. However, research revealing which factors influence males to become engaged in this way is nascent. Prior research designed to uncover which factors lead people to step in as prosocial bystanders has primarily focused on situational factors rather than personal characteristics, and has not explored males in the context of intimate partner violence (IPV) more specifically. Method: Survey data from 1,455 male participants, ages 18 through 25, …

A Divisive Community: Race, Nation, And Loyalty In Santo Domingo, 1822 – 1844, Antony Wayne Keane-Dawes Jan 2018

A Divisive Community: Race, Nation, And Loyalty In Santo Domingo, 1822 – 1844, Antony Wayne Keane-Dawes

Theses and Dissertations

On 8 February 1822, Haitian President Jean-Pierre Boyer entered Santo Domingo and ended the short-lived experiment of a moderate republic and the triumph of a popular and radical vision of nationhood. For the next two decades, this unified Haitian Republic faced the scrutiny of Spanish, French, and British slave empires, fueled by the accounts and reports of those Dominicans who rejected this change in events. Using government correspondences, reports, pamphlets, and proclamations, this study argues that the Haitian Unification affected Dominican political allegiances and drove white elites to support Spanish monarchy in contrast to those in Santo Domingo who supported …
