Atrocities By Corporate Actors: A Historical Perspective, Michael J. Kelly
Atrocities By Corporate Actors: A Historical Perspective, Michael J. Kelly
Case Western Reserve Journal of International Law
The article focuses on developments in international criminal law in addressing corporate human rights violations.
Liberals Vs Romantics: Challenges Of An Emerging Corporate International Criminal Law, Carsten Stahn
Liberals Vs Romantics: Challenges Of An Emerging Corporate International Criminal Law, Carsten Stahn
Case Western Reserve Journal of International Law
Holding bystanders and corporate agents accountable for international crimes is often at the periphery of international criminal justice. Based on its liberal foundations, international criminal law has traditionally been strongly centered on individual agency. In the industrialist cases after World War II, individual criminal responsibility was used to demonstrate and sanction corporate involvement in crime. Ideas of corporate criminal responsibility have been voiced in the post-war era and in the context of the negotiations of the Statute. In recent years, they have witnessed a renaissance in several contexts: the jurisprudence of the Special Tribunal for Lebanon, the Malabo Protocol of …

Financial Infidelity In Couple Relationships, Michelle M. Jeanfreau, Kenji Noguchi, Michael D. Mong, Hans Stadthagen-Gonzalez
Faculty Publications
Four hundred and fourteen participants answered questions regarding financial habits within the context of the couple relationship. The Big Five Personality Inventory and a Martial and Life Satisfaction Scale were used to determine the incidence and factors associated with financial infidelity. Results indicated that 27% of participants have kept a financial secret from their partner. Furthermore, both marital and life satisfaction were lower for participants who have experienced financial infidelity than in those who have not. Finally, conscientiousness, a factor from the Big Five Personality Inventory, showed a significant difference, suggesting that more organized individuals were less likely to keep …

Understanding The Structure And Resilience Of Trophic Dynamics In The Northern Gulf Of Mexico Using Network Analysis, Megumi C. Oshima, Robert T. Leaf
Faculty Publications
Network analysis is a framework that allows integration and evaluation of predator-prey interactions. In the present study, we synthesized diet composition information from 94 published studies (n = 12,335 unique predator-prey interactions) that reported food habits of teleost fishes in the northern Gulf of Mexico (nGOM). Using this information, we constructed 12 weighted trophic network models using three diet metrics and four levels of taxonomic resolution of predators and prey. We evaluated network resilience to simulated random and directed taxa loss by assessing changes in topological indices "complexity," "connectance," "efficiency," and "robustness" with respect to a priori minima. We found …
Evaluation Of A Flipped Classroom On Student Achievement In A Low Income School District, Michael Yeoman
Evaluation Of A Flipped Classroom On Student Achievement In A Low Income School District, Michael Yeoman
Graduate Research Papers
This purpose of this research is to determine whether using a flipped classroom is as effective for students in low-income schools as it is for students in wealthy school districts. A review of the literature is performed to determine what is the underlying philosophy of using a flipped classroom as well as determining barriers that may inhibit its effectiveness.
Control and treatment groups were determined so that data could be compared between a “traditional” classroom and a “flipped” classroom. The students in the treatment group were given a Pre-Unit Survey to determine a baseline of their perceptions of flipped learning. …

Three institutes ITT, ITB and DIT explored the benefits of collaborating and seeking designation as a technological university for Dublin following the publication of the Hunt Report in 2011. A high-level steering group was formed that would guide the alliance partners towards the goal of Technological University for Dublin. Support teams and working groups were set up to draw on the expertise of staff from across the 3 institutes. One workshop was set up to discuss the development of a teaching, learning and assessment strategy for a technological university. Further research carried out into the creation of a teaching, learning …
Digitization Of The World: A Phenomenology Of Digitization, Thomas C. Adolphs
Digitization Of The World: A Phenomenology Of Digitization, Thomas C. Adolphs
Dissertations, Master's Theses and Master's Reports
The dissertation analyzes digitization through a phenomenological lens, understanding the digitization as an “outgrowth” of a potential that was always already latent within our being as the human-being. The analysis primarily utilizes the philosophic work of the 20th century philosophers, Martin Heidegger and Maurice Merleau-Ponty.
Through their philosophies, I seek to synthesize Heidegger’s concept of de-severance with Merleau-Ponty’s concepts of embodiment and the world as possessing depth. In doing so, I bring these theoretical concepts together to build a phenomenological “picture” of how it is that the digitization of the world came into being. All the while, my ultimate …
Wisconsin Non-Industrial Private Forest Landowners And Wood-Based Bioenergy, Jennifer L. Dunn
Wisconsin Non-Industrial Private Forest Landowners And Wood-Based Bioenergy, Jennifer L. Dunn
Dissertations, Master's Theses and Master's Reports
Wood-based bioelectricity production is expanding due to its ability to reduce greenhouse gas emissions compared to conventional fossil fuel resources. U.S. non-industrial private forest landowners (NIPFs) are key to the production of wood-based bioelectricity since they own 59% of the forestland in the country that could supply bioelectricity feedstocks (The National Association of State Foresters 2018). This is particularly important in states like Wisconsin with a mandatory renewable portfolio electricity standard (RPS). My dissertation focuses on issues around Wisconsin bioelectricity production including related NIPF views and the creation of the state’s sustainable biomass harvesting guidelines. In Chapter Two, I present …
Detection And Determination Of Food Residues In Native American Pottery, Katherine A. Plotzke
Detection And Determination Of Food Residues In Native American Pottery, Katherine A. Plotzke
Honors Program Theses
The purpose of this research was to develop a new method of analyzing organic residues left on Native American pottery using linear Raman spectroscopy. Native American pottery was replicated using terra cotta and maple syrup was boiled in each of the pots using boiling stones. The pottery shards were then analyzed using Raman spectroscopy. Shards of pottery with maple syrup residue were compared to the standards and the syrup residue was not only detected, but also matched to compounds in the instrument library. Typically, the study of Native American pottery has been done in a variety of different ways, many …
Is It Morally Permissible To Have Children, Awinyandji W. Djebou
Is It Morally Permissible To Have Children, Awinyandji W. Djebou
Theses and Dissertations
Having children is something that has always been considered morally good. Generations and generations of human beings have been raised with the idea that procreating is part of the natural processes of life. To have a child is often considered an important milestone in a person’s life most societies. In fact, it is expected of any well-rounded adult. However, in recent years, some philosophers have argued against the moral permissibility of having children. In this thesis I aim to end the debate on the morality of procreation. I will argue that it is morally permissible to have children, but only …

Repetitive questioning is a major problem for caregivers, particularly taxing if they are unable to recognize and understand the reasons why their loved one keeps asking the same question over and over again. Caregivers may be tempted to believe that the patient does not even try to remember the answer given or is just getting obnoxious. This is incorrect. Repetitive questioning is due to the underlying disease: The patient’s short term memory is impaired and he is unable to register, encode, retain and retrieve the answer. If he is concerned about a particular topic, he will keep asking the same …

Insomnia And Mild Cognitive Impairment, Ronald C. Hamdy, Amber Kinser, Kara Dickerson, C Kendall-Wilson, Audrey Depelteau, Rebecca Copeland, Kathleen Whalen
ETSU Faculty Works
Insomnia is a common problem in older people, especially in patients with mild cognitive impairment (MCI) whose circadian rhythm is often compromised. Insomnia exerts such a toll on caregivers that it is frequently the primary reason for seeking to institutionalize their loved ones. Three different types of insomnia are recognized: sleep-onset or initial insomnia, sleep maintenance or middle insomnia, and early morning awakening or late insomnia. Nocturnal hypoglycemia, as a cause of middle insomnia, is the main focus of this case study. Other types of insomnia are also briefly reviewed. The management of insomnia is then discussed including sleep hygiene, …

Impulsive, Disinhibited Behavior—Dining In A Restaurant, Ronald C. Hamdy, Amber Kinser, Tracey Kendall-Wilson, Audrey Depelteau, Kathleen Whalen
ETSU Faculty Works
Dining in a restaurant with a loved one who has dementia can be an ordeal, especially if the expectations of the caregiver do not match those of the patient and the restaurant environment is not suitable for patients with dementia. The size of the dining area, lighting, background music or noise, décor of the room, number of customers, variety of the items on the menu, number of plates and cutlery on the table, in addition to flowers, candles, and other decorations on the table are all potent distractors. There are so many stimuli; the patient can be overwhelmed with information …

Visual Hallucinations And Paranoid Delusions, Ronald C. Hamdy, Amber Kinser, Tracey Kendall-Wilson, Audrey Depelteau, Rebecca Copeland, Kathleen Whalen, J. Culp
ETSU Faculty Works
Visual well-formed hallucinations, fluctuations in the level of cognition, and alertness and extrapyramidal signs are core features of dementia with Lewy bodies. Some patients realize that what they are seeing or hearing are just hallucinations and learn to accept them. Others, however experience these hallucinations as quite real and cannot be dissuaded from the firm belief that they are. In fact, efforts to dissuade them often serve only to confirm the often associated paranoid delusions and this may lead to a catastrophic ending. Hence, it is best not to contradict the patient. Instead, attempts should be made to distract the …

Driving And Patients With Dementia, Ronald C. Hamdy, Amber Kinser, Tracey Kendall-Wilson, Audrey Depelteau, K. Whalen, J. Culp

Driving is a symbol of autonomy and independence, eagerly awaited during adolescence, cherished during adulthood and reluctantly rescinded during old age. It is nevertheless an individual’s privilege, not right, especially as driving may affect other drivers and pedestrians on the road. It is therefore not only the individual patient who is at stake but essentially the entire community. In this case scenario, we describe the situation that arose when a patient with multi-infarct dementia wanted to go for a drive and his son and grandson tried to convince him that he could no longer drive. What went wrong in the …

Although patterns of African American and white women breast cancer incidence and mortality in St. Louis, Missouri is consistent with those seen elsewhere in the United States, rates vary greatly across zip codes within the city of St. Louis. North St. Louis, whose neighborhoods are primarily African American, exhibits rates of breast cancer mortality that are among the highest in the city and higher than the state as a whole. Based on information that up to 50% of women in North St. Louis with a suspicious diagnosis of breast cancer never enter treatment, we conducted three 2-hour group model building …

There is NO more traditional library function for instruction librarians than teaching information literacy. Without sacrificing expected librarian services such as demonstrating searching and citation management, the Association of College and Research Libraries (ACRL) Framework for Information Literacy in Higher Education allows us to orient students with a high-level, integrated view of how the seemingly disparate pieces and requirements of graduate research form an integrated whole.
Atheism As A Concealable Stigmatized Identity: Outness, Anticipated Stigma, And Well-Being, Dena M. Abbott, Debra Mollen
Atheism As A Concealable Stigmatized Identity: Outness, Anticipated Stigma, And Well-Being, Dena M. Abbott, Debra Mollen
Department of Educational Psychology: Faculty Publications
In a preliminary exploration of atheists using a concealable stigmatized identity framework, we investigated outness, identity magnitude, anticipated stigma, and psychological and physical well-being. Atheists (N = 1,024) in the United States, completed measures of outness, atheist identity magnitude, anticipated stigma, and psychological and physical well-being online. Consistent with predictions, we found small but significant associations between (a) anticipated stigma and well-being, (b) social components of atheist identity magnitude and outness as well as well-being, and (c) outness and well-being. A significant and moderate association was found between anticipated stigma and outness. There were significant, small indirect effects of …
The Minority Anti-Hero: Race And Behavioral Justification In Power, Claudia Hernandez
The Minority Anti-Hero: Race And Behavioral Justification In Power, Claudia Hernandez
Scripps Senior Theses
This thesis explores the minority anti-hero on television as it relates to concepts of race and behavioral justification. Previous studies have addressed the ways in which whiteness functions advantageously for popular criminal anti-heroes on television, yet little is known regarding the effects of race for similar characters of color. I hypothesized that accessibility of the criminal stereotype does not allow men of color to inhabit the same immoral status as white characters without penalty. I subsequently analyzed the first season from the Starz series Power and conducted a textual analysis using theories of race and hegemonic masculinity to compare the …
Schools Uniting Neighborhoods: Sustainability And Racial Equity In A Community Schools Initiative, Rachel Geller
Schools Uniting Neighborhoods: Sustainability And Racial Equity In A Community Schools Initiative, Rachel Geller
Scripps Senior Theses
Schools Uniting Neighborhoods (SUN), a collaborative initiative in Multnomah County, Oregon, combines the increasingly popular community school model with an innovative organizational structure to further two key goals: sustainability as an initiative and furthering racial equity. This thesis situates SUN within the context of American public education reform and existing literature on the positive outcomes, organizational structures, and leadership components of community schools. Building on past reviews of SUN and its outcomes, I use results from qualitative interviews with key stakeholders to provide insight into how its organizational structure contributes to the goals of sustainability and racial equity. I discuss …
Aspirations Of Objectivity: Systemic Illusions Of Justice In The Biased Courtroom, Meagan B. Roderique
Aspirations Of Objectivity: Systemic Illusions Of Justice In The Biased Courtroom, Meagan B. Roderique
Scripps Senior Theses
Given the ever-growing body of evidence surrounding implicit bias in and beyond the institution of the law, there is an equally growing need for the law to respond to the accurate science of prejudice in its aspiration to objective practice and just decision-making. Examined herein are the existing legal conceptualizations of implicit bias as utilized in the courtroom; implicit bias as peripheral to law and implicit bias as effectual in law, but not without active resolution. These views and the interventional methods, materials, and procedures they inspire are widely employed to appreciably “un-bias” legal actors and civic participants; however, without …
Recent Themes And Perspectives In The Analysis Of Domestic Work In Latin America: Reflections On Remaining Challenges And Question, Francisca Pereyra, Lorena Poblete
Recent Themes And Perspectives In The Analysis Of Domestic Work In Latin America: Reflections On Remaining Challenges And Question, Francisca Pereyra, Lorena Poblete
Journal of Latino/Latin American Studies (JOLLAS)
The 1 historic trend of domestic work as one of the main sources of employment among Latin American women continues even today. There is no doubt that among low-income women in the region, it is the occupational niche par excellence (ILO, 2012; CEPAL, 2015). As in the past, it is a job that is scarcely acknowledged and poorly paid while providing workers with limited social protection. The high levels of inequality in the region, the low barriers to entry to the occupation (in terms of required qualifications) and the lack of other job alternatives give the supply of poor women's …
Voices Of Women: The Impact Of Women's Political Reservations On Female Child Mortality In India, Kohsheen Sharma
Voices Of Women: The Impact Of Women's Political Reservations On Female Child Mortality In India, Kohsheen Sharma
Scripps Senior Theses
This paper uses state-level variation in the implementation of the 73rd amendment in India to observe the relationship between political reservations for women in local government and female child mortality. Nationally, reservations for women are not associated with a statistically significant difference in female child mortality. However, a state by state analysis shows variations in the level of impact of reservations on the topic of female child mortality. This paper examines the constraints on female representatives and their level of effectiveness in executing pro-female policies given the political and social environment. The two case studies on Kerala and Haryana explore …
Everyone Knows I Had An Abortion: Fighting Abortion Stigma Through Narrative Collection And Mutual Aid, Sabrina Gunter
Everyone Knows I Had An Abortion: Fighting Abortion Stigma Through Narrative Collection And Mutual Aid, Sabrina Gunter
Scripps Senior Theses
According to a 2017 study conducted by the Guttmacher Institute, roughly one in four women will have an abortion in their lifetime. Despite how incredibly common of an experience it is, one almost never hears abortion talked about on an individual basis. This study seeks to find out why people who’ve had abortions do or don’t talk about them, and why, as well as what, if anything, can and needs to be done to change the conversational landscape around abortion. I used qualitative methods to conduct seven participant-led interviews with different people who have had abortions. My findings show that …

What Is Mle, Who Speaks It, And Is It Safe?, Justina Goldbeck
Scripps Senior Theses
Some youth in London speak a non-standard variety of English whose lexical items are difficult for non-speakers to understand. This study collected naturally produced speech samples from students of various ethnicities and class backgrounds who spoke this dialect. It also polled students about their identity, as well as about their use of particular slang words. The recordings were glossed to determine the kind of slang used, as well which populations were more or less likely to use slang. The surveys were analyzed to determine relevant background characteristics of those who used slang versus those who did not. This study concludes …
The Criminalization Of Poverty: The Impact Of Cash Bail System On Black Women In New Orleans, Salome Kushindana
The Criminalization Of Poverty: The Impact Of Cash Bail System On Black Women In New Orleans, Salome Kushindana
All Graduate Theses, Dissertations, and Other Capstone Projects
Research on bail practices has shown that most of the people are in jail because of their inability to pay bail set by the court. A 2016 study by the Vera Institute of Justice concluded that the use of the cash bail system disproportionately impacts poor black people in Orleans Parish Prison, the entity that serves as the principal driver of the mass incarceration. With a focus on poor black people in Orleans Parish Prison, the experiences of the impact of the cash bail system on poor black women are still missing.
Using semi-structured interviews and qualitative method of data …

Rape Culture In Disney Animated Princess Movies, Patricia Paulson
All Graduate Theses, Dissertations, and Other Capstone Projects
Gender stereotypes, rape myths, and rape culture are perpetuated in U.S. media, including media aimed at young people. Previous research in the areas of gender, gender stereotypes, portrayals of gender in movies, Disney movies, rape myths, and rape culture are all examined. Prior to this research, no study had been conducted to determine if the characteristics of rape culture are portrayed in Disney animated princess movies. For this research, an ethnographic content analysis is conducted on all thirteen of the Disney animated princess movies to determine if the characteristics associated with rape culture are portrayed in these movies. The findings …

Are business faculty complicit in mythologizing business concepts by ignoring historical precedence?
The refusal to examine in totality the history of discrimination and racism allows us to perpetuate a mythology of white supremacy that is enhanced through impotent diversity programs repeated throughout corporate America. This paper examines the importance of demythologizing the business curriculum through symptomatic thinking, which allows faculty and students to untangle the quagmire of diversity and inclusion in corporate America. Students are thereby equipped with tools for behavior transformation in the workplace that uses a symptomatic, rather than symbolic approach, to decision making and problem solving.
Fornication Prosecutions Beyond The Mainstream Community And The Role Of Community Policing In Early Colonial New England, Bridget Sciscento
Fornication Prosecutions Beyond The Mainstream Community And The Role Of Community Policing In Early Colonial New England, Bridget Sciscento
Williams Honors College, Honors Research Projects
During the seventeenth century, New England was composed of several independent colonies of varying size and success. In the Puritan and separatist colonies of Massachusetts Bay, New Haven, and Plymouth, entire communities, including “others,” those who were relegated outside of the community on the basis of their status or faith, worked with the theocratical legal system to police sexual morality and preserve social hierarchies that colonists understood to be fundamentally intertwined. This commitment was so strong that these colonies overlooked centuries of English legal custom when drafting harsher fornication laws, relied on the expert testimony of midwives over that of …
Evaluating Stigmatizing Attitudes Among Clinicians Toward People With Abdl And Pedophilic Interests, Katlyn Hanson
Evaluating Stigmatizing Attitudes Among Clinicians Toward People With Abdl And Pedophilic Interests, Katlyn Hanson
All Graduate Theses, Dissertations, and Other Capstone Projects
Because child sexual abuse continues to be covered by mainstream media, the public has become more aware of the paraphilic interest pedophilia. While there is no definitive correlation between an individual with pedophilic interests and offenses against a child, strong public stigmatization toward these individuals remain. Additionally, stigmatizing attitudes have been found toward other paraphilic interests such as fetishes. This is the first study to evaluate and compare clinicians' attitudes toward the paraphilic interest pedophilia and the fetish interest community of Adult Baby/Diaper Lovers (ABDL). Clinicians were randomly assigned to one of three survey conditions assessing their attitudes toward people …
