Private Enforcement And Opt-Out System Risks, Rewards And Legal Safeguards, Maria Elisabete Ramos Dec 2018

Private Enforcement And Opt-Out System Risks, Rewards And Legal Safeguards, Maria Elisabete Ramos

Yearbook of Antitrust and Regulatory Studies

The EU Antitrust Damages Actions Directive does not include provisions for collective redress. Each EU member state is free to provide national regulation on this matter. The Portuguese legal system provided regulation on actio popularis since 1995. The ‘rational apathy’ of individual consumers may lead to non-reparation of damage and be of significant benefit for the company that is in breach of the law. The opt-out models solve the crucial economic problem caused by a large number of consumers or clients who have suffered a small loss because of competition law infringements. Under those circumstances, it is rational to be …

Can An Ideal Court Model In Private Antitrust Enforcement Be Established?, Dominik Wolski Dec 2018

Can An Ideal Court Model In Private Antitrust Enforcement Be Established?, Dominik Wolski

Yearbook of Antitrust and Regulatory Studies

Any discussion of private antitrust enforcement usually focuses on substantive law and proceedings applicable to private antitrust cases. Those elements are important, however, the efficacy of both public and private enforcement relies upon rules of law (substantive and procedural) along with their application. The latter constitutes a substantial aspect affecting the institutions which make decisions in private antitrust enforcement cases, namely the relevant courts. The enforcement of competition law is inextricably intertwined with the economy and markets. As a result, antitrust cases are demanding for non-specialist judges, who usually do not have enough knowledge and experience in the field of …

The Influence Of Economic Theories And Schools On Competition Law In Terms Of Vertical Agreements, Zbigniew Jurczyk

Yearbook of Antitrust and Regulatory Studies

The paper aims at showing the influence and the views espoused by economic theories and schools of economics on competition policy embedded in antitrust law and conducted by competition authorities in the field of vertical agreements. The scope of the paper demonstrates how substantially the economization of antitrust law has changed the assessment as to the harmfulness of vertical agreements. The analysis of economic aspects of vertical agreements in antitrust analysis allows one to reveal their pro-competitive effects and benefits, with the consumer being their beneficiary. The basic instrument of the said economization is that antitrust bodies draw on specific …

The Concept Of Unity In The Competition Law System, Kamil Dobosz Dec 2018

The Concept Of Unity In The Competition Law System, Kamil Dobosz

Yearbook of Antitrust and Regulatory Studies

The paper presents four pillars of competition law that can be recognised in the European Union and Member States, namely EU competition law, national competition law sensu stricto, national competition law sensu largo and competition rules sensu largissimo. In order to demonstrate that this multi-faceted and complex system is able to work in an orderly manner, it is considered in relation to various concepts, particularly unity, uniformity and effectiveness. Nevertheless, the concept of unity serves as a focal point for the observations. The perspective of the EU single market plays a part also, enhancing the call for unity. With regard …

Article 108(2) Tfeu As A Tool For The Commission To Bypass Article 258 Tfeu Proceedings, Marek Rzotkiewicz

Yearbook of Antitrust and Regulatory Studies

The legal basis the European Commission (EC) choses for its actions when it finds a Member State’s action (or inaction) to be in breach of its obligations stemming from its EU membership vary in different fields of law. This is particularly visible in State aid on one side, and general infringement proceedings on the other. But the line between the general character of a possible infringement and that of State aid law is sometimes blurred and difficult to establish. This article analyses if the EC does not abuse its powers when it chooses Article 108(2) TFEU, instead of Article 258 …

(Why) Did Eu Net Neutrality Rules Overshoot The Mark? Internet, Disruptive Innovation And Eu Competition Law & Policy, Oles Andriychuk Dec 2018

(Why) Did Eu Net Neutrality Rules Overshoot The Mark? Internet, Disruptive Innovation And Eu Competition Law & Policy, Oles Andriychuk

Yearbook of Antitrust and Regulatory Studies

This essay raises a number of theses in support for a more liberalised approach to EU Net Neutrality rules. It offers a graded system of levels of regulatory intervention, arguing that soft Net Neutrality rules are capable of meeting all positive objectives of regulation without causing the problems generated by Hard Net Neutrality rules, such as those currently in place in the EU. Hard Net Neutrality rules prevent Internet Service Providers (ISPs) from making disruptive innovations. Meanwhile, they enable some Content and Application Providers (CAPs) to monopolise many markets via (disruptive) innovations, resulting in newly established dominant positions which have, …

What’S New In Western Balkans?, Dragan Gajin Dec 2018

What’S New In Western Balkans?, Dragan Gajin

Yearbook of Antitrust and Regulatory Studies

Western Balkan jurisdictions (Serbia, Montenegro, Bosnia and Herzegovina, and Macedonia (FYROM)) are often outside the focus of the competition community in the EU. This paper aims to rectify that, by providing an overview of the most interesting competition law developments in these jurisdictions during 2017. The overview will show that, despite similarities in their competition legislation, the observed jurisdictions differ when it comes to their priorities in competition law enforcement: while for some the accent is on merger control, for others it is on antitrust. The paper also highlights certain peculiarities of the observed jurisdictions, even though they are all …

Five Oral Reading Fluency Strategies For Supporting Struggling Adolescent Readers, Kavin M. Ming

National Youth Advocacy & Resilience Journal

By the time students enter the fourth grade, it is expected that they possess the basic literacy skills needed to read and learn content. It is the general belief that in the early grades, students are taught foundational literacy skills that make them proficient readers by the time they become adolescent learners. For many, this assumption is true. However, for a large majority of students between Grades 4 and 12, basic literacy skills are not in place, leading them to struggle to acquire information. Oral reading fluency, one of the basic literacy skills that adolescents must possess, can be explicitly …

Synthesis Of Polymer-Drug Conjugates Using Natural Polymer: What, Why And How?, Erny Sagita, Rezi Riadhi Syahdi, Arif Arrahman

Pharmaceutical Sciences and Research

For years, natural polymers have played a significant role in pharmaceutical field due to their biocompatibility and biodegradability. In Indonesia, most research in natural polymers focus on application of the polymers as inert pharmaceutical excipients or as drug matrix in micro- and nano- particle. Meanwhile, research about polymers in the world (mostly synthetic polymers) have been progressed to advanced drug delivery system. In this system, the polymer can act as either pharmacologically active molecules, or sophisticated carrier in targeted prodrug delivery system. The latter is called polymer-drug conjugates, a system where the drugs are covalently attached to a polymeric carrier, …

The Whiteness Of The Elephant In The Room: How White Guilt, White Fragility, And Colorblind Racial Ideology Shape Environmental And Social Justice Activism In Santa Cruz County, Robert Michael Foran

Master's Theses

Using frameworks from critical race theory, social movement theory, and community-based activism, this thesis explores the phenomena of white fragility, white guilt, and colorblind racial ideology and how they impact the ways predominantly white-identified social and environmental justice organizations approach, build, and maintain solidarity with communities of color in Santa Cruz County, California. A qualitative approach was employed to investigate the experiences of white-identified activists and how they attempt to engage in this constantly challenging process. Using twenty-two semi-structured interviews and eight group observations, I explored how white-identified individuals negotiate the transformation from ‘moral passivity’ to meaningful, personal relationships with …

Hes1 Notch Response Elements And Their Roles In Rbpj-K Binding, Michael Majid Khayat Dec 2018

Hes1 Notch Response Elements And Their Roles In Rbpj-K Binding, Michael Majid Khayat

Master's Theses

The Notch signaling pathway is a one of few fundamentally conserved signal transduction pathways critical for metazoan cellular development. Upon ligand activation, the Notch intracellular domain (NICD) translocates to the nucleus and forms a transcription complex with C-binding promoter factor-1 (RBPJ-k/CBF-1/Suppressor of Hairless) and Mastermind-like protein (MAM). The DNA-binding factor, RBPJ-k, binds to a response element containing a consensus sequence of RTGRGAR (where R is G or A). When RBPJ-k interacts with the NICD and MAM, Notch target genes are activated. The most well-characterized gene for Notch is Hes1. Hes1 contains four Notch response elements (NREs), labeled NRE 1-4. Of …

Reproductive Performance, Foraging Effort, And Diet Of An Apex Predator, The Common Murre, At One Of The Largest Nesting Colonies In The California Current System, Stephanie Rianne Schneider

Master's Theses

Common Murre (Uria aalge) are the most abundant avian apex predator nesting in the California Current System (CCS) and nesting is the most energetically demanding phase of their lifecycle. The preyscape within flight distance of their nesting colony determines whether murres produce young, how hard they must work to do so, and what prey types are available to them. This study characterized the reproductive performance, foraging effort, and prey composition of murres nesting at a previously unstudied and large nesting colony in the CCS, Castle Rock National Wildlife Refuge, over an 11-year period (2007 - 2017) intended to capture a …

It was hypothesized that attitudes towards societal diversity and cognitive empathy would improve as a result of diversity training. Gender and ethnicity were also hypothesized to interact with diversity training such that women and ethnic minorities would show more positive attitudes towards societal diversity …

Psychological Presence In Immersive Virtual Environments, Steven L. Wu Dec 2018

Psychological Presence In Immersive Virtual Environments, Steven L. Wu

Master's Theses

Immersive virtual environments are simulated locations that attempt to create a sense of presence, or the psychological feeling that an individual is acting within the simulated environment rather than their physical one. When interfacing with an interactive virtual environment, evidence suggests that aspects of psychological presence are affected, such as time perception and situation awareness. As such, this study hypothesized presence as the construct by which immersive virtual environment usage influences time perception and situation awareness. Two levels of presence were manipulated using a monitor and Oculus Rift. Forty-one participants were tasked with a scavenger hunt in both monitor and …
