A Slanted View On The Morality Bars: Matal V. Tam, In Re Brunetti, And The Future Of Section 2(A) Of The Lanham Act, John Langworthy

The Business, Entrepreneurship & Tax Law Review

Section 2(a) of the Lanham Act contained two “morality bars” to the registration of trademarks: the Disparagement Clause and the Immoral and Scandalous Clause. Two recent cases, the Supreme Court decision in Matal v. Tam and the subsequent decision from the Federal Circuit, In re Brunetti, both held that the morality bars violate the First Amendment. Given the inconsistent application of the Disparagement Clause and the potential for viewpoint discrimination, theTam Court was correct in finding it unconstitutional. For similar reasons, the court in Brunetti properly extended this holding to the Immoral and Scandalous Clause. However, both decisions ignored the …

This article explores United States jurisprudence of the constitutionality of language rights as it correlates to communications between law enforcement officials and non-English speaking persons in emergency situations. The judicial and legislative bodies provide protections to limited English speaking minorities in the realms of education, healthcare, and when navigating through the United States court system. However, these protections are not extended to include interactions between language-minority citizens and initial police interactions during emergency situations.

Part I of this Note will discuss the Department of Homeland Security’s authority to regulate immigration and focuses on DACA and DAPA. Part II will address the U.S. Department of Justice’s Office of Legal Counsel Opinion on DAPA’s legality. Part III will turn to the lack of judicial constraints on or legislative responses to the executive branch’s enforcement discretion. This article seeks to correct some of the negative perceptions held by the general public pertaining to undocumented immigrants, by drawing attention to four major points. First, contrary to popular belief, undocumented immigrants pay taxes. Indeed, as this article will show, in many instances, undocumented immigrants pay a higher rate of tax than U.S. citizens because the burden of tax on such people tends to outweigh the benefits received. The Nebraska Mesonet: Technical Overview Of An Automated State Weather Network, Martha Shulski, Stonie Cooper, Glen Roebke, Allen L. Dutcher

The Nebraska Mesonet was established in 1981 as one of the nation’s first automated state weather networks. ‘‘Automated’’ is defined by the nature of the observations being made and recorded by machine, as opposed to observations made and recorded manually. At the time of inception, the five observing locations were geared toward servicing agricultural production applications. The Nebraska Mesonet has grown to 69 stations (as of 2018) and is now a multipurpose environmental observing network under the Nebraska State Climate Office (NSCO). The network is composed of environmental observation stations, sited using best practices for mesoscale and microscale environment situations. …

Perhaps it is their role in our survival, or our economic growth, or the environment. Whatever the reason, energy and natural resource conflicts seems to be unique in the way they can drive significant doctrinal change even outside of energy and natural resource law. Pennsylvania has been a fountainhead of these conflicts. In 1921, Pennsylvania’s Kohler Act and lesser known Fowler Act, which sought to protect surface owners from anthracite coal mine subsidence and to increase tax revenue from anthracite mining, ignited the legal wrangling that eventually led to Pennsylvania Coal Co. v. Spatial crime studies have existed for over a century, but the last 20 years have seen a turn in focus toward micro-spatial units such as street blocks and street segments. A particular subfield of this modern micro-spatial perspective is called crime trajectory analysis, which can isolate patterns of crime at small spatial units over time. Though several crime trajectory analyses have been conducted for coastal cities, the technique has never been applied to Midwestern data. This project fills that research gap by using the group-based trajectory modeling (GBTM) algorithm to uncover patterns of violent crime at street segments in St. …

Alexander Brown writes as an inter-disciplinary scholar at the intersections of law, ethics, philosophy, and politics. With Hate Speech Law: A Philosophical Examination he justly claims to have explored “numerous principled arguments for and against hate speech law by articulating a collection of key normative principles” (316). This ambitious book identifies and organizes conflicting values within the hate speech controversies. It aims to synthesize deeper questions about core concepts of liberalism, democracy, personhood, dignity, and tolerance with policy concerns about pragmatics and effectiveness. Researchers are actively investigating wireless sensor networks (WSNs) with respect to node design, architecture, networking protocols, and processing algorithms. However, few researchers consider the impact of deployments on the performance of a system. As a result, an appropriate deployment simulator that estimates the performance of WSNs concerning several deployment variables is needed. This research presents a holistic deployment framework that assists decision makers in making optimum WSN deployment choices by considering the terrain of their region of interest and type of deployment. Public protests have become armed events, with protesters and counter-protesters openly carrying firearms—generally pursuant to state law. Many view the presence of firearms at protest events as wholly incompatible with the exercise of First Amendment free speech and assembly rights. Although the Supreme Court has yet to decide whether there is a Second Amendment right to openly carry firearms in public, all but a small handful of states in the United States provide some legal protection for open carry. Limited liability is a double-edged sword. On the one hand, limited lia-bility may help overcome investors’ risk aversion and facilitate capital formation and economic growth. On the other hand, limited liability is widely believed to contribute to excessive risk-taking and externaliza-tion of losses to the public. The externalization problem can be mitigated imperfectly through existing mechanisms such as regulation, mandatory insurance, and minimum capital requirements. These mechanisms would be more effective if information asymmetries between industry and poli-cymakers were reduced. Private businesses typically have better infor-mation about industry-specific risks than policymakers.
