Abandoned Projects: The Economic Impact In San Luis Obispo, Andrew Steven Horton
Abandoned Projects: The Economic Impact In San Luis Obispo, Andrew Steven Horton
Construction Management
San Luis Obispo is in the midst of a housing crisis. This small college town cannot keep pace with the growing number of students and residents. The problem is that there are very few new housing options being developed. Other than the new freshman dorms, the housing market in San Luis Obispo has been stagnant for years. The housing market cannot afford inefficiency and waste, but there are still many abandoned construction sites around the city. These sites are not only eye sores and safety hazards, but they are wasted opportunities. They cost the city millions of dollars every year. …

Arms And The Man: Strategic Trade Control Challenges Of 3d Printing, Arjun Banerjee
Arms And The Man: Strategic Trade Control Challenges Of 3d Printing, Arjun Banerjee
International Journal of Nuclear Security
3D printing is on the verge of confronting Customs and other security agencies with a whole new set of mind-boggling problems. With the tremendous reach of the Internet worldwide, virtual blueprints to weapon parts, components and accessories of drones, narcotic drugs and psychoactive substances, all strategic trade items, as well as other restricted items such as pornographic material, can be proliferated and printed out swiftly by any individual or organization with access to a 3D printer. Intellectual Property Rights are also endangered by these machines. Technology is forever outpacing fast antiquating legal institutions, and security systems, which require revamping to …

Interrogation Or Experimentation? Assessing Non-Consensual Human Experimentation During The War On Terror, William J. Aceves
Interrogation Or Experimentation? Assessing Non-Consensual Human Experimentation During The War On Terror, William J. Aceves
Duke Journal of Comparative & International Law
The prohibition against non-consensual human experimentation has long been considered sacrosanct. It traces its legal roots to the Nuremberg trials although the ethical foundations dig much deeper. It prohibits all forms of medical and scientific experimentation on non-consenting individuals. The prohibition against non-consensual human experimentation is now well established in both national and international law.
Despite its status as a fundamental and non-derogable norm, the prohibition against non-consensual human experimentation was called into question during the War on Terror by the CIA’s treatment of “high-value detainees.” Seeking to acquire actionable intelligence, the CIA tested the “theory of learned helplessness” on …

Economic Effects Of Climate Change In Alaska, Matthew Berman, Jennifer Schmidt
Economic Effects Of Climate Change In Alaska, Matthew Berman, Jennifer Schmidt
ISER Reports
We summarize the potential nature and scope of economic effects of climate change in Alaska that have already occurred and are likely to become manifest over the next 30-50 years. We classified potential effects discussed in the literature into categories according to climate driver, type of environmental service affected, certainty and timing of the effects, and potential magnitude of economic consequences. We then described the nature of important economic effects, and provided estimates of larger, more certain effects for which data were available. Largest economic effects were associated with costs to prevent damage, relocate, and replace infrastructure threatened by permafrost …

Tbeish V. Attorney General, Yosef Elron, David Mintz, Isaac Amit
Translated Opinions
The Petitioner claimed that he was tortured in the course of interrogation by the Israel Security Agency (ISA) (formerly the General Security Service (GSS)), and petitioned the Court to order the Attorney General to rescind his decision not to open a criminal investigation of the interrogators, and to annul the Attorney General’s guidelines entitled: “ISA Interrogations and the Necessity Defense – Framework for the Attorney General’s Discretion” (hereinafter: the AG’s Guidelines) that provide the basis for the Internal Guidelines of the ISA (hereinafter: the Guidelines). The Petitioners argued that the Guidelines unlawfully permit interrogators to consult with more senior officials …

Zombie Patents And Zombie Companies With Patents, Xuan-Thao Nguyen
Zombie Patents And Zombie Companies With Patents, Xuan-Thao Nguyen
Florida Law Review
This Essay observes that dead patents are not dead. Recent statutory amendments, and U.S. Court of Appeals for the Federal Circuit decisions, allow dead patents to become undead, haunting the living businesses, as seen in Parts I and II, respectively. Notably, the Federal Circuit’s trio of cases has judicially prolonged zombie patents by wrongly eliminating any pathway to challenge improper revivals of dead patents or to raise improper revival as a defense in patent infringement actions. In addition, there is a zombification process that some drug companies have employed on certain patents at the expense of the consuming public, as …
Correctional Nurse Competency And Quality Care Outcomes, Deborah Shelton, Bill Barta, Louise A. Reagan
Correctional Nurse Competency And Quality Care Outcomes, Deborah Shelton, Bill Barta, Louise A. Reagan
Journal for Evidence-based Practice in Correctional Health
Purpose: In this paper, we report on the clinical care outcomes resulting from implementing a nurse competency education intervention to a nursing staff in a statewide correctional system. Background: State correctional healthcare systems face ongoing and serious challenges attracting and retaining an adequate number of qualified health professionals owing to the perceived undesirability of working in correctional facilities; high occupational stressors; and the effects of high turnover on the workloads of remaining nursing staff.
Methods: Nursing outcomes were evaluated on four most frequently used nursing protocols. The education intervention consisted of self-directed computer-based modules, hands-on clinical review of skills, and …
Core Curricular Priorities For Professional Development Of Nurses In Correctional Systems: A Delphi Study, Deborah Shelton, Annette T. Maruca, Louise A. Reagan
Core Curricular Priorities For Professional Development Of Nurses In Correctional Systems: A Delphi Study, Deborah Shelton, Annette T. Maruca, Louise A. Reagan
Journal for Evidence-based Practice in Correctional Health
Objective: To identify the core curricular elements to assure competency and professional development of registered nurses working with justice-involved populations.
Background: Numerous assessments of education priorities have been articulated for nurses working with patients who interface with justice systems. But no consensus of what comprises the core elements of a curriculum for nurses employed by justice systems has been published. Guidance from correctional nurse education experts is needed.
Design: A web-based Delphi survey methodology was used. Three de-identified surveys were sent to academic and clinical correctional nurse educators two weeks apart by email following an invitation and voluntary agreement to …
More Than Just Collateral Damage: Pet Shootings By Police, Courtney G. Lee
More Than Just Collateral Damage: Pet Shootings By Police, Courtney G. Lee
The University of New Hampshire Law Review
The Department of Justice estimates that American police officers shoot 10,000 pet dogs in the line of duty each year. It is impossible to ascertain a reliable number, however, because most law enforcement agencies do not maintain accurate records of animal killings. The tally may be substantially higher, and some suggest it could reach six figures.
Deferring to officers’ judgment when they reasonably fear for human safety is sound policy because they regularly must make split-second, life-or-death decisions in highly stressful situations; but many pet shootings occur when officers mistake the behavior of a friendly, curious dog for aggression. Further, …

Risk Factor And High-Risk Place Variations Across Different Robbery Targets In Denver, Colorado, Nathan T. Connealy, Eric L. Piza
Risk Factor And High-Risk Place Variations Across Different Robbery Targets In Denver, Colorado, Nathan T. Connealy, Eric L. Piza
Publications and Research
Purpose
Risk Terrain Modeling (RTM) has been effectively used to spatially diagnose risk for crimes such as robbery, aggravated assault, and gun violence. An important contribution is to consider how risk differs across individual crimes and different target types. This study tests four different robbery target types in unique models to examine the potential for variation across significant risk factors and high-risk locations.
Methods
Using the online diagnostic software RTMDx, individual robbery models were run for four robbery target types in Denver, Colorado: commercial (businesses), carjacking (driver/vehicle), residential (home/dwelling), and street (pedestrians). A conjunctive analysis of case configurations was also …
