A (Partial) Defense Of Section 501(C)(4)'S “Catchall” Nature, Lloyd Histoshi Mayer Mar 2018

A (Partial) Defense Of Section 501(C)(4)'S “Catchall” Nature, Lloyd Histoshi Mayer

Journal Articles

Internal Revenue Code section 501(c)(4) provides exemption from federal income tax for “social welfare” organizations. The vagueness of this term and the failure of the Treasury Department and Internal Revenue Service to interpret it in a manner that would significantly limit that vagueness has led some commentators to criticize this section’s “catchall” nature. While much scholarly attention has been paid to this criticism with respect to the most visible section 501(c)(4) organizations, particularly those involved in political campaign activity and lobbying, almost no attention has been paid to the many less common types of section 501(c)(4) organizations that illustrate that …

Forecasting Lightning Cessation Using Dual-Polarization Radar And Lightning Mapping Array Near Washington, D.C., Nancy M. Holden Mar 2018

Forecasting Lightning Cessation Using Dual-Polarization Radar And Lightning Mapping Array Near Washington, D.C., Nancy M. Holden

Theses and Dissertations

Accurate forecasts of thunderstorms are important to space launch, aviation, and public safety. While prior studies have primarily focused on atmospheric conditions leading to lightning onset, less research has been dedicated to the challenging problem of predicting lightning cessation. This study verifies the probabilistic lightning cessation model developed by Joseph Patton (2017) at Florida State University for use by the U.S. Air Force's 45th Weather Squadron at Cape Canaveral Air Force Station (CCAFS) and the National Aeronautics and Space Administration (NASA) Kennedy Space Center (KSC). The Washington, D.C. greater metropolitan area, which presents a climate different to that of central …

What's The "Use": Vehicle Maintenance Liability Barred By Sovereign Immunity Amendment Intended To Promote Waiver, Clayton Kendrick Mar 2018

What's The "Use": Vehicle Maintenance Liability Barred By Sovereign Immunity Amendment Intended To Promote Waiver, Clayton Kendrick

Mercer Law Review

Local government is an active participant in most communities. It picks up trash weekly, keeps tap water clean, and keeps citizens safe. Local government is the cog that keeps communities running smoothly, and as such, is afforded certain protections. One of those protections is the protection from lawsuits brought by citizens. This is known as the doctrine of sovereign immunity. While local government reaches out into the community to keep citizens comfortable and safe, sovereign immunity keeps citizens from reaching in and exposing the government to liability. At times, however, these protections can seem unjust. In 2002, the Georgia General …

Fifty Shades Of Gray Infrastructure: Land Use And The Failure To Create Resilient Cities, Jonathan Rosenbloom Mar 2018

Fifty Shades Of Gray Infrastructure: Land Use And The Failure To Create Resilient Cities, Jonathan Rosenbloom

Washington Law Review

Land use laws, such as comprehensive plans, site plan reviews, zoning, and building codes, greatly affect community resilience to climate change. One often-overlooked area of land use law that is essential to community resilience is the regulation of infrastructure on private property. These regulations set standards for infrastructure built by private developers. Such infrastructure is completed in conjunction with millions of commercial and residential projects and is necessary for critical services, including potable water and energy distribution. Throughout the fifty states, these land use laws regulating infrastructure constructed by private developers encourage or compel “gray infrastructure.” Marked by human-made, engineered …

Sentiment Analysis Of Twitter Data, Evan L. Munson Mar 2018

Sentiment Analysis Of Twitter Data, Evan L. Munson

Theses and Dissertations

The rapid expansion and acceptance of social media has opened doors into users’ opinions and perceptions that were never as accessible as they are with today's prevalence of mobile technology. Harvested data, analyzed for opinions and sentiment can provide powerful insight into a population. This research utilizes Twitter data due to its widespread global use, in order to examine the sentiment associated with tweets. An approach utilizing Twitter #hashtags and Latent Dirichlet Allocation topic modeling were utilized to differentiate between tweet topics. A lexicographical dictionary was then utilized to classify sentiment. This method provides a framework for an analyst to …

Planning For An Age-Friendly Belmont, Jan Mutchler

Center for Social and Demographic Research on Aging Publications

Belmont is a primarily residential community of around 25,000 residents with a small commercial district. Public transit access to downtown Boston and neighboring Cambridge offers Belmont residents access to services, employment, and recreational activities outside of the town’s boundaries. With 22% of its population age 60 and older, Belmont is expecting to see an increase in the number of older residents in the coming years. Commissioned by the Belmont Council on Aging (COA), this report will serve to help the COA and Town to better understand Belmont’s current assets, potentials, and challenges and to plan for changing community needs.

Drought And Public Necessity: Can A Common-Law “Stick” Increase Flexibility In Western Water Law?, Robin Kundis Craig Mar 2018

Drought And Public Necessity: Can A Common-Law “Stick” Increase Flexibility In Western Water Law?, Robin Kundis Craig

Utah Law Faculty Scholarship

Drought is a recurring—and likely increasing—challenge to water rights administration in western states under the prior appropriation doctrine, where “first in time” senior rights are often allocated to non-survival uses such as commercial agriculture rather than to drinking water supply for cities. While states and localities facing severe drought have used a variety of voluntary programs to re-allocate water, these programs by their very nature cannot guarantee that water will in fact be redistributed to the uses that best promote public health and community survival.

Using the example of the Brazos River drought of 2010 to 2013, this Article explores …

Fast Times In Federal Court And The Need For Flexibility, K. Michael Moore Mar 2018

Fast Times In Federal Court And The Need For Flexibility, K. Michael Moore

Fordham Law Review

The shifting landscape of criminal prosecutions involving designer drugs presents several novel legal issues. There are different ways to address these issues when they are the result of the production, possession, or distribution of as-of-yet unregulated substances. One way is for the legislature to enact appropriate legislation as quickly as the need for regulation or criminalization arises—a lofty, if not unrealistic, goal. The other is to guide the courts with general principles of applicability—the approach adopted by Congress through the enactment of the Analogue Act. This small but unfortunately quickly expanding area of federal criminal law supports the notion that …

Female Law Enforcement Officer's Experiences Of Workplace Harassment, Vanessa Brodeur Mar 2018

Female Law Enforcement Officer's Experiences Of Workplace Harassment, Vanessa Brodeur

Electronic Theses, Projects, and Dissertations

Prior research shows that female police officers experience more incidents of harassment than male police officers, and these experiences of harassment have been shown to have negative effects on their mental and physical health, retention, and job satisfaction. The current study examined the experiences of harassment of 20 female police officers from agencies around Southern California. A survey interview was used, and it was found that none of the women had experienced quid pro quo harassment, but every woman recalled experiencing environmental harassment at some point throughout their career. Hostility towards women was more commonly experienced than harassment which was …

Forecasting Lightning Initiation Utilizing Dual-Polarization Radar Parameters Over Washington, D.C., Sarah A. Olsen Mar 2018

Forecasting Lightning Initiation Utilizing Dual-Polarization Radar Parameters Over Washington, D.C., Sarah A. Olsen

Theses and Dissertations

Accurate forecasts of thunderstorms are vital to space launch, aviation, and public safety. Prior studies by Woodard (2011), Thurmond (2014), and Travis (2015) show that dual-polarization radar can be utilized to identify the presence of hydrometeors necessary for cloud charging. These studies emphasized that a combination of radar reflectivity (Z) and differential reflectivity (ZDR) predictors have the potential to improve forecast skill of lightning initiation over methods that rely on Z alone (Roeder and Pinder, 1998; Yang and King, 2010). Travis (2015) discovered two parameters, when used together, produced the best results: Z ≥ 36.5 dBZ and ZDR …

Resilience Portfolios And Poly-Strengths: Identifying Protective Factors Associated With Thriving After Adversity, Sherry L. Hamby, John H. Grych, Victoria Banyard Mar 2018

Resilience Portfolios And Poly-Strengths: Identifying Protective Factors Associated With Thriving After Adversity, Sherry L. Hamby, John H. Grych, Victoria Banyard

Psychology Faculty Research and Publications

Objective: Interest in protective factors for adversity has burgeoned, but the set of examined protective factors remains limited and most studies have focused on a single or narrow set of adversities. Using the resilience portfolio model as a conceptual framework, this study seeks to identify promising protective factors for individuals exposed to violence and other adversities. We include strengths drawn from the positive psychology literature in addition to established protective factors. We also explore the utility of the concept of poly-strengths, or the number of different types of protective factors an individual has. Method: Participants were 2,565 adolescents and adults …

Using The Re-Aim Framework To Evaluate Disaster Recovery Videos, Sarah Cronin, Lori Hendrickson, Sara Croymans Feb 2018

Using The Re-Aim Framework To Evaluate Disaster Recovery Videos, Sarah Cronin, Lori Hendrickson, Sara Croymans

Journal of Human Sciences and Extension

Natural disasters both increase and cause financial challenges for survivors. Crisis support reduces negative outcomes such as financial stress, yet survivors are often unaware or unable to access available services. Aiming to innovatively improve access to quality financial education and to support financial recovery post-disaster, a video series was developed with a community advisory board. The RE-AIM framework informed a developmental evaluation measuring the videos’ influence. Results indicated majority of participants have used or intend to use the videos in their disaster work. This indicates the video series may be a helpful tool for disaster responders when providing financial recovery …
