Bankruptcy Court Jurisdiction: Are Libel And Slander Personal Injury Torts?, Joseph Collini Jan 2018

Bankruptcy Court Jurisdiction: Are Libel And Slander Personal Injury Torts?, Joseph Collini

Bankruptcy Research Library

(Excerpt)

A bankruptcy court may adjudicate tort claims, including libel and slander against a debtor, if it concludes that it has jurisdiction over those claims. The statutes governing a bankruptcy court’s jurisdiction, including title 11 of the United States Code (“The Bankruptcy Code”) and title 28 of the United States Code, are ambiguous. Consequently, the bankruptcy courts are divided as to their jurisdiction over libel and slander claims.

At the heart of this issue is the personal injury tort exception under 28 U.S.C.A. §157(b). The exception specifically limits the jurisdiction of the bankruptcy courts and states that personal injury torts …

Administrator Support Of Social-Emotional And Academic Needs Of Students At A Selective Enrollment High School, Therese Elizabeth Plunkett Jan 2018

Administrator Support Of Social-Emotional And Academic Needs Of Students At A Selective Enrollment High School, Therese Elizabeth Plunkett

Dissertations

As an administrator at a selective enrollment high school in an urban district, I experienced firsthand the lack of differentiation for students experiencing social-emotional learning (SEL) issues, which in turn affects academic learning. This self-study examines what strategies and interventions assist administrators in targeting the social-emotional and academic needs of students. School leadership is obligated to facilitate increasing and implementing supports that address the SEL and diverse-learning needs of all students. One way in which leadership can promote addressing differentiated learning is through ensuring Multi-Tiered Systems of Support (MTSS) are implemented with fidelity. MTSS formerly known as response to intervention …

The Impact Of Mood On Health Behaviors And Quality Of Life For Women With Cardiovascular Disease, Jacqueline Ann Tulley Jan 2018

The Impact Of Mood On Health Behaviors And Quality Of Life For Women With Cardiovascular Disease, Jacqueline Ann Tulley

Dissertations

Methods/Measurements: A cross-sectional correlational design explored the relationships between symptoms, functional status, health perceptions and QoL in women with CVD. The aims of the study were: 1) to determine the relationship of symptoms (depression/anxiety) to functional status (health-promoting behaviors), health perceptions (illness perception), and QoL; and 2) to determine whether age is a factor contributing to negative mood symptoms, functional status, health perceptions, and QoL after controlling for social support. Measurements were collected at one time-point to address these aims that included the following: biological function (Framingham Recurrent Risk Model and Functional Comorbidity Index), symptoms (Patient Health Questionnaire-8 and Generalized …

Political Essentialism And Affective Polarization, Chase Wilson Jan 2018

Political Essentialism And Affective Polarization, Chase Wilson

Dissertations

Affective polarization, the phenomenon of liberals and conservatives treating each other as disliked outgroups, is increasingly intense (Iyengar & Westwood, 2015; Pew, 2016). In the present research, I used the construct of psychological essentialism (Medin & Ortony, 1989) to help understand this intergroup phenomenon. Specifically, I measured political essentialism, or the belief that political ideologies are strongly determined, informative, discrete and/or immutable, and tested the relationship between these beliefs and affective polarization. I approached this question with both correlational and experimental methods. In a correlational study, political essentialism overall is found to covary positively with affective polarization and social avoidance …

How Does The Classroom Teacher Promote Academic Success In The Spanish Native Speaker Class: A Study Of Classroom Teachers' Perceptions Of Culturally Relevant Pedagogy In The Spanish Native Speaker Course At The High School Level, Michael Angelo Ayala

Dissertations

The achievement gap between Latino and White students is a significant problem, prompting the need to address the cultural conflicts that hinder relationships and compromise learning opportunities for Latino students in the United States. This exploratory qualitative study focused on Spanish Native Speaker (SNS) teachers' perceptions and use of Culturally Relevant Pedagogy (CRP) at the high school level. Framed with theory related to CRP, data were collected through interviews and classroom observations with four SNS teachers who teach a SNS class at various high schools in the suburbs of Cook County. A thematic analysis and an analysis using Herrera's (2010) …

The Real Deal: A Program Evaluation Of A Teen Pregnancy Program, Sejla Dizdarevic Jan 2018

The Real Deal: A Program Evaluation Of A Teen Pregnancy Program, Sejla Dizdarevic

Dissertations

Teen pregnancy rates within the United States continue to be the highest amongst developed countries. The purpose of this study was to evaluate whether the Real Deal, a teen pregnancy prevention program currently implemented in a high school in a Midwestern state, has a short- and/or long-term impact on students' a) perceptions of taking care of a baby by oneself, b) abstaining from sexual activities, c) delaying pregnancies until obtaining a post-secondary education, and d) delaying pregnancies until after marriage. Furthermore, the study evaluated staff perceptions on a) ease of program implementation and b) adequacy of the content within the …

Beyond Body Mixing: Race, Space, And The Meaning Of School Integration In A Chicago Suburb, Megan Rigsby Klein Jan 2018

Beyond Body Mixing: Race, Space, And The Meaning Of School Integration In A Chicago Suburb, Megan Rigsby Klein

Dissertations

Integration is often characterized as an effective means of fixing the problems associated with segregation. Whether with respect to residential segregation, education, or to public spaces in general, integration is seen as a way to undo the perils of racial segregation. Yet often times, integration takes a certain reified form with a large white majority and non-white minority. How do lived experiences of Black residents in integrated spaces affect their perceptions of integration? Drawing on data collected from arcHIVal research, participant observation, and in-depth interviews with long-term African American residents, this dissertation examines the ways in which race, space, and …

Critical Conversations With Suburban Administrative Leaders On Special Education Disproportionality: Case Studies Of Suburban School Districts, Jennifer Colleen Sterpin Jan 2018

Critical Conversations With Suburban Administrative Leaders On Special Education Disproportionality: Case Studies Of Suburban School Districts, Jennifer Colleen Sterpin

Dissertations

This dissertation study explored high school administrators' beliefs about why racial disproportionality exists, sought to understand the local practices that contribute to disproportionality, and identified interventions and supports that impact disproportionality in the special education referral, eligibility, and placement process. Research shows that students who are disproportionately represented in special education are negatively affected by factors such as stigmatization, substandard instruction, zero tolerance policies, and isolation from the general education setting (Sullivan, Kozleski, & Smith, 2008). Administrators were invited to participate in this study because they have a significant impact on student achievement and system-wide changes in schools.

This research …

Exploring Community College Practitioners' Cultivation And Praxis Of Antiracist And Asset-Based Approaches To Education: A Phenomenological Study, Ester Ulibasa Sihite Jan 2018

Exploring Community College Practitioners' Cultivation And Praxis Of Antiracist And Asset-Based Approaches To Education: A Phenomenological Study, Ester Ulibasa Sihite

Dissertations

Community colleges comprise a robust and complex sector of U.S. higher education, serving large numbers of students of color and other historically underrepresented groups. There is a dearth of literature on how antiracist and asset-based approaches to education can be utilized to promote student success and racial justice. Using an inductive, phenomenological approach, this study utilized data from interviews with a purposive sample of community college practitioner-educators (faculty, staff, and administrators) who invested in racial justice praxis€”reflection and action€”to explore (a) how their cognitive frames, abilities, and interest in racial justice were cultivated, and (b) what this praxis looks like. …

Ecospatial Orientation And American Literature, Lowell Wyse Jan 2018

Ecospatial Orientation And American Literature, Lowell Wyse

Dissertations

Place is complex, and it undergirds and influences our fictional and nonfictional narratives in ways we often fail to recognize. In this dissertation, Lowell Wyse argues for a more holistic understanding of place's role in literature while asking what it means to read environmentally€”spatially, ecologically, and historically. Drawing from ecocriticism, which emphasizes the biological world, and geocriticism, which privileges the spatial, Wyse proposes a hybrid "ecospatial" criticism, with a particular emphasis on the role of maps in reading for place. With individual chapters on the nonfiction of William Least Heat-Moon, John Steinbeck's Salinas Valley fiction, Richard Wright's Native Son, and …

Education: School of Education Faculty Publications and Other Works

This study analyzes the implementation of schoolwide positive behavior interventions and supports (SWPBIS) for the staff of one middle school that implemented SWPBIS during a districtwide strike and school merger. The researchers developed a qualitative case study based on focus groups and interviews with the staff who remained at the school following the merger. Analysis focuses on the nuances of supporting a school implementing SWPBIS during a season of anxiety-producing events. Systems theory is used both to identify the possible benefits of implementing SWPBIS during challenging seasons and to describe nuances for coaching schools during the SWPBIS process. Results indicate …

Measuring Undergraduates' Global Perspective Development: Examining The Construct And Cross-Cultural Validity Of The Global Perspective Inventory Across Ethnoracial Groups, Lisa Davidson

Dissertations

This study examined the construct and cross-cultural validity of the Global Perspective Inventory’s (GPI’s) 32 global perspective development items, which measure six related dimensions of development spanning cognitive, intrapersonal, and interpersonal domains. The study’s sample consisted of 7,092 undergraduates who completed the GPI General Form between 2015-2017. The GPI’s hypothesized hierarchical factor structure was used for all confirmatory factor analyses and multiple-group confirmatory factor analyses for this study. The data from the GPI were ordinal in nature, presenting important considerations. This study makes several contributions to survey validation efforts. First, it provides a nuanced definition of the concept of validity …

Measuring Community Violence, Trauma, And Family Functioning Among Youth Living In Low-Income, Urban Environments, Kyle Deane Jan 2018

Measuring Community Violence, Trauma, And Family Functioning Among Youth Living In Low-Income, Urban Environments, Kyle Deane

Dissertations

Exposure to community violence is a pressing public health concern that has profound effects on an adolescent’s development and psychological well-being, and is disproportionately experienced by ethnic minority youth living in economically disadvantaged urban environments. Efforts to measure violence exposure and its sequelae have centered primarily on the use of retrospective questionnaires and cross-sectional design and often fail to consider other contributory risk or resilience factors. Comprised of three related studies, the goal of this dissertation is to address the relations between of exposure to community violence, adjustment difficulties, such as posttraumatic stress, and family functioning among African American and …

In Between: What The Experiences Of Biracial, Bisexual Women Tell Us About Identity Formation, Marissa C. Floro Jan 2018

In Between: What The Experiences Of Biracial, Bisexual Women Tell Us About Identity Formation, Marissa C. Floro

Dissertations

Research on bisexual, biracial women has been scarce; identity development in particular shows not only a gap in the research for this particular population, but shows the lack of intersectional models for approaching identity as a whole. Traditional models of queer identity have used White, gay, cisgender men as the default sample and coming out as the benchmark goal for identity integration. Biracial identity research, though more holistic, rarely includes intersectionality. Through feminist, queer theory and constructivist grounded theory, this project hopes to challenge traditional models of categorical identity development, give voice and visibility to a continually underrepresented group of …

Actor's And Partner's Self-Discrepancy As Moderators Of The Relationship Between Negative Events And Reflected Appraisals: A Daily Diary Study Examining The Actor-Partner Interdependence Model In African American Couples, Natalie J. Hallinger Jan 2018

Actor's And Partner's Self-Discrepancy As Moderators Of The Relationship Between Negative Events And Reflected Appraisals: A Daily Diary Study Examining The Actor-Partner Interdependence Model In African American Couples, Natalie J. Hallinger

Dissertations

Self-worth influences how individuals perceive the health of their romantic relationships

in response to adverse experiences, especially interpersonal threats. Though explicit

self-esteem is often used as an indicator of self-worth in investigations of relationship

functioning after interpersonal threats, particularly those focusing on perceptions of felt

love and acceptance, actual:ideal self-discrepancy is an evaluative aspect of the self

that may have more direct impacts on romantic relationship functioning after negative

events that are unrelated to the relationship. Using the Actor-Partner Interdependence

Model to analyze dyadic data from 150 African American couples using multilevel

regression models, the current study’s results were contrary …

Characterization Of Cross-Genre Writing Skills In Children With And Without Autism Spectrum Disorders: The Role Of Language, Handwriting, And Cognitive Processing, Elizabeth Hilvert Jan 2018

Characterization Of Cross-Genre Writing Skills In Children With And Without Autism Spectrum Disorders: The Role Of Language, Handwriting, And Cognitive Processing, Elizabeth Hilvert

Dissertations

It has been estimated that writing is one of the most significant academic problems for children with Autism Spectrum Disorder (ASD), with as many as 60% of children having a learning disability in writing (Mayes & Calhoun, 2008). The majority of evidence demonstrating this achievement gap, however, comes from research finding global writing deficits, using standardized tests. As a result, a number of questions remain about how the texts constructed by children with ASD specifically align or deviate from typical development. For instance, do these texts differ in terms of vocabulary, grammar, or structure? Are children with ASD better at …

Shaping Black Boys: Exploring School Construction Of Masculinity And The Impact On Black Male Scholastic Perceptions Toward Academic Achievement And Schooling, Kisha V. Jenkins Jan 2018

Shaping Black Boys: Exploring School Construction Of Masculinity And The Impact On Black Male Scholastic Perceptions Toward Academic Achievement And Schooling, Kisha V. Jenkins

Dissertations

African American boys face unique challenges. They are more likely to be suspended or expelled from school than any other racial group (Losen, 2015). Equally disturbing, African American male students are largely suspended for more subjective and ambiguous reasons such as appearing “threatening or disrespectful” (Verdugo, 2007, p. 60). Research on teacher bias in the classroom has indicated that “African American males are generally viewed as possessing characteristics incongruent with academic success (e.g., laziness), valuing athletics over academic accomplishments, and having a propensity toward aggression and violence” (Thomas & Stevenson, 2009, p. 162). These issues experienced by African American males …

A Mixed Methods Evaluation Of The Social Emotional Needs Of Middle School Students, Vicky Karahalios Jan 2018

A Mixed Methods Evaluation Of The Social Emotional Needs Of Middle School Students, Vicky Karahalios

Dissertations

Middle school is a critical transition for all school-aged youth. On a personal level they experience rapid changes across several areas of development. Their environment simultaneously adapts as schools’ expectations seem greater and social pressures arise. During this juncture, they are more vulnerable to academic and psychological difficulties. Research findings demonstrate how positive school climates have the ability to moderate the detrimental effects of middle school students’ self-criticism on internalizing and externalizing behaviors (Kuperminc, Leadbeater, & Blatt, 2001). Historically schools have responded to the social emotional challenges students face at an individual level, however these finding points to the importance …

An Examination Of School Psychologists’ Exposure To And Preparedness To Support Transgender Students In Schools, Natalie Meier Meier Jan 2018

An Examination Of School Psychologists’ Exposure To And Preparedness To Support Transgender Students In Schools, Natalie Meier Meier

Dissertations

The purpose of this study was to examine school psychologists’ professional practice in relation to transgender youth. The frequency with which school psychologists engage in the professional guidelines outlined by the National Association of School Psychologists (NASP) in their position statement: "Safe Schools for Transgender and Gender Diverse Students" was explored as well as school psychologists’ feelings of preparedness to complete these duties. Results indicate rural practitioners and school psychologists in elementary and middle schools feel the least prepared to implement the NASP best practices for serving transgender students. School psychologists working in non-rural and high school settings with more …

The Experience Of Mentors In A Cross-Age Peer Mentoring Program: Exploring The Helper Therapy Principle, Dakari Quimby Jan 2018

The Experience Of Mentors In A Cross-Age Peer Mentoring Program: Exploring The Helper Therapy Principle, Dakari Quimby

Dissertations

Mentoring programs are increasingly popular interventions for promoting positive development in Black youth from high risk environments. Cross-age peer mentoring refers to an older youth serving as a mentor for a younger mentee. Although not as widely studied as adult mentoring, this relationship has been found to have a beneficial effect for both the mentor and mentee. The current study seeks to better illuminate this bidirectional benefit by focusing on one half of the relationship—the experience of cross age peer mentoring by Black American mentors from low income communities. This is an important untapped area of study as peer mentoring …

How Does She Do It All? A Test Of The Social Cognitive Career Theory Self-Management Model Of Women’S Multiple Role Management, Meghan Roche Jan 2018

How Does She Do It All? A Test Of The Social Cognitive Career Theory Self-Management Model Of Women’S Multiple Role Management, Meghan Roche

Dissertations

In 2013 Lent and Brown presented the Social Cognitive Career Theory (SCCT) Career Self-Management (CSM) model in order to understand the processes whereby people engage in adaptive career behaviors, as well as what factors may hinder or facilitate. The current study examined the CSM model in the context of women’s multiple role balancing. Social support and access to economic resources, two variables which have garnered empirical attention in both the SCCT and multiple role literature, were tested as potentially meaningful contextual and person input variables within the model. Results indicated support for a CSM model of women’s multiple role balancing. …

Medically Modified Eyes: A Baptismal Cataract Surgery In Clement Of Alexandria, Emily R. Cain Jan 2018

Medically Modified Eyes: A Baptismal Cataract Surgery In Clement Of Alexandria, Emily R. Cain

Theology: Faculty Publications and Other Works

In Paedagogus 1.6.28, Clement describes baptism through the metaphor of a cataract surgery that enables the percipient to see God. In antiquity, cataract surgery was neither a common nor a safe procedure, which raises the question: why does Clement use such an unlikely metaphor for baptism? In this article, I demonstrate that this medical metaphor of cataract surgery enabled Clement to blur the line between the physical and the spiritual. The visual component of the metaphor allowed Clement to draw from Epicurean sensory perception and epistemology, which understood objects to emit tiny films that entered the eye of the body …

Design Of Revising Proximity Between Space And Time Cues On Flight Deck Displays To Support Nextgen – The First Phase, Chang-Geun Oh, Jennie J. Gallimore, Pamela S. Tsang Jan 2018

Design Of Revising Proximity Between Space And Time Cues On Flight Deck Displays To Support Nextgen – The First Phase, Chang-Geun Oh, Jennie J. Gallimore, Pamela S. Tsang

International Journal of Aviation, Aeronautics, and Aerospace

The objective of this study is to develop and evaluate novel display formats to support RTA operations for near to midterm NextGen. Traditional cockpit displays separate space and time information in distant display sources in heterogeneous formats (graphics vs. text). This design composition may cause potential pilot errors when required time of arrival (RTA) obligations are imposed at every waypoint in NextGen. Pilots were randomly assigned to four different display conditions in a simulator – one traditional display with distant space and time cues, and three novel displays with close spatial proximity between the two cues. In the first phase …

Design Of Revising Proximity Between Space And Time Cues On Flight Deck Displays To Support Nextgen – The Second Phase, Chang-Geun Oh, Jennie J. Gallimore, Pamela S. Tsang

International Journal of Aviation, Aeronautics, and Aerospace

The prior first phase of this study investigated the effectiveness of new design of flight deck display for required time of arrival operation of NextGen by collecting objective query response data during autopilot flights and subjective data about the perception between display condition and situation awareness level. To evaluate pilots’ mental workload during the operations when they interacted with novel flight deck display design, this second phase provided pilots with simulation flight tasks arriving at four successive waypoints on time in the same display conditions as the first phase and asked them to rate their mental workload ratings. The workload …
