The Litigators: Perceptions Of Predictability, Definitions Of A Good Outcome, And An Alternative To Mass Tort Trials, Lisa K. Dicker, Shane K. Hebel Jan 2018

The Litigators: Perceptions Of Predictability, Definitions Of A Good Outcome, And An Alternative To Mass Tort Trials, Lisa K. Dicker, Shane K. Hebel

Faculty Publications

(Excerpt)

A pervasive theme in our understanding of civil legal disputes is the “big case”; that is, the generic mass tort that pits sympathetic clients against shadowy, villainous corporations. In John Grisham’s stories about these cases, a David-and-Goliath legal battle ensues, the parameters of the law shift, the attorneys’ ethics stretch, and the author uses characters to reveal both sides’ deep secrets unwillingly—and sometimes unwittingly. Ultimately, the case leads to a “win” for one side or the other—either a huge payday for the clients and a large percentage-based fee for the lawyers who stumbled across it, or a corporation that …

Effects Of Knee Sleeves On Knee Mechanics During Squats At Variable Depths, Alexandria A. Trypuc Jan 2018

Effects Of Knee Sleeves On Knee Mechanics During Squats At Variable Depths, Alexandria A. Trypuc

Human Movement Studies & Special Education Theses & Dissertations

The squat is a functional, compound and multi-joint exercise that targets several muscles of the lower body and is widely used in both athletics and many exercise programs. This exercise has been the subject of many studies, comparing different squat variations and examining how external gear, such as squat suits and knee wraps impact the exercise. The aim of this study was to assess the effects of wearing neoprene knee sleeves on lower extremity kinematics, kinetics, and muscle activations during weighted back squats. Fifteen resistance trained men and women, aged 28±5 years, from the local fitness community and university campus …

Coexistence And Secure Communication In Wireless Networks, Saygin Bakşi Jan 2018

Coexistence And Secure Communication In Wireless Networks, Saygin Bakşi

Electrical & Computer Engineering Theses & Dissertations

In a wireless system, transmitted electromagnetic waves can propagate in all directions and can be received by other users in the system. The signals received by unintended receivers pose two problems; increased interference causing lower system throughput or successful decoding of the information which removes secrecy of the communication. Radio frequency spectrum is a scarce resource and it is allocated by technologies already in use. As a result, many communication systems use the spectrum opportunistically whenever it is available in cognitive radio setting or use unlicensed bands. Hence, efficient use of spectrum by sharing users is crucial to increase maximize …

Molecular Candidates For Blocking The Transmission Of Vector-Borne Diseases, Ashish Naresh Vora Jan 2018

Molecular Candidates For Blocking The Transmission Of Vector-Borne Diseases, Ashish Naresh Vora

Biological Sciences Theses & Dissertations

Vector-borne diseases (VBDs) require urgent attention as they have a high mortality rate, with 700,000 people dying in a year as of 2017. So far, extremely few reliable vaccination strategies and solutions have emerged. Transmission blocking vaccines are one among many solutions available to manage the control of VBDs. These require identification of both vector and pathogen molecules that play important roles in the transmission, dissemination and establishment of VBDs. Our strategy is to characterize these candidates that play important roles in vector-host-pathogen interactions. This manuscript presents two such studies identifying the participation of two arthropod molecules in vector-host-pathogen interactions. …

Regional Sea Level Rise Along The United States Coasts, Alessandra G. Burgos Jan 2018

Regional Sea Level Rise Along The United States Coasts, Alessandra G. Burgos

OES Theses and Dissertations

Over the past several years, there has been several studies focused on reconstructing global mean sea level (GMSL) for the 20th century, along with projecting rates out into the future. Of greater importance for mitigation and adaptation plans, however, is the rate of local or regional sea level (RSL) rise. Ocean dynamics along with changes in Earth’s gravitational field can cause RSL to deviate from the change in GMSL. During the satellite altimeter era covering the past two decades, RSL trends can be four times the global average, with much of this spatial variation due to internal climate variability. Isolating …

Multicharged aluminum ions are generated by a ns Q-switched Nd:YAG laser pulse ablation of an aluminum target in an ultrahigh vacuum. The experiments are conducted using laser pulse energies of 45–90 mJ focused on the Al target surface by a lens with an 80-cm focal length to 0.0024 cm2 spot area …

Examining The Role Of Behavioral Inhibition In Harsh Parenting Preferences: An Analog Study, Kelsey T. Ellis Jan 2018

Examining The Role Of Behavioral Inhibition In Harsh Parenting Preferences: An Analog Study, Kelsey T. Ellis

Psychology Theses & Dissertations

Understanding the cognitive processes involved in harsh parenting behavior would have broad implications for parenting interventions and training programs. Few studies have addressed how parental stressors, specifically infant crying, can influence individuals’ self-regulatory cognitive capacities and ultimately their preference for harsh parenting strategies. Furthermore, little research has explored the link between these cognitive processes and harsh parenting preferences; thus, little work has been done to establish a true causal relationship. This study examined the role of behavioral inhibition in harsh parenting preferences when individuals were exposed to an infant crying noise.

Participants (n = 129) were undergraduate students (Mage = …

Dynamic Response Modeling Of High Speed Planing Craft With Enforced Acceleration, Brian K. Johnson Jan 2018

Dynamic Response Modeling Of High Speed Planing Craft With Enforced Acceleration, Brian K. Johnson

Mechanical & Aerospace Engineering Theses & Dissertations

Due to the harsh conditions high speed planing crafts must endure, research to further the understanding of high speed vessel response during wave impacts was conducted. The integration of a finite element model and captured sea trial acceleration data was investigated. The research shows that the finite element model sub-model can be used in lieu of a full finite element model with minimum degradation in output, thus allowing for the analysis of local stress concentrations where critical equipment and or personnel may be located.

The research effort was completed to develop a method for realizing the stress field and deformation …

Development And Evaluation Of Post-Production Oxygenation Techniques For The Augmentation Of Biochar, Matthew David Huff Jan 2018

Development And Evaluation Of Post-Production Oxygenation Techniques For The Augmentation Of Biochar, Matthew David Huff

Chemistry & Biochemistry Theses & Dissertations

Biochar is the carbon rich solid by-product of biomass pyrolysis. Interest in biochar can be broken down to several main categories: use as a carbon sequestration agent, use as a medium for the removal via adsorption of unwanted materials in wastewater, and as a soil amendment for the increase of cation exchange capacity (CEC). In order to generate a biochar which is stable enough for carbon sequestration, higher temperature pyrolysis must be used in order to ensure a lower O:C ratio in order to increase the half-life of biochar in soil. This dissertation addresses the evaluation of biochars made from …

Predicting Speech-Language Pathology Graduate Student Success: Executive Functions And Standardized Admission Tests, Jane E. Roitsch Jan 2018

Predicting Speech-Language Pathology Graduate Student Success: Executive Functions And Standardized Admission Tests, Jane E. Roitsch

Communication Disorders & Special Education Theses & Dissertations

Within the next three years, the number of available speech-language pathology (SLP) jobs is projected to increase by 18% (Bureau of Labor Statistics, 2018). The most logical response to the escalating market demand would be to increase the number of students admitted into SLP graduate programs. However, this may not be as simple as it sounds.

Successful training of graduate SLP clinicians requires the professional, emotional, financial, and time commitments of the program’s clinical and academic faculty. The accreditation status of graduate SLP programs is based in part on graduation completion rates and students passing the national examination in SLP, …

Extreme Makeover: Finding Aid Edition, Jessica E. Johnson, Margaret T. Kidd, Laura Muskavitch Jan 2018

Extreme Makeover: Finding Aid Edition, Jessica E. Johnson, Margaret T. Kidd, Laura Muskavitch

VCU Libraries Faculty and Staff Presentations

Just as fashion trends change over time, so do our standards for finding aids. Recently, we revisited a number of our guides that have existed unchanged online for years and found that many have not aged well. Some finding aids were written by untrained staff or were created prior to the introduction of DACS. Others suffered from neglect in that they weren’t updated to reflect accruals to a collection or were not checked for grammar and spelling errors. It was time to take our finding aids from drab to fab, but how?

Demonstration And Damnation: William Blake's Eternal Death Of Unbelief, Joshua Schouten De Jel Jan 2018

Demonstration And Damnation: William Blake's Eternal Death Of Unbelief, Joshua Schouten De Jel

School of Law, Humanities and Social Sciences

In Blake’s mythopoeia, as well as his personal eschatology, belief is the source of life itself; all creative acts, all visionary episodes, stem from an individual’s belief. “Eternal Death,” which is the cycle of Generation, is the result of unbelief. Francis Bacon, Isaac Newton, and John Locke were, for Blake, the triumvirate of culpable votaries for the propagation of rational reductionism which had led to the reification of “Natural Religion” in the form of Deism and Rational Dissent in England and, with the addition of Rousseau and Voltaire, of the apotheosis in France of the Cult of Reason. The French …

Below-Knee Amputations: A Review, Erika L. Garbrecht Jan 2018

Below-Knee Amputations: A Review, Erika L. Garbrecht

UNM Orthopaedic Research Journal

At our institution, physicians from the orthopaedic department perform a considerable proportion of below-knee amputations. These amputations are performed to treat non-traumatic and traumatic injuries. However, the outcomes of amputation are not discussed as often in our educational experience as those of other procedures. The current review examines the current and relevant studies for indications and outcomes of patients with non-traumatic and traumatic conditions treated with below-knee amputations.

Primary Fusion For Treating High-Energy Intraarticular Fractures Of The Distal Tibia: A Review, Tony G. Pedri Jan 2018

Primary Fusion For Treating High-Energy Intraarticular Fractures Of The Distal Tibia: A Review, Tony G. Pedri

UNM Orthopaedic Research Journal

Orthopaedic surgeons on-call often see patients with fractures of the distal tibia involving the articular surface, with extension proximal into the metaphysis, or intraarticular distal tibia fractures. These injuries pose unique challenges owing to the typical highenergy mechanism, articular-surface involvement, high degree of comminution, and typically large soft-tissue injury. Treatment has evolved greatly with the advent of modern fracture-fixation techniques and implants. However, a large percentage of patients continue to report poor subjective outcomes. Nearly all of these patients develop posttraumatic arthritis, with the most severe often requiring further reconstructive or fusion procedures once healed to treat the symptoms. Recent …

Controversies In Treatment Of Pediatric Supracondylar Humerus Fractures: A Review, Brielle Payne Plost Jan 2018

Controversies In Treatment Of Pediatric Supracondylar Humerus Fractures: A Review, Brielle Payne Plost

UNM Orthopaedic Research Journal

Although supracondylar humerus fractures are one of the most common fractures in children, there remains notable controversy regarding several treatment aspects. Controversial topics include fixation of ipsilateral forearm fractures, treatment of type II supracondylar humerus fractures, pin configuration, timing of operative intervention, and treatment of supracondylar humerus fractures with a vascular injury. Studies have supported both closed and open reduction for treating ipsilateral forearm fractures associated with supracondylar humerus fractures. For type II supracondylar humerus fractures, some studies support nonoperative treatment owing to risks associated with operative treatment such as pin-site infections. However, other studies support operative fixation because of …

Correlating Patient-Specific Anthropometric Variables With Soft-Tissue Thickness At The Superolateral Arthrocentesis Entry Site To The Knee, Savannah P. Krebsbach, Tony G. Pedri, Paul J. Johnson, Christina G. Kurnik, Gehron P. Treme Jan 2018

Correlating Patient-Specific Anthropometric Variables With Soft-Tissue Thickness At The Superolateral Arthrocentesis Entry Site To The Knee, Savannah P. Krebsbach, Tony G. Pedri, Paul J. Johnson, Christina G. Kurnik, Gehron P. Treme

UNM Orthopaedic Research Journal

Background: Irrigation for treating septic joints in adults in the emergency department is possible but requires the development of novel systems that fit all body habitus. However, varying body habitus and age of patients may affect the amount of soft tissue surrounding the knee joint capsule. We examined whether the dimensions of the soft-tissue thickness at the superolateral approach of entry to the arthrocentesis site correlated with patient anthropometric data such as age, sex, height, weight, and body mass index (BMI, kg/m2).

Methods: Using the diagnosis code 844.2 (International Classification of Diseases, Ninth Revision), we reviewed findings of magnetic resonance …

Rhabdomyolysis Of The Abdominal Wall In A 23-Year-Old Football Player: A Case Report, Brandon J. Hockenberry, Christopher A. Mcgrew, Shane P. Cass, James P. Toldi Jan 2018

Rhabdomyolysis Of The Abdominal Wall In A 23-Year-Old Football Player: A Case Report, Brandon J. Hockenberry, Christopher A. Mcgrew, Shane P. Cass, James P. Toldi

UNM Orthopaedic Research Journal

Rhabdomyolysis is a syndrome caused by injury to skeletal muscle, which results in leakage of large quantities of potentially toxic intracellular contents into plasma. Causes include direct trauma, drug use, genetic muscle diseases, hyperthermia, seizures, ischemia, and severe exertion. We describe a rare case of exercise related rhabdomyolysis of the abdominal wall in a 23-year-old football player. He presented with painless hematuria after starting a new abdominal workout routine to lose weight. Although the workout was not excessively strenuous, it involved new exercises targeting a poorly trained muscle group. Results of initial workup indicated severely elevated levels of creatine kinase. …

Simultaneous Avulsion Fractures Of The Tibial Tuberosity Of Both Knees In A 14-Year-Old Boy: A Case Report, Margaret E. Pusateri, Selina R. Silva, Christopher A. Mcgrew Jan 2018

Simultaneous Avulsion Fractures Of The Tibial Tuberosity Of Both Knees In A 14-Year-Old Boy: A Case Report, Margaret E. Pusateri, Selina R. Silva, Christopher A. Mcgrew

UNM Orthopaedic Research Journal

Fractures of the tibial tuberosity are uncommon injuries in adolescents, representing an estimated 0.4% to 2.7% of all pediatric fractures. Most of these injuries occur in young, active males commonly between the ages of 12 to 17 years. Sports, particularly those involving jumping or sudden starts and stops, are most often implicated. Injuries of the tibial tuberosity of both knees are especially rare, with little more than 30 cases reported in the past 60 years. We present a 14-year-old male football player with simultaneous avulsion fractures of the tibial tuberosity of both knees. We reviewed the anatomy, mechanisms of injury, …

Open Reduction And Internal Fixation For Treating Pertrochanteric Femoral Fracture Below A Hip-Resurfacing Implant In A 65-Year-Old Man: A Case Report, Alex Telis, Christopher R. Hanosh Jan 2018

Open Reduction And Internal Fixation For Treating Pertrochanteric Femoral Fracture Below A Hip-Resurfacing Implant In A 65-Year-Old Man: A Case Report, Alex Telis, Christopher R. Hanosh

UNM Orthopaedic Research Journal

Periprosthetic proximal and pertrochanteric femur fractures around a well fixed hip resurfacing implant present a challenge to orthopaedic surgeons, as they do not allow the most biomechanically favorable fixation constructs in patients with otherwise highdemand levels of physical activity. A 65-year-old man hit a tree while skiing. He presented to our emergency department with a right-sided pertrochanteric fracture of the proximal femur beneath an implant used in prior hip resurfacing. The patient underwent open reduction and internal fixation with intraoperative fluoroscopyassisted manipulation to ensure fixation of the hip resurfacing. At 6-week follow-up, a slight varus collapse at the fracture was …

Orthopaedic-Based Treatment Of Laurin- Sandrow Syndrome In A 13-Month-Old Child: A Case Report, Marcella R. Woiczik, John C. Carey, David M. Bennett, Brielle Payne Plost Jan 2018

Orthopaedic-Based Treatment Of Laurin- Sandrow Syndrome In A 13-Month-Old Child: A Case Report, Marcella R. Woiczik, John C. Carey, David M. Bennett, Brielle Payne Plost

UNM Orthopaedic Research Journal

Laurin-Sandrow syndrome (LSS) is a rare condition with only a few published cases in studies. This syndrome, originally described by Laurin in 1964 and again by Sandrow in 1970, can involve digit duplication with mirror hand and foot deformity, ulnar and tibial dimelia, and abnormalities of the knee, ankle, and nasal passages. A 7-month-old male infant presented to our clinic with limited function of his hands and feet due to multiple abnormalities. Results of clinical and radiographic examinations were suggestive of LSS, confirmed by a geneticist. Amputations through the knees, reconstructive pollicization of the right hand, and surgical removal of …

Acute Gluteus Medius And Minimus Intramuscular Tear In A 59-Year-Old Half-Marathon Runner: A Case Report, Claire E. Zeorlin, Eric R. Reynolds, Dustin L. Richter, Christopher A. Mcgrew Jan 2018

Acute Gluteus Medius And Minimus Intramuscular Tear In A 59-Year-Old Half-Marathon Runner: A Case Report, Claire E. Zeorlin, Eric R. Reynolds, Dustin L. Richter, Christopher A. Mcgrew

UNM Orthopaedic Research Journal

Acute gluteus medius and minimus tears are an infrequent and possibly underdiagnosed cause of lateral hip pain. When reported, they most commonly occur at the distal tendinous attachment at the insertion on the greater trochanter or at the musculotendinous junction. It is rare for muscle belly or proximal muscle tears to occur. They are more prevalent in the setting of degenerative joint disease, but cases have also been described in previously healthy athletes without preexisting joint or muscle disease. We describe a 59-year-old man who developed considerable pain and swelling on the left side of the hip during a halfmarathon …

Battling For Human Rights In Indian Country (Speech At The 50 Years Of The Indian Civil Rights Act Symposium), David E. Wilkins, Lumbee Nation Jan 2018

Battling For Human Rights In Indian Country (Speech At The 50 Years Of The Indian Civil Rights Act Symposium), David E. Wilkins, Lumbee Nation

Tribal Law Journal

The speech discusses the Indian Civil Rights Act (ICRA) and its implications on citizenship, specifically disenrollment. Prof. Wilkins discusses his view of “‘dismemberment’ as the act of cutting off a part of the tribal body—doing harm to both the politically discarded individual and the Nation itself—taking place behind the cloak of native sovereignty.”

The speech first provides a brief history of banishment within tribal communities followed by a discussion of federal Indian law and its impact on tribal banishment through a review of important federal Supreme Court cases as well as significant tribal court cases.

Second, the speech provides a …
