Mission Product Holdings, Inc. V. Tempnology, Llc, Nka Old Cold Llc: Brief Of Law Professors As Amici Curiae Supporting Petitioner, John A. E. Pottow
Appellate Briefs
Amici, whose names and affiliations are set forth in alphabetical order in the attached Appendix, are law professors who study the United States bankruptcy system. They write solely to share their disinterested views regarding the important question of federal bankruptcy law presented in this case. To the best of their knowledge, no amicus has any financial interest in the outcome of this case.
The First Circuit's decision below inexplicably resuscitates a long-rejected decision-Lubrizol Enters., Inc. v. Richmond Metal Finishers, Inc., 756 F.2d 1043 (4th Cir. 1985) that allowed intellectual property licensors to exploit a bankruptcy filing to unilaterally …

Representing Outside The Box: Identity-Based Constituencies And Surrogate Representation In U.S. State Legislatures, Julia Hellwege
Representing Outside The Box: Identity-Based Constituencies And Surrogate Representation In U.S. State Legislatures, Julia Hellwege
Political Science ETDs
This project asks: whom do representatives seek to represent and how do they do it? Specifically, I seek to understand how marginalized state legislators define the concept of “constituency” and the implications for their legislative behavior. I argue that marginalization affects legislators through two avenues: socially through their identity, and institutionally through the proportion their identity group holds in the state legislature. I argue that when legislators are marginalized their awareness of identity and identity-based issue needs are prioritized and they will come to define group members as a salient identity constituency. Furthermore, they will seek to represent this salient …
S.O.S. Eisberg Versus S.O.S. Iceberg - Two Nations' Visualizations Of Arctic Landscapes, Kerstin Anne Aloia
S.O.S. Eisberg Versus S.O.S. Iceberg - Two Nations' Visualizations Of Arctic Landscapes, Kerstin Anne Aloia
English
This project is a comparison of the perspectives on Arctic nature that are featured in the 1933 films S.O.S. Eisberg and S.O.S. Iceberg. I am arguing that the director of each version was influenced by his cultural background in visualizing the relationship between Arctic nature and the white explorers that encounter it in their films. Both Arnold Fanck, who created S.O.S. Eisberg, and Tay Garnett, who created S.O.S. Iceberg, worked with the same documentary footage that was filmed at Greenland's Arctic shores, but turned it into two different films. S.O.S. Eisberg turns the Arctic into a space whose hostile forces …
Metal(Loid) Liberation From Alaskan Coal Combustion Products As A Function Of Time In Various Aqueous Media, Kyle P. Milke
Metal(Loid) Liberation From Alaskan Coal Combustion Products As A Function Of Time In Various Aqueous Media, Kyle P. Milke
Chemistry and Biochemistry
Little is known about the fate and potential toxicity of metal(loid)s that could be leached from coal combustion products by a (sub- )Arctic environment. Several potentially toxic elements are enriched in coal combustion products relative to the average crustal abundance including As, Cu, Se, and Sb. The overarching goal of this project is to examine the release of these and other metal(loid)s from early stage coal ash and fly ash from the University of Alaska Fairbanks (UAF) power plant and identify transformations in the presence of aqueous environmental media. Bioaccessibility experiments performed indicate that early stage coal ash and fly …

Integrating Comprehension Instruction, Multimodalities And Co-Construction Into Cultural Learning, Christine Harrington
Education
This study explores the impact of a story-based approach to teaching reading strategies, and examines the implementation of and co-construction within multimodal activities. Eight third grade students participated in this study in a charter school focused on Alaska Native cultural learning. The phases of the PACE Model focused on transitional words and phrases in the context of a traditional story from the Tlingit, Haida, and Tsimshian cultures of Alaska. Their attention to the language feature was extended to summarizing and retelling as part of the Extension phase of the model. The results are consistent with previous studies that attributed focus …
Gizmos And Gadgets: A Guidebook Of Technological Resources In The Elementary Classroom, Rachel A. Dobrich
Gizmos And Gadgets: A Guidebook Of Technological Resources In The Elementary Classroom, Rachel A. Dobrich
Education
This research examines the implementation of technology in elementary classrooms. Prior research has shown that elementary teachers have more positive perspectives towards technology incorporation when sufficiently trained through pre-service teacher preparation programs and professional development opportunities for existing educators. Adequate technology instruction is necessary because it teaches educators about available resources and how to appropriately and meaningfully incorporate them into their lessons. Teachers need to provide relevant, authentic learning experiences for their students, teaching them how to function in a technological society. Technology has the potential to increase engagement and academic performance. It also allows teachers to create an accessible …

Design Of A Multichannel Outdoor Data Logger For Precise Temperature Measurements, Kirill Dolgikh
Engineering
In this thesis, we present the prototype of a multichannel data logger (the Logger) for precise temperature measurements. Its intended application is to take soil (permafrost) temperature measurements with a thermistor probe or thermistor string. However, its hardware and firmware architectures are quite flexible, so it can be used in other applications. The Logger has 16 channels. In addition to the internal memory, it supports microSD-cards of up to 2 GB, which allows it to store up to 41.9 million measurements for each channel. The Logger's estimated battery life is 8 years when making measurements once per hour. It has …

Reindeer, Dogs, And Horses Among The Tozhu Reindeer Herder-Hunters In The Siberian Taiga, Tayana Arakchaa
Reindeer, Dogs, And Horses Among The Tozhu Reindeer Herder-Hunters In The Siberian Taiga, Tayana Arakchaa
Anthropology
Anthropological studies have typically represented reindeer as the uniquely key domesticated animal species for Siberian people. For Tozhu reindeer herder-hunters, however, such a perspective ignores the important roles of dogs and horses. These species are equally vital and interdependent partners of daily life in the mountainous areas of Tuva where Tozhu people live. Each animal comes with specific characteristics, challenges and benefits that necessitate a multispecies perspective--the reindeer-dog-horse triad of Tozhu hunting and reindeer herding economies. This research completes the picture of how taiga-dwelling Tozhu and the three important animal species co-exist together. It seeks to portray: 1) how the …
Dui Courts: The Need For Standardized Dui Court Evaluations, Howard Cameron
Dui Courts: The Need For Standardized Dui Court Evaluations, Howard Cameron
Justice
There have been numerous evaluations of driving under the influence (DUI) treatment courts. The evaluation process and tools vary widely. This research project reviewed seven individual courts' evaluations, including process evaluations and outcome evaluations to determine the strength of each court's evaluation. The research goal was to better understand how these courts are evaluated, the strength of those evaluation processes, and to determine what, if any, changes can and should be made to strengthen them. Presently, there are not any standardized evaluations tools for DUI treatment courts. This research concludes that evaluations should be standardized and such standardization will allow …

Being Black And Depressed Double Sucks, Stephanie C. Jones
Being Black And Depressed Double Sucks, Stephanie C. Jones
Student Theses and Dissertations
This paper investigates the ways race and racism mediate perceptions and experiences of depression among young Black Americans living in the New York metropolitan area. Based on 25 in-depth interviews with Black Americans between the ages of 18-28, the research shows that the Black identity exacerbates suffering for participants because it fundamentally changes how depression is lived, felt, and navigated. This study extends research about the lack of cultural competence among American health professionals, stigma surrounding mental illnesses among the Black American community, and the effects of the systematic dehumanization of Black bodies in American society.

Examining The Role Of Professional Orientation In How Trustees Of New Jersey's State Colleges And Universities Experience Their Fiduciary Responsibilities: A Mixed Methods Study, Brittany Ann Williams-Goldstein
Theses and Dissertations
The purpose of this sequential explanatory study was to examine, through the lenses of sensemaking theory and professional authority, the relationship between how largely non-educational professionals in New Jersey experience their fiduciary responsibilities as trustees of the state's public colleges and universities and to what extent their professional orientations influence their oversight.
Trustees draw from a continuum of orientations to navigate their responsibilities and chief among them are professional orientation, institutionally-rooted orientation, and orientations as members of traditionally underrepresented populations. Trustees frequently engage in deferential activities with their fellow board members whose professional or other orientations provide needed context for …

Sub-Nanometer Coupling Distance Control And Plasmon Enhanced Carrier Generation And Dynamics In Iii-V Semiconductor Heterostructures, Sharmin Haq
Optical Science and Engineering ETDs
Plasmonic modes in metal nanostructures enable light confinement at subwavelength scales. This field confinement is important for exploring the potential of nanotechnology in miniaturization of optics as well as for the advancement of optoelectronic devices, such as photodetectors, photovoltaics, and light-emitting diodes. Plasmon resonances are also ideal for developing ultrasensitive biosensors, and for enhancing surface photochemistry and photocatalysis. The increasing number of plasmon applications requires fundamental understanding of the plasmon coupled system which has not yet been completely understood. Controlling and engineering the plasmon response at the nanoscale will open still more applications in material science, communications, biochemistry and medicine. …

Effect Of Strong Electrolyte Containing Gelling Aids On The Sol-Gel Transition Temperature Of Hypromellose 2910, Elnaz Sadeghi
Biomedical Engineering ETDs
Hypromellose, or hydroxypropyl methylcellulose (HPMC) - has been widely used for biomedical and pharmaceutical applications due to its advantages, including that it is modifiable in terms of viscosity, and it has the ability to form thermally reversible hydrogels. The thermal gelation temperature (TGel) of a given HPMC solution strongly depends on its characteristic grade and the solution concentration. Applying certain additives can modify the TGel even further; depending on their nature and concentration. With the addition of said additives, a lower or higher TGel can be obtained. For example, the addition of sodium chloride (NaCl) reduces …
