Lies, Liars, And Lawyers As Legislators: An Argument Towards Holding Attorneys Accountable For Violating The Model Rule Of Professional Conduct 8.4(C) Whilst Acting In A Legislative Role, Eliot T. Tracz
Southern Illinois University Law Journal
This essay looks at Model Rule of Professional Conduct 8.4(c) (often referred to hereafter simply as the Dishonesty Rule) and questions its scope and authority when applied to statements made by elected legislators who are lawyer-legislators. In using the term “lawyer-legislator,” I specifically mean an elected member of a state or federal legislative body who holds a law license, though the license is not necessarily being used in the capacity as a legislator. The fact that the lawyer-legislator is not acting in a professional capacity becomes important later on. Section II provides an introduction to Model Rule of Professional Conduct …

The History Of The Modern Class Action, Part Ii: Litigation And Legitimacy, 1981-1994, David Marcus
The History Of The Modern Class Action, Part Ii: Litigation And Legitimacy, 1981-1994, David Marcus
Fordham Law Review
The first era of the modern class action began in 1966, with revisions to Rule 23 of the Federal Rules of Civil Procedure. It ended in 1980. Significant turmoil roiled these years. Policymakers grappled with the powerful device as advocates argued over its purpose, and judges struggled to create rules for the novel litigation the remade Rule 23 generated. This Article tells the story of the class action’s second era, which stretched from 1981 to 1994. At first blush, these were quiet years. Doctrine barely changed, and until the early 1990s, policymakers all but ignored the device. Below this surface …

When Girls Play With G.I. Joes And Boys Play With Barbies: The Path To Gender Reassignment In Minors, Nicole Burt
When Girls Play With G.I. Joes And Boys Play With Barbies: The Path To Gender Reassignment In Minors, Nicole Burt
Florida Law Review
Currently, the process of gender reassignment in minors requires parental consent and the approval of a mental-health counselor. The actual treatment can begin with puberty blockers-which stall the beginnings of puberty-followed by hormone injections to transform the minor into the requested gender. The hormone injections are thought to have irreversible features, but the effects of these injections are largely untested. The final step, surgical reassignment, is seemingly limited to those over the age of eighteen. The process of reassignment in minors has seen a substantial increase nationwide over the past decade, although the exact number of those seeking reassignment is …

Survivors Representing Survivors: Shared Experience And Identity In Direct Service Lawyering, Kelly Jo Popkin
Survivors Representing Survivors: Shared Experience And Identity In Direct Service Lawyering, Kelly Jo Popkin
Lincoln Memorial University Law Review Archive
First, the survey gauges the effects that personal experiences of gender-based violence may have on the delivery of quality direct legal representation for survivors of gender-based violence. Instead of tracking trial outcomes or other tangible legal “wins,” these questions assess metrics of quality through empathy, professional distance, client-centered practice, and other commonly regarded ideals within the practice of direct service lawyering for under-served communities. The survey also gauges the lasting effect that this work may have on the attorneys themselves, in both their approach to lawyering and their perception of gender-based violence on an individual, local, and systemic scale.

Litigating Genocide: A Consideration Of The Criminal Court In Light Of The German Jew's Legal Response To Nazi Persecution, 1933-1941, Jody M. Prescott
Maine Law Review
After years of negotiation, a majority of the nations of the world have agreed to create an International Criminal Court. It will be given jurisdiction over three core types of offenses: genocide, crimes against humanity, and war crimes. With regard to war crimes, however, nations that join the court may take advantage of an “opt-out” procedure, whereby the court's jurisdiction over these offenses may be rejected for seven years after the court comes into existence. For various reasons, a small number of nations, including the United States, have refused to sign the treaty creating the court. While heralded as a …

Competing Liabilities: Responding To Evidence Of Child Abuse That Surface During The Attorney-Client Relationship, Alison Beyea
Maine Law Review
Kevin Adams, a practicing attorney in Maine, represents John Brown in a dispute with Brown's landlord. Brown is facing eviction as a result of his inability to pay the rent. Over the course of the representation, Adams has come to believe that Brown is abusing his son. Brown--who is working two jobs but still cannot pay his rent--has told Adams of the incredible pressure he is facing. Brown has admitted that the pressure is getting to him and that he feels bad that he has been “taking it out on the kid.” Brown also told Adams that he had been …

On The Liberation Of All Women: Socialist Feminism And Materialist Ecofeminism, Gina Gaebl
On The Liberation Of All Women: Socialist Feminism And Materialist Ecofeminism, Gina Gaebl
Acta Cogitata: An Undergraduate Journal in Philosophy
Feminists of the Western world claim to be striving for the liberation of all women, yet face a number of challenges in the pursuit of truly acting upon this objective. One of these challenges is the way in which western structures, such as capitalism, thrive off of the exploitation of women in developing countries. Other related challenges include the unintentional belittling of the cultures and feminist movements of developing countries through cultural imperialism and culture-blaming. In this paper, I argue that the only version of feminism that truly works for the liberation of all women is socialist feminism. Furthermore, this …
