Their task is to increase the flexibility and efficiency of the management of local government units. The aim of the paper is to find out about the first experiences of capital cities of voivodeships, and to indicate the most commonly functioning organisational models. The studies were based on the analysis of resolutions establishing shared services centres and the analysis of city budgets.

Conceptualizing Allyship As An Actionable Construct In Higher Education, Shannon Radford May 2018

Conceptualizing Allyship As An Actionable Construct In Higher Education, Shannon Radford

Honors Program Theses and Projects

This research intends to re-conceptualize allyship as an actionable construct. Previous research conducted on allyship primarily focuses on development and motivation. Although action is often identified as a component of allyship, previous research has only briefly touched upon this topic. In such a tumultuous political climate, this gap in research is distressing. With hate groups on the rise, it has become increasingly important for allyship to become synonymous with action. As institutions of higher education can play a crucial role in providing an actionable definition of allyship and fostering it in campus communities, this study focuses on identifying actions exhibited …

What To Expect When You Are Arrested: A Guide To Navigating For Unhoused Defendants, Brittany Chiechi, Ivona Ogramic, Colleen Rowe, Sara Rankin

Homeless Rights Advocacy Project

Public defenders often are overworked and have little time to spend with clients; many defendants do not even receive one. But even represented unhoused defendants can help themselves with HRAP’s first-of-its-kind guide to navigating court, which introduces common legal terms and timelines, and provides strategies for those experiencing homelessness to advocate for themselves.

Creating A Classroom Component For Field Placement Programs: Enhancing Clinical Goals With Feminist Pedagogy, Linda Morton May 2018

Creating A Classroom Component For Field Placement Programs: Enhancing Clinical Goals With Feminist Pedagogy, Linda Morton

Maine Law Review

There exists a historic conflict between the more traditional Langdellian philosophy of legal education, and the experiential philosophy of apprenticeship programs, now known as field placement programs. The conflict is most recently apparent in the American Bar Association's (ABA) attempts to impose a more traditional classroom format on field placement programs through its regulations, guidelines, and instructions pertaining to law school accreditation. The ABA argues that law schools need to allocate greater instructional resources toward their field placement programs, particularly programs that provide more than one-half a semester's credit. Such programs should include a classroom component that meets ABA guidelines. …

Examining The Impact Of Transformational And Transactional Leadership Style On Work Attitudes, Motivation, And Work Outcomes In Nonprofit Organizations, Kim Hartzler-Weakley

Dissertations, 2014-2019

In an effort to better understand leadership and turnover in the nonprofit sector, this study investigated the impact of transactional and transformational leadership style on work attitudes, motivation, and work outcomes in nonprofit organizations. Hierarchical multiple linear regression analyses were conducted. Neither transactional leadership nor transformational leadership were significant predictors of turnover. Only transactional leadership was found to be a significant predictor of organizational citizenship behaviors. Transactional leadership was a significant predictor of perceived organizational support, affective commitment, procedural justice, and continuance commitment. Transformational leadership was a significant predictor of job satisfaction, perceived organizational support, and procedural justice. Finally, mediation …

Access To Justice And Routine Legal Services: New Technologies Meet Bar Regulators, Benjamin H. Barton May 2018

Access To Justice And Routine Legal Services: New Technologies Meet Bar Regulators, Benjamin H. Barton

Scholarly Works

We are in the early stages of a technological revolution in legal services. Technology is displacing lawyers in a wide array of tasks such as document drafting, review, and assembly, and is also reshaping the way that lawyers find clients and deliver assistance. For most consumers, these are welcome developments. Such innovations generally reduce costs and increase both accessibility and efficiency. The potential gains are particularly great for low- and middle-income consumers, who lack access for a vast array of basic, often urgent, legal needs. Yet for lawyers, the consequences of technology have been more mixed. Many feel that their …

Health And Human Rights Of Syrian Women And Children Refugees: Trafficking, Resettlement, And The United Nations Convention On Refugees Revisited, Lori Maria Walton Phd, Dpt, Mph(S), Clt

Journal of Health Ethics

In 2016, there were approximately 22.5 million refugees displaced outside their home country because of armed conflict, over half of whom are minors. Syria reported the highest number, with over eleven million refugees displaced, both internally and externally, from zones of conflict in 2017. Over five million Syrian refugees, between the years 2011 and 2017, have fled to other countries including: Lebanon (1.1 million), Jordan (660,000), Egypt (122,000), Turkey (2.9 million) and Iraq (241,000). Exposure to war, displacement, and violence deprives women and children of the basic right to health, including the “right to control one’s health and body” and …

Sex Trafficking Of Transgender And Gender Nonconforming Youth In The United States, Meaghan Tomasiewicz May 2018

Sex Trafficking Of Transgender And Gender Nonconforming Youth In The United States, Meaghan Tomasiewicz

Center for the Human Rights of Children

There is a growing body of research from a variety of disciplines highlighting the overrepresentation of LGBTQ identified individuals among sex trafficked and commercially sexually exploited (CSE) youth. A much smaller subset of this research specifically focuses on transgender female youth. Transgender male, GNC, and intersex youth are largely excluded from the available literature. The issues and obstacles faced by the transgender and GNC communities require specialized services that are not necessarily applicable to the LGBTQ community as a whole due to population-specific healthcare, mental health, and safety factors in addition to employment discrimination, housing discrimination, and familial rejection. By …

Removing Camouflaged Barriers To Equality: Overcoming Systemic Sexual Assault And Harassment At The Military Academies, Rebecca Weiant May 2018

Removing Camouflaged Barriers To Equality: Overcoming Systemic Sexual Assault And Harassment At The Military Academies, Rebecca Weiant

Michigan Journal of Gender & Law

The Education Amendments of 1972 introduced requirements to protect female students from discriminatory policies at post-secondary institutions. A portion of those amendments, commonly known as Title IX, require that no students be subjected to discrimination based on their sex by any educational institution or activity receiving federal financial assistance. An exemption under § 1681(a)(4), however, explicitly prohibits application of Title IX to any educational institution whose primary purpose is to train individuals for military service or the merchant marine. Although those students are still subject to stringent conduct standards, the service academies themselves are tethered to sex discrimination policies only …

Family Courts As Certifying Agencies: When Family Courts Can Certify U Visa Applications For Survivors Of Intimate Partner Violence, Sylvia Lara Altreuter May 2018

Family Courts As Certifying Agencies: When Family Courts Can Certify U Visa Applications For Survivors Of Intimate Partner Violence, Sylvia Lara Altreuter

Fordham Law Review

Undocumented intimate partner violence survivors living in the UnitedStates have limited options for immigration relief. One of the only avenuesopen to them is the U Visa: a nonimmigrant visa established by the BatteredImmigrant Women Protection Act of 2000. To apply for a U Visa, a survivormust prove to immigration authorities that she was the victim of a crime;suffered substantial abuse; and was, is,or is likely to be helpful in theinvestigation of her abuser. The statute requires that all U Visa applicationsbe certified by an appropriate officialwho testifies to the applicant’shelpfulness with the investigation. This certification is a tremendous obstaclefor survivors: …

Guilty Until Proven Innocent: California's Prop. 50 Turns The Concept Of Due Process On Its Head, Brantley I. Pepperman

Loyola of Los Angeles Law Review

For decades, “good governance” has been little more than a talking point for politicians on the road to reelection or a promotion to higher office. In 2014, the California Legislature attempted to give teeth to the idea, successfully spearheading an amendment to the California Constitution approved by voters in 2016. But despite its efforts to “drain the swamp,” the Legislature gave itself a powerful tool, the authority to suspend or expel legislators without pay, that presents more problems than solutions. This article explores the implications of that amendment, including the extent to which it, as codified, comports with procedural due …

Undocumented Immigrants And The Us Professional Licensing Problem, Madeleine Truman May 2018

Undocumented Immigrants And The Us Professional Licensing Problem, Madeleine Truman

Brigham Young University Prelaw Review

The number of illegal immigrants to the United States continues to rise each. Many individuals are blocked from citizenship and its subsequent opportunities by a broken system. Undocumented early arrivals, such as DACA recipients and DREAMers, though currently not targeted for deportation, are prevented from succeeding in their chosen field due to an immigration status they did not choose. Like their native born counterparts, they should have the same right to work in a professional field if they prove themselves to be as equally qualified in all aspects barring immigration status.

Lawyers' Abuse Of Technology, Cheryl B. Preston May 2018

Lawyers' Abuse Of Technology, Cheryl B. Preston

Cornell Law Review

Lawyers are highly educated and, allegedly, of higher than average intelligence, but sometimes individual lawyers demonstrate colossal errors in judgment, especially when insufficiently trained in the new and emerging risks involved with the technological age. For instance, although the internet is a necessary tool for attorneys' and is now a prominent feature in the everyday lives of all actors in the legal system, this technology poses particularized and often unanticipated risks of professional and ethical abuse -- risks that are extraordinary both in quantity and intensity. As Harvard's Director of the Center for the Legal Profession warned: We are "only …

The Right To Two Criminal Defense Lawyers, Bruce A. Green May 2018

The Right To Two Criminal Defense Lawyers, Bruce A. Green

Mercer Law Review

"What can courts, legislators, or criminal defense lawyers themselves do to seriously change criminal defense practice in a manner that significantly benefits criminal defendants and promotes justice?" That question was posed to the participants in an August 2017 SEALS discussion group and Mercer University School of Law's 2017 Symposium on "disruptive innovation in criminal defense." The implied premise of the question is that aspects of criminal defense should be fixed or can be improved-and in radical ways.

The question of disruptive innovation provides an occasion for identifying deficiencies and weaknesses in contemporary criminal defense practice, and because defense lawyers do …

Raising The Bar: Indigent Defense And The Right To A Partisan Lawyer, Steven Zeidman May 2018

Raising The Bar: Indigent Defense And The Right To A Partisan Lawyer, Steven Zeidman

Mercer Law Review

In Ake v. Oklahoma, the Supreme Court of the United States held that an indigent defendant is entitled to the assistance of an expert in cases where it is established that mental health is at issue. Thirty-two years later, in McWilliams v. Dunn, the Court finally addressed whether an expert must be independent of the prosecution. During oral argument, counsel for McWilliams argued that Ake required that the expert must be part of the defense team and on the defendant's side. Justice Gorsuch, in only his second week on the Court, stated dubiously that if that were the …

Exploring Adolescent Dating Violence In Rural Communities: A Mixed Methods Study, Sarah A. Taylor May 2018

Exploring Adolescent Dating Violence In Rural Communities: A Mixed Methods Study, Sarah A. Taylor

College of Education and Human Sciences: Dissertations, Theses, and Student Research

Adolescent dating violence (ADV) occurs nearly twice as often among rural adolescents than it does among non-rural adolescents. Research has suggested several reasons for this population difference. First, people in the rural context oftentimes have traditional gender role attitudestowards male dominance over women, which can be displayed in the form of relationship violence. People in the rural context also tend to have less access to friends and resources (e.g., social services), whichcan further perpetuate violence by limiting a victim’s opportunity to seek help. In addition, rural individuals tend to have a reduced sense of anonymity, and thus, victims may be …

On The Politics And Conceptualization Of Gender Non-Conformity : Exploring Thailand’S Kathoey Population., Macey E. Mayes

College of Arts & Sciences Senior Theses

The purpose of this thesis is to investigate the politics and conceptualization of gender in Thailand, drawing specifically on the Thai understanding of sex and gender with regard to the kathoey population. This work considers the solidification of a third-gender category and looks to the ways this solidification can inhibit the fluidity of gender and sexuality. It also analyzes the dangers of transnational advocacy and the superimposition of Western queer advocacy and theory on Thai gender identities. I approach this issue from an interdisciplinary framework that seeks to include historical, cultural, and theoretical perspectives. In examining anthropological research, critiques of …
