The Devious Debtor: 11 U.S.C. § 523(A)(2)(B) And The Need For A More Equitable Outcome, Torie Levine
Brooklyn Journal of Corporate, Financial & Commercial Law
Section 523(a)(2)(A) of the Bankruptcy Code prohibits debtors from discharging debts for money, property, services, or credit obtained by false pretenses, a false representation, or actual fraud other than a statement respecting the debtor’s financial condition. Under § 523(a)(2)(B), if those debts are obtained by a statement respecting the debtor’s financial condition, then the statement must be in writing for the debt to be discharged. A conflict among the circuit courts arose as to whether a statement about a single asset can be a statement respecting the debtor’s financial condition. This paper aims to determine to what extent Moroccan law is protecting female Sub-Saharan migrants against human rights abuses and in the process, it attempts to determine what the Moroccan government needs to do differently to protect this population. Female migrant women from Sub-Saharan Africa are a population that suffers human rights abuses because of their dual positionality as both women and Sub-Saharan migrants: both of which are discriminated populations in Morocco. This paper explores the relationship between migrants seeking socio-economic integration in Morocco, the organizations facilitating that integration, and the Moroccan government, which determines the bounds within which socio-economic integration takes place. A background in government policy on migration and economic integration, as well as previously gathered data on the ways in which migrants integrate into the economy, forms the foundation for the study. Data collection and analysis from three organizations providing programs within Morocco to support migrants' economic integration provides insight into the ways in which policies and migrants' needs influence the programs that NGOs and other community organizations provide …

In this Article, I will highlight some of my concerns, but they boil down to this: in terms of diagnosis, I am simply not convinced that Judge Marrero has compellingly demonstrated that in the run of cases, our procedural rules are being abused in ways that undermine justice and increase cost and inefficiencies. In part, this is a data-driven critique-there is little empirical support for the proposition that our procedural system is too costly in most cases. But my critique is also an attitudinal one. Markets are becoming more complicated in an ever faster changing world. New findings pertaining to human behavior and consumer markets constantly challenge traditional legal and policy assumptions. Social science offers a myriad of insights into the ways trust, identity, ideology, and preferences interact and impact one another. Against this background, the need to advance a nuanced legal framework is increasingly vital.

Minority Entrepreneurs And Fast Failure, Jesse P. Houchens

Minority businesses now make up more than a quarter of all U.S. businesses; yet, due to discriminatory lending practices, cultural aversions to debt, and limited access to capital, these businesses continue to have higher failure rates. At the same time, m inority entrepreneurs are more likely to rely on informal lending and less likely to turn to bankruptcy for relief of debt. Doing so slows down failure for minority entrepreneurs — contra Silicon Valley’s new mantra, “fail fast” — and diminishes the minority entrepreneur’s ability to efficiently reallocate resources towards more productive ventures. The Pervert’S Guide To Historical Revisionism: Traversing The Marcos Fantasy, Victor Felipe; Bautista
Philippine Studies: Historical and Ethnographic Viewpoints
Thisarticle argues that historical revisionism is constituted by the Marcos fantasy, which (1) generates jouissance and (2) shields Marcos apologists and supporters from the traumatic Real through narrativization, the concealment of lack, and displacement. This fantasy can be dialectically undermined by pushing Marcos apologists and supporters to fully identify with their desire. Although many critiques of such distortions validly tackle factual inconsistencies, they ultimately miss the fantasy by which these perversions are framed. Hence, thearticle attempts a way out of this impasse by employing Žižekian philosophy and psychoanalysis, a mapping of this perversion’s historical origins, and gesturing toward the necessity …

In the age of Michelle Alexander’s The New Jim Crow (2010), promises to depopulate overcrowded American prisons, and a mainstream acknowledgement of mass incarceration, the American criminal justice system is anything but inert. Instead, modalities of punishment are shifting, particularly towards community-located corrections involving GPS surveillance. This paper seeks to examine this evolution of the carceral state through the marriage of two theoretical lenses: carceral geography and Foucauldian spatial power analysis. Carceral geography offers a theory of the embodied nuance of movement. Its work revolves around the three mobilities of the carceral system: movement to/from, within, and between prisons. This …

This article examines international migration from a gender perspective. It asserts that migration can be empowering for women, and at the same time it may exacerbate their vulnerabilities, including abuse and trafficking, particularly when migrants are low skilled or irregular.

Utilizing his executive powers, one of President Trump’s first actions denied entry into the U.S. to individuals from seven different countries. This action immediately set into motion many relief efforts undertaken by attorneys around the nation and showcased lawyers’ work on high impact cases through suits brought by organizations such as the American Civil Liberties Union. While the media attention focused on these efforts in coastal cities at international airports, cities in the interior United States struggled to gather resources and effectively provide legal assistance to affected individuals. A Canadian Lens On Third Party Litigation Funding In The American Bankruptcy Context, Stephanie Ben-Ishai, Emily Uza
Chicago-Kent Law Review
This Article offers two major recommendations to expand the use of third party litigation funding (“TPLF”) into the U.S. insolvency context. As seen in the Canadian context, courts have accepted the use of litigation funding agreements fitting within certain parameters. If U.S. courts follow suit, friction against the implementation of TPLF can be mitigated. Alternatively, regulation may occur through legislative and regulatory models to govern and set out precisely what types of arrangements are permitted. Involving entities such as the SEC may expedite the acceptance of TPLF, but special attention is necessary not to intermingle notions of fiduciaries into the …
