As The Grapefruit Turns Sixty, It’S Time To Get Serious About Clean Up In Outer Space, Humaid Alshamsi, Roy Balleste, Michelle L. D. Hanlon

Journal of Air Law and Commerce

The ability to physically interact with an on-orbit object is an idea that has been stymied by its great cost. Yet the rewards are incalculable. Autonomous on-orbit servicing (OOS) vehicles can potentially repair or salvage an ailing satellite or remove it from orbit. The former can help recoup the considerable investment that goes into the development and construction of a satellite, and the latter would reduce space debris. In short, the development of OOS should be promoted. This paper will explore the legal ramifications and complications of unmanned on-orbit servicing missions. After reviewing the international framework and the current state …

This project focuses on resources available through Tennessee’s privatized public sector healthcare system, TennCare, during the first phases of the Patient Protection and Affordable Care Act (ACA). A critical medical anthropological analysis is used …

Knowledge, Attitude And Health Care Practices For Gender-Based Violence Cases In Yangon, Myanmar, Aye Nyein Ei

Chulalongkorn University Theses and Dissertations (Chula ETD)

Gender-based violence has negative impact on physical, psychological and social wellbeing of the survivor. The initial response can lessen the magnitude of the effect and thus the health care sector's readiness to response GBV cases is important. Hence, a study to explore the knowledge, attitude and practice level regarding GBV response among health care personnel was conducted. A cross-sectional study was conducted in 48 public hospitals in Yangon, Myanmar during April and May 2019 involving 398 health care personnel (doctors and nurses). The measurement tool is self-administered structured questionnaires for demographic assessment, knowledge, attitude, supportive environmental factors and practice. Analysis …

New Takes On Jim Crow: A Review Of Recent Scholarship, Anders Walker Jan 2018

New Takes On Jim Crow: A Review Of Recent Scholarship, Anders Walker

All Faculty Scholarship

More than half a century has passed since C. Vann Woodward penned his iconic monograph, The Strange Career of Jim Crow, and legal segregation continues to compel. Recent works have reassessed Jim Crow’s birth, its life, and its aftermath, suggesting that the system was at once more implicated in the reproduction of racist ideas than had been previously assumed, and also more fluid: a variegated landscape of rules and norms that lent themselves to various forms of political, legal, and cultural resistance.

Socioeconomic Status Discrimination, Danieli Evans Jan 2018

Socioeconomic Status Discrimination, Danieli Evans

Articles

This Article makes the case for protecting socioeconomic status (SES) under discrimination statutes that govern employment, housing, education, voting, public accommodations, and credit/lending. While others have argued that poverty should be a protected class under the Fourteenth Amendment, the courts have rejected this idea. The possibility of protecting SES under discrimination statutes has received little consideration. I argue that this idea deserves more serious attention. I advance four arguments in favor of adding SES to the list of protected traits. Two moral, one political, and one legal.

First and most straightforward, the values animating discrimination law apply to poverty: Existing …

Work Only We Can Do: Professional Responsibility In An Age Of Automation, Sherman J. Clark Jan 2018

Work Only We Can Do: Professional Responsibility In An Age Of Automation, Sherman J. Clark

Articles

Automation can help us do our work as lawyers; but in the process, it should also force us to be more thoughtful about what our work really is or ought to be.' The challenge for the profession, as I see it, is not simply to survive the advent of new technology, nor even merely to make effective use of new tools. While addressing those immediate concerns, we should also welcome the concomitant opportunity to develop and refine our understanding of what it means to be a good and ethical lawyer. As technological developments free us from and prevent us from …

Black Power And Neighborhood Organizing In Minneapolis, Minnesota: The Way Community Center, 1966-1971, Sarah Jayne Paulsen Jan 2018

Black Power And Neighborhood Organizing In Minneapolis, Minnesota: The Way Community Center, 1966-1971, Sarah Jayne Paulsen

Theses and Dissertations

The Way Opportunities Unlimited, Inc. was a non-‐profit community center that operated from 1966—1984 in Minneapolis, Minnesota. Inspired by the national black power movement that arose in the 1960s, this community center led a local movement for African American equality. This thesis investigates The Way as a unique example of how black power ideology was implemented at the local level, in a city with a statistically small black population, presenting a northern urban context often overlooked by historians. The Way offered a space where aspiring young black musicians could perform, including Prince.

Hiv In The United States: A Spatial Examination Of Testing And Outcomes, Sazid Shameem Khan Jan 2018

Hiv In The United States: A Spatial Examination Of Testing And Outcomes, Sazid Shameem Khan

Theses and Dissertations

The main objectives of this dissertation were to provide a complete depiction of the prevalence of HIV across the United States and to assess HIV testing trends among various subpopulations. Additionally, we focused on measuring spatial access to HIV testing resources across the U.S. South, where HIV is rapidly becoming more burdensome and resources have historically been allocated disproportionately. We sought to identify disparate populations and locations that require further focus moving forward to stem the HIV epidemic. We utilized a variety of data sources such as the Behavioral Risk Factor Surveillance System (BRFSS) which was used to assess national …

Central Issues In The Protection Of Child Migrants, Mary Crock, Lenni Benson

Articles & Chapters

In this introductory chapter we identify themes that will be carried throughout the book. We begin in section 2 with a discussion of the human rights challenges presented by children on the move, posing questions that our contributors will address as they build on the themes we identify. This is followed by an examination ofobstacles that have been created to recognising child migrants as rights bearers. After setting out in section 4 a brief outline of the book’s structure, the chapter concludes with some comments on global initiatives that have been made to address the challenges associated with mass migration …

Studying The "New" Civil Judges, Anna E. Carpenter, Jessica K. Steinberg, Colleen F. Shanahan, Alyx Mark

Articles, Chapters in Books and Other Contributions to Scholarly Works

We know very little about the people and institutions that make up the bulk of the United States civil justice system: state judges and state courts. Our understanding of civil justice is based primarily on federal litigationand the decisions of appellate judges. Staggeringly little legalscholarship focuses on state courts and judges. We imply do not know what mostjudges are doing in their day-to-day courtroom roles or in their roles asinstitutional actors and managers of civil justice infrastructure. We know little about the factors that shape and influence judicial practices, let alone the consequences of those practices for courts, litigants, and the …

Appointed Counsel And Jury Trial: The Rights That Undermine The Other Rights, Russell L. Christopher Jan 2018

Appointed Counsel And Jury Trial: The Rights That Undermine The Other Rights, Russell L. Christopher

Articles, Chapters in Books and Other Contributions to Scholarly Works

Do the Sixth Amendment rights to appointed counsel and jury trial unconstitutionally conflict with defendants' other constitutional rights? For indigents charged with felonies, Gideon v. Wainwright guarantees the right to appointed counsel; for misdemeanors, Scott v. Illinois limits the right to indigents receiving the most severe authorized punishment-imprisonment. Duncan v. Illinois limits the right to jury trial to defendants charged with serious offenses. Consequently, the greater the jeopardy faced by defendants, the greater the eligibility for appointed counsel and jury trial. But defendants' other constitutional rights generally facilitate just the oppositeminimizing jeopardy by reducing charges, lessening the likelihood of guilt, …

Comparing Literate And Oral Cultures With A View To Improving Understanding Of Students From Oral Traditions: An Autoethnographic Approach, Carol Lee Anderson

EWU Masters Thesis Collection

In his book Orality and Literacy, Walter Ong describes the difference between cultures that have never been exposed to literature and those that have been highly influenced by literature and literacy. He suggests that such learners have a different “consciousness” as a result of their life experience. This notion is later confirmed by research on brain structures that shows preliterate people having developed very different structures from those of highly literate people. In this paper, I describe my own process of becoming literate in a highly literate culture. By comparison, I cite my 34-year experience living with a people group …

The U Visa's Failed Promise For Survivors Of Domestic Violence, Natalie Nanasi Jan 2018

The U Visa's Failed Promise For Survivors Of Domestic Violence, Natalie Nanasi

Faculty Journal Articles and Book Chapters

Recognizing the unique vulnerabilities of immigrants who become victims of crime in the United States, Congress enacted the U visa, a form of immigration relief that provides victims, including survivors of domestic violence, a path to legal status. Along with this humanitarian aim, the U visa was intended to aid law enforcement in efforts to investigate and prosecute crime, based on the notion that victims without legal status might otherwise be too fearful to “come out of the shadows” by reporting offenses to the police. Although these two goals were purportedly coequal, in practice, by requiring survivors to cooperate with …

Collective Struggles: A Comparative Analysis Of Unionizing Temporary Foreign Farm Workers In The United States And Canada, Robert Russo

All Faculty Publications

The use of temporary foreign migrant workers in the labor sector is part of a vibrant political and legal discussion in both the United States and Canada. Current reforms of temporary foreign worker programs in both countries call for an analysis of this workforce. This article focuses on documented temporary foreign workers performing agricultural labor in both countries. It is a comparative study of alleged violations of documented temporary foreign farm workers' rights relating to unionization in the United States and Canada.

The Ethical Practice Of Human-Centered Civil Justice Design, Victor D. Quintanilla, Haley Hinkle Jan 2018

The Ethical Practice Of Human-Centered Civil Justice Design, Victor D. Quintanilla, Haley Hinkle

Articles by Maurer Faculty

Over the past two decades, legal professionals have increasingly engaged in a new form of professional activity: civil justice design. In the past, legal professionals handled cases and transactions for clients or served as neutrals, including mediators and arbitrators, who helped to resolve disputes between parties. Today, legal professionals increasingly play a principal design role in creating systems that resolve streams of conflicts, disputes, and grievances between parties. Lawyers regularly now create internal grievance procedures, procedures for companies to resolve disputes with customers, and court-annexed alternative dispute resolution systems. The emergence of this new role raises difficult questions about the …

Policymaking And Paid Family Leave: Revitalizing The Family Medical Leave Act Of 1993, Jasmeer Basi Jan 2018

Policymaking And Paid Family Leave: Revitalizing The Family Medical Leave Act Of 1993, Jasmeer Basi

Doctoral Dissertations

The Family Medical Leave Act (FMLA) applies to all public agencies, public schools, private elementary schools, and companies with 50 or more employees. It is designed to help employees balance their work and family responsibilities by allowing them to take unpaid leave for certain family and medical reasons. Employees are eligible for leave if they have worked for their employer at least 12 months, at least 1,250 hours over the past 12 months, and work at a location where the company employs 50 or more employees within 75 miles. However, the FMLA has proven to be ineffective in meeting the …

Mobilizing Doubt: The Legal Mobilization Of Climate Denialist Groups, Aaron J. Ley Jan 2018

Mobilizing Doubt: The Legal Mobilization Of Climate Denialist Groups, Aaron J. Ley

Political Science Faculty Publications

The climate change counter-movement (CCCM) deploys a broad repertoire of tactics in its effort to cast doubt on the science of climate change. One important yet understudied tactic is the effort by CCCM groups to use open records laws in scientifically uncertain areas to cast doubt on the accuracy of scientific information. This article explores the use of this tactic by CCCM groups and adds to the legal mobilization literature in three ways. First, it traces the origin of CCCM groups to the broader conservative legal movement of the 1970s that challenged the dominance of the liberal legal network. Second, …

Exposure To Gender-Based Violence And Depressive Symptoms Among Transgender Women In Cambodia: Findings From The National Integrated Biological And Behavioral Survey 2016, Siyan Yi, Sovannary Tuot, Srean Chhim, Pheak Chhoun, Phalkun Mun, Gitau Mburu

Background: Transgender women are at significant risk of HIV, and they face intersecting barriers to health, social, and legal services. However, data regarding the unique needs and experiences of transgender women are globally scant. This study examined the relationship between gender-based violence and depressive symptoms among transgender women in Cambodia.

Methods: This cross-sectional study included 1375 sexually active transgender women recruited by using the respondent-driven sampling method in the capital city of Phnom Penh and 12 provinces between December 2015 and February 2016. Depressive symptoms were assessed using the Center for Epidemiologic Studies Depression scale (CES-D). Multivariate regression analysis was …
