Halted Innovation: The Expansion Of Federal Jurisdiction Over Medicine And The Human Body, Myrisha S. Lewis
Halted Innovation: The Expansion Of Federal Jurisdiction Over Medicine And The Human Body, Myrisha S. Lewis
Utah Law Review
Modern medical innovations are blurring the line between medical practice and medical devices and drugs. Historically, many techniques have been developed in medicine, without any interference from the federal government, as medical practice is (and has historically been) an area of state jurisdiction. Over the past two decades, however, the U.S. Food and Drug Administration (FDA) has been exerting jurisdiction over the human body and the practice of medicine by targeting new medical techniques for oversight and subjecting the continued use of those treatments to onerous and legally questionable regulatory requirements that hinder the use of those treatments in practice. …

Watersheds (also known as water catchments and river basins) are recognised in contemporary science as important natural systems in which to investigate the complex socioecological foundations of health. A watershed is the spatially bound geophysical unit within which surface and shallow groundwater drain to a single collecting stream or river (see appendix). Watersheds are physical and abstract systems: they are open and hydrologically permeable, yet can be represented as functionally distinct. Collectively, watersheds comprise a complex hierarchical network, and thus exemplify the upstream and downstream nature of ecosystems. Watersheds include the social actors, relationships, and institutions located within their boundaries. …

Gender Balance From Civil Strife, Wyndi Shaffner
Boise State University Theses and Dissertations
The purpose of this study is to examine the effect of conflict on the sociopolitical status of women in several affected countries. The conflicts analyzed within this work are both violent and non-violent. I infer that conflict acts as an impetus to propel gender equity. I utilize the Global Gender Gap Index (GGGI) dataset to determine which movements in women’s equality have been made over the preceding twelve years and reinforce that data analysis with qualitative information through case analysis to add context and meaning to the quantitative findings.
This work focuses on two of the four primary indicators of …

Vibration Control In Wind Turbines To Achieve Desired System-Level Performance Under Single And Multiple Hazard Loadings, Milad Rezaee, Aly Mousaad Aly
Faculty Publications
The increased demand in energy and the need for sustainable and renewable sources of electricity in hazardous environments with significantly growing population yields the installation of more wind turbines in these areas. In addition, the technological development in material and construction methods has led to the building of taller and more flexible turbines, with inherent low structural damping. Installing modern wind turbines in offshore harsh environments or seismic prone areas can cause an increment in the probability of failure due to excessive vibrations. The current study evaluates the performance of onshore and offshore wind turbines under multihazard loads, including wind, …

Theses/Capstones/Creative Projects
On December 22, 2017, President Trump signed into law the Tax Cuts and Jobs Act (TCJA), the most expansive change to the Internal Revenue Code (IRC) since 1986. What was the purpose of overhauling the IRC? President Trump identified four main goals: (1) tax relief for the middle-class, (2) simplification of the tax code, (3) American economic growth, and (4) no additional debt added to the government’s deficit. Speaker Ryan also identified similar goals. Now that the TCJA has been in place for over six months, an analysis of the new law in respect to both the President’s and Speaker’s …

Evaluation Of A Natural Challenge Model Of Zebrafish With Influenza A Virus, Kelvin Blade
Evaluation Of A Natural Challenge Model Of Zebrafish With Influenza A Virus, Kelvin Blade
Honors Theses
Influenza A virus (IAV) presents as a global public health concern, resulting in an extensive burden on morbidity and mortality rates in humans. IAV has high mutation rates, influencing emergence of new virus strains, which could lead to increased antiviral resistivity and altered virulence. Although prevention and treatment of influenza infections have been improved, animal models still play a major role in understanding of host responses and the pathogenesis of IAV infection. Zebrafish are useful host models for evaluating infectious diseases processes, especially with the ability to manipulate the genome of zebrafish. Research by others have shown that parenteral applied …

The Tax Court’s 2017 holding in Estate of Powell v. Commissioner1 followed by its 2018 decision in Estate of Cahill v. Commissioner,2 signals a need to rethink how best to structure the family limited partnership and the terms of the partnership agreement. In a shift away from its historical approach to analyzing gross estate inclusion of family limited partnership assets, the Powell court endorses application of Section 2036(a)(2)3 to include the value of partnership assets in decedent’s gross estate, and in an unprecedented step employs Section 2043 to determine the value of family limited partnership assets includible in the gross …

A Framework For Thinking About Law School Affordability, Sandy Baum, Accesslex Institute
Commissioned Research
This research report, authored by Sandy Baum, Ph.D., explores the most constructive ways to think about the affordability of legal education in the context of trends in law school enrollment, prices, debt and employment. However, the report cautions that law school affordability cannot be evaluated through simple metrics; it must be measured by taking into account the lifetime value of the investment. The report was commissioned by AccessLex Institute to add to the public discourse about what makes law schools affordable for students in different circumstances.

Are Choice Experiment Treatments Of Outcome Uncertainty Sufficient? An Application To Climate Risk Reductions, Christos Makriyannis, Robert J. Johnston, Adam W. Whelchel
Are Choice Experiment Treatments Of Outcome Uncertainty Sufficient? An Application To Climate Risk Reductions, Christos Makriyannis, Robert J. Johnston, Adam W. Whelchel
Economics
Choice experiments addressing outcome uncertainty (OU) typically reframe continuous probability densities for each risky outcome into two discrete categories, each with a single probability of occurrence. The implications of this simplification for welfare estimation are unknown. This article evaluates the convergent validity of willingness-to-pay (WTP) estimates from a more accurate multiple-outcome treatment of OU, compared to the two-outcome approach. Results for a case study of coastal flood adaptation in Connecticut, United States, suggest that higher-resolution OU treatments increase choice complexity but can provide additional information on risk preferences and WTP. This tradeoff highlights challenges facing the valuation of uncertain outcomes.
