By according agencies the power to interpret the law, Chevron deference increases the power of administrative agencies. Yet agencies may not always want the benefits of Chevron deference. If the agency is a party in a lawsuit, it might decide not to seek Chevron deference in the hope that the court will reverse its binding policy. Following the inauguration of President Donald Trump, the Federal Communications Commission did just that in Global Tel*Link Inc v FCC, a lawsuit concerning regulations of calling services at correctional facilities. In America, fines are typically imposed without regard to income. The result is a system that traps low-income offenders in a cycle of debt and jail while letting rich offenders break the law without meaningful financial consequence. One-sizefits-all fines also fail to meet basic goals of the justice system: to treat like offenders alike, punish the deserving, and encourage respect for the law. Elsewhere in the world, however, systems that assess fines based on earnings have been around for nearly one hundred years. Rodents are one of the major storage pests in on-farm maize storage in the tropics. However, information on actual magnitude of weight and quality losses caused by rodents in maize stores and species of rodent associated with the losses is scarce and if available would help to improve maize postharvest management. Bactrocera dorsalis, the Oriental fruit fly, is one of the world's most destructive agricultural insect pests and a major impediment to international fresh commodity trade. The genetic structuring of the species across its entire geographic range has never been undertaken, because under a former taxonomy B. dorsalis was divided into four distinct taxonomic entities, each with their own, largely non-overlapping, distributions. Based on the extensive sampling of six a priori groups from 63 locations, genetic and geometric morphometric datasets were generated to detect macrogeographic population structure, and to determine prior and current invasion pathways of this species. Entomopathogenic fungi (EPF) can be established as endophytes in the host plants to offer a long-term preventive measure for pests and diseases. This practice serves as a better alternative to the common practice of periodic direct application of EPF on plants or the target pests as a short-term defense strategy against pests and diseases. Lablab bean (Lablab purpureus) is a popular vegetable crop in Bangladesh, but farmers growing this crop experience significant losses to insect pests despite heavy reliance on conventional insecticides. We conducted field studies to improve pest management in lablab bean by testing biorational insecticides as alternatives to conventional insecticides for the control of pod borers (Maruca vitrata) and aphids (Aphis craccivora), and characterizing flower-inhabiting thrips as an emerging pest in this crop. In field experiments, spinosad was the most promising biorational we tested, suppressing pod-boring caterpillars more effectively than thiamethoxam or quinalphos. Bartram’s Bass Micropterus sp. cf cataractae is endemic to the Savannah River basin of South Carolina and Georgia. Bartram’s Bass is threatened by habitat alteration and hybridization with invasive Alabama bass (M. henshalli) and other non-native co-occurring congeners. This study aimed to identify reproductive habitat preference of this species, and factors contributing to its occurrence.

In Chapter 1 we identified Bartram’s Bass nesting preference throughout the upper portion of its native range. In spring/summer 2017 and 2018, snorkel surveys were performed in tributaries to quantify nesting microhabitat use of Bartram’s Bass. Zig-zag transects were used to locate nests and to …

The dark rover ant, Brachymyrmex patagonicus Mayr, is a minute (~0.5 mm) dark brown or black formicine ant invasive from Argentina and Paraguay. In the southeastern United States, the dark rover ant is considered a nuisance pest, and is difficult to control. Recently, B. patagonicus has expanded its invasive range, especially in the southeastern United States. In South Carolina, this species has become more common in pest control accounts. Despite this, most of the biology and behavior of the dark rover ant remains unknown. The only official record of B. patagonicus in South Carolina is from 2010 in Horry County. …

Urbanization is among the largest threats to amphibian populations through habitat fragmentation, isolation, and outright destruction. Urban open spaces, such as parks and golf courses, have the potential to provide amphibians with suitable habitat within an urbanized matrix. During the spring and summer of 2018, I conducted dip net surveys and active call surveys to determine the presence and abundance of anurans at 51 wetland sites within the Piedmont ecoregion of South Carolina. Free Trade, Immigrant Workers, And Employment Discrimination, Angela D. Morrison

This article reframes the outward-looking perspective on workers’ rights provisions in free trade agreements. It argues that those provisions provide an opportunity to reinforce the workplace rights of noncitizen workers in the United States. Scholars and worker advocates have criticized recent free trade agreements for their lack of enforcement mechanisms and protections for workers in developing countries. They argue that this has encouraged a race to the bottom on the part of multi-national corporations who relocate to developing countries to take advantage of cheap labor costs, thereby costing U.S. workers’ jobs.

Corporate Deferred Prosecution Agreements (DPAs) are contracts negotiated between the federal government and defendants to address allegations of corporate misconduct without going to trial. The agreements are hailed as a model of speedy and efficient law enforcement, but also derided as making a “mockery” of America’s criminal justice system stemming from lenient deals being offered to some defendants. This Article questions why corporate DPAs are not given meaningful judicial review when such protection is required for other alternative dispute resolution (ADR) tools, including plea bargains, settlement agreements, and consent decrees. Determination of neutron dose can be challenging and requires knowledge of neutron energy and neutron flux. A plutonium-239/beryllium (239PuBe) alpha-neutron source was used to irradiate bacterial samples to create neutron dose response. The goal of this project was to characterize the thermal neutron flux of the 239PuBe alpha-neutron source and model the neutron dose using version MCNPX of the Monte-Carlo N-Particle transport codes. The 37 GBq 239PuBe alpha-neutron source was placed in a neutron “howitzer,” that is, a 2-ft diameter moderating barrel with four radial irradiation ports. Objective: Evaluation of the presentation, etiology, management strategies (including both surgical and nonsurgical options), and neurological functional outcomes in patients with cervical spinal epidural abscess (SEA).

Objectives: The aims of this study were to (1) describe the clinical features, disabilities, and incidence of neurologic deficits of pyogenic spondylodiscitis prior to treatment and (2) compare the functional outcomes between patients who underwent medical treatment alone or in combination with surgery for pyogenic spondylodiscitis.

RATIONALE: The presentation of sepsis and bacteremia in cutaneous and cavitary myiasis is uncommon. We present a patient, residing in a temperate region of the United States, with myiasis and sepsis from the emerging human pathogens Wohlfahrtiimonas chitiniclastica and Ignatzschineria indica.

PATIENT CONCERNS: A 37-year-old male patient with an 8-month history of chronic lymphedema and ulcers of the lower left extremity presented with myiasis of the left foot and leg. Humankind, for Gregory of Nyssa, was poisoned through a primordial act of eating the forbidden fruit from the Garden of Eden. As a result, the toxin of sin and death has been blended into the body and soul of each person, dispersing itself throughout the component parts of their nature. If eating and drinking initiated the spiritual and physical degradation of humanity, Gregory argues, then it must also be through eating and drinking—namely, through the Eucharist—that humanity will be healed. Social difficulties inherent to autism spectrum disorder are often linked with co‐occurring symptoms of anxiety and attention deficit hyperactivity disorder (ADHD). The present study sought to examine the relation between such co‐occurring symptoms and social challenges. Parents of adolescents with autism (N = 113) reported upon social challenges via the social responsiveness scale (SRS) and anxiety and ADHD symptomatology via the Child Behavior Checklist. Results revealed differences in SRS scores across co‐occurring symptom subgroups (Anxiety, ADHD, Both, Neither)—namely, adolescents with autism and anxiety as well as those with autism, anxiety, and ADHD showed greater scores on the SRS than …

I begin with a review of the literature on approaches to trauma therapy, identifying similarities and differences in key approaches, and comparing outcomes where that information is available. I then review a variety of cross cultural variations in mental health conditions and symptoms, attempting to roughly position each within the ethnic group or groups in which the variation is mostly likely to be found.
