Alchemistic Metaphors In Comparative Law: Mixed Legal Systems, Reception Of Laws And Legal Transplants, Andreas Rahmatian

The terms “mixed legal systems” and “legal transplants” are used frequently in comparative law. What they denote exactly, is difficult to ascertain: what does the mixité consist of, what are its ingredients or building blocks; which types of mixité exist, how are legal transplants transformed in the receiving legal system? Comparative lawyers often resort to metaphors when they try to describe and explain these complex phenomena: metaphors from cooking, music, horticulture or biology. Whenever there are mixtures, trans-formations, or transmutations, metaphors from the philosophical concepts of alchemy are at least equally illuminating. Orbital Angular Momentum Generation Using Composite Quasi-Continuous Metasurfaces With Perfect Efficiency, Menglin L.N. Chen, Li (Lijun) Jun Jiang

A composite perfect electric conductor (PEC)-perfect magnetic conductor (PMC) metasurface is proposed for orbital angular momentum (OAM) generation. Each scatterer on the metasurface consists of an anisotropic PEC layer and an isotropic PMC layer. Unlike conventional metasurfaces that composed of discrete scatterers, the scatterers on the proposed metasurface form a quasi-continuous pattern. Therefore, negative consequences of periodicity breaking from the patterned scatterers with varying sizes or orientations and their mutual coupling are avoided. We model the scatterer using Jones matrix. Its design is based on the features of PEC and PMC, which abandons complicated optimization process. The patterning of scatterers …

Service-Learning: A Powerful Pedagogy For Promoting Academic Success Among Students Of Color, Michelle C. Sterk Barrett, Isabelle Jenkins

This article discusses a mixed-methods study that investigated the service-learning experiences of students of color at College of the Holy Cross to better understand how service-learning may be an effective pedagogical tool for reducing cultural dissonance and addressing related achievement gaps. Quantitative data were collected from over 1,500 students who had enrolled in 59 different service-learning classes. In addition, interviews were conducted with 13 students of color who had participated in service-learning. Findings indicated that students’ service-learning experiences paralleled study participants’ descriptions of how they learned most effectively. Furthermore, the findings suggest that service-learning may resonate for students of color …

Economic Analysis Of The Interaction Between National Legal Systems: A Contribution To The Understanding Of Legal Diversity And Legal Unity, Hugues Bouthinon-Dumas

Journal of Civil Law Studies

Scholars increasingly use expressions such as “regulatory com-petition” or even “law market” to illustrate the new global legal system and the rivalry between national laws. This paper scrutinizes the legitimacy of the application of such economic concepts to legal systems’ interactions. An economic analysis could allow us to, more precisely, delimit the factors of convergence (leading to unity) and divergence (leading to diversity) between national legal systems due to competitive strategies (namely differentiation and alignment) and the consequences for the regulation of legal systems’ interactions.

Given Indonesia’s recent legal policy developments regarding cryptocurrency, it is pertinent to ask whether this new investment market, by its overall structural formation, holds any further risks to Indonesia beyond those to individual parties. This paper contends that any effective regulation of this new ecosystem requires adoption of the machinery of more fundamental concepts and a clear direction. Brazilian author-painter Clarice Lispector's work, especially her prose in her last published novella The Hour of the Star, is rich with deliberate color use; her abstracted prose style, including abstraction of punctuation, deliberate mention of specific colors during her narrative, and fragmented sentence structure all create an rich word-painting of the main character Macabea. This word painting creates an opportunity for Lispector to color her work with sharply pointed satire, convey political and social agendas of awareness, and ultimately places Macabea in an image-rich and meaning-driven view to the reader. This article describes the analytical support a Saint Joseph’s University (SJU) data mining class provided over the past three academic years to Fe y Alegría in Bolivia (FyAB), a Jesuit-sponsored institution dedicated to the education of the poor and looking for a feasible model that could help them identify which students and schools have the most need. SJU undergraduates, working without viable socio-economic household income information for each student in the database, had to be creative in assisting FyAB using only survey data provided by Bolivian school-age pupils. Since January 2017, the Northern Irish government has been shut down, with both the Executive and Assembly collapsed and the two major political coalitions deadlocked. Since then, civil servants with no major decision-making power have largely run the government. One of the deadlock’s major battlegrounds is whether there should be legislation in Northern Ireland mandating that Gaeilge, or Irish Gaelic, be treated as a language of equal status to that of English. The late 19th century essayist Andrew Lang, born in the Scottish borders, shared with Walter Scott a passionate devotion for the Borders landscape, mapped and mediated by Scott’s fictions; in his introductions to the Border Edition of Scott's novels, Lang argued that, by “immortalising” national antiquities, Scott ensured that Scotland's geographical and architectural heritage would be preserved.

This essay discusses from his Minstrelsy of the Scottish Border (1802 etc) Walter Scott's version of the ballad "Thomas the Rhymer" (or "True Thomas") tracing the ballad's history within the social context of its reception, and then comparing Scott’s version with the orally-transmitted version "Thomas Rhymer and the Queen of Elfland",written down by Anna Gordon Brown in 1800, for differences both in wording and in punctuation choices as the “apologetic apostrophe,” to suggest how such textual traces show the changing relationship between textual form and textual function. Discusses the influence of Scott's Waverley novels on George Eliot, as novels set in recent history, drawing on Eric Hobsbawm's idea of a "twilight zone between history and memory" to examine Eliot's Adam Bede and The Mill on the Floss, and to argue that Eliot in reworking Scott's reimagining of this recent-historical "time-lapse" articulates a psychological experience of historical transition and modernisation.
