Structural Origins Of The Doonerak Anticline, Central Brooks Range, Alaska, Gregory James Hammond
Structural Origins Of The Doonerak Anticline, Central Brooks Range, Alaska, Gregory James Hammond
Graduate Theses, Dissertations, and Problem Reports (ETD)
The Doonerak anticline in the central Brooks Range, Alaska, exposes a package of Early Paleozoic metavolcanic and metasedimentary rocks overlain by Carboniferous to Triassic sedimentary rocks which have been correlated to the North Slope subsurface. The flanks of the anticline have been interpreted as portions of a single north-vergent nappe system emplaced during the Brookian orogeny. The Doonerak anticline is a key location for understanding the structure of the Brooks Range fold and thrust belt. Field mapping, microstructural analysis, Raman-spectroscopy of carbonaceous material (RSCM) paleothermometry, and detrital zircon geochronology data suggest the structure is not a tectonic window resulting from …
Routine Regrets: Over Disclosure And Self-Violations Of Privacy In Social Media Spaces, Matthew P. Hartwell
Routine Regrets: Over Disclosure And Self-Violations Of Privacy In Social Media Spaces, Matthew P. Hartwell
Graduate Theses, Dissertations, and Problem Reports (ETD)
A cognitive application of the theory of ritualized media is applied to computer mediated communication to explain unintended consequences of routinization in social media spaces connected to patterns of use and network growth, creating an increased opportunity for self-violations of privacy. While The unintentional self-violation of a digital user's privacy of information, thoughts, and behavior in part stems from interconnected structural components of a user's networks as well as the situational constraints they experience while utilizing social media. This study found that as networks increased in complexity, both in volume and diversity, SNS users experienced a higher likelihood of posting …
Creating The Need To Serve: How West Virginia Spontaneous Disaster Relief Volunteers' Motivations And Experiences Influence Their Willingness For Continued Volunteerism*, Erin Hudnall
Graduate Theses, Dissertations, and Problem Reports (ETD)
Spontaneous volunteerism, or emergent volunteer behavior, is characterized by an individual's actions of impulsively offering volunteer services immediately following the occurrence of a natural disaster or community tragedy, such as a flood or terrorist attack. This type of volunteerism differs from traditional volunteer activities that are usually preplanned and not related to a recent tragedy. It is unclear what types of motivations spur individuals to volunteer after a disaster, whether spontaneous volunteers' experiences lead to willingness for continued volunteerism in the future, and whether motivations and experiences differ significantly by context. To study this phenomenon, spontaneous volunteers who offered help …
The Impact Of Athletic Trainers In A Clinic Setting, Danielle L. Kirsch
The Impact Of Athletic Trainers In A Clinic Setting, Danielle L. Kirsch
Health Nutrition and Exercise Science
The purpose was to determine if patients understand the abilities and skill sets of ATs in the orthopedic sports medicine clinic and to examine how ATs employed in an orthopedic sports medicine clinic setting influence patient satisfaction. A total of 126 participants, 68 male and 58 female patients seen at the clinic participated in the study. A survey to determine patient satisfaction, perception and knowledge of ATs was adapted by combining portions of three surveys. 47.5% of participants were either "very familiar" or "extremely familiar" in the abilities of an AT. While 93% of participants rated their satisfaction during their …

Wrongful Living, Alberto B. Lopez, Fredrick E. Vars
Essays, Reviews, and Shorter Works
Executing an advance directive that specifies a patient's wishes regarding end-of-life medical care is an exercise of self-determination--a conscious choice about the degree and type of medical intervention one wishes to receive under end-of-life circumstances. Empirical studies, however, consistently report that healthcare professionals fail to comply with advance directives; violations of a patient's interest in self-determination are alarmingly common. From a practical perspective, the conduct of either patients or healthcare professionals may make an advance directive unavailable, which results in noncompliance. Legally, courts have historically rejected claims for “wrongful living” associated with the prolongation of life that results from unwanted …

Getting Students To Think Critically And Visibly, Alanna Bowie
Getting Students To Think Critically And Visibly, Alanna Bowie
Becoming: Journal of the Georgia Association for Middle Level Education
Students can sometimes find the classroom to be an uncomfortable environment; hence, it can be difficult to persuade them to voice their thinking in front of their peers. Students’ fear of accidentally recalling incorrect answers in a classroom setting may set a domino effect of instant ridicule from their classmates, which can consequentially inhibit many of them from participating in future classroom discourse. To reduce fears, educators should foster an environment of support that encourages students to think visibly and more critically. The purpose of this article is to explore the literature, which suggests an environment that promotes creative learning …
Encouraging Teacher Candidates To Cultivate Habits Of Reflection, Amanda Wall
Encouraging Teacher Candidates To Cultivate Habits Of Reflection, Amanda Wall
Becoming: Journal of the Georgia Association for Middle Level Education
The conceptual framework for the College of Education at Georgia Southern University is: Reflective Practitioners for a Diverse World. Three of the five Middle Level Teacher Preparation Standards from the Association of Middle Level Education (AMLE, 2012) also specify reflection as a habit. Standard 5 on Middle Level Professional Roles, for example, states: “Middle level teacher candidates understand, reflect on, and are successful in their unique roles as middle level professionals.” In order for teacher candidates to become reflective, they need multiple opportunities to engage in reflection.
Commodifying Consumer Data In The Era Of The Internet Of Things, Stacy-Ann Elvy
Commodifying Consumer Data In The Era Of The Internet Of Things, Stacy-Ann Elvy
Articles & Chapters
Internet of Things (“IOT”) products generate a wealth of data about consumers that was never before widely and easily accessible to companies. Examples include biometric and health-related data, such as fingerprint patterns, heart rates and calories burned. This Article explores the connection between the types of data generated by the IOT and the financial frameworks of Article 9 of the Uniform Commercial Code and the Bankruptcy Code. It critiques these regimes, which enable the commodification of consumer data, as well as laws aimed at protecting consumer data, such as the Bankruptcy Abuse Prevention and Consumer Protection Act, various state biometric …
My Brain Is So Wired; Neuroimaging's Role In Competency Cases Involved Persons With Mental Disabilities, Michael L. Perlin, Alison Lynch
My Brain Is So Wired; Neuroimaging's Role In Competency Cases Involved Persons With Mental Disabilities, Michael L. Perlin, Alison Lynch
Articles & Chapters
In this article, we consider the therapeutic jurisprudence implications of the use of neuroimaging techniques in assessing whether a defendant is competent to stand trial, a topic that has been the subject of no prior legal commentary. Recent attention paid to neuroscience in the criminal process has focused on questions of mitigation and competency to be executed, but the potential of such evidence transcends these areas.
There has been almost no attention paid to its potential impact on a critical intersection between the criminal trial process and inquiries into mental or psychological status: a defendant’s trial competency. Less than a …
What Authorizes The Image? The Visual Economy Of Post-Secular Jurisprudence, Richard Sherwin
What Authorizes The Image? The Visual Economy Of Post-Secular Jurisprudence, Richard Sherwin
Articles & Chapters
In law’s visual economy our commitment to justice grows out of a renewed encounter with an interior libidinal source whose ongoing collective investment binds us to the nomos in which we live. We experience this corporeal bond in paintings, films, and video images on screens large and small. In the ethically inflected aesthetic of post-secular jurisprudence, justice is to law as beauty is to art. As distant as an abstract expressionist canvas, as close as any neighbor, or indeed any screen on which the neighbor becomes real to us. That is where we behold the source and instantiation of law’s …

Who Will Judge The Many When The Game Is Through: Considering The Profound Differences Between Mental Health Courts And Traditional Involuntary Civil Commitment Courts, Michael L. Perlin
Articles & Chapters
This paper is an expansion of a presentation given by the author at the annual Therapeutic Jurisprudence Workshop at Osgoode Hall Law School, York University, Toronto, Ontario, Canada, October 15, 2016. There is a developing robust literature about mental health courts (MHCrts) in the United States, and researchers have begun to focus on a broad range of empirical issues, such as the extent to which defendants are competent to waive their trial rights in such settings, the significance of diversion, etc. Also, advocates and other scholars have engaged in vigorous debates about the value of these courts, and the extent …

May Federal Prosecutors Take Direction From The President?, Bruce Green, Rebecca Roiphe
May Federal Prosecutors Take Direction From The President?, Bruce Green, Rebecca Roiphe
Articles & Chapters
Suppose the president sought to serve as prosecutor-in-chief telling prosecutors when to initiate or dismiss criminal charges in individual cases and making other discretionary decisions that are normally reserved to trained professionals familiar with the facts, law, and traditions of the U.S. Department of Justice. To what extent may prosecutors follow the president's direction? In recent presidential administrations, the president has respected prosecutorial independence; while making policy decisions, the president deferred to the Attorney General and subordinate federal prosecutors to conduct individual criminal cases. In a recent article, we argued that this is as it should be because the president …
Cancer's Ip, Jacob S. Sherkow
Cancer's Ip, Jacob S. Sherkow

The state of publicly funded science is in peril. Instead, new biomedical research efforts — in particular, the recent funding of a “Cancer Moonshot” — have focused on employing public-private partnerships, joint ventures between private industry and public agencies, as being more politically palatable. Yet, public-private partnerships like the Cancer Moonshot center on the production of public goods: scientific information. Using private incentives in this context presents numerous puzzles for both intellectual property law and information policy. This Article examines whether—and to what extent — intellectual property and information policy can be appropriately tailored to the goals of public-private partnerships. …
The Science Of Substitution: A Response To Carrier And Minniti, Jacob S. Sherkow
The Science Of Substitution: A Response To Carrier And Minniti, Jacob S. Sherkow
Articles & Chapters
In Biologics: The New Antitrust Frontier, Michael A. Carrier and Carl J. Minniti provide an overview of potential antitrust harms in the newly enacted biologic drug approval and litigation regime, the Biologics Price Competition and Innovation Act (“BPCIA”). Importantly, Carrier and Minniti suggest that the scientific complexity of biologic products has the potential to make some litigation conduct that is typically anticompetitive more or less so, given uncertainties surrounding regulatory approval and patent infringement. This response advances Carrier and Minniti’s thesis, suggesting the authors do not take it far enough for their assessments of reverse payment settlements, submarine patenting, …

Privacy, Notice, And Design, Ari Ezra Waldman
Articles & Chapters
Design configures our relationship with a space, whether offline or online. In particular, the design of built online environments can constrain our ability to understand and respond to websites’ data use practices or it can enhance agency by giving us control over information. Design, therefore, poses dangers and offers opportunity to protect privacy online. This Article is a comprehensive theoretical and empirical approach to the design of privacy policies.
Privacy notices today do not convey information in a way understandable to most internet users. This is because they are designed without the needs of real people in mind. They are …
Designing Without Privacy, Ari Ezra Waldman
Designing Without Privacy, Ari Ezra Waldman
Articles & Chapters
In Privacy on the Ground, the law and information scholars Kenneth Bamberger and Deirdre Mulligan showed that empowered chief privacy officers (CPOs) are pushing their companies to take consumer privacy seriously, integrating privacy into the designs of new technologies. But their work was just the beginning of a larger research agenda. CPOs may set policies at the top, but they alone cannot embed robust privacy norms into the corporate ethos, practice, and routine. As such, if we want the mobile apps, websites, robots, and smart devices we use to respect our privacy, we need to institutionalize privacy throughout the corporations …
Are Anti-Bullying Laws Effective?, Ari Ezra Waldman
Are Anti-Bullying Laws Effective?, Ari Ezra Waldman
Articles & Chapters
Since 2010, when several high profile bullying-related suicides brought bullying and cyberharassment into the national consciousness, all 50 states have passed laws that address bullying among the nation’s youth. This essay is the first in a series of three projects on federal, state, municipal, and individual school approaches to bullying. There are only 4 published studies on the relationships between law and bullying rates. This Essay adds several features to the discourse. It offers a comprehensive analysis of the contents of state anti-bullying laws, using a 16-item list of guidelines from the United States Department of Education as a frame. …

Whistleblowers - A Case Study In The Regulatory Cycle For Financial Services, Ronald H. Filler, Jerry W. Markham

The Securities and Exchange Commission and the Commodity Futures Trading Commission were directed by the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 (Dodd-Frank) to create whistleblower protection programs that reward informants with massive bounty payments. At the time of its passage, the Dodd-Frank Act was a highly controversial statute that was passed on partisan lines. Its whistleblowing authority was one of its "most contentious provisions." As the result of the 2016 elections, the Dodd-Frank Act has come under renewed attack in Congress and by the new Trump administration. The stage is being setfor possible repeal ofmajor parts …

Should social media companies ban Holocaust denial from their platforms? What about conspiracy theorists that spew hate? Does good corporate citizenship mean platforms should remove offensive speech or tolerate it? The content moderation rules that companies develop to govern speech on their platforms will have significant implications for the future of freedom of expression. Given that the prospects for compelling platforms to respect users’ free speech rights are bleak within the U.S. system, what can be done to protect this important right? In June 2018, the United Nations’ top expert for freedom of expression called on companies to align their …

Carpenter V. United States And The Fourth Amendment: The Best Way Forward, Stephen E. Henderson
Faculty Articles
We finally have a federal ‘test case.’ In Carpenter v. United States, the Supreme Court is poised to set the direction of the Fourth Amendment in the digital age. The case squarely presents how the twentieth-century third party doctrine will fare in contemporary times, and the stakes could not be higher. This Article reviews the Carpenter case and how it fits within the greater discussion of the Fourth Amendment third party doctrine and location surveillance, and I express a hope that the Court will be both a bit ambitious and a good measure cautious. As for ambition, the Court …

Few industries in the United States carry the clout and capital of the oil and gas and agricultural sectors. Economic behemoths, their booms and busts shape the destinies of states, define national policy, and secure the life or death of small towns across the United States. Like it or not, the agriculture and oil and gas industries have strong lobbies and vehement and mobilized constituencies. Recent years have seen both sectors facing public push-back on modern trends in extraction, growth, and methods of production. In response to these developments, these industries have used their considerable political capital to seek new …

Department of Special Education and Communication Disorders: Faculty Publications
Stuttering anticipation is endorsed by many people who stutter as a core aspect of the stuttering experience. Anticipation is primarily a covert phenomenon and people who stutter respond to anticipation in a variety of ways. At the same time as anticipation occurs and develops internally, for many individuals the “knowing” or “feeling” that they are about to stutter is a primary contributor to the chronicity of the disorder. In this article, we offer a roadmap for both understanding the phenomenon of anticipation and its relevance to stuttering development. We introduce the Stuttering Anticipation Scale (SAS)—a 25-item clinical tool that can …
