Marketing Strategies To Improve Online Sales, Paul Barrie Targett

Walden Dissertations and Doctoral Studies

Marketing executives of traditional retail firms who lack strategies to expand e-commerce business, can experience inhibited growth, higher transaction costs, and a loss of competitive advantage. The purpose of this qualitative single case study was to explore marketing strategies that marketing executives of a traditional retail firm used to improve online sales. Eight purposefully selected marketing executives in the head offices of a large traditional retail business in South Africa who had implemented effective marketing strategies to improve online sales participated in the study. Radical Feminist Harms On Sex Workers, I. India Thusi Jan 2018

Radical Feminist Harms On Sex Workers, I. India Thusi

Faculty Scholarship

Sex work has long been a site for contesting womanhood, sexuality, race, and patriarchy. Its very existence forces us to examine how we think about two very dirty subjects-money and sex. The radical feminist literature highlights the problems with sex work and often describes it as a form of "human trafficking" and violence against women. This influential philosophy underlies much of the work in human trafficking courts, was evident in a letter signed by several Hollywood starlets in opposition to Amnesty International's support for decriminalization, and is the premise of several movies and documentaries about "sex slavery." Radical feminists aim …

Administrative Guidance And Genetically Modified Food, Edward L. Rubin, Joanna K. Sax Jan 2018

Administrative Guidance And Genetically Modified Food, Edward L. Rubin, Joanna K. Sax

Faculty Scholarship

One of the most controversial issues in administrative law, the use of guidance, is exemplified by the regulation of one of the most controversial areas in modern society: genetically modified (GM) food. The appropriate use of guidance versus notice and comment rulemaking is a much-debated issue in administrative law. While agency officials generally assert that they are using guidance to express an agency’s thoughts about how to comply with a specific statutory provision or agency rule, the practical consequence is that the regulated party will hesitate to disobey, even if it believes that the guidance goes beyond the requirements of …

The Rise Of Self Sidelining, Leslie Culver Jan 2018

The Rise Of Self Sidelining, Leslie Culver

Faculty Scholarship

This Article coins the term "self sidelining" as an experience emanating from two theories: impostor phenomenon and gender sidelining. The impostor phenomenon is a well-established psychological construct that describes the inability of some high-achieving women and men to internalize success. Gender sidelining, recently popularized in legal scholarship, describes the undermining of women's achievements, as compared to men, that are unactionable as legal discrimination. In view of these theories, this Article contends that when internal fraudulent feelings (imposter phenomenon) are perceived to be externally validated by male gender preference (gender sidelining), women consciously or subconsciously discipline themselves to forgo their professional …

Preparation, Protection, Connection And Embodiment: A Phenomenological Exploration Of The Value Of Spiritual Self-Care For Conflict Professionals, Diane Marie Gaston Jan 2018

Preparation, Protection, Connection And Embodiment: A Phenomenological Exploration Of The Value Of Spiritual Self-Care For Conflict Professionals, Diane Marie Gaston

Department of Conflict Resolution Studies Theses and Dissertations

The field of mediation has emerged as one of the premier tools in the peacemaking process. While mediation has grown in popularity and become widely accepted in the judicial court system and corporate America, very few studies have focused on how mediators are impacted by the conflict resolution process. Moreover, few studies have focused on the role of spiritual self-care on the mediator. This research study explored how mediators who identify as spiritual integrate their spirituality in their own self-care practice. In order for mediation to continue as one of the most important tools in the peacemaking process, mediators of …

Banking On Remittances? How Bank Account Possession In The United States Affects Mexican Migrants Sending Money Home, Elizabeth Durden Jan 2018

Banking On Remittances? How Bank Account Possession In The United States Affects Mexican Migrants Sending Money Home, Elizabeth Durden

Faculty Journal Articles

Data from 154 different Mexican communities, housed within the Mexican Migration Project (mmp), is used to explore the influence of U.S. assimilation on a Mexican migrant’s propensity to remit money back to Mexico. A migrant opening a U.S. bank account is employed as a proxy for assimilation. Sociodemographic, U.S. migration, and Mexican community control variables are included. It is found that a migrant opening a bank account during the last U.S. migration is associated with a reduced probability of remitting money back to Mexico, suggesting a shift in social and economic activity from Mexico to the U.S. for migrants abroad

Rethinking The Boundaries Of "Criminal Justice", Benjamin Levin Jan 2018

Rethinking The Boundaries Of "Criminal Justice", Benjamin Levin

Publications

This review of The New Criminal Justice Thinking (Sharon Dolovich & Alexandra Natapoff, eds.) tracks the shifting and uncertain contours of “criminal justice” as an object of study and critique.

Specifically, I trace two themes in the book:

(1) the uncertain boundaries of the “criminal justice system” as a web of laws, actors, and institutions; and

(2) the uncertain boundaries of “criminal justice thinking” as a universe of interdisciplinary scholarship, policy discourse, and public engagement.

I argue that these two themes speak to critically important questions about the nature of criminal justice scholarship and reform efforts. Without a firm understanding …

Where Should My Child Go To School? Parent And Child Considerations In Binational Families, Edmund T. Hamann, Víctor Zúñiga, Juan Sánchez García Jan 2018

Where Should My Child Go To School? Parent And Child Considerations In Binational Families, Edmund T. Hamann, Víctor Zúñiga, Juan Sánchez García

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Using examples encountered from our multi-year study of students encountered in Mexican schools with prior experience in US schools, we look at transnationally-tied families’ decision-making regarding where to send their children to school and ask whether parents should ‘parent from afar’. We don’t pose that as a question about ideals— what would be best if parents had economic security and unambiguous legal residential status— but rather as a more pragmatic one. Given some parents’ and children’s limited agency in real- world circumstances, what is their best path forward?

Death In Life And Life In Death: Forms And Fates Of The Human, Connor Graham, Alfred Montoya Jan 2018

Death In Life And Life In Death: Forms And Fates Of The Human, Connor Graham, Alfred Montoya

Sociology & Anthropology Faculty Research

This chapter traces the origins, meanings and characteristics of “the human” in recent time – its forms. The chapter contends that, instead of being immutable, “the human” has taken different forms, been ascribed different meanings, and exhibited different characteristics over time. Our approach to “the human” contributes to this volume on digital existence, which confronts existential questions centered on being and technology, with historical and anthropological awareness. We aim to show, through Foucault’s (1971 ) insistence upon the forms of subjectivity as opposed to its substance, how understandings of “the human” are subject to change and transformation. Exploring these diverse …

The Origin And Role Of The Penitentiary In Brazil, Scandanavia, And The United States, Nitin Sapra Jan 2018

The Origin And Role Of The Penitentiary In Brazil, Scandanavia, And The United States, Nitin Sapra

UC Law SF International Law Review

Modern penitentiaries offer valuable insight on the core of society’s sensibilities, perceptions, and values. They shed light on the relation between the State and the citizenry, particularly the lower classes. Beyond its explicit reformative goals to the criminal justice system, the penitentiary functions to affect social policy through norms of decency and respect for human rights. From the unique architectural choices to the minute logistical details, a government makes choices that intimately speak on how it views its most vulnerable groups of individuals. The origins of the penitentiary offer insight into the circumstances that interweave to organize the social fabric …

Simultaneous Use Of Physiological Sensors For A Neuromarketing Task, Charles Descheneaux Jan 2018

Simultaneous Use Of Physiological Sensors For A Neuromarketing Task, Charles Descheneaux

Electronic Theses and Dissertations

Physiological measurements have become more popular in Psychological research over the past ten years. These advancements allowed different objective sensors to become another measurement tool in a scientific arsenal of collecting data. Traditionally, performance and after task subjective measures have been used for most studies in Psychological research. With the opportunity to use these subjective measures along with objective measures, more data can be collected during research and therefore potentially produce better quality conclusions. Eye Tracking (ET), functional near infrared (fNIR), transcranial Doppler ultrasound (TCD), electrocardiogram (EKG) and the electroencephalogram (EEG) have shown great promise in their ability to produce …

Culture And Critical Thinking: Exploring Culturally Informed Reasoning Processes In A Lebanese University Using Think-Aloud Protocols, William Merrifield

Doctor of Education (EdD)

This study examined the role of cultural and contextual factors in the critical thinking processes of bilingual Lebanese undergraduate students. In addition, it investigated whether bilingual students used comparable processes to answer equivalent critical thinking questions in Arabic and English. A purposive sample of 24 upper division undergraduate students enrolled in a Lebanese university completed the Cornell Critical Thinking Test Level Z (CCTT) as well as 10 questions from the Sample Reasoning Mindset Test (SRMT). Participants were divided into two similar procedural groups. Group A completed the CCTT and SRMT in Arabic. Group B completed the assessments in English. A …

Dismantling Monuments, Richard Henry Seamon Jan 2018

Dismantling Monuments, Richard Henry Seamon

Articles

The Antiquities Act of 1906 authorizes the President to "declare" certain objects "to be national monuments," and to "reserve parcels of land" to protect those national monuments. The Act does not expressly authorize the President to reduce or rescind a monument established by a prior President under the Act, and recent actions by President Donald Trump raise the question whether the Act impliedly authorizes such reductions or rescissions. The majority of legal scholars who have studied this question have said no, the Act does not grant such implied authority. This Article takes the contrary position. The President's authority under the …

International Judicial Practices: Opening The "Black Box" Of International Courts, Jeffrey L. Dunoff, Mark A. Pollack Jan 2018

International Judicial Practices: Opening The "Black Box" Of International Courts, Jeffrey L. Dunoff, Mark A. Pollack

Michigan Journal of International Law

This paper utilizes “practice theory” to identify and analyze the everyday practices of international judges, with particular focus on practices associated with judicial decision-making. Examining judicial practices illuminates a wide range of otherwise hidden activities that shape international judicial opinions; provides a pathway toward uncovering the subjective understandings that international judges attach to their own behaviors; and reveals underlying causal processes and mechanisms that influence tribunal decisions. By opening the “black box” of international courts, the practice turn permits us to shed light on their inner workings, and thereby enrich our understanding of these increasingly important bodies.

Incorporating Social System Dynamics In The Columbia River Basin: Food-Energy-Water Resilience And Sustainability Modeling In The Yakima River Basin, Barbara Cosens Jan 2018

Incorporating Social System Dynamics In The Columbia River Basin: Food-Energy-Water Resilience And Sustainability Modeling In The Yakima River Basin, Barbara Cosens

Articles

In the face of climate change, achieving resilience of desirable aspects of food-energy-water (FEW) systems already strained by competing multi-scalar social objectives requires interdisciplinary approaches. This study is part of a larger effort exploring “Innovations in the Food-Energy-Water Nexus (INFEWS)” in the Columbia River Basin (CRB) through coordinated modeling and simulated management scenarios. Here, we focus on a case study and conceptual mapping of the Yakima River Basin (YRB), a sub-basin of the CRB. Previous research on FEW system management and resilience includes some attention to social dynamics (e.g., economic and governance systems); however, more attention to social drivers and …

Theology, Phenomenology, And The Divine In King Lear, Kent R. Lehnhof Jan 2018

Theology, Phenomenology, And The Divine In King Lear, Kent R. Lehnhof

English Faculty Books and Book Chapters

"In what follows, then, I would like to think through Levinas's ideas on transcendence and ethics in such a way as to map out a new pathway for approaching Shakespeare's great tragedy. As unorthodox as it may sound, I propose to shed light on the darkling religiosity of King Lear by turning-not to the theological doctrines of early modem Christians-but to the postmodern ethics of a twentieth-century Jew."
