Eu Competition Law Put To The Brexit Test: What Impact Might The Exit Of The Uk From The Union Have On The Enforcement Of The Competition Rules?, Arianna Andreangeli
Yearbook of Antitrust and Regulatory Studies
This contribution examines some of the consequences of the UK’s exit from the European Union for the enforcement of the competition rules. It reflects on the impact that Brexit is going to have on future transnational antitrust litigation in Britain and Europe. Thereafter it analyses the challenges that Brexit is likely to present for cooperation in public competition enforcement and suggests solutions for future development.

Effects Of Stand Structure, Browsing, And Biophysical Conditions On Regeneration Following Mountain Pine Beetle In Mixed Lodgepole Pine And Aspen Forests Of The Southern Rockies, Kristen A. Pelz, Frederick W. Smith
Aspen Bibliography
Aspen (Populus tremuloides) and lodgepole pine (Pinus contorta var. latifolia) co-occur in the southern Rocky Mountains (USA), where mountain pine beetle (MPB, Dendroctonus ponderosae) has caused extensive lodgepole pine mortality since the late 1990s. Both species excel in post-disturbance high-light environments, but lodgepole pine has generally been thought to establish poorly on undisturbed seedbeds, and aspen suckering may be inhibited by intact aspen overstory. We ask whether lodgepole pine and aspen will regenerate in sufficient quantities to revegetate these forests. We visited a random sample of aspen and lodgepole pine stands across the affected landscape …

Also reported are state rediscoveries of three species thought to be extirpated from Kentucky: Ichthyomyzon gagei (Tennessee River drainage), Hemitremia flammea (Lower Cumberland and Green river drainages), and Hybopsis amnis (upper Cumberland River drainage). Unreported drainage records comprise nine species: Ichthyomyzon castaneus (Salt River drainage and Upper Green River drainage); Ichthyomyzon unicuspis (Salt River drainage and upper Big Sandy River drainage); Campostoma pullum (Tennessee River drainage); Umbra limi (Obion Creek drainage); …
Soft-Served Deserts: Soft Retributivism As A Free Will-Independent Alternative For The Criminal Justice System, Theodore Benson Randles
Soft-Served Deserts: Soft Retributivism As A Free Will-Independent Alternative For The Criminal Justice System, Theodore Benson Randles
Catholic University Law Review
Human free will is foundational to our criminal justice system, yet contemporary scientific understanding casts doubt on a robust sense of human free will. If a person’s actions are wholly determined by the laws of physics, is that person morally deserving of punishment? This Article argues that our criminal justice system can be put on a footing that is not threatened by physical determinism. It suggests that a coherent system of criminal punishment can be founded on Daniel Farrell’s notion of “weak retributivism.” The Article build on Farrell’s work and develops a system built up from the universal right to …

Discordant Alternans Mechanism For Initiation Of Ventricular Fibrillation In Vitro, Laura M. Muñoz, Anna R.M. Gelzer, Flavio H. Fenton, Wei Qian, Weiye Lin, Robert F. Gilmour Jr, Niels F. Otani
Articles
Background: Ventricular tachyarrhythmias are often preceded by short sequences of premature ventricular complexes. In a previous study, a restitution-based computational model predicted which sequences of stimulated premature complexes were most likely to induce ventricular fibrillation in canines in vivo. However, the underlying mechanism, based on discordant-alternans dynamics, could not be verified in that study. The current study seeks to elucidate the mechanism by determining whether the spatiotemporal evolution of action potentials and initiation of ventricular fibrillation in in vitro experiments are consistent with model predictions. Methods and Results: Optical mapping voltage signals from canine right-ventricular tissue (n=9) were obtained simultaneously …

The anticoagulant and antithrombotic properties of three structurally correlated sea urchin-derived 3-linked sulfated α-glycans and their low molecular-weight derivatives were screened comparatively through various in vitro and in vivo methods. These methods include activated partial thromboplastin time, the inhibitory activity of antithrombin over thrombin and factor Xa, venous antithrombosis, the inhibition of platelet aggregation, the activation of factor XII, and bleeding. While the 2-sulfated fucan from Strongylocentrotus franciscanus was observed to be poorly active in most assays, the 4-sulfated fucan from Lytechinus variegatus, the 2-sulfated galactan from Echinometra lucunter and their derivatives showed multiple effects. All marine compounds showed no …

The European Competition Network In The European Administrative System: Theoretical Concerns, Erzsébet Csatlós
Yearbook of Antitrust and Regulatory Studies
The public administration of the European Union (EU) is a sui generis multi-level structure under constant development. After five decades of successful functioning, the European Union still lacks a coherent and comprehensive set of codified rules of administrative procedure at all levels. The existing acquis related to European administration and administrative procedures is fragmented, sector specific and although it is based on the constitutional principles of the democratic traditions of its Member States, such coincidence is often insufficient for the present requirements of good administration. The EU basically relies on indirect administration, while a growing number of cooperation forms exists …

Are Enhanced Warfighters Weapons, Means, Or Methods Of Warfare?, Rain Liivoja, Luke Chircop
International Law Studies
Advances in science and technology have made it possible to improve the physical and cognitive capabilities of warfighters by biomedical interventions, such as the administration of drugs, the implantation of devices, and the magnetic stimulation of the brain. These advances raise the question as to whether enhanced warfighters ought to be considered weapons, means of warfare, or methods of warfare, for the purposes of the law of armed conflict. An affirmative answer to this question would make human enhancement subject to various restrictions arising from the law of armed conflict as well as arms control law. This article disagrees with …

Recent Developments In Indonesia's Macro-Economy And Trade, Q1-2018, Febrio Kacaribu
Economics and Finance in Indonesia
This paper discusses Indonesia's macroeconomic and trade development in the first quarter of 2018. The macroeconomic data shows that the industrial growth was inhibited by regulatory regime inconsistency, while consumption growth still lagged overall GDP growth, and investment growth tended to rise. The trade data shows that the non-oil-and-gas commodities dominated its export, although the commodities terms-of-trade declined. Indonesia's imports were mostly used as raw and auxiliary materials for the input of domestic production. The data also reveals that the larger the firms, the stronger tendency that they have comparative advantage in capital-intensive commodities, and vice versa.

Sources Of Students’ Difficulties In Learning Chemistry, David F. Treagust, Reinders Duit, Martina Nieswandt
Administration and Staff Articles and Research
Chemistry is a difficult subject to teach and to learn at both secondary and tertiary levels. Major learning difficulties are due to the particular views of chemistry phenomena that in many ways contradict intuitive and everyday views of the learners. As a result, major misunderstandings occur when students try to comprehend chemical explanations within the framework of their pre-instructional conceptions. This paper describes research findings on students’ pre-instructional conceptions in the domain of chemistry and on attempts to guide students from their conceptions to the core ideas of chemistry. Rather than providing an overview of students’ conceptions in various topics, …

Sensor Network Trained To Understand Arbitrary Labels, Fred Bertsch
Defensive Publications Series
Sensor devices can be used to measure a large number of attributes in an environment (e.g., a job site, a building, a traffic intersection, and/or other constrained region). These sensors can generate a significant amount of measurement data over time. However, it is challenging to synthesize and process this large amount of data to produce a meaningful understanding of events as they occur. This is particularly true for arbitrary, custom, or otherwise uncommon events which may be of interest only to certain limited users or in certain limited situations.

Material is reviewed that consists of reconstituted collagen fibril gel mineralized in a manner that produces biomimetically sized nanoapatites intimately associated with the fibrils. This gel is formed into usable shapes with a modulus and strength that allow it to be surgically press fitted into bony defects. The design paradigm for the material is that the nanoapatites will dissolve into soluble Ca2+ as the collagen is degraded into RGD-containing peptide fragments due to osteoclastic action. This is intended to signal to the osteoclasts to continue removing the material in a biomimetic fashion similar to bony remodeling. Preliminary experiments in …

Occupancy And Habitat Use By Six Species Of Forest Ungulates On Tiwai Island, Sierra Leone, Kathryn R. Mccollum, Emily Belinfante, April L. Conway, John P. Carroll
School of Natural Resources: Faculty Publications
Forest ungulates in West Africa are common bushmeat species and are subject to habitat degradation through deforestation. Based on historical data, there are possibly 12 species of forest Bovidae and Tragulidae found in eastern Sierra Leone. We used camera trapping to assess occupancy by forest ungulates on and around a small protected area, Tiwai Island, Sierra Leone. We then assessed habitat over two field seasons during 2008–2011 for those species where we had sufficient numbers of detections. We detected 6 of 12 potential species and obtained enough data to further assess the habitat of two species. Species detected included the …

To find an electrical conductivity (EC) in the nutrient solution used for pakchoi (Brassica campestris L. ssp. Chinensis) cultivation that optimizes the plant’s physiology, growth, and quality, we conducted an experiment with eight EC treatments (from EC0 to EC9.6) in a hydroponic production system (i.e. soilless culture) under greenhouse condition in Shanghai, China. Plants biomass production, leaf photosynthesis, vegetable quality variables, tissue nitrate and nitrite contents, and antioxidant enzyme activities were measured. The results showed that very high (EC9.6) or low EC (EC0-0.6) treatments clearly decreased plants fresh weight (FW) and dry weight (DW), leaf size, leaf water content, leaf …

Beyond The Local: Places, People, And Brands In New England Beer Marketing, Jeffrey S. Debies-Carl

Despite decades of domination by a few large companies, the American beer market has seen a dramatic resurgence of microbreweries. Contrary to conventional oligopolistic market theories, small firms have consistently gained market share from their entrenched competitors. Researchers have attributed this success to ‘neolocalism.’ Through their marketing, microbreweries appeal to consumers’ desire for connections to real people and distinctive products from local places. However, no study has verified whether this pattern is most characteristic of microbreweries. With newer firms threatening their market share, larger firms might adopt neolocal claims, but little empirical attention has been directed at large brewers, and …

Genetics Of A De Novo Origin Of Undifferentiated Multicellularity, Matthew D. Herron, William C. Ratcliff, Jacob Boswell, Frank Rosenzweig
Biological Sciences Faculty Publications
The evolution of multicellularity was a major transition in evolution and set the stage for unprecedented increases in complexity, especially in land plants and animals. Here, we explore the genetics underlying a de novo origin of multicellularity in a microbial evolution experiment carried out on the green alga Chlamydomonas reinhardtii. We show that large-scale changes in gene expression underlie the transition to a multicellular life cycle. Among these, changes to genes involved in cell cycle and reproductive processes were overrepresented, as were changes to C. reinhardtii-specific and volvocine-specific genes. These results suggest that the genetic basis for the experimental evolution …

Pulmonary Histoplasmosis In A Patient With Cough, Dyspnea, Pulmonary Nodule And Rheumatologic Manifestations: Case Report And Review, Johnson Britto
The University of Louisville Journal of Respiratory Infections
In this case report we describe a case of pulmonary histoplasmosis in a healthy adult female living in Kentucky. The patient presented with two months history of poly-arthralgia and myalgia, intermittent dry cough, chest tightness, exertional dyspnea, malaise, fatigue and one week history of skin rash. She did not respond to broad-spectrum antibiotic therapy and she also had extensive endocrine and rheumatologic work up that was negative. A diagnosis of histoplasmosis was established based on radiological findings as well as endobronchial ultrasound-guided transbronchial needle aspiration cytology (EBUS-TBNA) of mediastinal lymph nodes demonstrating necrotizing granuloma with fungal stains positive for Histoplasma. …

Pulmonary Aspergillosis: A Review On Diagnosis And Management, Bilal A. Jalil, Juan M. Galvis, Karim A. El Kersh, Mohamed Saad, Mostafa M. Fraig, Juan J. Guardiola Ii
The University of Louisville Journal of Respiratory Infections
Aspergillosis is acquired by inhalation of spores of Aspergillus, a ubiquitous species in the environment. In normal hosts, spore inhalation rarely causes lung disease.
Pulmonary aspergillosis covers a wide spectrum of clinical syndromes depending on the interaction between Aspergillus and the host (immune-status, prior bronchopulmonary disease). It runs the gamut from invasive aspergillosis to Aspergillus bronchitis and colonization.
Invasive aspergillosis occurs in severely immunocompromised patients, typically with neutropenia. Chronic pulmonary aspergillosis affects patients with chronic structural lung disease such as chronic obstructive pulmonary disease, mycobacterial lung disease, but without significant immunocompromise. Aspergillus bronchitis affects patients with bronchial disease such …

Use Of Ultrasound For Diagnosis Of Pneumonia In Adults, A Review, Dafang Chen, Rodrigo Cavallazzi
The University of Louisville Journal of Respiratory Infections
Pneumonia is a common lung infection with significant morbidity and mortality. Currently, the diagnosis of pneumonia is made by patient history confirmed with chest radiograph or computed tomography. These modalities, however, have limitations including low accuracy, radiation exposure, and high cost. Lung ultrasound has become more prevalent in evaluating pulmonary conditions and has shown to be highly accurate in the diagnosis of pneumonia. The purpose of this review is to discuss sonographic findings associated with pneumonia, techniques used to obtain quality images, and the evidence in literature supporting the use of lung ultrasound in the diagnosis of pneumonia. Numerous studies …
