Evaluation Of An Adaptive Reading Program At A Title I Public Elementary School, Monica M. Gordon

This applied dissertation was designed to evaluate the I-station adaptive reading program and determine its impact on reading proficiency of third-grade students. The school of study was a Title I school with proficiency rates for third-grade students of about 40% annually. The district recommendation for student usage mirrored the recommended minutes per week established by Imagination Station, the I-station parent company.

We are going through an unprecedented period of political instability. With the rise of the alt-right and of xenophobic sentiment, and the fallout of neoliberal government policies, our political future is at stake. These times call for the type of critical theory and praxis that gave rise to the Frankfurt School in the 1920s and to the critical ferment of the 1970s. Yet, in the face of our crises today, contemporary critical theory seems disarmed.

Critical theory is in disarray because of a wave of anti-foundational challenges in the 1960s that shattered the epistemological foundations of the Frankfurt School. The …

Post-merger appraisal rights have been the focus of heated controversy within mergers and acquisitions circles in recent years. Traditionally perceived as an arcane and cabalistic proceeding, the appraisal action has recently come to occupy center stage through the ascendancy of appraisal arbitrage — whereby investors purchase target-company shares shortly after an announcement principally to pursue appraisal. 'Fraternité' In Echr Jurisprudence, Andrea Scoseria Katz, Paulo Pinto De Albuquerque

Solidarity rights can increasingly be found in the jurisprudence of the European Court of Human Rights (ECtHR), the preeminent rights-protecting body in the world. This article examples three specific spheres in which the ideal of solidarity has left its mark on the Court’s jurisprudence: (1) society’s obligation to its most vulnerable members; (2) the right to collective enjoyment of public goods like the environment; and (3) the rights of particular groups to self-development. It examines the manner and extent that such rights have been instantiated and the theoretical difficulties they pose to a human rights court.

Law involves institutions rooted in the history of a society that evolve in relation to surrounding social, psychological, cultural, economic, political, technological, and ecological influences. Law must be understood naturalistically, historically, and holistically. In my usage, naturalism views humans as social animals with natural traits and requirements, historicism presents law as historical manifestations that change over time, and holism sees law within social surroundings. These insights inform my perspective in A Realistic Theory of Law. While these propositions might seem obvious, few works in contemporary jurisprudence build around them.

For labor, 2018 was a year of highs and lows. A wave of teachers’ strikes in states traditionally hostile to public sector labor unionism and collective bargaining garnered widespread popular support. The passions animated by the strikes were credited with inspiring a range of progressive political shifts, including the rollback of right to work laws in Missouri and new challengers running on education platforms aimed at increasing investment in public education. Reginald Heber Smith's 1919 book, Justice and the Poor, is one of the most important books about the legal profession in history. It found that people without money were denied access to the courts. Smith argued that this failure to provide equal justice undermined the social fabric of the nation. Accordingly, he urged a number of actions, including simplifying court procedures, creating small claims courts, and providing the poor with access to lawyers. These lawyers would deliver a full range of legal services to their clients, including seeking reform of the substantive laws that burdened the poor. Smith's book shamed …

Perez: A Call For A Renewed Look At Chevron, Jurisdictional Questions, And Statutory Silence, Spencer S. Fritts

In City of Arlington v. FCC, the Supreme Court ended the debate over whether an agency's interpretation of the scope of its jurisdiction should receive Chevron deference, answering in the affirmative. This Comment, however, argues that the Supreme Court should revisit this issue and establish a no-deference rule for jurisdictional cases in which the agency's assertion of power comes from statutory silence.

The Ninth Circuit's recent decision in Oregon Restaurant & Lodging Ass'n v. Perez serves as the vehicle for illustrating the necessity of this Comment's proposed no-deference rule. This Comment examines how the Perez decision fits within this narrow …

Water bugs fall under the order Hemiptera, suborder Heteroptera, which is further divided into two types, i.e., semi-aquatic (Gerromorpha) and true water bugs (Nepomorpha). They play a vital role as biological control agents and also a source of food for fishes, birds and other aquatic organisms. The present work was carried out to ascertain aquatic Hemiptera in different lentic and lotic water bodies of various sizes in Gujranwala district, Pakistan. Noncommunicable diseases such as coronary artery disease continue to remain the principal cause of mortality in the United States, claiming nearly 800,000 lives in 2016. Reducing the onset of chronic diseases, specifically coronary artery disease, requires a fundamental approach to health care, involving patient access to high-quality primary care and accessibility to disease prevention programs. This study examined multifactorial risk factors and prevention mechanisms associated with coronary artery disease.

The United States is more than fifteen years into a fight against terrorism that shows no sign of abating and, with the change in administration, appears to be intensifying. Other Western democracies that have historically been uneasy about U.S. counterterrorism policies have, in recent years, shifted toward those policies. And armed nonstate groups continue to commit large-scale acts of violence in multiple distinct theaters. The Jus Ad Bellum'S Regulatory Form, Monica Hakimi

This article argues that a form of legal regulation is embodied in decisions at the UN Security Council that condone but do not formally authorize specific military operations. Such decisions sometimes inflect or go beyond what the jus ad bellum permits through its general standards — that is, under the prohibition of cross-border force and small handful of exceptions. Recognizing that this form of regulation is both part of the law and different in kind from regulation through the general standards should change how we think about the jus ad bellum.

The U.S. Supreme Court’s approach to human rights is a global outlier. In conceiving of rights adjudication in categorical terms rather than embracing proportionality analysis, the Court limits its ability to make the kinds of qualitative judgments about rights application required to adjudicate claims of disparate impact, social and economic rights, and horizontal effects, among others. This approach, derivative of a private-law model of dispute resolution, sits in tension with the rights claims typical of a pluralistic jurisdiction with a mature rights culture, in which litigants more often disagree, reasonably, about the scope of rights rather than deny that others …

According to Reber (2016), subjectivity springs from primitive life itself. Granting his non-neurocentric stance, I shall try to show that his framework falls prey to zoocentric preconceptions that divest certain non-animal life-forms of mentality. There is no reason to exclude the possibility that plants have evolved different structures that underlie their own subjective experiences, all according to Reber’s model. It is the degree of phenotypic flexibility and integration that we observe in the behavioral repertoire of plants that may end up supporting their capacity for subjective experience. This remains an open empirical question.

Canal transportation occurs primarily in the apical region and to the outside of curvature when dentin is removed in a single direction. The goal of this paper is to validate the emotion toward the ad scale among Chinese consumers as well as test several well-accepted hypotheses in advertising literature in shock advertising setting. The results of our study suggested that emotion was correlated with attitude toward ad (Aad), the casual relationship between Aad and Attitude toward brand (Ab), and the correlation between Ab and purchase intention (PI). A validated emotion scale was also proposed to measure emotions after viewing ads in Chinese consumers. A 17-item feelings toward ads (emotion) scale was finalized by using EFA. Suggestions for future research were discussed.

This article explores the relationship between the structure of not-for-profit organizations and the ethical issues, moral hazards, and public perceptions they are likely to face. It offers a preliminary taxonomy of organizations based on their structures and relates key ethical issues to each of those categories. The equine industry, despite its considerable impact on the economy, remains overlooked in contemporary supply chain research. The current paper aims at narrowing the gap along two directions: First, the equine industry supply chain is conceptualized, and its main participants and relationships involved are identified. Second, the complex nature of these relationships is illustrated within the context of a specific strategic decision, outsourcing.
