Striking The Right Balance: Hate Speech Laws In Japan, The United States, And Canada, Craig Martin Jan 2018

Striking The Right Balance: Hate Speech Laws In Japan, The United States, And Canada, Craig Martin

UC Law Constitutional Quarterly

This Article engages in a comparative examination of three different approaches to finding the right balance between legal limits on hate speech and the right to freedom of expression. The Japanese and American systems have struggled to find both a sufficiently important purpose to justify hate speech laws, or an appropriate limiting principle to narrow their scope. Neither system views hate speech laws as implicating equal protection rights, and so the balance is heavily in favor of freedom of speech. The American doctrine views hate speech laws as justifiable only if they can come within other ill-fitting categories of lesser-protected …

Proceed With Caution: Hate Speech Regulation In Japan, Junko Kotani

UC Law Constitutional Quarterly

The Diet of Japan enacted the Hate Speech Elimination Act in 2016 amid heated debates over the appropriate role that the government should play in confronting the vulgar racist hate speech that had been permeating the country. The Act, however, does not criminalize or make illegal hate speech and is thus criticized by Professor Craig Martin. This Article argues that while the principles of freedom of speech under the Constitution of Japan may tolerate criminalization of narrowly defined hate speech, one should be cautious in advocating for immediate criminalization of racist hate speech in the country. This Article provides an …

Ethics Of Using Artificial Intelligence To Augment Drafting Legal Documents, David Hricik, Asya-Lorrene S. Morgan, Kyle H. Williams

Texas A&M Journal of Property Law

This article focuses on the second step in the due diligence process. While it addresses the question of competency, it focuses more on the further steps a lawyer must take to ensure that the use of the service as part of the representation of a client is consistent with the lawyer’s other ethical obligations. While it is important to emphasize that competency requires that the lawyer must be able to assess whether the work product is comparable to what a human would produce, competency is of course a fact-depending inquiry: whether a will is competently drafted turns on the standard …

The most profound questions that philosophers and scientists have asked across the centuries have been metaphysical and existential, such as “What is the meaning and purpose of life, why are we here, and why is there something rather than nothing?” There can be no definitive answers to these questions, so those who pose and propose answers to them necessarily engage ideology. Some physicists have become philosophers in that they are attempting to answer these profound questions with highly speculative theories as, for instance, Hawking and Mlodonow’s book The Grand Design (2010) which they tout as providing new answers to age-old …

Looking For A Needle In A Haystack: Call And Advanced Language Proficiency, Jack Burston, Kelly Arispe

World Languages Faculty Publications and Presentations

The goal of this meta-analysis is to evaluate how instructional technology has impacted advanced second language (AL2) development. Although numerous meta-analyses have been conducted within the CALL literature over the past two decades, they primarily focus upon learning outcomes and related effect sizes. None focus on advanced learning per se. Where AL2 is even mentioned, which is only rarely, little or no attention is paid to critical research parameters within the studies that are analyzed. Most notably, in summarizing learning outcomes, the linguistic competence of learners claimed to be at advanced level is simply taken at face value. So, …

Simon Brenner: Wolf Haas (1960—), Heike Henderson

World Languages Faculty Publications and Presentations

Conceived in defiance of a literary establishment that had for fifteen years refused to publish Haas's novels, the quirky ex-policeman turned private investigator Simon Brenner is now celebrated by literary critics and readers alike. Cranky, ambitionless, and often underestimated, Brenner (whose name translates as "Burner") is a reluctant hero who embodies many stereotypical Austrian traits while at the same time undermining traditional images of Austria as an unspoiled tourist destination with a rich cultural heritage, traditional values, and wholesome inhabitants.

Dying For Foie Gras: Murder, Politics And Ethical Food Production, Heike Henderson

World Languages Faculty Publications and Presentations

In recent years, culinary mysteries have enjoyed immense popularity in Germany. Marketed to both fans of detective fiction and food aficionados, they enjoy a large crossover appeal, which at least partially explains their commercial success. Ella Danz is the author of the Georg Angermüller mystery series (started in 2006, nine books so far) set in the Northern German Lübeck area. While this series, whose main protagonist is a police inspector who likes to cook and eat, did not start out as a culinary mystery series per se, it has developed into one of the most popular manifestations of this subgenre. …

Climate Change, Cattle, And The Challenge Of Sustainability In A Telecoupled System In Africa, Tara S. Easter, Alexander K. Killion, Neil H. Carter

Ecology, Evolution, and Behavior

Information, energy, and materials are flowing over greater distances than in the past, changing the structure and feedbacks within and across coupled human and natural systems worldwide. The telecoupling framework was recently developed to understand the feedbacks and multidirectional flows characterizing social and environmental interactions between distant systems. We extend the application of the telecoupling framework to illustrate how flows in beef affect and are affected by social-ecological processes occurring between distant systems in Africa, and how those dynamics will likely change over the next few decades because of climate-induced shifts in a major bovine disease, trypanosomosis. The disease is …

Background: D-Cycloserine has potential to enhance exposure therapy outcomes. The current study presents a preliminary randomized, placebo-controlled double-blind pilot trial of DCS-augmented one-session treatment (OST) for youth (7–14 years) with specific phobia. A secondary aim of this pilot study was to explore the effects of youth age and within-session fear reduction as potential moderators of DCS outcomes in order to generate hypotheses for a larger trial. It was hypothesized that DCS would be associated with greater improvements than placebo, that children (7–10 years) would have greater benefits than adolescents (11–14 years), and that DCS effects would be stronger for participants …

A Panorama Of Parks: Deep Nature, Depopulation, And The Cadence Of Conserving Nature, Emily Wakild

History Faculty Publications and Presentations

During the twentieth and early twenty-first centuries, Latin American countries set aside nature for conservation in thousands of parks and reserves. Today, such designations cover more than one-fifth of Latin America’s territory (see map 11.1). Parks range from Costa Rica’s tiny coastal Manuel Antonio National Park, consisting of a mere sixteen square kilometers, to those as large as Brazil’s Tumucumaque National Park, at nearly fifteen thousand square kilometers, a size larger than Belgium. Conservation areas famously include some of the region’s and even the world’s largest tropical forests, but also its driest deserts, highest mountain ranges, biggest waterfalls, deepest marine …

"Tho This Is My Last Tale": When Did Jeffers Write The First Version Of Point Alma Venus, Tim Hunt Jan 2018

"Tho This Is My Last Tale": When Did Jeffers Write The First Version Of Point Alma Venus, Tim Hunt

Jeffers Studies

Textual, contextual, and critical evidence suggests, but does not prove, that Robinson Jeffers worked on the first version of Point Alma Venus (a precursor to The Women at Point Sur) prior to Tamar. If so, this abandoned attempt helps clarify his transition from the conventional, allegorically controlled The Coast-Range Christ to the narrative mode that first emerges in Tamar. It also points to the need to reconsider the relationship of the long poems from this period (Tamar, Roan Stallion, and The Tower Beyond Tragedy) to The Women at Point Sur. That is, the recovery of the Alma Venus material provides …

Influence Of Invasive Hybrid Cattails On Habitat Use By Common Loons, Spencer L. Wesche, Benjamin J. O'Neal, Steve K. Windels, Bryce T. Olson, Max Larreur, Adam A. Ahlers Jan 2018

Influence Of Invasive Hybrid Cattails On Habitat Use By Common Loons, Spencer L. Wesche, Benjamin J. O'Neal, Steve K. Windels, Bryce T. Olson, Max Larreur, Adam A. Ahlers

United States National Park Service: Publications

An invasive hybrid cattail species, Typha x glauca (T. x glauca), is rapidly expanding across the United States and Canada. Dense clonal stands of T. x glauca outcompete native wetland plants, reduce open-water habitats, and negatively affect native wetland plant diversity; however, effects of hybrid cattail expansions on native wildlife are still unclear. We used multiple surveys and single-season occupancy models to examine how the relative coverage of T. x glauca affected habitat use by common loons (Gavia immer) at 71 wetland sites in Voyageurs National Park, Minnesota, USA, during summer 2016. Delineated wetland sites (2 …

United States National Park Service: Publications

Sylvatic plague poses a substantial risk to black-tailed prairie dogs (Cynomys ludovicianus) and their obligate predator, the black-footed ferret (Mustela nigripes). The effects of plague on prairie dogs and ferrets are mitigated using a deltamethrin pulicide dust that reduces the spread of plague by killing fleas, the vector for the plague bacterium. In portions of Conata Basin, Buffalo Gap National Grassland, and Badlands National Park, South Dakota, US, 0.05% deltamethrin has been infused into prairie dog burrows on an annual basis since 2005. We aimed to determine if fleas (Oropsylla hirsuta) in portions of …

The Utility Of Point Count Surveys To Predict Wildlife Interactions With Wind Energy Facilities: An Example Focused On Golden Eagles, Maitreyi Sur, James R. Belthoff, Emily R. Bjerre, Brian A. Millsap, Todd Katzner Jan 2018

The Utility Of Point Count Surveys To Predict Wildlife Interactions With Wind Energy Facilities: An Example Focused On Golden Eagles, Maitreyi Sur, James R. Belthoff, Emily R. Bjerre, Brian A. Millsap, Todd Katzner

United States Fish and Wildlife Service: Publications

Wind energy development is rapidly expanding in North America, often accompanied by requirements to survey potential facility locations for existing wildlife. Within the USA, golden eagles (Aquila chrysaetos) are among the most high-profile species of birds that are at risk from wind turbines. To minimize golden eagle fatalities in areas proposed for wind development, modified point count surveys are usually conducted to estimate use by these birds. However, it is not always clear what drives variation in the relationship between on-site point count data and actual use by eagles of a wind energy project footprint. We used existing …

Chaotic Based Self-Synchronization For Rf Steganography Radar/Communication Waveform, Michael A. Gonnella Jan 2018

Chaotic Based Self-Synchronization For Rf Steganography Radar/Communication Waveform, Michael A. Gonnella

Browse all Theses and Dissertations

In this project, we continue previous CSR project entitled RF Steganography based Joint Radar/Communication Waveform Design to develop a bio-inspired secure low probability detection (LPD) radio frequency (RF) waveform that can serve multiple purposes simultaneously. Previously, we have developed an RF steganography based RF waveform to conceal a secure digital communication within a linear frequency modulated (LFM) chirp radar signal. By exploiting novel reduced phase shift keying modulation and variable symbol duration, the new waveform is resistant to time domain analysis, frequency domain analysis and cyclostationary analysis. However, to demodulate the hidden communication message, the intended receiver has to know …

Pediatrics Faculty Publications

Background

Several tyrosine kinase inhibitors (TKIs) developed as anti-cancer drugs, also have anti-viral activity due to their ability to disrupt productive replication and dissemination in infected cells. Consequently, such drugs are attractive candidates for “repurposing” as anti-viral agents. However, clinical evaluation of therapeutics against infectious agents associated with high mortality, but low or infrequent incidence, is often unfeasible. The United States Food and Drug Administration formulated the “Animal Rule” to facilitate use of validated animal models for conducting anti-viral efficacy studies.

Methods

To enable such efficacy studies of two clinically approved TKIs, nilotinib, and imatinib, we first conducted comprehensive pharmacokinetic …

Changes In Water Quality Of Grand Lake St. Marys Watershed Following Implementation Of A Distressed Watershed Rules Package, Stephen J. Jacquemin, Laura T. Johnson, Theresa A. Dirksen, Gregory J. Mcglinch

Biological Sciences Faculty Publications

Grand Lake St. Marys watershed has drawn attention over the past decade as water quality issues resulting from nutrient loading have come to the forefront of public opinion, political concern, and scientific study. The objective of this study was to assess long-term changes in water quality (nutrient and sediment concentrations) following the distressed watershed rules package instituted in 2011. Since that time, a variety of rules (e.g., winter manure ban) and best management practices (cover crops, manure storage or transfers, buffers, etc.) have been implemented. We used a general linear model to assess variation in total suspended solids, particulate phosphorus, …
