The Commodification Of Trademarks: Some Final Thoughts On Trademark Dilution, Kenneth L. Port Dec 2017

The Commodification Of Trademarks: Some Final Thoughts On Trademark Dilution, Kenneth L. Port

Hofstra Law Review

After nearly 20 years of effectiveness, the Federal Trademark Dilution Act (FTDA) remains as controversial as ever. What the 20 years of jurisprudence has taught us is that academics have been right all along. Dilution is either unconstitutional, inappropriate, or simply misguided legislation. This article calls for its repeal. A thorough literature review shows that most academics oppose dilution. A study of all trademark litigation demonstrates that the cause of action of pure dilution never appears in reported cases anymore. The existence of the FTDA gives trademark holders the perverse incentive to claim that all marks are famous as “fame” …

Articles, Abstracts, and Reports

Although many tools have been developed to analyze small RNA sequencing (sRNA-Seq) data, it remains challenging to accurately analyze the small RNA population, mainly due to multiple sequence ID assignment caused by short read length. Additional issues in small RNA analysis include low consistency of microRNA (miRNA) measurement results across different platforms, miRNA mapping associated with miRNA sequence variation (isomiR) and RNA editing, and the origin of those unmapped reads after screening against all endogenous reference sequence databases. To address these issues, we built a comprehensive and customizable sRNA-Seq data analysis pipeline-sRNAnalyzer, which enables: (i) comprehensive miRNA profiling strategies to …

Des And Tdes Performance Evaluation For Non-Pipelined And Pipelined Implementations In Vhdl Using The Cyclone Ii Fpga Technology, Edni Del Rosal

Theses and Dissertations

Two ongoing issues that engineers must face in the new era of data analytics are performance and security. Field Programmable Gate Arrays (FPGAs) offer a new solution for optimizing the performance of applications while the Data Encryption Standard (DES) and the Triple Data Encryption Standard (TDES) offer a mean to secure information. In this thesis we present a Non-Pipelined and Pipelined, in Electronic Code Book (EBC) mode, implementations in VHDL of these two commonly utilized cryptography schemes. Using Altera Cyclone II FPGA as our platform, we design and verify the implementations with the EDA tools provided by Altera. We gather …

In His Wake: Applying Life's Truths In Fiction, Joseph M. Balderas

Theses and Dissertations

The culmination of the creative work and its introduction attempt to delve into the psyche of what it means to lose someone you love. The screenplay explores the grieving process and the coping mechanisms that accompanies it, with an examination on how far some people are willing to go for closure.

To reach my conclusions, I draw from my own life experience, the experiences of others, and a fine amount of research. It also means to shed light on the impermanent mental strain that chaperon’s grief.

Brava & Gloria: A Mexican Counterstory Screenplay, Jose David Garcia Gilling Dec 2017

Brava & Gloria: A Mexican Counterstory Screenplay, Jose David Garcia Gilling

Theses and Dissertations

“Brava & Gloria: A Counterstory Screenplay” is a thesis work which combines the theoretical aspects of Latinx representation in films with a full-length, feature film screenplay. In this work I use speculative fiction aesthetics to address the matter of representation and I create a version of how I would like to see Latinxs represented on screen. The story of “Gloria and Brava” is a medium to achieve this. Even though it does not mimic my personal experience as an immigrant, the core of the story is my family’s and my own experience as a Latino in the United States. Consequently, …

Single Tower Crane Allocation Models Using Ant Colony Optimization, Carlos Abelardo Treviño Dec 2017

Single Tower Crane Allocation Models Using Ant Colony Optimization, Carlos Abelardo Treviño

Theses and Dissertations

The construction industry greatly benefits from the utilization of heavy machines and equipment to accomplish successful projects. Tower cranes, in specific, have a crucial role in the transportation of material loads across the site. Because these machines are fixed to the ground, it is essential for planners and managers to position them in a location that provides the most efficient transfer of materials possible. This is commonly known as the tower crane allocation problem, and many researchers have attempted to optimize the tower crane location using mathematical, artificial intelligence, and simulation approaches. However, many works from the literature contain critical …

Tongs: Tldr; Opinion Network Guide System, Andrew Jen Wang

Master's Theses

In the modern world, huge amounts of text are being generated every minute. For example, Twitter users post their current emotions in tweets, while Facebook users vent about their experience in posts. In just one minute, Twitter users upload 350,000 tweets, and Facebook users post anywhere from 2.5 million to 3 million posts. To keep up with this growth in data, almost all of this information goes through automated text processing. To extract features such as the opinion and subjectivity in text, sentiment analysis is applied to the corpus. In this thesis, we present the TONGS library for conducting sentiment …

Department of Neurology Faculty Papers

The idea that synchronous neural activity underlies cognition has driven an extensive body of research in human and animal neuroscience. Yet, insufficient data on intracranial electrical connectivity has precluded a direct test of this hypothesis in a whole-brain setting. Through the lens of memory encoding and retrieval processes, we construct whole-brain connectivity maps of fast gamma (30-100 Hz) and slow theta (3-8 Hz) spectral neural activity, based on data from 294 neurosurgical patients fitted with indwelling electrodes. Here we report that gamma networks desynchronize and theta networks synchronize during encoding and retrieval. Furthermore, for nearly all brain regions we studied, …

As an answer to a lack of policy around follow up training between CRS Center Staff and school systems across the country, a policy needs to be created around providing follow up training opportunities nationally. This policy provides a repeatable, consistent model for CRS Center staff members to use with each school implementing CRS across the nation. This paper outlines the policy for allowing teachers to see other teachers implementing CRS strategies in their schools, therefore increasing the use of these strategies in classrooms nationally. This process will be applicable for school districts that works with CRS nationally. This policy …
