Modern penal theory, like prevalent western theories of law, adopts a determined model of autonomy, one in which people are separable from social and family contexts. Taken to the criminal law context, this model proposes people can be defined without taking into account the social context. The use of prisons thus presupposes that individuals can be removed from their communities and families to be reeducated, readapted, treated or—in the retributive approach—simply punished. This notion of autonomy, however, hides from sight the group of people who not only maintain family ties with the men and women in prison, but who also, …

In the past couple of decades, there has been an increase in the occurrence of wildfire events in the United States. The U.S. Forest Service estimates that over 73,000 wildfires on average occur annually in the U.S., burning about 7.3 million acres of land. Bandelier National Monument, in northern New Mexico, has been affected by several wildfires in the past 40 years, one of the most recent being the Las Conchas Fire in 2011, which burned over 60,700 hectaresin Bandelier National Monument and Valles Caldera National Preserve. Background Plasticity in foraging behavior among individuals, or across populations may reduce competition. As a generalist carnivore, western gulls (Larus occidentalis) consume a wide range of marine and terrestrial foods. However, the foraging patterns and habitat selection (ocean or land) of western gulls is not well understood, despite their ubiquity in coastal California. Here, we used GPS loggers to compare the foraging behavior and habitat use of western gulls breeding at two island colonies in central California. Highly Vented Truss Wall Honeycomb Structures, David J. Sypeck

A vented honeycomb structure with a plurality of honeycomb cells arranged in a hierarchical order and having a plurality of truss walls, each truss wall including a plurality of members. The vented honeycomb structure is fabricated by joining a plurality of sheets of trusses using any one of an expansion, a corrugation, and a slotting process. Fabrication can also occur by deposition, casting, additive, extrusion, or aligning and joining methods. The honeycomb cells, truss walls, truss wall openings, and truss wall members can be functionally graded.

People differ in how quickly they learn information and how long they remember it, and a common finding in the literature is that a quicker rate of learning coincides with better retention for the learned material. Zerr and colleagues (2017) termed the relation between learning rate and retention as learning efficiency, with more efficient learning representing both a faster acquisition rate and better memory performance after a delay. Zerr et al. also demonstrated in separate experiments that how efficiently someone learns is stable across a range of days and years. Abstract. Establishing models for the formation of well-mixed polyphase domains in ultramylonites is difficult because the effects of large strains and thermo-hydro-chemo-mechanical feedbacks can obscure the transient phenomena that may be responsible for domain production. We use scanning electron microscopy and nanotomography to offer critical insights into how the microstructure of a highly deformed quartzo-feldspathic ultramylonite evolved. The dispersal of monomineralic quartz domains in the ultramylonite is interpreted to be the result of the emergence of synkinematic pores, called creep cavities. The cavities can be considered the product of two distinct mechanisms that formed hierarchically: Zener–Stroh cracking and viscous grain-boundary …

The study purpose was to explore grade level differences (7^th, 8^th, and 9^th) among junior high school students’ perception of participation in physical education class on individual environmental stress. Physical activity’s role as a stress reduction tool has been well documented. However, physical activity as a stressful event in the school and physical education environment has been less established; particularly in junior high school students. The Gulf of Alaska is a highly productive ecosystem that supports fisheries and subsistence harvesting of marine resources. The highly productive summer season begins with a bloom that is dominated by diatoms. Both river and submarine groundwater discharge have been recognized as substantial terrestrial nutrient (nitrate and silicate) sources to the Gulf’s coastal waters. Here, the response of in-situ phytoplankton to groundwater and river water additions was evaluated via a bioassay incubation experiment. Special attention was given to diatom genera, as previous studies have shown that submarine groundwater discharge preferentially induces growth of diatoms. We hypothesize that distinct cell phenotypes are governed by different sets of gene master regulators (GMRs) whose strongly protected (by the homeostatic mechanisms) abundance modulates most cell processes by coordinating the expression of numerous genes from the corresponding functional pathways. Gene Commanding Height (GCH), a composite measure of gene expression control and coordination, is introduced to establish the gene hierarchy in each phenotype. If the hypothesis is true, than one can selectively destroy cancer nodules from a heterogeneous tissue by altering the expression of genes whose GCHs are high in cancer but low in normal cell phenotype. Colorado Civil Rights Commission, in which baker (self-described cake artist) Jack Phillips, owner of Masterpiece Cakeshop, asked the court to decide “whether applying Colorado’s public accommodations law to compel artists to create expression that violates their sincerely held religious beliefs about marriage violates the Free Speech or Free Exercise Clauses of the First Amendment.”

In this paper, we propose a Bayesian generative model that can form multiple categories based on each sensory-channel and can associate words with any of the four sensory-channels (action, position, object, and color). This paper focuses on cross-situational learning using the co-occurrence between words and information of sensory-channels in complex situations rather than conventional situations of cross-situational learning. We conducted a learning scenario using a simulator and a real humanoid iCub robot. Library Philosophy and Practice (e-journal)

A case of a credit bearing information literacy skills class, offered to first year undergraduate students though not across all colleges at the Kwame Nkrumah University of Science and Technology (KNUST), Ghana was analysed. The survey research methodology was used and questionnaire was distributed to 136 students. The findings indicated that the course was relevant and should be maintained though students’ knowledge on ethical use of information, citation skills, and information searching skills were poor. The study recommends a collaborative partnership between librarians and faculty for the teaching and learning of information literacy skills.

In Herr v. U. S. Forest Service, the Sixth Circuit ruled on whether the Forest Service could infringe on pre-existing private property rights held adjacent to a designated Wilderness Area. The Herrs purchased lakefront property adjacent to the Sylvania Wilderness in the Upper Peninsula of Michigan with the intention of using their littoral rights for recreational boating. The Sylvania Wilderness was created under the Michigan Wilderness Act in 1987, but the Act observed valid existing rights. The court found that the Herrs’ littoral rights were recognizable “valid existing rights.” Therefore, the Forest Service’s restriction of those rights was illegal.

In Mays v. City of Flint Michigan, Michigan Department of Environmental Quality employees removed a class action against them in the Michigan state court to federal court under the federal-officer removal statute. This court ruled in favor of the residents of Flint, determining that the federal officer removal statute did not give the federal court jurisdiction over a state agency simply because the agency must follow federal rules. The court held that Michigan Department of Environmental Quality employees could not have been “acting under” the federal government even though the state agency’s enforcement authority could be trumped by the …

This Article deals with debt-for-equity swap-related issues in Korean corporate restructuring procedures. Debt-for-equity swaps were widely employed during the Latin American foreign debt restructuring process, but the Korean case is slightly different. Because the creditors of reorganizing corporations are mainly Korean domestic financial institutions rather than foreign creditors, this type of financial scheme is applied under local law. The following examines the legal aspects of debt-for-equity swaps, which have been promoted as a way to eliminate excessive insolvent loans and financial debts (and stood in the way of restructuring, via IMF bail-out funds). During normal DisplayPort^TM operation, a cable connects from the Sink (monitor) to the Source directly via physical DisplayPort pins. But, what happens when Sink is connected to an Intermediary Device (ID) that connects to the Source? The straightforward approach is to transfer DisplayPort signals from Intermediary Device (ID) to the Source by hard-wiring all DisplayPort signals between them. This approach could be challenging if enough hardware pins are not available to send all the DisplayPort signals across from Intermediary Device to Source.
