Trends In Prisoner Litigation, As The Plra Approaches 20, Margo Schlanger

The Prison Litigation Reform Act (PLRA) enacted in 1996 as part of the Newt Gingrich “Contract with America,” is now as old as many prisoners. In the year after the statute’s passage, some commenters labeled it merely “symbolic.” In fact, as was evident nearly immediately, the PLRA undermined prisoners’ ability to bring, settle, and win lawsuits. The PLRA conditioned court access on prisoners’ meticulously correct prior use of onerous and error-inviting prison grievance procedures. It increased filing fees, decreased attorneys’ fees, and limited damages. It subjected injunctive settlements to the scope limitations usually applicable only to litigated injunctions. It made …

In a provocative essay, philosopher Jeffrie Murphy asks: 'what would law be like if we organized it around the value of Christian love, and if we thought about and criticized law in terms of that value?'. This book brings together leading scholars from a variety of disciplines to address that question. Scholars have given surprisingly little attention to assessing how the central Christian ethical category of love - agape - might impact the way we understand law. This book aims to fill that gap by investigating the relationship between agape and law in Scripture, theology, and jurisprudence, as well as …

Any attempt to comprehensively analyse the enforcement of corporate law and securities regulation is difficult, not only because there are so many distinct national systems in play, but also because, we need to examine both formal enforcement mechanisms and the way in which such mechanisms are applied in practice. If nothing else, the expert analyses presented in the foregoing chapters of this book confirm that with respect to enforcement issues a rather large gap does exist between what Roscoe Pound memorably called ‘law in books’ and ‘law in action’.

Fine particulate matter (PM2.5) air pollution outbreaks have recently occurred frequently in China. However, evidence of the associations between short-term exposure to PM2.5 and cardiovascular morbidity is still limited in China. This study aimed to evaluate the associations between PM2.5 and hospital emergency room visits (ERVs) for cardiovascular diseases in urban areas in Beijing. Daily counts of cardiovascular ERVs were collected from ten large general hospitals from Jan 1 to Dec 31, 2013. Air pollution data were obtained from the Beijing Environmental Protection Bureau including 17 monitoring stations. A generalized additive Poisson model was used to …

Introduction
A blood-based biomarker panel to identify individuals with preclinical Alzheimer's disease (AD) would be an inexpensive and accessible first step for routine testing.
Methods
We analyzed 14 biomarkers that have previously been linked to AD in the Australian Imaging Biomarkers lifestyle longitudinal study of aging cohort.
Results
Levels of apolipoprotein J (apoJ) were higher in AD individuals compared with healthy controls at baseline and 18 months (P =.0003) and chemokine-309 (I-309) were increased in AD patients compared to mild cognitive impaired individuals over 36 months (P =.0008).
Discussion
These data suggest that apoJ may have potential in the context …

Workplace Violence Against Nurses: A Cross-Sectional Descriptive Study Of Ghanaian Nurses, Isaac Mensah Boafo, Peter Hancock
Research outputs 2014 to 2021
The aim of this study was to document the incidence, sources, and effects of workplace physical violence against Ghanaian nurses. Self-report questionnaires were completed by 592 nurses employed in public general hospitals in Ghana. Participants were selected using a combination of purposive and random sampling techniques. Nine percent of the participants experienced physical violence in the 12 months preceding the study. The majority of perpetrators were relatives of patients. Chi-square tests suggested significant relationships between type of hospital and workplace physical violence, and between intention to quit the nursing profession and workplace physical violence. Workplace violence had several negative effects …

Pd-L1 Expressing Circulating Tumour Cells In Head And Neck Cancers, Arutha Kulasinghe, Chris Perry, Liz Kenny, Majid E. Warkiani, Colleen Nelson, Chamindie Punyadeera
Research outputs 2014 to 2021
Background
Blockade of the PD-1/PD-L1 immune checkpoint pathway is emerging as a promising immunotherapeutic approach for the management and treatment of head and neck cancer patients who do not respond to 1st/2nd line therapy. However, as checkpoint inhibitors are cost intensive, identifying patients who would most likely benefit from anti PD-L1 therapy is required. Developing a non-invasive technique would be of major benefit to the patient and to the health care system.
Case presentation
We report the case of a 56 year old man affected by a supraglottic squamous cell carcinoma (SCC). A CT scan showed a 20 mm right …

Teaching Teamwork In Australian University Business Disciplines: Evidence From A Systematic Literature Review, Linda Riebe, Antonia Girardi, Craig Whitsed
Research outputs 2014 to 2021
Australian employers continue to indicate that the development of teamwork skills in graduates is as important as mastering technical skills required for a particular career. In Australia, the reporting on the teaching of teamwork skills has emanated across a range of disciplines including health and engineering, with less of a focus on business related disciplines. Although Australian university business schools appear to value the importance and relevance of developing teamwork skills, implementation of the teaching, learning, and assessment of teamwork skills remains somewhat of a pedagogical conundrum. This paper presents evidence from a systematic literature review as to the salient …

Feasibility Of Presurgical Exercise In Men With Prostate Cancer Undergoing Prostatectomy, Favil Singh, Robert Newton, Michael Baker, Nigel Spry, Dennis Taaffe, Jeffery Thavaseelan, Daniel A. Galvao
Research outputs 2014 to 2021
Background:
Prostatectomy is associated with short- and long-term morbidity, which includes attenuation of muscle function and deterioration of lean body mass. Physical function is a known predictor of morbidity and mortality, with initial evidence indicating that presurgical exercise is associated with fewer postsurgical complications and shorter hospitalization. The aim was to determine the feasibility of a supervised presurgical exercise program for prostate cancer (PCa) patients scheduled for prostatectomy.
Methods:
Ten men (68+6.4 years old) with localized PCa undertook a 6-week resistance and aerobic exercise program prior surgery. Training was undertaken twice weekly and patients were assessed at baseline, presurgery, and …

Behavioral Responses Of Tuta Absoluta To A Wild And Cultivated Tomato Plants And Characterization Of The Mediating Semiochemical Blends, Raphael Njurai Miano
All Master’s Theses
Tomato is rated the second most important horticultural crop after potato in most parts of the world. However, its cultivation is threatened by infestations of Tuta absoluta (Lepidoptera: Gelechiidae). The pest originated from South America and is now invading fields and greenhouse production sites in the world. Tuta absoluta was first officially reported in Kenya in March 2014 at Isiolo and has spread to all parts where tomato is grown. The pest has been nicknamed tomato ‗Al-shabaab‘ as it leaves unimaginable damage of the crop after infestations. Chemical methods used to control the pest have led to high levels of …

Transgenic Expression Of The Tsetse Fly Glossina Fuscipes Fuscipes Olfactory Receptor, Or67d, In Drosophila Melanogaster, Bishola Tania
All Master’s Theses
Tsetse flies are the sole vectors of Human African trypanosomiasis (sleeping sickness) and Animal African trypanosomiasis (Nagana). The insect is attracted to its suitable hosts through external signals which are perceived by olfactory receptors (ORs); thus representing the basis of transmission of the disease to thousands of people and millions of livestock. A developing approach to efficiently identify the key chemical ligands of odorant receptors entails expressing single ORs in different cell systems for consequent screening analysis. This study aimed to establish the expression of an expanded olfactory receptor family, Or67d of Glossina fuscipes fuscipes, a vector of both animal …

Muddy Waters: Unintentional Consequences Of Blue Carbon Research Obscure Our Understanding Of Organic Carbon Dynamics In Seagrass Ecosystems, E. Fay Belshe, Miguel-Angel Mateo, Lucy Gillis, Martin Zimmer, Mirta Teichberg
Research outputs 2014 to 2021
The recent surge in research on organic carbon sequestration by seagrass ecosystems has begun to reveal the complexity of the carbon cycle within these ecosystems. In this prospective we discuss two areas of investigation that require further scrutiny: (1) why organic carbon is stabilized in seagrass sediments, and (2) how long organic carbon resides within these sediments. By delving into these topics, pointing out current pitfalls, and highlighting methodological advances, our motive is to focus future efforts and provide a frame work to manage the complexity found within the diverse seagrass bioregions. The high rate of seagrass degradation and loss, …

Assessment Of Rodents' Postharvest Losses In On-Farm Maize Storage In Kenya, Kukom Edoh Ognakossan
All Master’s Theses
Rodents are one of the major postharvest pests that affect food security by impacting on both food availability and safety. However, knowledge of the impact of rodents in on-farm maize storage systems in Kenya is limited. A survey was conducted in 2014 with a total of 630 farmers spread across the six maize growing agro-ecological zones (AEZs) to assess postharvest losses magnitudes in on-farm maize storage systems in Kenya, and the contribution of rodents to the losses. Experiments were also set in the AEZ identified from the survey study as the main rodents' hot-spot area with 20 farmers from which …
"You Are No Longer Creative When You Give Up": Technical Theatre’S Creative Sleight Of Hand, Maggie Phillips, Renee Newman
"You Are No Longer Creative When You Give Up": Technical Theatre’S Creative Sleight Of Hand, Maggie Phillips, Renee Newman
Research outputs 2014 to 2021
The Western Australian Academy of Performing Arts at Edith Cowan University contains vocational education training programmes including technical design courses with broad reach covering arts administration, stage management, stage lighting, sound design, set and costume design. In an unsettling problematic, teachers and students in the broadly themed Production and Design courses often find themselves isolated from the other creative disciplines or battle with the perception that their work is in fact not creative but entirely the technical implementation of ‘someone’s else’s vision’. This approach seems to dismiss the creative thinking required in the development and orchestration of the design and …

Despite the increasing number of studies examining the effects of mindfulness interventions on symptoms associated with Bipolar Disorder (BD), the effectiveness of this type of interventions remains unclear. The aim of the present systematic review was to (i) critically review all available evidence on Mindfulness Based Cognitive Therapy (MBCT) as a form of intervention for BD; (ii) discuss clinical implications of MBCT in treating patients with BD; and (iii) provide a direction for future research. The review presents findings from 13 studies (N = 429) that fulfilled the following selection criteria: (i) included BD patients; (ii) presented results separately for …
Interpersonal Apologies: A Psychological Perspective Of Why They Might Work In Law?, Alfred Allan, James Strickland, Maria M. Allan
Interpersonal Apologies: A Psychological Perspective Of Why They Might Work In Law?, Alfred Allan, James Strickland, Maria M. Allan
Research outputs 2014 to 2021
Apologies have become an accepted feature in many fields of law and there is evidence that they make a constructive contribution to the resolution of disputes. The reason for this might be that they address the intangible needs of parties after adverse events that law otherwise find difficult to address. Legal reformers introduced apologies into law primarily on the basis of deductive reasoning without being able to refer to a comprehensive psychological theory that explains the apology process; in part because apology was only identified as a psychological construct worthy of empirical research during the last quarter of the 20th …
Japan’S Adr System For Resolving Nuclear Power-Related Damage Disputes, Daniel H. Foote
Japan’S Adr System For Resolving Nuclear Power-Related Damage Disputes, Daniel H. Foote
Articles
This paper has dual aims. First, it introduces the Nuclear Power-Related Damage Claim Resolution Center, established in 2011 to handle disputes arising out of the March 2011 meltdown at the Fukushima Daiichi nuclear power plant. After first examining the genesis of that Center, this paper describes its structure and roles and discusses its performance, including the challenges it has faced and the accomplishments it has achieved. Second, this paper seeks to place that Center into the broader context of the overall development of alternative dispute resolution (ADR) in Japan and to assess its impact. Two major themes recur throughout this …
Privacy, Vulnerability, And Affordance, Ryan Calo
Privacy, Vulnerability, And Affordance, Ryan Calo
Articles
This essay begins to unpack the complex, sometimes contradictory relationship between privacy and vulnerability. I begin by exploring how the law conceives of vulnerability — essentially, as a binary status meriting special consideration where present. Recent literature recognizes vulnerability not as a status but as a state — a dynamic and manipulable condition that everyone experiences to different degrees and at different times. I then discuss various ways in which vulnerability and privacy intersect. I introduce an analytic distinction between vulnerability rendering, i.e., making a person more vulnerable, and the exploitation of vulnerability whether manufactured or native. I also describe …
Artificial Intelligence Policy: A Primer And Roadmap, Ryan Calo
Artificial Intelligence Policy: A Primer And Roadmap, Ryan Calo
Articles
Talk of artificial intelligence is everywhere. People marvel at the capacity of machines to translate any language and master any game. Others condemn the use of secret algorithms to sentence criminal defendants or recoil at the prospect of machines gunning for blue, pink, and white-collar jobs. Some worry aloud that artificial intelligence will be humankind’s “final invention.” This essay, prepared in connection with UC Davis Law Review's 50th anniversary symposium, explains why AI is suddenly on everyone's mind and provides a roadmap to the major policy questions AI raises. The essay is designed to help policymakers, investors, technologists, scholars, and …
Is There A Right To Be Free From Corruption?, Anita Ramasastry
Is There A Right To Be Free From Corruption?, Anita Ramasastry
Articles
Scholars and policymakers have, for some time, focused on the link between corruption and human rights. This has been to illustrate that corruption is not a victimless crime. While this has publicized the impact of corruption on individuals and on society, it has not changed the lack of political will to prosecute many instances of corruption. Thus citizens often stand by as their leaders plunder national treasuries. Rather than focusing solely on human rights, or trying to create a new “human right” to be free from corruption, this article explores the right to a legal remedy for victims of corruption …
Model Rule 5.7 And Lawyers In Government Jobs - How Can They Ever Be Non-Lawyers, Hugh D. Spitzer
Model Rule 5.7 And Lawyers In Government Jobs - How Can They Ever Be Non-Lawyers, Hugh D. Spitzer
Articles
This article focuses on the application of the Rules of Professional Conduct to licensed attorneys who serve in non-lawyer jobs in government. There is a fair amount of literature about members of the bar who serve as staff counsel in legislatures or executive agencies. There is also literature on Rule 5.7 of the ABA Model Rules of Professional Conduct (“Responsibilities Regarding Law-related Services”) in the context of practicing lawyers who participate in ancillary “non-lawyering” business activities. Model Rule 5.7 deals with “services that might reasonably be performed” or “are related to the provision of legal services” but which are permitted …
Beyond A Zero-Sum Federal Trust Responsibility: Lessons From Federal Indian Energy Policy, Monte Mills
Beyond A Zero-Sum Federal Trust Responsibility: Lessons From Federal Indian Energy Policy, Monte Mills
Articles
The federal government’s trust relationship with federally recognized Indian tribes is a product of the last two centuries of Federal Indian Law and federal-tribal relations. For approximately the last 50 years, the federal government has sought to promote tribal self-determination as a means to carry out its trust responsibilities to Indian tribes; but the shadows of prior federal policies, based largely on notions of tribal incompetence and federal paternalism, remain. Perhaps no other policy arena better demonstrates the history, evolution, and promise for reform of the federal trust relationship than Federal Indian energy policy, or the range of federal statutes …
Postpartum Taxation And The Squeezed Out Mom, Shannon Weeks Mccormack
Postpartum Taxation And The Squeezed Out Mom, Shannon Weeks Mccormack
Articles
Faced with too-short (or nonexistent) maternity leaves, inflexible work schedules, and the soaring costs of childcare in the United States, many new mothers temporarily leave the workforce to care for their young children. Although media attention has focused on the “opt-out” mom, many more mothers are squeezed out of the external workplace. But mothers that try to return to work may discover that it is difficult to do so, as employers have been shown to be less likely to hire mothers than others. A mother that does reenter may find that even short periods out of work cost (sometimes far) …
Zombie Patents And Zombie Companies With Patents, Xuan-Thao Nguyen
Zombie Patents And Zombie Companies With Patents, Xuan-Thao Nguyen
Articles
While a zombie is the undead and has no expiration, patents do. A patent comes into existence the moment the government, through the United States Patent and Trademark Office (USPTO), examines the invention application and issues a grant of patent. From that birth, a patent will have a lifetime of only twenty years from the date of filing the application. Patents expire and have no life after the twenty-year period.
Some patents die when the patentees abandon them by not paying maintenance fees. Dead patents must remain dead and become part of the public domain. Unfortunately, this Essay observes that …
