This article argues that the uniquely adversarial nature of the United States litigation system, rooted in the medieval English system of "trial by battle," has replicated itself in almost all aspects of American society, distinguishing the United States from even its common law counterparts that shared the genesis of their legal systems in English "trial by battle." This "trial by battle" is often characterized in the context of speech by terms such as the 'marketplace of ideas," or in the context of economics by terms such as "the law of the jungle.," Even resolution of basic Constitutional concepts are subject …

Hank is universally recognized as the Dean of Black international law scholars and lawyers in the United States (U.S.), Africa, and beyond. Trace explosive detection is the primary way for quick and easy sampling of various surfaces in a check-point environment, e.g. an airport. The swabs used for commercial explosive detectors, such as ion mobility spectrometers, are made of various materials. The difficulty in collection and analysis of explosive traces is that the swabs must be effective at adsorbing as well as desorbing materials, i.e. pickup from the surface and release into the detection device. This dichotomy results in a tradeoff for development of new swabs. Generally, desorption is considered to be the more desirable property; therefore, Teflon is one choice for …

Terrorist Aesthetics As Ideal Types: From Spectacle To "Vicious Lottery", Marshall Battani, Michaelyn Mankel

This essay builds on Arnold Berleant’s concept of the negative sublime and his less-appreciated image of the vicious lottery to engage the ongoing discussion about the importance of aesthetic analysis for understanding terrorism. Sociological definitions of aesthetics and terrorism are presented as potential tools to aid in the analyses of terrorist aesthetics. Three aesthetic types of terrorism are developed in the tradition of Weberian sociological ideal typification. The article discusses the appropriateness and applicability of that typology for enriching our understanding of terrorism and counterterrorism.

The government is unique among speakers because of its coercive power, its substantial resources, its privileged access to national security and intelligence information, and its wide variety of expressive roles as commander-in-chief, policymaker, educator, employer, property owner, and more. Precisely because of this power, variety, and ubiquity, the government's speech can both provide great value and inflict great harm to the public. In wartime, more specifically, the government can affirmatively choose to use its voice to inform, inspire, heal, and unite -- or instead to deceive, divide, bully, and silence.

A core failing of today’s administrative state and modern administrative law scholarship is the lack of imagination as to how agencies should operate. On the conventional telling, public agencies follow specific grants of regulatory authority, use the traditional tools of notice-and-comment rulemaking and adjudication, and are checked by judicial review. In reality, however, effective administration depends on entrepreneurial leadership that spearheads policy experimentation and trial-and-error problem-solving, including the development of regulatory programs that use non-traditional tools.

This Thesis argues that violence is essential to the structures and plots of Charles Dickens’s Barnaby Rudge and A Tale of Two Cities and of Leo Tolstoy’s War and Peace and Anna Karenina, and is particularly essential to the edification, or the moral and intellectual improvement, of principal characters in these four novels. Additionally, this Thesis contends that this edification is both anticipated and reinforced by the novelists’ incorporation of counterparts whose demeanor and/or narrative overtly mirror that of the principal characters.

This paper provides an analysis of what information can be found on laptops that may or may not have connections to an organisation of some form, the statistics of the number of laptops stolen or otherwise misplaced in 2015 and 2016, and the number of potentially affected people from each of the cases. As seen in many news articles, laptops are often stolen or otherwise misplaced by employees or contractors in an organisational environment. The primary objective of this research is to critically analyze changes in perceptions associated with hydraulic fracturing within Dimock, Pennsylvania. Residents of Dimock initially welcomed fracking in 2006 due to positive corporate rhetoric promoting economic benefits such as mineral rights acquisition, land-leasing, and local business development. However, economic benefits diminished as Dimock advanced through a boom period resulting in a current economic and ecological bust. Two months of data collection occurred in the summer of 2016 using semi-structured interviews, participant observation, and document analysis. The process involves identification of the critical resources, proposing plans for responding to potential breaches and executing effective containment and recovery procedures. This Article focuses on the role of the lawyers using the framework described by Professor Richard J. Lazarus in his 2008 article, Advocacy Matters Before and Within the Supreme Court: Transforming the Court by Transforming the Bar. Lazarus argues the modern Supreme Court bar has come to be dominated by a small number of Supreme Court specialists. Because of their experience and superior knowledge of the Justices and Supreme Court practice, Supreme Court specialists are more likely to obtain outcomes desired by their clients, which are typically large corporations or industry trade associations. This thesis uses quantitative and qualitative methods to examine the relationship between water availability and civil conflict through an ethnic conflict lens. It further applies the trends observed in this relationship to United States National Security concerns to provide real-world applications of the knowledge gained. Consisting of quantitative and qualitative parts, this thesis uses logit analysis of data to test for significance in the water-conflict relationship then conducts a case study on Israel and Palestine, Darfur, and ISIS in Iraq to examine how water impacts conflict in true situations. The purpose of this study is to provide an introduction and analysis of Harvest Festival, a work for piano four hands by Taiwanese composer Yann-Jong Hwang. This work incorporates elements of traditional Taiwanese music that is largely unfamiliar to performers and listeners beyond the border of Taiwan.

With the exception of Professor Hwang’s own journal article on this piece, this project is the only study of Harvest Festival available in the United States or Taiwan. This research will be meaningful to both performers and piano teachers as an encouragement to include Yann-Jong Hwang’s work within their concert repertory.
