Federal and state law both provide a cause of action against inappropriate and unauthorized uses that ‘tarnish’ a trademark. Copyright owners also articulate fears of ‘tarnishing’ uses of their works in their arguments against fair use and for copyright term extension. The validity of these concerns rests on an empirically testable hypothesis about how consumers respond to inappropriate unauthorized uses of works. In particular, the tarnishment hypothesis assumes that consumers who are exposed to inappropriate uses of a work will find the tarnished work less valuable afterwards. This paper investigates the relationship between Habermas’s theory of communicative action (TCA) and writing. It begins with a review of the features of Habermas’s TCA: validity claims, their corresponding criteria, and the ideal speech situation. Then TCA is applied in analyzing a first grader’s written notes. Finally, the implications for the teaching and learning of writing are discussed from a Habermasian perspective. This paper demonstrates the applicability of Habermas’s TCA in examining writing. It also shows how TCA informs the teaching and learning of writing.

งานวิจัยนี้จึงมีวัตถุประสงค์เพื่อศึกษาพฤติกรรมของผู้ใช้บริการ ปัจจัยการเข้าใช้บริการคอมมูนิตี้มอลล์ และความสัมพันธ์ระหว่างการใชบริการกับร้านค้าในคอมมูนิตี้มอลล์ โดยทำการศึกษาคอมมูนิตี้มอลล์ที่มีบริบทโดยรอบต่างกันใน 2 กรณี คือพื้นที่ชุมชนโดยรอบที่เป็นที่พักอาศัยเป็นส่วนใหญ่ อันได้แก่ นวมินทร์ ซิตี้ อเวนิว และชุมชนโดยรอบที่มีทั้งแหล่งงาน สถานศึกษาและที่พักอาศัย อันได้แก่ อเวนิว รัชโยธิน เพื่อหาความเหมือนและแตกต่างของ 2 กรณี โดยผู้วิจัยเก็บข้อมูลด้วยการสำรวจพื้นที่ภาคสนามเพื่อเก็บข้อมูลร้านค้า และใช้แบบสอบถามจำนวน 400 ชุด ด้วยการสุ่มแบบบังเอิญ (Accidental Sampling) โดยเลือกเก็บแบบสอบถามกระจายตั้งแต่วันจันทร์ถึงอาทิตย์ ผลการศึกษาพบว่ากลุ่มคนที่เข้าใช้บริการคอมมูนิตี้มอลล์ทั้ง 2 แห่ง เป็นเพศหญิงมากกว่าเพศชาย ส่วนใหญ่ มีอายุ 18-25 ปี ร้อยละ 59 มีระดับรายได้อยู่ในช่วง 10,001-35,000 บาท เป็นกลุ่มนักเรียน นักศึกษา และพนักงานประจำ เหตุผลในการเข้าใช้บริการคอมมูนิตี้มอลล์ที่ให้ความสำคัญมากที่สุด คือคอมมูนิตี้มอลล์อยู่ใกล้ที่พักอาศัย มีร้านค้าที่ตรงความต้องการ และมีที่จอดรถ ลักษณะการใช้บริการมีทั้งมาคนเดียว มากับเพื่อน คนรัก หรือครอบครัว พฤติกรรมการใช้บริการส่วนใหญ่สอดคล้องกับลักษณะร้านค้าและเหตุผลการเข้าใช้บริการ เช่น กลุ่มตัวอย่างผู้เข้าใช้บริการ อเวนิว รัชโยธิน ส่วนใหญ่มักมาใช้บริการคนเดียว ต่างจาก กลุ่มตัวอย่างที่ใช้บริการนวมินทร์ซิตี้ อเวนิว ส่วนใหญ่มากับกลุ่มเพื่อนและครอบครัว สัมพันธ์กับเหตุผลความต้องการที่จอดรถและประเภทร้านค้าอย่างมีนัยสำคัญทางสถิติ เป็นต้น จากข้อมูลดังกล่าวทำให้สรุปได้ว่าร้านค้าในคอมมูนิตี้มอลล์สอดคล้องกับพฤติกรรมที่เน้นความสะดวกในการเดินทางและใช้จ่าย เพราะสถานที่ให้บริการอยู่ไม่ไกลจากที่พักอาศัย หรืออาคารสำนักงาน หรือสถานศึกษา ใช้เวลาเดินทางไม่นาน มีร้านค้าที่ให้บริการตรงวัตถุประสงค์ มีที่จอดรถ แต่กลุ่มคนที่เข้าใช้บริการอาจมีความแตกต่างกันตามบริบทแวดล้อมของแต่ละสถานที่

Dancers are susceptible to overuse foot and ankle injuries, however there is a lack biomechanical studies examining foot mechanics to explain the causality of these injuries. The purpose of this study was to determine the intra and inter-assessor repeatability of a modified Rizzoli Foot Model (RFM) for ballet dancers.

Methods: Six university-level ballet dancers performed the following trials in randomized order, natural stance, turnout plié and stance, and two dynamic trials; turnout rise and flex-point-flex movement. Functional turnout in ballet involves maximal external rotation through the lower limb kinetic chain. Hip external rotation, is considered the primary contributor of functional turnout. However, dancers will tend to increase their functional turnout angle through additional tibiofemoral external rotation and pronation of the foot/ankle complex. Hip external rotation measures in functional turnout has received extensive examination in dance science. However, the relationship between the ‘below the hip' assessments with functional turnout is poorly understood. We hypothesis that dancers with greater passive external tibiofemoral rotation (pTFR) and/or pronated stance will have a greater functional turnout angle.

Alleys are underutilized as contemporary pedestrian thoroughfares because they have historically served to hide the utilitarian functions of urban life. Thus, the narrow spaces fail to provide the necessary amenity required for active pedestrian spaces, and are therefore shrouded by negative stigmas. As a result, alleyways are disregarded as being viable pedestrian thoroughfares and therefore fail to be integrated into existing urban networks. I have researched Butoh as a model for original work that employs multiculturalism against hegemonic control of personal identity. It expostulates that doing so during college gives students an advantage in marketing themselves professionally. It substantiates the general lack of cohesive undergraduate training in this area. In a traditional Middle Eastern society, men and women have been confined within society’s gender definitions. Those imposed social constructs condition men differently from women by dictating expected behaviors, establishing a hierarchy of gender positioning and enforcing definitions that limit abilities and potential.

Based on postmodernist philosopher, feminist and social theorist, Simone de Beauvoir and postmodernist American philosopher and gender theorist Judith Butler, gender is not an inborn role, but rather created through stylized repetition of acts informed by society, named performative acts. For de Beauvoir and Butler, gender can never be a stable identity (Butler 1988).

Magic Kingdom is a feature-length, microbudget motion picture, produced, "written", directed, and edited by Milos Ajdinovic as a part of the University of Central Florida's Masters in Fine Arts program in Digital Entrepreneurial Cinema. Its narrative is a product of the collective improvisation between a group of collaborators – Chealsea Anagnoson, Henry Gibson, Mikaela Duffy and Marcus Nieves – moderated by Milos Ajdinovic.
