Rapid Litigation Management Ltd. V. Cellzdirect, Inc.: Limiting The Use Of Subject Matter As A Functional Barrier To Patent Eligibility In The Biotechnology Industry, Casey M. Olesen
Maine Law Review
In recent years, the biotechnology industry has surpassed a market worth of $200 billion dollars, with over 1.4 million jobs dependent on that market. However, the biotechnology industry is also uniquely dependent on the patent system to protect the huge investments of time and money required to bring new research to the market. Increasingly, courts have improperly used the Patent Act's Section 101 subject matter eligibility requirement as a functional barrier for new biotechnological patents, creating substantial uncertainty in the validity of many patents. In particular, the courts have utilized judicially created exceptions to allowable subject matter--laws of nature, natural …

Putting The Restroom Debate To Rest: Addressing Title Ix And Equal Protection In G.G. Ex Rel. Grimm V. Gloucester County School Board, Alexandra A. Harriman
Maine Law Review
Courts, legislatures, and citizens have been debating whether transgender students should use the restroom that corresponds to their biological sex, or whether they can choose to use the facilities which align with their gender identity. The Fourth Circuit decided that Title IX required the latter in G.G. ex. rel. Grimm v. Gloucester County School Board, but that didn't settle the issue. To complicate things, the Trump Administration revoked the guidance that the Fourth Circuit had relied on. This Note argues that a court should resolve this once and for all by finding that a school policy that requires students to …

The Advent Of University-Level Packaging Scholarship: The Time, The Place And The People, Diana Twede, Laura Bix
The Advent Of University-Level Packaging Scholarship: The Time, The Place And The People, Diana Twede, Laura Bix
Journal of Applied Packaging Research
In 1952, Michigan State College (MSC), now Michigan State University (MSU), was the first university in the world to offer a Bachelor of Science degree in Packaging. Other universities had previously offered related courses like canning (as part of a food science degree) or military packaging (in wartime), but MSU was the first to propose packaging as its own academic field of scholarship.
Other universities followed, sharing faculty and curriculum models developed at MSU. As a result, graduates’ careers in packaging now have a higher professional status, and universities play a key role in developing our international community of packaging …

Quantification Of Areal Extent Of Soil Erosion In Dryland Urban Areas: An Example From Windhoek, Namibia, Rosemary Shikangalah, Eva Paton, Florian Jetlsch, Niels Blaum
Cities and the Environment (CATE)
Soil erosion, while often studied in dryland settings for rural regions, has only occasionally been studied in urban settings. This study maps and quantifies areal extent and severity of water erosion in a dryland city (Windhoek, Namibia) using a snap-shot field survey approach. The results show that nearly 56% of the city could be affected by water erosion with signs of accelerated erosion in the form of rills and gullies. These occur mainly in the underdeveloped, informal and semi-formal areas of the city. Factors influencing the extent of erosion in Windhoek include vegetation cover and type, socio-urban factors, and to …
Can The Global Forest Sector Survive 11°C Warming?, Alice Favero, Robert Mendelsohn, Brent Sohngen
Can The Global Forest Sector Survive 11°C Warming?, Alice Favero, Robert Mendelsohn, Brent Sohngen
Fondazione Eni Enrico Mattei Working Papers
It is well known that the forestry sector is sensitive to climate change but most studies have examined impacts only through 2100 and warming of less than 4°C. This is the first timber analysis to consider possible climate change impacts out to 2250 and warming up to 11°C above 1900 levels. The results suggest that large productivity gains through 2190 lead to a continued expansion of the global timber supply. However, as carbon fertilization effects diminish and continued warming causes forestland to continue to shrink, warming above 8°C is predicted to become harmful to the forest sector.

Fondazione Eni Enrico Mattei Working Papers
The Paris Agreement has set stringent temperature targets to limit global warming to 2°C above preindustrial level, with efforts to stay well below 2°C. At the same time, its bottom-up approach with voluntary national contributions makes the implementation of these ambitious targets particularly challenging. Climate engineering – both through carbon dioxide removal (CDR) and solar radiation management (SRM) – is currently discussed to potentially complement mitigation and adaptation. Results from integrated assessment models already suggest a significant role for some forms of climate engineering in achieving stringent climate objectives1. However, these estimates and their underlying assumptions are uncertain and currently …
Special Issue: Intramolecular Hydrogen Bonding 2017, Steve Scheiner
Special Issue: Intramolecular Hydrogen Bonding 2017, Steve Scheiner
Chemistry and Biochemistry Faculty Publications
Even after more than a century of study [1–6], scrutiny, and detailed examination, the H-bond continues [7–12] to evoke a level of fascination that surpasses many other phenomena. Perhaps it is the ability of the simple H atom, with but a single electron, to act as a glue that maintains contact between much more complicated species. Or it might be its geometry, which prefers to hold the bridging proton on a direct line between the two heavy atoms. Not to be ignored are the spectral features of the H-bond: the large red shift of the stretching frequency of the covalent …

Respiratory Sinus Arrhythmia Activity Predicts Internalizing And Externalizing Behaviors In Non-Referred Boys, Wei Zhang, Shawn E. Fagan, Yu Gao
Publications and Research
Atypical respiratory sinus arrhythmia (RSA), a biomarker of emotion dysregulation, is associated with both externalizing and internalizing behaviors. In addition, social adversity and gender may moderate this association. In this study, we investigated if RSA (both resting RSA and RSA reactivity in an emotion regulation task) predicts externalizing and/or internalizing behaviors and the extent to which social adversity moderates this relationship. Two hundred and fifty-three children (at Time 1, mean age D 9.05, SD D 0.60, 48% boys) and their caregivers from the community participated in this study. Resting RSA and RSA reactivity were assessed, and caregivers reported children’s externalizing …

© 2017 American Chemical Society. Significant cellulose-pectin interactions in plant cell walls have been reported recently based on 2D 13C solid-state NMR spectra of intact cell walls, but how these interactions affect cell growth has not been probed. Here, we characterize two Arabidopsis thaliana lines with altered expression of the POLYGALACTURONASE INVOLVED IN EXPANSION1 (PGX1) gene, which encodes a polygalacturonase that cleaves homogalacturonan (HG). PGX1AT plants overexpress PGX1, have HG with lower molecular weight, and grow larger, whereas pgx1-2 knockout plants have HG with higher molecular weight and grow smaller. Quantitative 13C solid-state NMR spectra show that PGX1AT cell walls …

The master cytokine TGF-β mediates tissue fibrosis associated with inflammation and tissue injury. TGF-β induces fibroblast activation and differentiation into myofibroblasts that secrete extracellular matrix proteins. Canonical TGF-β signaling mobilizes Smad2 and Smad3 transcription factors that control fibrosis by promoting gene expression. However, the importance of TGF-β–Smad2/3 signaling in fibroblast-mediated cardiac fibrosis has not been directly evaluated in vivo. Here, we examined pressure overload–induced cardiac fibrosis in fibroblast- and myofibroblast-specific inducible Cre-expressing mouse lines with selective deletion of the TGF-β receptors Tgfbr1/2, Smad2, or Smad3. Fibroblast-specific deletion of Tgfbr1/2 or Smad3, but not Smad2, markedly …

A Validated Measure For Fertility Awareness: An Essential Step Toward Informed Reproductive Decision-Making, Brennan Peterson
Marriage and Family Therapy Faculty Articles and Research
"The efforts by Kudesia and colleagues (1) to create and validate a fertility awareness survey is a vital development in the field of reproductive health care. The 29-item Fertility and Infertility Treatment Knowledge Score (FIT-KS) was created to measure fertility awareness and infertility treatment knowledge in the general population and among medical trainees. Using a combination of existing questionnaires, consultation with specialists in test construction, and clinical recommendations of an expert panel of 15 reproductive endocrinologists, the FIT-KS is the first of its kind in the United States. The authors should be commended for their foresight and attempts to address …
