Smoking Guns: The Supreme Court's Willingness To Lower Procedural Barriers To Merits Review In Cases Involving Egregious Racial Bias In The Criminal Justice System, Carrie Leonetti

Marquette Law Review

The systematic foreclosure of federal-court review of even the most meritorious federal constitutional challenges of state criminal convictions has made review on the merits of an inmate’s claim that a state court violated the U.S. Constitution in adjudicating a criminal case exceedingly rare. Nonetheless, over the past two terms, the Supreme Court appears to have started down a different road, overlooking potential procedural hurdles in several cases to uphold on the merits state inmates’ claims that their criminal trials were tainted by explicit race discrimination. While these cases taken together seem to suggest that the Court is willing to address …

Population and Public Health Sciences Faculty Publications

What is already known about this topic? Illicitly manufactured fentanyl has become a significant contributor to unintentional overdose deaths in the United States. What is added by this report? Approximately 90% of unintentional overdose deaths examined in 24 Ohio counties that occurred during January–February 2017 involved fentanyl, fentanyl analogs, or both, whereas heroin was identified in the minority (6%) of cases, with somewhat higher prevalence in Appalachian counties. Fentanyl is commonly appearing in combination with other analogs. What are the implications for public health practice? These findings highlight the urgent need to make illicitly manufactured fentanyl testing a part of …

The Difference Law Makes: Domestic Atrocity Laws And Human Rights Prosecutions, Mark S. Berlin, Geoff Dancy Sep 2017

The Difference Law Makes: Domestic Atrocity Laws And Human Rights Prosecutions, Mark S. Berlin, Geoff Dancy

Political Science Faculty Research and Publications

This article offers the first systematic analysis of the effects of domestic atrocity laws on human rights prosecutions. Scholars have identified various political and sociological factors to explain the striking rise in human rights prosecutions over the past 30 years, yet the role of domestic criminal law in enabling such prosecutions has largely been unexamined. That is surprising given that international legal prohibitions against human rights atrocities are designed to be enforced by domestic courts applying domestic criminal law. We argue that domestic criminal laws against genocide and crimes against humanity facilitate human rights prosecutions in post-authoritarian states by helping …

Repeat Players In Multidistrict Litigation: The Social Network, Elizabeth Chamblee Burch, Margaret S. Williams Sep 2017

Repeat Players In Multidistrict Litigation: The Social Network, Elizabeth Chamblee Burch, Margaret S. Williams

Cornell Law Review

As class certification wanes, plaintiffs’ lawyers resolve hundreds of thousands of individual lawsuits through aggregate settlements in multidistrict litigation. But without class actions, formal rules are scarce and judges rarely scrutinize the private agreements that result. Meanwhile, the same principal- agent concerns that plagued class-action attorneys linger. These circumstances are ripe for exploitation: few rules, little oversight, multi-million dollar common-benefit fees, and a push for settlement can tempt a cadre of repeat players to fill in the gaps in ways that further their own self-interest. Although multidistrict litigation now comprises 36% of the pending federal civil caseload, legal scholars have …

Una Democracia Aterrorrizada: Justicia Y Afecto En Los Textos De La Transición Democrática Argentina, Mariana Graciano Sep 2017

Una Democracia Aterrorrizada: Justicia Y Afecto En Los Textos De La Transición Democrática Argentina, Mariana Graciano

Dissertations, Theses, and Capstone Projects

This dissertation analyzes the links between justice and affect in some of the most emblematic texts of the democratic transition in Argentina. Films, novels and photos are incorporated here as texts or complex utterances, as they constitute a framework of signs with a communicative intention that makes sense in a given context. In order to analyze these links, I consider terms from the field of transitional justice (reconciliation, forgiveness, restoration) and specific affects (terror, empathy, guilt, resentment, tenderness, happiness and cruelty).

The key questions guiding this thesis are: what links did visual arts and literature have in relation to the …

The New American Slavery: Capitalism And The Ghettoization Of American Prisons As A Profitable Corporate Business, David A. Liburd Sep 2017

The New American Slavery: Capitalism And The Ghettoization Of American Prisons As A Profitable Corporate Business, David A. Liburd

Dissertations, Theses, and Capstone Projects

The labor of enslaved Africans and Black Americans played a large part in the history of colonial America, with the American plantation being the epicenter for all that was to be produced. While the two have never been completely tied together, capitalism and modern day slavery have been linked with one another. Some analysis sees slavery as a remote form of capitalism, a substitute, to an antiquated form of labor in the modern world.

Slave plantations adopted a new concentration in size and management, referred to by W.E. DuBois as a change "from a family institution to an industrial system."1 …

Discovering Forensic Fraud, Jennifer D. Oliva, Valena E. Beety Sep 2017

Discovering Forensic Fraud, Jennifer D. Oliva, Valena E. Beety

Northwestern University Law Review

This Essay posits that certain structural dynamics, which dominate criminal proceedings, significantly contribute to the admissibility of faulty forensic science in criminal trials. The authors believe that these dynamics are more insidious than questionable individual prosecutorial or judicial behavior in this context. Not only are judges likely to be former prosecutors, prosecutors are “repeat players” in criminal litigation and, as such, routinely support reduced pretrial protections for defendants. Therefore, we argue that the significant discrepancies between the civil and criminal pretrial discovery and disclosure rules warrant additional scrutiny.

In the criminal system, the near absence of any pretrial discovery means …

Warfare As Regulation, Robert Knowles Sep 2017

Warfare As Regulation, Robert Knowles

Washington and Lee Law Review

The United States government’s national security activities, including the use of force, consume more than half of all federal discretionary spending and are carried out by the world’s largest bureaucracy. Yet existing scholarship treats these activities as conduct to be regulated, rather than as forms of regulatory action.

This Article introduces a new paradigm for depicting what agencies involved in national security do. It posits that, like other agencies, the national security bureaucracy is best understood to be engaging in regulatory activity—by targeting, detaining, interrogating, and prosecuting enemies; patrolling the border; and conducting surveillance and covert actions. Also, like other …

An Investigation Of Public Injection Drug Use In New York City: A Mixed-Methods Study, Taeko M. Frost Sep 2017

An Investigation Of Public Injection Drug Use In New York City: A Mixed-Methods Study, Taeko M. Frost

Dissertations and Theses

Background: Drug use and injection-related harms are on the rise in the United States (US). As a result, new outbreaks of HIV and viral hepatitis C (HCV) attributed to injection drug use have been identified across the country. In addition to HIV and HCV, skin and soft tissue infection (SSTIs) that result from risky injection practices lead to preventable and costly emergency department (ED) visits. The concurrent opioid overdose epidemic has prompted a national conversation on how to effectively address drug-related harms and associated costs. International studies have identified that the place a person injects is related to adverse health …

Teacher Perceptions On The Utilization Of School-Based Mentoring As A Targeted Intervention For Secondary Students Identified As At-Risk, Allison Bradley, Wilnic Gideon Sep 2017

Teacher Perceptions On The Utilization Of School-Based Mentoring As A Targeted Intervention For Secondary Students Identified As At-Risk, Allison Bradley, Wilnic Gideon

Graduate Student Dissertations, Theses, Capstones, and Portfolios

The purpose of this study was to examine the experiences of secondary teachers who participated in school-based mentoring programs and their perspectives on the impact this targeted intervention may have on students identified as at-risk. Participants included a total of fourteen secondary teachers with previous school-based mentoring experience at secondary schools located in the southeastern United States. The study was conducted in two phases and the data analyses included transcriptions from audio-taped interviews and statistical analyses from a qualitative questionnaire. The findings of the study indicated secondary students identified as at risk participating in a school-based mentoring program may improve …
