Adjudication In The Age Of Disagreement, John Fabian Witt
Adjudication In The Age Of Disagreement, John Fabian Witt
Fordham Law Review
In the time I have here with you today I would like to offer the beginnings of an answer. It does not lie in the distance between the court’s traditions and Manton’s conduct. That would be too easy. At base, I think the answer lies in something far more subtle and interesting: the relationship between acentral tradition of the Second Circuit and one of the great questions we face as a society today. That question is how to deal with disagreement.

Heroin Use Onset Among Nonmedical Prescription Opioid Users In The Club Scene, Hilary L. Surratt, Steven P. Kurtz, Mance Buttram, Maria A. Levi-Minzi, Maria E. Pagano, Theodore J. Cicero
Center for Health Services Research Faculty Publications
Background—Nonmedical prescription opioid use (NMPOU) is well documented among participants in the club scene, yet prior studies have not examined transition to heroin use. We prospectively examined heroin initiation among a sample of young adults with drug involvement associated with participation in the club scene, to understand factors that influence transition from NMPOU to heroin and to identify opportunities for intervention.
Methods—Data were drawn from a randomized trial that enrolled 750 Miami-based club and prescription drug users through respondent driven sampling, and tested the efficacy of assessment interventions in reducing risk. Participants reported current substance use at baseline, …

2017 Point-In-Time: Count Of Homelessness In Portland/Gresham/Multnomah County, Oregon, Uma Krishnan, Deborah Elliott
Publications, Reports and Presentations
The 2017 Point-in-Time (PIT) Count of Homelessness provides a snapshot of people who were experiencing homelessness on the night of Wednesday, February 22, 2017, in Portland, Gresham, and Multnomah County, Oregon. The US Department of Housing and Urban Development (HUD) requires communities to count people living in emergency shelters, transitional housing or places not meant for human habitation (these people are collectively known as “HUD homeless”) on a single night (a “point in time”) at least once every two years. This enumeration is one way of understanding the levels and trends in unmet need for shelter and permanent housing within …

U.S. Circuit Courts & The Application Of The Terrorism Enhancement Provision, Pinky Wassenberg
Southern Illinois University Law Journal
The U.S. Sentencing Commission created the U.S. Federal Sentencing Guidelines (hereinafter referred to as the Guidelines) pursuant to their statutory mandate to provide guidance to federal courts to rationalize federal criminal sentencing practices and “further the basic purposes of criminal punishment: deterrence, incapacitation, just punishment, and rehabilitation.” Congress created the Sentencing Commission and authorized it to establish the Guidelines to reduce perceived disparities in the sentencing behaviors of federal judges by limiting and systematizing the factors that went into arriving at a sentence for an individual defendant. The goal was to have defendants receive comparable sentences when convicted of comparable …

Collateral Visibility: A Socio-Legal Study Of Police Body Camera Adoption, Privacy, And Public Disclosure In Washington State, Bryce Clayton Newell
Indiana Law Journal
Law enforcement use of body-worn cameras has become a subject of significant public and scholarly debate in recent years. This Article presents findings from a study of the legal and social implications of body-worn camera adoption by two police departments in Washington State. In particular, this study focuses on the public disclosure of body-worn camera footage under Washington State’s public records act, state privacy law, and original empirical findings related to officer attitudes about—and perceptions of—the impact of these laws on their work, their own personal privacy, and the privacy of the citizens they serve. The law in Washington State …
The Ambulance Chasing Epidemic In Texas, Ronald Rodriguez
The Ambulance Chasing Epidemic In Texas, Ronald Rodriguez
St. Mary's Journal on Legal Malpractice & Ethics
Barratry and solicitation of professional employment is illegal and unethical. The Texas Disciplinary Rules of Professional Conduct define barratry as ethical misconduct and a serious crime. Unfortunately, for citizens and law-abiding attorneys of Texas, the criminal and ethical prohibitions against barratry have rarely been enforced. Consequently, barratry continues to proliferate rapidly throughout South Texas. For lawyers who engage in this unethical practice, the potential for large financial gain proves irresistible given the virtually nonexistent risk of prosecution. The lack of robust and successful prosecutions has created an optimal environment for barratry to proliferate. This Article discusses the current barratry epidemic …
