Drug exposure during pregnancy constitutes a major legal issue and public health concern. Drug and metabolite determination in biological matrices from mother and newborn is an objective indication of prenatal drug exposure. However, limited data are available regarding the interpretation of these analytical results in terms of window of detection and degree of exposure. We collected paired maternal hair, meconium, placenta and umbilical cord from 727 mother-newborn dyads. We analyzed these specimens by liquid chromatography tandem mass spectrometry for the determination of cocaine, opioids, methadone and amphetamines, and compared the analytical results from the four different matrices. The cases were …

World Music And Activism Since The End Of History (Sic), Peter L. Manuel
World Music And Activism Since The End Of History (Sic), Peter L. Manuel
Publications and Research
While the decline of protest music in the USA has often been noted, a global perspective reveals that progressive, activist protest musics occupied lively niches in many music cultures worldwide (e.g., of Jamaica, India, Spain, Latin America) during similar periods, roughly the 1950s-80s. While on one level these music movements were embedded in particular socio-political movements, on a broader level they reflected an ardent commitment to the secular universalist ideals of the Enlightenment. The subsequent dramatic decline of all these protest musics—roughly since Fukuyama’s much-debated “end of history”—reflects a broader transformation of the global political climate. This transformation has both …
The King And The Land: A Geography Of Royal Power In The Biblical World, Stephen C. Russell
The King And The Land: A Geography Of Royal Power In The Biblical World, Stephen C. Russell
Publications and Research
The King and the Land offers an innovative history of space and power in the biblical world. Stephen C. Russell shows how the monarchies in ancient Israel and Judah asserted their power over strategically important spaces such as privately-held lands, religious buildings, collectively-governed towns, and urban water systems. Among the case studies examined are Solomon's use of foreign architecture, David's dedication of land to Yahweh, Jehu's decommissioning of Baal's temple, Absalom's navigation of the collective politics of Levantine towns, and Hezekiah's reshaping of the tunnels that supplied Jerusalem with water.
By treating the full range of archaeological and textual evidence …
The Impact Of The Boston Marathon Bombing On Public Willingness To Cooperate With Police, Gary Lafree, Amy Adamczyk
The Impact Of The Boston Marathon Bombing On Public Willingness To Cooperate With Police, Gary Lafree, Amy Adamczyk
Publications and Research
While a key to law enforcement success is the willingness of the public to cooperate with police, we have limited understanding of how terrorist attacks affect this public readiness. Prior research suggests that terrorist attacks might increase citizen cooperation with police through both prevention efforts and rally effects. We test these assertions with three nationally representative surveys on respondents’ willingness to help police combat terrorism: one before the Boston Marathon bombings and two after. As predicted, public willingness to report suspicious behavior to police increases significantly following the bombings and there is evidence that these increases generalize to ordinary crime. …

Perspectives On Crime And Justice: Selected Speeches, Jeremy Travis
Perspectives On Crime And Justice: Selected Speeches, Jeremy Travis
Publications and Research
"The speeches in this volume are the record of a consummate policy artist operating from the remarkable platform that John Jay College of Criminal Justice was, and that [President Jeremy Travis] evolved it to be, during his tenure. "If you agree with me that the time for reform is now", Travis put to a conference hosted by the Ford Foundation in the context of bringing college education to prisons, "then the question is how to make the convincing argument, how to mobilize the political forces that will make this dream a reality". It is, I think, the defining passage in …
Stronger Together: Increasing Connections Between Academic And Public Libraries, Maureen Richards
Stronger Together: Increasing Connections Between Academic And Public Libraries, Maureen Richards
Publications and Research
Much has been written about collaborations between public and academic libraries. These collaborations generally take the form of joint libraries, special programs or consortia. They are motivated by the desire to do public outreach or community building or to provide better facilities, services or library resources to users from both library systems or, in the case of consortia, by economics.
Since the library website is now the most common entry point to an academic library, this paper explores the opportunities for building connections between an academic and public library’s resources by hyperlinking to public library resources. Deepening these connections supports …
Using Role-Play To Enhance Critical Thinking About Ethics In Psychology, Jillian Grose-Fifer
Using Role-Play To Enhance Critical Thinking About Ethics In Psychology, Jillian Grose-Fifer
Publications and Research
In this chapter, I describe a highly structured, student-centered role-play activity. Before coming to class, students read about the Tuskegee Syphilis Study. They then work cooperatively in small groups to decide on how to collectively portray the role of their assigned character from the study. Each group then presents their character's testimonial at a tribunal, with the aim of clarifying the injustices that occurred during the study. The activity is designed to foster collaboration and communication skills and to encourage students to think critically about how this historical study violated ethical standards for conducting research with human subjects. Assessment data …
Jailhouse Informants In Canadian Criminal Courts, Olena Beshley
Jailhouse Informants In Canadian Criminal Courts, Olena Beshley
Theses and Dissertations (Comprehensive)
Criminal justice systems in Canada and around the world have been established to deal with matters that require attention, punishment, and justice. An important function of criminal justice systems is the evaluation of evidence presented in the court of law. Evidence from jailhouse informants who testify that they have been privy to confessions of crimes is a contentious issue. Much of the scholarly literature available to date on wrongful conviction cases focuses on causes of insufficient and unreliable evidence obtained through different techniques and from different sources. Despite the high number of investigations into wrongful conviction cases, the subject of …
Exploring Police Officers' Perceptions Of Mobile Crisis Rapid Response Teams Within A Nodal Policing Framework, Trevor Viersen
Exploring Police Officers' Perceptions Of Mobile Crisis Rapid Response Teams Within A Nodal Policing Framework, Trevor Viersen
Theses and Dissertations (Comprehensive)
An increasing portion of police service resources are being dedicated to interactions involving persons with mental illness (PMI). As a result, Mobile Crisis Rapid Response Teams (MCT) comprised of mental health professionals have been recently implemented to assist police officers in more efficiently handling police calls for service involving PMI. The current ethnographic study used data collected through researcher ride-alongs with police officers at a mid-sized police service in Ontario to assess how police officers interact with and perceive MCTs. Results from thematic analysis indicated that officers value the skill sets possessed by MCT workers, had relatively positive perceptions towards …
Capital Punishment Of Unintentional Felony Murder, Brenner M. Fissell, Guyora Binder, Robert Weisberg
Capital Punishment Of Unintentional Felony Murder, Brenner M. Fissell, Guyora Binder, Robert Weisberg
Faculty Publications
Under the prevailing interpretation of the Eighth Amendment in the lower courts, a defendant who causes a death inadvertently in the course of a felony is eligible for capital punishment. This unfortunate interpretation rests on an unduly mechanical reading of the Supreme Court’s decisions in Enmund v. Florida and Tison v. Arizona, which require culpability for capital punishment of co-felons who do not kill. The lower courts have drawn the unwarranted inference that these cases permit execution of those who cause death without any culpability towards death. This Article shows that this mechanical reading of precedent is mistaken, because the …
Through A Federal Habeas Corpus Glass, Darkly- Who Is Entitled To Effective Assistance Of Counsel In Tribal Court Under Icra And How Will We Know If They Got It?, Jordan Gross
Faculty Law Review Articles
Part I of this article is a history and analysis of the federal constitutional right to effective assistance of counsel. It explains how federal ineffective assistance of counsel jurisprudence has developed almost exclusively in the context of federal habeas review of state court convictions and rendered most federal ineffective assistance of counsel claims unviable. Part II explains the right to counsel in tribal court and the habeas corpus remedy available to tribal prisoners under ICRA. Part III identifies issues that will need to be addressed now that Congress has created a statutory ineffective assistance of counsel claim for tribal prisoners …

Chinese International Students In A Northwest University: Investigating Cultural Academic Learning And Teaching Preferences, Michael L. Bevis
Chinese International Students In A Northwest University: Investigating Cultural Academic Learning And Teaching Preferences, Michael L. Bevis
Theses and Dissertations
As Chinese international students on American university campuses continue to rise, the importance of these institutions to accommodate the students in adapting to a different academic culture has become more critical. On a public, coeducational research university located in the Pacific Northwest, a concurrent triangulated mixed method research design was implemented to investigate cultural factors with preferred learning and teaching styles of Chinese international students along with what corroborative descriptions these students provide as effective learning experiences in American college classrooms.
The study brought attention to Chinese international students’ differing cultural values from the previous literature understanding, it supported previous …
Evaluating The Attitudes Of Preservice Teachers Toward Multicultural Competence, Angela D. Marshall
Evaluating The Attitudes Of Preservice Teachers Toward Multicultural Competence, Angela D. Marshall
Theses and Dissertations
Changes in the ethnicity of the student population across the nation necessitated a change in teacher education curricula. This explanatory, sequential, mixed-method study examined how a group of preservice teachers viewed the importance of multicultural competence before and after student teaching. Specifically, an evaluation of preservice teachers’ attitudes about their own multicultural preparedness was made prior to and after being given full responsibility for an ethnically diverse classroom.
The study employed quantitative and qualitative measures to assess preservice teachers’ levels of multicultural competence as well as their awareness of self-perceptions of multicultural competence that contribute to attitudes toward teaching an …
A Replication Study: 20 Years Later Correctional Officers: How Do They Perceive Sexual Offenders?, Kimberlie Massnick
A Replication Study: 20 Years Later Correctional Officers: How Do They Perceive Sexual Offenders?, Kimberlie Massnick
Theses and Dissertations
Correctional officers represent a large, influential group working within the criminal justice system; as such they have long attracted the interest of social scientists. These professionals, their attitudes towards inmates and the impact of these attitudes, have received scrutiny, especially since Zimbardo’s (1973) study of a mock prison, commonly referred to as the Stanford Prison Experiment. When compared to other professionals within the criminal justice system, correctional officers are often the least empathic, the most punitive, and the least supportive of rehabilitation. These potential attitudes this is unfortunate since correctional officers are ideally placed to improve the social atmosphere of …

Ministers Of Justice And Mass Incarceration, Lissa Griffin, Ellen Yaroshefsky
Hofstra Law Faculty Scholarship
Over the past few years, scholars, legislators, and politicians have come to recognize that our current state of“mass incarceration” is the result of serious dysfunction in our criminal justice system. As a consequence, there has been significant attention to the causes of mass incarceration. These include the war on drugs and political decisions based on a “law and order” perspective. Congressional and state legislative enactments increased the financing of the expansion of police powers and provided for severely punitive sentencing statutes, thereby giving prosecutors uniquely powerful weapons in securing guilty pleas. All of this occurred as crime rates dropped.

A Critical Race Theory Intervention Into The Cultural Defense Debate, Phoebe Shen
A Critical Race Theory Intervention Into The Cultural Defense Debate, Phoebe Shen
Scripps Senior Theses
The cultural defense is an informal term that describes the use of cultural information to mitigate criminal responsibility, often used in conjunction with traditional defense strategies such as provocation or insanity. Arguments for the cultural defense include respecting cultural practices under the liberal narrative that frames the United States as a multicultural and pluralistic society. Advocates of the cultural defense recognize the harmful effects of the false universalism of the law. However, the cultural defense has been criticized as essentialist and harmful as it has been used in high profile cases to justify violence against women of color. The cultural …
"She's Not A Real Monster": Orphan Black's Helena And The Monstrous-Feminine, Natalie Eisen
"She's Not A Real Monster": Orphan Black's Helena And The Monstrous-Feminine, Natalie Eisen
Scripps Senior Theses
This thesis explores the idea of the “monstrous-feminine,” or the idea that female monsters of television and film are linked to their femininity in a way that male monsters are not linked to their masculinity. Using the work of scholars such as Barbara Creed, Shelley Stamp Lindsey, and Jane M. Ussher, the thesis covers various facets of women’s lives as seen through the distorted lens of the monstrous. The character of Helena from the television show Orphan Black is used as a concrete example of the stages of the monstrous-feminine: the girl-child, menstruation and puberty, sexuality, and motherhood.
Community-Based Learning: A Primer, Zeinab Bedri, Ruairí De Fréin, Geraldine Dowling
Community-Based Learning: A Primer, Zeinab Bedri, Ruairí De Fréin, Geraldine Dowling
Irish Journal of Academic Practice
Employers are increasingly demanding graduates with industry-ready communication, leadership, emotional intelligence and social ethics skills. Community-based learning (CBL) is a pedagogical approach which has tremendous potential to produce graduates with these attributes. However, for many early-career lecturers, distilling the insights from the teaching and learning literature, and then producing a well-designed CBL module, can be an intimidating task. What is missing is a primer which presents the core ideas of CBL in a way that is independent of subject-specific jargon. Ideally, this primer should provide the reader with the means of either drafting an initial project plan or, at the …
Measuring The Judicial Performance Of The European Court Of Human Rights, Elizabeth Lambert Abdelgawad
Measuring The Judicial Performance Of The European Court Of Human Rights, Elizabeth Lambert Abdelgawad
Research outputs 2014 to 2021
Faced with a sharp rise in the number of individual applications, the European Court of Human Rights has been forced to provide greater accountability to governments eager to downsize its budget and staff. This has resulted in the introduction of quantitative criteria, to the detriment of quality and of the service rendered to individual victims. These new management policies have admittedly reduced the number of pending cases, but they have also considerably eroded the right of individual application. The new managerial policy has definitely shaped a new Court.

Female Undergraduate's Perceptions Of Intrusive Behavior In 12 Countries, Lorraine Sheridan, Adrian J. Scott, John Archer, Karl Roberts
Research outputs 2014 to 2021
The present study examines young women's (N = 1,734) perceptions of the unacceptability of 47 intrusive activities enacted by men. Female undergraduate psychology students from 12 countries (Armenia, Australia, England, Egypt, Finland, India, Indonesia, Italy, Japan, Portugal, Scotland, Trinidad) indicated which of 47 intrusive activities they considered to be unacceptable. Responses were compared with parasite-stress values, a measure of global gender equality and Hofstede's dimensions of national cultures. There was no unanimous agreement on any of the items, even for those relating to forced sexual violence. Cluster analysis yielded four clusters: “Aggression and surveillance” (most agreement that the constituent items …
The Role And Approach Of The European Court Of Human Rights In The Protection Of Core Human Rights And In Deferring To The Judgment Of States Under The European Convention On Human Rights., Adrian Berski

In order to understand the complexity and peculiarity of human rights, it is important to provide a proper definition of human rights, based on the Irish concept.
Human Rights is defined […] as: the rights, liberties and freedoms conferred on, or guaranteed to persons: (a) by the Constitution, and (b) by any agreement, treaty or convention to which the State is a party […] the definition of human rights is restricted as regards any agreement, treaty or convention to which the State is a party by including only those (or a provision thereof) which has been given the force of …

Encountering Death In The Prison; An Exploration Of Irish Prison Staff Experiences, Emotions And Engagements With Support., Colette Barry
Doctoral
This thesis examines prison staff experiences of the deaths of prisoners in custody. It explores staff accounts of their encounters with prisoner deaths, their emotional responses to these incidents and their engagement with support in the aftermath of their experiences. This thesis represents the first Irish research focused exclusively on prison staff encounters with prisoner deaths. In so doing, it illuminates Irish prison staff practices, sensibilities and traditions. Despite increasing scholarship on the working lives and traditions of prison staff, and greater awareness arising from a small number of studies of staff experiences of prisoner suicide, there remains little research …

Article 28A(1)(13) of the Protocol to the Statute of the African Court of Justice and Human Rights lists ‘Illicit exploitation of natural resources’ as a criminal offense within the Court’s jurisdiction. In conjunction with the new mandate of the African Court, which includes the exercise of jurisdiction over corporations for the first time in an international treaty, the prohibition of “illicit exploitation of natural resources” creates an offense with especially sharp teeth, for business people, their corporations, military actors and politicians. The crime constitutes an important innovation in international law, since it offers a distinct legal basis for prosecution of …
